And Ah, well, I I want to talk a little bit about. Why can you buy a tiger? Can you imagine you can buy a tiger cub for as little as $2000? Why was this guy allowed to run this roadside zoo with seem like no regulation by the government. And are there laws And why aren't there laws to protect these beautiful wonderful animals? Joining us is not really the foremost expert in the country. On this topic. Kearney and Nasserist serves as the director and assistant clinical professor of animal welfare at Michigan State College of Law. She runs Klaus Consulting on has a great podcast called Tiger Talk. Welcome to the show. Carney. How are you? I'm fine. Thank you for having me so excited to talk about this topic because it's just fascinating and let me at first ask you. How were you involved in the Joe exotic thing at all in any way, shape or form? I'm the attorney who pitched the wildlife trafficking case the federal prosecutors against him so suddenly, the murder for hire thing didn't happen until after the K five hits with already under investigation for a couple of years, you know, he was charged with multiple counts of illegal trafficking. So you know, being involved in the animal law world as I assume you are you knew about Joe exotic. You knew about what he was doing there and people in the in that milieu knew what he was doing. Is that right? Sort of robotic has long been, you know, on the top at the top of the list of the most notorious abuser than a goiter of big cats in the country, So you know, he all of the things that made for a great reality show that a lot of people who wanted to watch it during quarantine or the things that we had already known about been accustomed to you for one time, But I told people I live in New Orleans, you know? After you've seen that person you have painted themselves head in gold body caves and thinking on top of the stair on Bourbon Street. It's not there. No wow. Factor left any more. And the same is true for Joan thought it We've been after him for a long, long time. So you know, Chicago here has two world class ooze. We have Brookfield Zoo. I grew up very close. I could almost hear I actually when the wind was blowing right, you could hear some of the noises from the animals. And then we have Lincoln Park Su another beautiful city zoo, and I had never heard of a roadside zoo. I mean, I never understood that someone could just open up. Zoo without having certain regulations. Now tell me are there now regulations that would prohibit a Joe exotic from acquiring big, beautiful animals and putting them in a zoo? Like a menagerie of animals, capped by unqualified people who just collected animals that they want to open their doors in charge. If anybody can get us life in, um like from the U. S Department of Agriculture, which is the threshold entry point in order to get animals to the public and the application of the $30 That is really what hate you open a road pie deal. If you pass a pre lightened infection know that you're probably only going to be some feel about One infection per year in the U. S. D a very understaffed. It's notorious even in his own internal auditing department for failing to enforce applicable regulations, which are very, very low standards of care. Like Do the animals have water? Do they have food? Do they get veterinary care? Then they stand up, turn around and lie down on DNA with Russell, you know, And so in a, for example, like in a state like Illinois The law states that you know you cannot own. There can't be any private ownership of of the danger of exotic animals. Not great. Sounds like a prohibition. It is not really in practice because all it requires to circumvent that prohibition is to get that USDA license tell the federal agency that you have some future plan couldn't get an animal to the public. Pay your $30 half your initial infection and rock and roll and keep those animals so a lot of loopholes in victim lives on nine Good point, Illinois. But in fact, there are four things that don't have any regulation whatsoever. Existing federal laws are fraught with the pole that are really easy to circumvent. They're even free, really, and people working on the Internet. Or using the network of roads by do that are going to dump animals month. They've become too big that once they reach that passed that threshold age where they can no longer be used for the extremely lucrative cub handling called pay to play photo op bottle feeding. divorce and death will get into that in just a bit tell us a little bit about your practice right we a cover on many areas of law that consumers when facing a state planning and all aspects of that a probate divorce on a bankruptcy financial issues student loans foreclosure defense things like that and a lot of those topics we've discussed on past two programs yes and they're all on I wanted to check it out for yourself correct yeah we have a blog on page on our website that covers all the different a podcast I call them and I heard radio app has them searchable under experts you can trust up of sorts we are you're on like twice a twice a month and last last time around we're talking about marital property yeah before we get into divorce death one couple people were wondering about the gifting yeah well I mean I I call this segment middle property part two yeah so you know we mentioned that in the in the first I show earlier this month which was that a gift or inheritance from a third party so let's say you know and dad passes away or grandma or what have you and it's gifted to a spouse that is separate property it's not part of the marital property Max as long as it's kind of kept separate right they we mentioned last time that it could become commingled and then if it's all kind of lost in the shuffle of the the joint assets are drawn accounts you know it's it's going to be hard to really characterized as a separate a separate asset but the minute probably Lana chapter seven six six does separate that out as an individual and also our divorce chapter seven six seven they're two separate chapters keeps it separate as well again as long it's been kept separate and there can be little tracing down to H. if it was used for a joint asset like a home and we can you know try to back that out at the time of divorce as well this is why you're the expert they can get complicated after we talked about marital property last time around now how does it work it in divorce you know so something like a misunderstanding that wealth smell properties so everything everything you know is divisible or what have you and that's not the case there can be again like I get that on here to example we just mentioned there could be somebody wants a Pottawatomie and was spending forty thousand dollars in the last twelve months you know and for whatever reason you know that's kind of you know as you know mental you know mental waste or you know there's there's a the proper divisions division stature just for it and our listeners can't see it but only printed three pages but the little cases snippets go on for a couple more pages and so the court can do can actually doing on equal property division it they're required to do any call property division of marital property unless there's certain things like inheritance or you know squandering of assets or things like that that was that was not in the in the intent of the marriage so it can get a little complicated but the card is not required to take each dad or each asset and divide each one and say you could have they're just required to look at the total of the dead on the assets and and make it approximate equal division of all the the miracle on something silly like what like splitting a car loan tell us about that yeah so it's not as if I'm going to be responsible for half your car loan I'm I'm not gonna get half the car right his soul yeah if you're awarded the asset that the car if it's worth twenty thousand dollars in your car loan is nineteen thousand dollars we're going to also be awarded that car loan and and that sort of a wash if you will because you got the the positive side of the Dayton credit or that you know that if I you know I I did want to counting class in college and the other credits and debits and all that but that's kind of how that works okay and so on and sing for credit cards I mean you know it there could be a couple different bills are credit cards are less of that there's a medical bill for three thousand on a credit card for three thousand of the court can order one party to the medical billing or the other party to deal with a credit card okay I see they don't have to say your each paying half of these two different bills okay and and they prefer not to because I can be a accounting nightmare later coming up on my thirtieth anniversary been married happily never never getting divorced but you know that my wife and I have taken out a lot of student debt yeah what happens in that situation you know that's just very very interesting because now you're going into deeper little angles of metal property we have wow okay did it benefit the marriage was the the loan taken to you know was the student loan taken before the marriage after the marriage was did they completed agreed that that degree benefit you know did they have a benefit to you know transfer the merits all that kind of stuff and then even after that the characterization of that kind of died has to be dealt with too because it allows you to the court wants to divide it really can't be here you can't are you not only the person took that that really has the options to different if it's a federal under the federal program the L. hello out loans for my my kids you know so that's what I mean so what he did not mention kind of parent plus loan you're talking yeah yeah plus loan yeah we address those someone what is it again really unique and complicated situations but you know that I have a case where we're going to add language to the the the divorce judgment that indicates that if the children because intent is that maybe they're gonna know when certain play overlapping it back yeah we're gonna just have some language that indicates if the children aren't doing better to fall behind that the parties that need to split that fifty fifty okay but it would be almost in equitable to say well you know Joe is going to take on this forty thousand dollar parent plus loan and the other person and that and then get forty thousand more of house equity or something like that you know what I mean you're you're you're kind of exchanging current asset of the equity in the house which both parties might need for a future house right for future debt that may or may not come into play yeah this is really an obligation so you don't really want to do that yeah you know and so and these are just things that are you know not I am unfortunately not all divorce attorneys are you know are at a turning spirit are are you mathematically inclined to use be a math teacher so it's kind of my my alley there but you know and just that thinking of the the the longer term a fact of the parties the stator parties you know future financial economic you know circumstances come naturally there so you really have to think about those sort of sort of uniquely and individually if you are just joining us we're chatting with attorney Michelle of with you know it's probably not much more than what our listeners might be thinking about you have one side of the chart that has all the assets and then maybe the dots at the bottom and then then you have a column for that you know for once also account for the other spouse and we say you know what we're we're we're we're putting him right again we don't have to divide every single account we just have to in those two columns on the far right just make sure that it we've accounted for all of the assets and if it ends up being like so if one party has a four oh one K. that's got you know two hundred twenty thousand another party has a four one K. that has three hundred sixty and it we can still find them too in their columns to that either you know to the US and the party that owns that that has it in their name and then just at the bottom of the charts okay the differences you know hundred forty so we've got a shift over half of that half of that seventy thousand back to the equitable in the retirement arena right because not you can't use it for forty some years old you're not gonna be pulling that money out right now yeah verses and and then he collects the cash assets know what it's kind of form but what I mean my house is a Cassius that well it is because it could be sold tomorrow yeah right and turned into a check so the cash whereas the retirement is not a cash asset because even if you try to cash it coach you'd have taxes penalties or whatever because you know it's so it's not it's not like what we call a cash aside let's close out with what happens may dandy Maryland and and divided equally you know essentially going to the spouse because it sure you know have each had half of the others and you know what what have you that gets a little more It's within reason ability that you could expect votes to maybe change. But you're looking at a factor of a hundred two hundred three hundred votes, the most that I've ever changed in Wisconsin's history and a statewide recount is three hundred ten votes. That was for JoAnne kloppenburg out up about one point four million cast. Now, you've got about that number in the twenty nineteen supreme court election, but it's not going to change now for those who are questioning whether or not it's legal for a candidate to just sort of hoard money that's donated. Yes. Absolutely. In fact, there are only three basic things that you can do with campaign cash after you lose an election or witted election, quite frankly, you can donate to charity so long as you yourself don't get money from that charity, for example, let's say the president of the human fund. Okay. George Costanza president of the human fund runs for office. He loses. He can't donate to the human fund because human fund, which is used that money, or at least part of it to pay him. You can donate to another candidate. You can donate to a presidential. Candidate. Gubernatorial candidates? Something like that. But there are of course, maximums for how much you can donate you can transfer all of it to a party committee, like the the national Democrats, the state Republican party of Milwaukee county GOP, for example, you can put all of your money in that. Or you can save it. You can transfer it to a future election committee that benefits you for example. She's not being completely honest about it. She has been all over this knows this space better than anyone. So Jillian as you guys have unpacked this deal. What really jumps out to you. I was lucky enough to speak to Howard marks. And Bruce flat this morning, the CEOs of fulfilled and oaktree one key point that jumped out was that the driver behind this transaction is an ability to serve clients. So if you think of L pays for those who want familiar sovereign wealth funds, pension funds endowments, they're looking to park money, billions of dollars massive checks with fuel manages. So if you step back and think what does that mean people looking to put five ten maybe fifteen twenty billion with fuel manages, folks. Like Brookefield sat back they realized they didn't have the capability until now to be able to meet some of the mandates. Bruce, flat told us we have difficulty meeting the street terms of some of these mandates and very few firms in the world would be able to do that. And the combination should be quite powerful. If you think broadly, really only black started, or maybe even black rook, maybe those would be among the groups able to provide an all service one stop shop. This combination is really sort of changed the game. Yeah. I mean, it is amazing. I'm so glad you brought up those other names because up until this point you we've been in this mode where and you've written a lot about this Blackstone has essentially been putting a lot as fates between itself. And everyone else Brookefield has always been there for them as a real estate competitor. But now this really is you say changes the game. Yeah. Absolutely. So Brookfield recognized that it didn't have a distrust credit capability trade. That's been it's bread and butter for years.
