These were not the most impactful items to say the least charlie. Were you surprised that he didn't spend more time. I mean aside from which topics he decided to talk about. Did you think that he would spend more time with robert durst just trying to make him seem a little bit more sympathetic. I was thinking about it the night. Before what are you gonna do to try to rehabilitate them to stem this avalanche of information from the prosecution to suggest to the jury you know they got the wrong guy. And i wasn't sure how you would do that. But i do. Think we got an example today of how not to do it. He has a podcast host and producer. I was hoping that to garin. Wasn't going to take the silent advice that i would have given him. Which is quit while you're behind because you're only going to get more behind and i was grateful that he did go another half day and go ahead and ask bob some questions but i don't think he did himself any favors with any of that redirect examination. That's for sure britney. What did you make of fluids. Re-cross of bob. I think lou and ended on a high note. You know. I think by going back to the jailhouse call with debbie and his previous testimony about knowing where cathy was buried really helped make his point. You know i think it would have been unrealistic to expect durst to come right out and confess but what has done over the course of all. These many days is show him to be an unreliable narrator of his own story. And when bob went back and used the same strategy of just trying to explain his way out of these very damning things he said. I think that's telling. And i can only imagine that the jury sees that too i agree. It was very precise. And it didn't take that long. And i loved when lewin astor's if he really thought kathy would including your application that her husband was emotionally and physically abusive like that was going to happen. Yeah at the end. I thought it was a nice little ending said so bob. You have repeatedly admitted that. If you would kill capi or susan or both of them you would never tell us correct and bob one word response. "She provided diverse with an alibi or some version of that. And bob's response to that really was one of the stunning moments of the trial. Why don't you talk about what it was like. Hearing all of that in the courtroom absolutely he starts talking about the witnesses and about susan and he was very dismissive of the woman who wants described as his best friend. You know he said well. I didn't really believe half of what she told me. I'm not saying there's anything wrong. With the witnesses it. What's wrong with what susan said. What susan told and this was a really stunning moments all of a sudden. Everybody's sitting up straight moving onto susan towards the end of the day. John lewin came. Around to discussing testimony regarding robert durst trip to los angeles. In december of two thousand and he started by talking about durst. Ca alleged conversation with emily altman. And the fact that. Emily allman revealed in court. For the first time the fact that robert durst had been in los angeles at the time of susan. Berman's death charlie. You have spoken to emily. Allman what did you make of the way that robert durst handled those questions from john. Lewin well i it's a it's a peculiar thing because bob is now admitting not only that he was in los angeles but he was a the person perhaps the first person to find susan's lifeless body and so but now he's attacking emily for that so i think it's a case You know he's trying to exact revenge on her because it was actually her testimony. That ultimately led the defense to admit that bob was in los angeles and that he wrote the cadaver note right and then at the end of the day. We probably got the best exchange of the dialogue. Between lewin and endorsed it was at that point that durst for the first time actually stated that he thought the killer was in the house with him and susan's lifeless body. He implied in his direct testimony. But he actually said it underlines questioning and lewin said will how is it possible that the body was cold if the killer was still in the house and then durst denied that he said that the body was cold then lewin played the clip where he says he put his hand over susan's mouth and it was cold and bob tried to say that it was her breath that was cold the breath of her lifeless body and liu and made a quip you mean. The stiff was breathing. Charlie what was the reaction of the jurors when dir said that and when liu and made the quip about the stiff again. It's pretty hard you know. They're they're off on the side. But i think it was a little bit of a jaw dropper there and lewin expressed it right. How can our breath feel cold. She's a steph yet charlie. Czeslaw asked loftus about her extensive curriculum vitae including her list of honorary degrees czeslaw. Then got to the heart of his examination. His questions seemed to take direct. Aim at the prosecution. In this case. Six to eight people are interrogated by the search person and they say the same thing that's still indicate a false memory. It can if if so six eight people are subjected to the same. Maybe problematic Interviewing or post amount suggestion some kind of suggestive information name. They might all end up believing something. That isn't accurate. It's important to note that the defense and prosecution cannot refer to specific witnesses or testimony when questioning this memory expert witness but chestnuts line of questioning begs the question. Who are the six to eight people that he is referencing. The defense team's narrative suggests that chasnoff is taking aim at the memories of a handful of susan berman's close friends who testified about information they had regarding susan's involvement in the alleged cover-up of kathy durst. That's the kind of thing that we've actually done. In some of my experiments we incorporate false information into a question and we look to see what people do with that suggestive questions. So you show people say a simulated accident where a car goes through a yield sign before the accident and ask a leading question like did another car past the red car. When it was at the intersection with a stop sign that can cause many people to now believe in remember they saw a stop sign instead of yields time. That's just one experimental example of how a question that has embedded in some misinformation can be adopted by people. Both the question and answer appear to insinuate that the prosecution might have implanted false memories in witnesses by asking leading questions but who specifically among susan's friends is chestnut referencing. Could it be nick shaven. Nick you also mentioned that susan said to you that bob had confided in her to more easily set up an alibi. Do you remember telling the police. That is yes amused fourteen years now. We're not saying whether this is necessarily true or not. We're trying to figure out what susan told you that. Somehow she helped with an alibi and early. Yeah yeah yeah. I would say about tasks and again. It's not that year saying you believe to.

"Door. What did you make of that. Well i actually keyed in on his last line where he said well he was an adult. That wasn't when we were kids as if maybe that was okay. If they were adults they were on even ground. I thought it was odd that he remembered exactly how much he paid for the monthly rent in vermont but didn't remember that incident. Well i'm not sure that he wouldn't be reluctant to own up to that. And those kinds of cruelties in indignities were probably so commonplace for him that i actually wasn't surprised that he didn't remember that i just took it as something that he did sort of matter-of-factly and he got a laugh out of it in the moment. And then he forgot about it whereas it was traumatic for thomas understandably charlie odd kept mentioning the psychiatrists that he had seen over the years and lewin objected every single time. But i was just wondering if you have a sense of what his strategy is there. Do you think he's going for some kind of insanity defense. Well it's funny. We knew that. Bob at the age of About eight or nine was fighting with his father and his brother so much that they decided to send him to see a psychiatrist. Bob is now saying that you know he was constantly going to psychiatrists. You know the shrinks were adam trying to get inside his head i. I'm not sure what that's all about. But i do think you're right. The prosecutor john lewin seems to think he's going somewhere with that that there is a purpose to it. I think lewin actually said what he thinks. The purpose is what lewis said was in this case. The defense is not presented any psychiatric testimony but what they did in texas was. They asked a lot of questions about psychiatrists with the prosecutors. In that case never oppose. And that's how they got psychiatric evaluations in testimony in the galveston case. Lewin wanted to make sure that kind of stuff didn't get in that way. What that raises for me is more generally what you guys think. Geren strategy is with durst. I think he sort of playing out what he essentially said in his opening statement. And that is. Bob is been this hapless guy more often than not who finds himself in the wrong place wrong time and he runs. I actually think and this is just my impression. But i sort of think that garin sort of using his appearance as a way to gain sympathy. Almost like a racehorse whose on its last legs but seems to want a race one more time. Maybe if he talks long enough you'll be able to humanize himself for the jury. Carry what do you think to garin. Strategy is here yeah. I'm not sure he has much of a strategy. And i'm going to go out on a limb and say he's sort of just winging it and to the degree that there is a strategy. As we have reported on multiple occasions dirks lawyers have repeatedly moved for a mistrial based on their assertion that his various health issues have rendered him unable to participate in his own defense. Contrary to these repeated assertions robert durst appeared alert and focused providing cogent testimony during the beginning of dicta guarantee direct examination in this episode. We want to present an update of the highlights from his first day of testimony. Later in this episode. We'll talk with reporter charles bagley about what we can expect from robert durst in the days ahead. That's coming up. After the break. In his opening statement robert durst. Attorney dicta garin summed up the defense narrative. Concisely bob durst did not kill susan berman. And he doesn't know who did. He opened his direct examination of durst addressing these points. "The trial of robert durst. I'm joined by my co host brittany bookbinder. And we're bringing you some breaking news from los angeles superior court brittany will read you. The memo that just came in from the meteo relations office of the court for immediate release august. Six twenty twenty one judge mark e wyndham orders a recess until monday after trial observer tests positive for cova nineteen judge mark e wyndham. Recessed the trial yesterday after notification that an individual present in the courtroom but not a member of either trial team had tested positive for in nineteen. Furthermore judge wyndham learned that this individual in defiance of strict cove nineteen court and public health protocols had been experiencing symptoms for several days but none the less attended the trial. The member of the public who tested positive was wearing a mask when attending trial this week after receiving the positive test notification yesterday judge wyndham immediately recessed. The trial excused the jury until monday and began gathering details of this troubling incident. The delay of the trial could have easily been avoided. If the courts cove nineteen protocols which match the protocols of the los angeles county department of health and the c. d. c. had been followed as directed at all courtroom entrances on the courts website and announcements on the courts twitter account after review of the facts including contact tracing and an assessment of close contacts under established public health definitions. Just before the prosecution began presenting the last part of their case against robert durst. The defense team presented evidence of robert durst declining health in support of one final motion for a mistrial in a hearing this morning. The defense called dr klein who specializes in internal medicine and kidney disorders back. In may the defense presented a report. From dr klein that outlined robert durst various maladies this morning under questioning from dicta garin. Dr klein reiterated the conditions. He noted in his report. Based on your records review and based on your two examinations of this mr dirt would you please outline for it briefly. Each significant medical condition that he has that could affect his physical abilities to withstand brawl and his cognitive abilities. Would you tell us what those conditions are. I is that he has normal pressure hydrocephalus and he had a shunt place about six or seven years ago so he was treated and fifty percent of people within six seven eight years will have some sort of a relapse at this point deputy. Da john lewin offered to stipulate to the various conditions that dr klein had detailed in his report since it did not appear that the physician was offering any new information however judge mark e wyndham decided. It was important to hear the doctor out. The doctor klein proceeded to describe the conditions that we have previously reported on including chronic lung disease. Cardiac issues esophageal gastric as well as his preferred methods of treatment which involve immediate hospitalization to garin. Then ask dr klein to lay out. The cognitive issues that he believes would prevent robert durst from continuing to stand trial. Yes now address the cognitive or how his conditions affect his cognitive ability in in the medical record the it describes him as he cognitively impaired deficient many many many times. I can give you a stack of papers. I extracted from the medical record. We're again and again. It mentions his cognitive deficits. There's many actions he does it show that he's got cognitive deficit and he's declining. When pressed for an example. This is how the doctor responded he. He was found in jail to have defecated on the floor of his cell and he covered it with his clothing. And that's not considered normal behavior when deputy da. John lewin cross examined dr klein he pushed back on the conclusions. That the doctor has drawn in your may report. You basically said you didn't know this durst. He was had such so ill that he had a limited life expectancy you do not know if he could survive trial correct. That's would you agree. Dr did mr jurists if anything has gotten better in terms of how he has been able to understand the proceedings and participate during the trial. He's not even better. Have you watched the trial. Dr no sir. Do you know anything about the fact that mr jurists participates hands notes to his attorneys tells them to object. Is that any way going into your decision making process involving his confidence. I think better at you especially read the notes. But he's writing his handwriting. Berman had a complicated relationship with even her closest friends and one thing that really stood out to me was that while she didn't have the easiest time with adults. It sounds like she was great with kids. Yeah you're right. She did seem to have a maternal relationship to her friends. Kids yeah there was that sweet anecdote about susan. That one. right. Yeah i mean. It's no wonder that launched her career. It was basically click bait before there was click bait. You know that's a great way of putting it actually. It did occur to me that there's almost a greek tragedy quality that susan berman's life and specifically in the span of about two months. Susan experienced the incredible high of robert durst hosting a book. Party for her memoir. Easy street that was in november of nineteen eighty-one and then if the prosecution's case is to be believed just over a month after that she helps bob durst cover up the murder of his wife. Kathy yeah that's a great point. It's like she made a deal with the devil you know as you say if the prosecution's case is to be believed bob does her a favor throwing her the book party and then when he calls in a favor she's got to pay the piper.
