"Missing. Thousands are without power, a new report says former President Donald Trump and personal lawyer Rudy Giuliani. Both made phone calls to try and pressure Arizona election officials to change the November election results. This is Bloomberg Law with June Brussels. From Bloomberg Radio. Gavin Grimm's name is well known in the fight for transgender rights. His legal battle began in 2014 when he was just a 15 year old high school sophomore and a Virginia school board barred him from continuing to use the boys bathroom. Mukasey was transgender Grimm told MSNBC. How being a transgender teenager in that position made him feel it can already be very difficult to get through life and avoid being bullied and stigmatized and discriminated against. And then you have a school board set this precedent for your school, saying the student should not be treated the same way as other students. It's very difficult. It's very Frustrating. His legal case against the school board wound its way through the courts. And finally, last August, the fourth Circuit Court of Appeals said the school board had discriminated against grim on the basis of sex by prohibiting him from using the bathroom that aligned with his gender identity. This week, the Supreme Court refused to take the school board's appeal. Sealing the legal victory for now. 22 year old grim Joining me is Katherine Franke, a professor at Columbia Law School. How much of a victory is this for transgender students in this country? Well, even though the court decided not to decide this case, what it is, it's a huge victory. Trans kids, But for trans people more generally and for the idea of federal laws prohibiting gender identity based discrimination because with the Supreme Court essentially said by refusing to take this case is that we decided this case already inbox stock Last year, The court ruled there that federal laws prohibiting sex discrimination include protections against gender identity and sexual orientation based discrimination. And that case, the box dog case resolved the Gavin Grimm case as well in Gavin's favor. Didn't justice Gorsuch say that the decision didn't apply to bathrooms. He did, he said. We don't have to decide that today. He didn't say it didn't apply, but that that issue was not before us. But I think the rule that the court established in that case applies to the bathroom issue equally as it does to employment and educational opportunity. On the basis of sex equality. And so the court But for two members, who defended from the denial of granting third in this case, agreed that the boss Dog case applies to educational equality just as much as employment based equality. Tell us a little bit about Gavin Grimm and his seven year legal battle. Well, Gavin, you know, was a high school student who, as he says in his legal papers, and he said in the media many times Is a boy like any other boy and wanted to be able to use the boys bathroom like all the other boys did, And what the school wanted to do was permit him to use the women's room or to use a gender neutral bathroom. That was one that was basically designated only for him. And you know if we did that to students of color and said, Well, you can use the colored bathroom, not the white bathroom or Will make a special bathroom just for you, but you can't use the white bathroom. I think we would all understand that to be discrimination. And what the courts now saying is that discrimination? Also, when we create either segregated or separate facilities for trans kids, they should be treated like all the other kids with the same gender identity. The Supreme Court had agreed to hear an earlier appeal in the case four years ago, but then dismissed it. Explain what happened there. Well, I think what the court wanted to do with heavy issue right then, if you will. In the lower courts. There was a lot of litigation around trans kids equality claims when it came to bathrooms and other aspects of their education, and I think the court saw themselves as perhaps reaching the issue a little too soon. A few years ago, so they wanted to issue to percolate a little bit more in the lower court and with the Boston decision last term, they now recognize that this issue has already been decided, and there's nothing more for them to say about it other than what they said in Brossard. Let's take a step back for a moment. Will you explain the fourth circuit's decision and how they came to that decision? They based it on sex discrimination. There's several different ways to think about why gender identity based discrimination is a form of sex discrimination, and Gavin argued all of these different ways of thinking about the issues that it's a kind of sex. Stereotyping. If we assume that only real women are those who were also women, identified biologically by a doctor at birth. Or only real men are those whose birth certificates also say male and what Gavin was arguing is that there are lots of different ways of being mailed. His gender identity is one of them and to choose as real males. Who can use mail bathrooms. Only those who were identified at mail is at birth as a form of sex discrimination and the fourth circuit embrace that argument, as well as the kind of argument that we saw in the box. Our case that any kind of discrimination against a person on the basis of their gender identity is necessarily a form of sex discrimination, really reading and updating our sex discrimination laws to conform to where we're now thinking about sex based identity. I think this is the third time that the Supreme Court has left in place lower court rulings supporting transgender rights for students, so the issue is now settled in the fourth Circuit, and I believe the seventh and 11th circuits as well. But there is no national precedent set by the court, refusing to take the appeal. If the justices really wanted to settle the issue, wouldn't they have taken the case and decided it? That's right. And so the fact that the court did not take the case and did not issue even a unsigned opinion and does mean that we have different rules coming out of different circuits. But it does also send a pretty strong message that the court didn't think there was a significant legal claim in the appeal raised in the appeal in this case, but they could have done what they've been doing in the religious liberty cases is even in a paragraph for a couple of sentences, said This case was already decided inbox, talking that the lower court should apply the back. Stark decision or lower courts generally should so they could have gone that extra mile. But for whatever reason they chose not to this time. Are there any circuits still considering the transgender bathroom issue or other issues related to transgender students? Well, I think the bathroom issue is pretty resolved. At this point. We have the federal government having issue regulations that interpret sex equality protections under title nine to transgender claims, like Gavin But the next wave of cases that we will see and they make their way to the Supreme Court deal with the issues of transgender athletes, and particularly male, the.

The board of directors of warner amex looked at this idea and go now too risky because no one had had forget music no one had ever had a successful ad supported cable network yet. You see them getting started. Espn starting everybody's losing tons of money. So we got a meeting with the ceo of american express and the ceo of warner communications and gave them the pitch. And at the end of the pinch i expected the warner guys to say yes because they had a music company. Wanna music at the time They were you know. The warner brothers. Pictures very cool and that set but instead the ceo. Jim robinson of american express. Look that steve ross. Who was the ceo. of warner. Go steve. I'm from my half. How about you. And that sold the deal. Because i think he hadn't said that. I'm not sure steve would have said yes. The product side not the sales side and in about a year everybody on the sale five would go on and they look at me and said hey kid you think you can run this thing and make money and as only time twenty eight twenty eight year old. So of course. I can't having different. Had a sales job in my life but the good news is we did turn it around. There was a guy named drew lewis. Who the transportation secretary under ronald reagan. Who fired all the air. Traffic control a really tough guy came in in the interim since we after we launched mtv as chairman of the warner amex joint venture and drew took me to lunch one day. When he got there it turns out that lunch. I learned that he didn't know who the rolling stones were had. Never heard of mick jagger didn't know clint eastwood was nothing about popular culture. And he's okay. Bob if you can't get this mtv thing profitable at the end of the ice wants you to know. I'm shutting it now so we were scrambling and the good news is. We were profitable by the end of the year. We were the first profitable advertiser supported cable network. And for the time i was there we were the most profitable basic cable network. And you know there's a lot of people all in this common mission. We were all just working together. Wow so do you think that if he hadn't said of shut us down if we're not profitable at the end of the year. Do you think that was the fire right there like we got now. We got to prove these guys absolutely. We had to do it or we were all. We got work right And this great idea would go even nerve. I loved it. It would be shut down because they couldn't make money and you know it's like today. There are some businesses going on today. The don't make money and happened at the dot com bust to. Is you know you either get profitable when you get one of those times or do you go out of business no matter how much people love you. By the way we begin cutting cost him if you talk to the original crew of mtv. I think i'm really creative. They'll say what do you think about giving though saying he was cheap. Talk because i just found a way for us to do everything we needed to do. Cheaper because the gulf we only had x amount revenue though one way to make money is key costs down and And that and by the way a lot of great inventions come out of that. When you have all the money in the world you do what everybody else is doing when you don't have much money if forces you to do something different in many ways more creative that on our look of mtv. Fred not we're talking about what's the on air look going to be and i'm sort of thinking in my head we'll do sort of cheap version of what everyone else is doing. It doesn't look cheap. It just looks different. That's sort of the impetus of why we did such a radically different design. Look we broke every rule of design with mtv but obviously we let a whole new way because then people start copying what we were doing. I look at this bob. The mtv in the beginning like Like street artists do where they'll take like clips of something that was like big and pop culture and no tag their name over or whatever. That's exactly what mtv was. Plus why would see the vj's on mtv. They looked. They were sitting on my on my dresser in my room. Talking to me about van halen. We tried to do what you do. Every day. we tried to take the intimacy of the radio personalities of what we do in radio which is we keep people company. We're hanging out. And we wanted it to look like they were hanging out and and talking about twelve and they were hanging out with that access. Most people didn't half they could talk to. I mean I talked about them all preseason even like we talked about them a lot during the draft is just one of those teams that you thought was just going to start off the season in the top four and it hasn't been the case, I just wanna say this. I feel like angel car tree is way under appreciated. Let me just start off by saying that like people forget that she has been to the finals three times. Okay. She is the number one pick, but with. With no other lottery picks on on her team now I could be wrong. I worked for the team for twelve years. I forget it thing or two, but the lineups that I remember going except for maybe one year we're Lindsey Harding. I think was on the roster like angel has carried teams on her back, and she's a kind of player, you know, during least from what I can gather from other people that she's either loved or hated. I've always loved her. But a lot of people don't like angel. And I think they don't give her the benefit of the doubt. She has matured so much as a player as a person as a teammate at the leader, I can't even begin to tell you how much since two thousand nine when she was drafted to Atlanta. So I, I really believe that last year after she got injured Atlanta was running off of a lot of adrenaline. Right like your teammates. Get your teammate gets hurt. You wanna play for them.
