Yeah, is the first thing is just get knowledge on what is available to you. I think the biggest thing that people do is they don't get the information and it's easiest thing to do is as well. And so the number one thing is to get information, get the knowledge of understanding really what a state planning is, how it applies to you and your particular situation because one size doesn't always fit all when it comes to certain things and depending upon where you live, what kind of assets you have. We can definitely help you in determining what's the best way of protecting those things and coming up with a good estate plan for your particular situation. Jennifer? The thing that gets me the most is when people say, well, I don't want to worry about it because that then something will happen to me. It's like this fear that if you talk about a will or you talk about a retirement plan, planning something bad is going to happen. And I'm just going to tell you that it's actually probably the biggest preventative. The people who go out there and have this all set, it's amazing how they end up living these long, healthy lives and everything's great. It's the people who are Willy nilly, you know, that are off there jumping off of base jumping and stuff like that. And then something bad happens. So just don't think that. That's actually opposite of reality. Just go ahead and do it. It's usually you can get a pretty low cost consult. And then find out where you're at. And it's only going to help you think of more ways to make more money.

"Some of the main advantages of the trust is it's going to reduce the taxes, it's going to reduce the taxes on the estate. It's going to distribute the assets to the airs efficiency efficiently and it's going to put conditions on that property. So if it's set up correctly, then obviously it's going to protect it from the litigation that, you know, one of the things that lawyers like to say is that we live in a litigious society. So people want to sue for everything. And when they usually see they go after the people with the money. So a lot of times setting up that trust and setting it up effectively is going to protect those assets. So, you know, that's something that's extremely important in having the trust and even something that you want to make sure that you have properly done when you set up the trust if you have a trustee who is reliable. Someone who knows what they're doing is somebody who has a lot of knowledge about the state and the property so they can do it. They can have everything done properly because again, like I said, we live in a litigious society, so you always want to protect yourself. Now, one thing a lot of people in my audience do have are retirement plans. So if they have a retirement plan and they actually do have trust as well, how do you coordinate the two of those so that you're not accelerating taxes, which I know a lot of us don't want to do for very obvious reasons. Well, depending on what your structures you have set up and what type of retirement plans that we're talking about, you know, we're big fans of self directed SD IRAs and solo four-o-one-ks because we believe you should have the power of your own money and be your own bank and have checkbook control. But even still, if you have traditional retirement plans, it depends on the structure that is set up.

"And listen, I want to talk about beneficiary nightmares. I honestly feel like that could be a podcast episode on its own. And I want to talk about why we can't forget about our state plan and when we have these life changes that were inevitably going to have. Whoever wants to step up and take this away, go for it. Beneficiaries is basically who's going to get whatever assets you own after you pass or whatever you want in that trust. And so the idea is that all your things that you own, whether it be real estate, collectibles, even your retirement plans and things like that in other paper assets, for example. We want to know who those are people are going through. And what can happen is if you don't have anybody really outlines specifically, it can go to the person that you don't want it to. And so you may want it to go to your children and be divvied up as certain way. Evenly, well, it could end up. And I've seen this happen before in my wife's family is my father in law passed away and he had a pension. And there was 5 kids and the pension went to the oldest kid. And there was a lot of issues around that. And so it can have a nightmare like that. And it wasn't too bad, but just to my own family, I've seen that happen where you want your assets to go to one person or maybe be divided evenly among your children. And if you don't have it fully outlined and updated all the time, it can really turn into a nightmare. And it's kind of to go off of even Brian's example, some of the things I've seen in practice where there's also a new one to wear an individual may be able to inherit inherit a piece of property or whatever it would

"The only thing I would possibly add as far as the process and what to how to avoid it would be that when it comes to probate, there's a certain ideas of there's certain hierarchy of laws and individuals based on the individual's family who would get it. So depending on who you had on your living relatives, those individuals and a certain lineage of how it goes depending on who you have living, if you're a married person, if you have children, if you have living siblings, that's how it would typically be structured. But you want to avoid that because let's say you have an individual who you know probably isn't the most responsible individual. But then because of the laws of probate they're the deemed under the law as the next person in line to inherit your property. And typically, one of the things you can do to avoid it is to simply have a will, but obviously just a will alone sometimes they can be issues with that. And then another way to avoid it would be having something known as the affidavit of airship. If you have individuals named that who are to your property, but the difference between something as an affidavit of airship is there's a certain amount of that the property or the things that you don't have to be valued at. So if it valued at a certain number, depending on what region or state that you live in, it's something that you can utilize because it may not be something that's proper for your exact state. So at least if you want to avoid that probate, having a will or properly done a state plan and by filling out those documents is the best way. A lot of people don't realize that in a state may undergo formal probate for reasons such as when the will is contested, if it's unclear or invalid or when the assets are held only in the deceased dame.

"The house that he just bought was lost because none of the payments were made, even though him and his wife had talked about how that would happen. It would have been his sister. But in the shuffle, the strongest people, the people you don't think of come out of the woodwork and they kind of push around while everybody else is grieving and nothing they wanted to have happen. So we had this happen in the news, this last week there was a royal Caribbean cruise line went and dropped people off at a volcano excursion, and yes, it's an active volcano. Anything could happen. But a hundred people were caught up in that and they had absolutely no idea. Many of them were young couples, some of them had kids. There are some survivors, but people lost their lives. Right now, I'm going to tell you, this situation is playing out in a variety of different ways with the loved ones and survivors of this. And if you don't have something in place that is powerful, then who knows what you might wake up to. So everyone wants to think about this is and, you know, this is when I'm elderly. This is way on down the road. And I'm going to assure you, no, it's not. You need to start thinking about this now. And I hate to be such a bummer, right? Bringing everybody down, man, but the thing that won't bring you down is when you go through something that's comprehensive, you get this paperwork done. Yeah, it's not fun, but then you can feel completely free. And you know that your plans are taken care of, and you don't really have to worry. Because when things go wrong, it's a lot better if it's already mapped out for you, from the bills, to the kids, to what happens with your business. You know, one thing people both don't know about me is actually been practicing martial arts for about ten years and I just got my second degree black belt in Keppel karate. Wow. This is Jennifer and most people don't know that I can play all woodwind instruments in all melodic percussion because I was drum major and but that was a long time ago so they don't know that now. Cool stuff both you guys. Thanks for sharing that. And as I shared with fire nation in the intro, we have quite a doozy of an episode because we'll be talking about end of year estate planning, specifically for entrepreneurs, which of course makes up my audience entrepreneurs on fire. And let's just kind of get right into this because a lot of people must be Frank. They think that a final will and testament is actually in a state plan. They're covered if they have one or the other. But that's just not the case. So can you jump in here, share with fire nation, what the two are, why they're different and what entrepreneurs specifically should have. Number one, a will is not like a full estate plan. There's a lot more that goes into in the state plan, including having directives and medical directives, pour over will if you have assets. So a state plan is a lot more comprehensive and will usually involve some sort of a trust. The idea of an estate plan is to avoid probate. And probate can happen with a will if it's contested and under a variety of different circumstances. So it's much better to have an estate plan rather than just a will. "The beach last month, and they were looking at recent policies on Cape Cod and Rhode Island, which allow indigenous residents free beach access if they have tribal IDs. And they also pointed to these historic treaties that guarantee shinnecock residents uncovered access to the ocean around them. For us to be denied the same rate as village residents, when that is our Aboriginal territory is kind of not kind of it's a slap in the face. That's Brian price. He's the chairman of the shinnecock Indian nation. He says he struck a deal with the Southampton village mayor, Jesse Warren, earlier this summer. That was supposed to have a granted them free parking passes, but when the mayor took the agreement to the village board, he told WNYC that it was shot down by the other trustees. Interesting, why did that happen? We've heard a few things. One reason that keeps coming up is just the cost of maintaining Cooper's beach. It's really wide, it's raked every night as concessions, it has lifeguards, a few years ago, it was named the best speech in America, Roy Stephenson is one of the trustees that opposed the deal, and he said that some village residents didn't think it would be fair to offer free parking to shinnecock residents, since they don't have to pay taxes that go to cover the beach costs. Right now, if you are a taxpayer, one of the reasons you pay a tax in the village may be to have access to the beach. The shinnecock would point out that Cooper's beach sits at the edge of a Peninsula that's known as billionaires Wayne. It's home to some of the largest mansions on the east end. The 1% of the 1%. So it's not exactly the tax base there is hurting. And really what you have is this stark income disparity with some of the wealthiest people on Long Island on one side, and members of the shinnecock, who make an average of $30,000 a year on the other. So what is the relationship like between these billionaire residents and the members of the shinnecock tribe? It's fraught that two sides have clashed over billboards over fishing rights over development on the tribes ancestral burial grounds, more recently, a shinnecock plan to build a casino on their territory has set off a wave of opposition from other Hamptons residents. They say the facility would worsen traffic and hurt the area's small town charm. For some tribal citizens, the fight for beach access has reinforced a sense that the other residents would rather not have them around. They have no regard for us or anything that affects us. That was dioni Brown, a resident of shinnecock nation. She spent many of her childhood summers at Cooper's beach and said she only learned about the parking fees after she got a ticket a few years back. She ended up surveying her fellow shinnecock citizens and found a majority of them had started limiting their beach access to off hours because of the parking enforcement. I feel like it totally is indicative of the relationship. Like there's no intention to collaborate on anything or we're all here in this village community together. Why shouldn't we want to collaborate? Brown said she hopes the battle for the beach eventually makes its way to court, but for now she plans to continue avoiding Cooper's beach. business flash Thank you so much And of course you are Doug Chris indeed I'm afraid I was a little bit on holiday autopilot earlier Thank you so much and I apologize Doug Shut down last year through a wrench into much of the economy and that's certainly includes real estate as reflected in a real estate investment trust share prices Some of those have now recovered Some still have a ways to go Narrate the association of real estate investment trusts has a report out on what happened and what to expect in 2022 We welcome now it's senior vice president for research and economic analysis Kelvin snores or Calvin thanks so much for being back with us Fascinating report take us through what has come back the fastest Well the initial Fox certainly was hard on everything We saw that across the whole country of the whole economy and real estate was no exception Pretty early last year we saw some sectors come back and it continued this year These are the sectors that support the digital economy this includes industrial logistics REITs They own and operate many of the supply chain facilities but logistic facilities that deliver goods bought on the Internet There are other tech related sectors the data centers that host the servers for websites the cell tower is the transmitted data These sectors all performed incredibly well last year and this year as well I'd also add in self storage REITs We have a very strong housing market and apartment market and with people moving and maybe needing to store things So storage REITs actually have returned 75% this year That's just an incredible number Overall REITs are up 35% in 2021 That's compared to about 23 or 24% on the S&P 500 So it's been a good year overall for reach But you're right there are the pockets that are not as strong So first of all you've got a terrific bar chart in your report I recommend this report to everyone We can't show it to you in a radio but it's 2022 outlook for the economy commercial real estate and REITs And the self storage as you said is just shooting the lights out but the departure explains it all right quick So let's turn to the other side of the equation and half empty part What hasn't come back yet But was it haven't come back are the ones that haven't those that have not come back in the stock market are the ones that have not had the on the ground improvement And those would be the hotels The travel and leisure sector The office sector some of the retail sectors the retail has come back but that was from a pretty low level from last year Really with hotel and office we are still in the middle of the recovery The business travel has not come back very strongly yet I was supposed to be speaking at a conference in New York in two weeks and it was just canceled yesterday So I'm canceling some of my hotel reservations I think people across the country are doing that Similar thing with office we are seeing still the actual physical occupancy in an office Now this is different from tenant sign leases or not But the number of people in the office building is hovering somewhere around 40% or so A lot of people have not gone back to the office Now that has caused some concerns in the market But this is really just a matter of timing The key point is not do people come back to the office next month or the month after But in the long term how many people are going to be in the office with a work from home environment And what I'm seeing from most employers is they're embracing a flexible work from home but that means on the days when they have team meetings when they have big projects kick-offs or things like that they're going to have everybody in the office So the demand there is going to be based on the peak when everyone's in the office So the hotel's in office really we have not seen a full recovery yet either operational terms or in the stock market but as the pandemic goes away many of those obstacles should disappear We expect to see those improved next year A good number of these I guess I would have expected I mean whether it's data centers or its industrial going up and lodging in resorts going down The one that mildly surprised me was retail which is actually up because we tend to think of bricks and mortar retailers really not doing so well Well that is certainly what everyone thought last year and the consumers have proven them wrong As the shopping centers the stores the malls have reopened many people have gone back to the stores Now it's true that people are still buying a lot of things online We still have all the delivery trucks in our neighborhoods It's very convenient to buy things online But we saw even before the pandemic and that anything were the size the 5th the touch the feel Those things matter People are still going into the stores going into the physical brick and mortar retail to buy them And sometimes it's just people trying to be on the computer You want to break It's nice to go out and go shopping Stroll around and look at things Brick and mortar retail is a core part of the U.S. lifestyle And it's shown that it's going to be here to stay Let's talk about a couple of factors that are outside of the four corners so to speak of retail That is inflation right now is on the march in this country We talk about it all the time Is that driving more money into reach as a practical matter Because it's thought that real estate would be a hedge against inflation People have certainly interested in REITs because they're what many people call a real asset And lots of parts of real assets But what we mean when we say a real asset is they own a property They're not just making something or selling a service They own a property and the property prices tend to rise when inflation rises So the value of the shopping mall the bounty the department building the value of the industrial facility tends to rise when inflation rates That protects the investors And it's not just the property values that rise It's also the income stream Many of the leases have read escalator clauses for inflation And for those that don't leases are rolling over all the time We've done some research at nareit looking at REIT performance during periods of moderate inflation And they quite often outperform the S&P 500 Again because they have this asset that rises with higher prices and their lease the lease receipts lease revenues will rise as inflation is up So in this type of environment I should also say I don't expect this to have run away inflation Inflation is going to be here through the next year but it's not going to cause a problem like we had in decades past But moderate levels inflation tend to be good for real estate Let me just interrupt you just for a moment stay there There's a headline crossing the Bloomberg right now that the Amazon cloud unit has drawn and a trust scrutiny from the icons and there's a Linux cons FTC She's the chair of the FTC We know that the FTC was looking into this had requested documents from Amazon and others and is pursuing it But now it appears that Bloomberg is reporting that it's going to move forward with that investigation of Amazon cloud unit So that's the headline coming across the Bloomberg right now Charlie one last one here there was also a story in the Bloomberg today about private equity and how much money they've raised for real estate They can't actually find the places to invest it Is that driving prices up Well there are two things you can say Brian prices up One is a lot of money to invest in it But why are people looking for the money Because earnings are up We published a near key tracker which is a report on earnings of REITs the list of equity real estate And earnings in the third quarter are the record high So we're seeing strong earnings which is why you have prices rising Yes it's an attractive investment A lot of investors see that a lot of people want to have REITs in their portfolio for diversification for the income that they get And that's as important as anything that the private equity funds are doing Okay it's really great.

He was not like brian price where they they hired him to sort of oversee what they knew was going to be a dismantling of the club. He was not hired to oversee a rebuild. He was not hired to sort of be a placeholder for the next guy. David bell was hired to win. And i believe that we overstate the role of a manager in a team's success or lack thereof reality as he was hired to win. We're going to be ending year. Three and the reds will not have one with david bell. I wouldn't have a huge issue. David bell managing the team next year. But good luck selling your public on the manager that you hired to win not winning and then coming back it feels like there is so much riding on these next eighteen games and maybe even beyond. Because i'll be honest with you if the reds get the last wildcard and then lose the wildcard game. Well that's that's not necessarily a smashing success right so i think what happened over. The last couple of weeks is yes. They've gone into the tank offensively and they've blown some games. They should have won. This should have won that game on saturday night. You have four. Nothing lead early in the game. Louise cassidy on the bump. You're supposed to win that game. You are supposed pennant winning teams in september. Win that game. You're supposed to win that. Damn game but i think really what's happened here is because they have failed to take advantage of the padres being terrible. They have failed to take advantage of a bunch of games. Head to head against the cardinals. They have failed to take advantage of the field and the field. Top to bottom is pretty uninspiring. It's it's not very deep. It's not very good. What they do is they've put themselves in a position where it's eighteen games maker break really for this little mini era of reds baseball. And they've put themselves at the mercy of eighteen games that are going to determine how people feel about the direction of the club. The ownership of the club the management of club the manager of the club and many of the players on the club and perhaps the organization itself two thousand twenty in two thousand twenty one were built. They were billed as okay. You waited for that long rebuild. You waited for ninety eight losses in two thousand fifteen and ninety four losses in two thousand sixteen and ninety four losses in two thousand seventeen and ninety five losses in two thousand eighteen and eighty-seven whatever it was losses in two thousand nine hundred. You waited through all of that and now. Here's the payoff. The payoff is supposed to be more than the seven seed and twenty one shutout innings last year and finishing lower than fifth and on the outside looking in this year. I believe the reds are going to make the playoffs. Do that is as much a statement. About how i don't think the padres are going to recover and the cardinals gonna play a tougher schedule. The reds and not really bein. the phillies because of the gap. They're facing between themselves in cincinnati. Philly schedule is pretty easy..

Haven't won a series in about three weeks. They lose the bad clubs like the Tigers and the Cubs. They play again tonight. Many issues so little time. No eager. Welcome again in the Bill Cunningham show. Would you like to extend and revise your remarks? No, not yet. Not yet. You still believe I still believe, although I don't feel as good about as good about things with the Reds as I did maybe a week ago. Uh, If they don't get to the postseason, they have no one to blame but themselves because they've lost a series of the Miami Marlins. They've lost a series for the Detroit Tigers and as well as the Chicago Cubs are playing. Um, you know, maybe they win this series at Wrigley Field, but they're not off to a very good start. I still like I still like their positioning relative to the Padres, even though they're a game out. I still like their positioning relative to the Philadelphia Phillies, even though they're red hot, and I still like their positioning relative to the ST Louis Cardinals, who have both had issues of their own so, but I don't feel as good today as I did when you and I last talked. Why is that? Of course Offense stinks. Except for the 12 run explosion. They can't hit the ball. Votto had a nice run, and he's done. Winker may not play again. This year, Castellan is is doing okay. Not strong. They can't The moose is loose. The moose is impossible. I think he's hitting like 1 18 or something. When you when you hit half your weight, That's always a problem. Is it just offense or more things than that? I think it's the manifestation of what I think my sees along fear was and I would imagine what the seats along here for a lot of people were. You know you go back to last year, they had about a six week offensive swoon. Now it was exacerbated by the fact that the season was basically nine weeks long, but For the better part of six weeks. This team did not hit and what happened. It dug itself a whole We hadn't seen that this year. This team offensively top to bottom from opening day until about 10 games ago was pretty good. And even when you have guys who are struggling like you, Hey, neo Suarez, or you had players who are out of the lineup like Mike Moustakas. Somebody was carrying the load. Um Winker and Castano, certainly early Joey Votto for a huge stretch during the summer. They've gotten a great boost from Jonathan India. The catchers have been more productive, and I think anybody ever would have imagined Tyler Nay Quinn has had some really hot streaks. What I think with the concern has been at some point. Every team goes through an offensive slumber. When is it going to occur? And when it does, how long will it occur for? And the first answer to that question? We have it. Here is the offensive slumber. The second part of that question. We don't have that answer yet, which is how long it lasts for the next 3 3.5 4 weeks. That's going to be a problem. If this team can bust out of it, then I think they're going to be okay. But I think that's the issue. Look, they're they're both had is better. But not fixed. Their starting rotation has some quality assets. It pales in comparison to maybe a team like the San Francisco Giants or the L. A Dodgers. But certainly most days you feel like whoever the red starting pitcher is, is going to give you a good outing. Um But this team is contending the team is in contention in contention on the shoulders of an offense that is vastly superior or so far, at least, has been vastly superior to the one we saw last year. Even good offenses go through swoons, and we're seeing one. Now. The question is, How long is it going to last? They better get out of it soon because the Cubs are Cubs, not even trying to win baseball games. They got rid of their team about three weeks ago. Everybody left. No one's behind and they're kicking the crap out of every, but I think it won seven in a row, which is unbelievable for a club and this portends poorly for Tony Bender is good friend David Bell. Because David Bells deal is up, and you want to see the Reds finished well in September and Megan of the playoffs. And if not if the Reds continue this swoon and end up at or below 500 is David Bell gone? I think it's a legitimate question. I think David Bell has done a good job with his team. But look, they were built to win. This team was built to what do you think the Reds front office or ownership was the one about the right way of building a team to win? The idea is starting last year was for the Reds to win something substantial. And in the absence of that, I think it's fair, uh, to at least examine the role of the manager in the team's failures. He doesn't have a guarantee for 2022. If they brought him back right now, I certainly wouldn't have a major issue with it. But But again, I mean, He was he was given. I think the best Reds roster a better read faster than his predecessor, Brian Price. They spent a lot of money in order to win. I think to a large degree they handicap in this offseason by what they did to the bullpen. But you go into the last month of the season leading the wild card race. Your team is reasonably healthy. The idea is to play in the postseason, and if they don't do that, I think there's a lot of managers around Major League baseball that would pay for that failure with their job, and it wouldn't surprise me. Especially given the fact that the guy who led the charge and hiring David Bell Dick Williams is no longer here. I like I like the job. David Bell is done. I think to a large degree, so he's got a raw deal from people who default to blaming the manager when things go poorly, but at the end of the day Managers are evaluated by how much they win, especially when the front office fields it set the manager up to win. Was that guy actually. Good jose arredondo. Who pitched in a ton of games that year and was pretty reliable or secure right. Sample cure had kind of been starter and reliever and then really sort of carved out a nice niche as a relief pitcher on the two thousand twelve team and did a good job finished a bunch of games. "This doesn't look like a soul sawmill when we visited big industrial sawmills in the in the us. These things automated. And that way the slices that you get out of that log you can put on the front on that sound board of the guitar and it's all one piece it's two pieces said i do. Think book matching well. They'll take a pace that might be say eight to ten millimeters thick a slice like that. Cut it down the middle very carefully and then open those two pieces like a book when they open those two pieces of pas and join together. That's the front of the guitar. So if you imagine looking at guitar if you look at anything yeah you've got roughly sort of twenty draw a line down the middle on either side you've got about twenty five of would there. That's at least the the width that you need to have of the of the tree on one side of the center of the tree. I was still Don't you think? I was still in Oakland. And I think he was with Seattle. On. He's an amazing guy. And so I don't miss. And you know, when you have discussed we played for the Giants, and you know the roundabout way you hear if you grow up on the peninsula, you hear about the other guys that played baseball or get in the big leagues, Whatever. And so I remember. Like just saying, What's up, like? Hey, Bob. You know her friends and he's like, Yeah, yeah, yeah, like Saint Francis guy, And I think if another steak and Wasn't Bob. And so he was supposed to be the fourth outfielder. But there's no way just because of the spring had that you couldn't play it, but I want to see he had 500. It was absolutely smoke balls all over the yard is playing a defense. He was still a basis. And so I started still on opening day and then Davani got got right in there and got a couple hits and the snack and he was hottest to be so broad comes up to me. He was looked down. all woodwind instruments and all melodic percussion because i was drum major and but that was a long time ago so they don't they don't know that now the stuff both you guys thanks for sharing that and as i share with fire nation the intro we have quite a doozy even episode talking about end of year estate planning specifically for entrepreneurs which of course makes up my audience entrepreneurs on fire and let's just kind of get right into this because a lot of people all must be frank they think that a final will and testament is actually an estate plan like their coverage they have one or the other but that's just not the case so can you jump in here share with fire nation what the two are why they're different and what entrepreneurs specifically should have number one a real is is not like a full estate plan there's a lot more that goes into an estate plan including having directives medical directives pour over will if if you have assets so estate plan is a lot more comprehensive and will usually involves some sort of a trust the idea of an estate plan is to avoid probate and probate can happen with a will if it's contested and under a variety of different circumstances so it's much better to have have an estate plan rather than just a will and i'm sure richard can tell you more about richard richard gula here he's our attorney here at leafy legal and and he can tell you more about the different ways that you can get caught up it is contested contested very cool well listen i know we have bryan jennifer and richard on the mike and i'm just gonna say this right now you guys all have good audio quality but definitely avoid this shuffling the papers because we got four people on the mike at august august picked up so for clean audio stop shop in the papers and fire nation will appreciate that so richard take it away i think one of the things as far as sped jennifer mentioned was specifically about probate and that's one of the things you always wanna voice simply because when you have a will you have a proper estate plan to glean that the happened probate the hell is happening outside of how you want it to happen so when you have certain directives empowered returnees put in place when you have a great estate plan put together by at at least a will at the very least you can at least have things done in the way that you want to be done except when you do it through probate kinda happened the way the law wants it to happen and just being honest a lot of times the way that certain laws are naked starting laws put in place it hasn't happened exactly how you want to happen so he may have other individuals he probably don't want to get at the house or you probably don't wanna get the vacation hogging because of probate that's how it happened so that's one of the issues that you want avoid especially when it comes to probate now can we get maybe an example example from any one of the three people on the mike right now about what has a situation looked like you don't need to use real names or real places i know blah blah blah you wanna protect checked identities but i think having a specific example would be cool like when has somebody not been prepared in this manner this really blown up in their face so i'm going to tie in something that just happened this last week to another situation that was very similar to this so you have a young couple couple the husband and wife love each other very much say the child before they got married and then they ended up getting married her parents parents are very strong willed people they come from a very different type of background and they weren't too happy about the whole new son-in-law situation they weren't happy they didn't get married married before the baby was born they're not happy about a lot of things but they're trying to make it work obviously the closest the couple was lot closer to his family family they decide to go on vacation it's a great cruise there with you know a big cruise line that everyone's heard of they stop off at an excursion that's given by the cruise line and tragedy strikes they don't have anything in place by the time one of them wakes up none of the bills have been paid the child is living with her parents which is something that they would never ever went to have happened the house that he just bought was lost because none of the payments were made even though him and his wife had talked about how that would happen it would have been his sister but in the shuffle the strongest people the people you don't think of come out of the woodwork and they kind of push around while everybody else grieving and nothing they wanted to have happen so we had this happened in the news this last week there was a royal caribbean cruise line went and drop people off at a volcano excursion and yes it's an active volcano anything could happen but a hundred people were caught up in that and they had absolutely no idea many of them were young couples some of them had kids there are some survivors but people lost their lives right now i'm gonna tell you this situation is playing hang out in a variety of different ways with the loved ones in survivors of this and if you don't have something in place that is powerful awful then who knows what you might wake up to so everyone wants to think about this and you know this is when i'm elderly this assist wait on down the road and i'm going to assure you know it's not you need to start thinking about this now and i hate to be such a bummer bringing everybody down and but the thing that won't bring you down is when you go through something that's comprehensive you get this paperwork done yet it's not fun and but then you can feel completely free and you know that your plans are taken care of and you don't really have to worry because when things go wrong it's a lot better if it's already mapped out for you from the bills to the kids to what happens with your business you know if you're an entrepreneur if you're a real estate investor you're doing doing deals on houses you you've got all this stuff in the mix and you don't have to lose it all you can't continue at you can have plans for it and then if you were to pass away it can it can be distributed the way you want it to be distributed without the government coming in and really messing everything up probate probate i've never heard of single kobe that ever ever happened where people were happy with it well i hope you bring people down what i hope you're doing is giving people a backslap of reality who need it because the reality for you fire nation is you have loved ones in your life you want you need you should be prepared hard for tragedy to strike hopefully it never does but as we know every single day by watching the news by listening to the news tragedy does strike strike someone somewhere every single day it's just reality so thanksgiving that personal example and a couple of personal like real stories because i know that it just kind of really resonated with people such a deep way than just like these vague broad terms that a lotta people hear over and over again but don't really get what that means what it comes down to and speaking of which that's what i want to move into next is that we've used a couple of times and that's probate so let's get real for a second and define what probate actually is and then very importantly how the heck can we avoid probate probate is about basically win win there's no real time that that assets are going to be allocated when someone passes away someone goes into those assets if they don't have a trust or if the will is being contested basically it's when the government gets involved to say ey what happens to those assets normally what happens is basically taken by the government it and then they're gone through scrutiny in order to determine where where you know where those are actually gonna go what happens in a with with with if there's unfortunately children or something like that or you know mostly it's it's with all your assets you know where those people who gets them how do they get to those people and whatnot in so most of the time is stock and so you can't do anything with it you know you hope that you know it it'll be done soon but you're basically at the government's you know timelines and things like that and they don't move very quickly and so not getting any kind of probate situation is ideal for anybody
