Based on the position that she has occupied on the California state Supreme Court. So if she is in fact the nominee or it looks like she's going to be an you know we will do a deep dive on her jurisprudence. But I will tell you I expect that it will be classified as sort of a well, do you want the most liberal of the two picks, which would be Jackson? Or do you want the younger of the two picks, which would be Kruger either way? I mean, you can not measure the distance apart that even the swing vote on the California Supreme Court. Which, by the way, is a very, very liberal court. Is from the current composition of the Supreme Court. So I don't think both would be eminently qualified. I think both will be fine in terms of Democrats. Now here I'm assuring my fellow liberals Kruger will not go wobbly. I think that both are eminently qualified both will not disappoint as Supreme Court nominees. But liberals we love to eat our own. So well, here's what I'll say about that. I don't know what calculation will be made with, you know, Manchin, or if anybody wants to be a troublemaker here, Manchin or cinema. It seems that they have not at all done that with the federal judiciary. But nope, also, people don't pay attention to that as much. So I could imagine that this will be a way more headline grabbing thingy. Someone like sinema or Manchin could want to make hay with that or whatever. Manchin Manchin and cinema both voted and were the key votes to advance Kentucky Brown Jackson to the D.C. circuit. But again, she said, we're also make the coded move. To bypass the filibuster when it came to raising the debt ceiling, but not voting rights on Martin Luther King day. So just no, I hear you. I think the odds are pretty good that they'll go with it. But the point I was gonna make is, as liberals, as people on the left, as Democrats, I really don't think we ought to fuss too much about a couple points left or center on the third justice of you know what I mean?.

Let me ask you, there is some speculation of whether or not Kamala Harris, the VP can cast a tie breaking vote, which seems especially relevant if Susan Collins and Mitt Romney don't vote with whomever this nominee is. I do predict that she will not have to do so. Republicans in general tend not to be as hardline or as ruthless on judicial nomination fights as Democrats do. This is evil vile like civilization destroying stuff. And Republicans should not stoop to that ridiculously low level. But in general, like Lindsey Graham, Mitt Romney, there are any number of Republican senators who historically have voted with many democratic nominees. And the leading contender right now is probably katai Brown Jackson from the U.S. corps repeals for the D.C. circuit. I think she's, you know, she's probably like a 60 to 70% FrontRunner. It's not a lock, but that seems to be kind of the early favorite right out of the gate. And she was confirmed in pretty bipartisan form to the D.C. circuit. So I do predict the nominee will probably get around like 55 votes overall. So I'll be wrong. I'll be honest, Josh, I don't think we should smear. I agree with that. I don't think we should lie. But I think we should go scorched earth. I think any Republican that votes for the nominee should leave the Republican Party immediately. I think the line's going to be drawn. I think we need to say that. Collins, Murkowski, all these people, you want primaries, Murkowski already has one. Be careful vote for this nominee. And the country's on fire. "This morning, Democrats on the Senate Judiciary Committee tried and failed to slow down the confirmation of Supreme Court nominee Amy Cockney Barrett, who appears to be on track for the high court before the November 3rd election. NPR congressional reporter Claudia Gonzalez joins us with the latest and Claudia Today is Day four of Cockney barrettes confirmation How far apart of Republicans and Democrats on this committee over the sheer pace of this confirmation hearing? It's really going pretty fast. They're moving as quickly as they can. Republicans. Are they? Both sides remain very far apart. Just this morning is you had mentioned Democrats were able to delay today's proceedings. They did that by about two hours. Democratic senators told reporters last night that Barrett isn't his combative as Kavanaugh. So that's taken Ah lot of the heat out of this wave of hearings this time that say they've complained repeatedly that Barrett has been evasive. She's declined to talk about how she might rule in the future on certain cases. And she's also dodged questions on climate change and other matters that air of importance right now, But in light of that, Republicans say Barrett and her background is still resonating with the American public. She did have some things to say, though, about the case coming before the high court this week after the election, challenging the affordable care act, what stood out there? So she hasn't said she'll recuse herself. From that case, she was grilled extensively on this. Democrats say Trump is putting her on the court to overturn it. And Democrats say Barrett auditioned for the court threw a Siri's of critical pieces against the we should note. Again that this case will be before the court just a week after the election, and she hasn't said this week, however, that she's on a mission to destroy it, but still, it remains unclear how she could rule here. And in Harris was responding there on noting that Cockney Barrett is saying climate change is a debatable point. What are other Democrats saying about moments like this? And what are Republicans, also saying in response, Democrats are using this as ammunition that Baird has been evasive and using. This is an example of claims that the American public still doesn't know. Bear it well enough to know she's a right fit for the Supreme Court in this ties into another concern, just raised by Democrats in today's hearing. Claiming Barrett has yet to submit comprehensive information of the committee about her background because again, this is such a rushed process on. Even Democrats have conceded they haven't had enough time to dig in to bat. Barrett's background to bring some And even more comprehensive look at this nominee and how she could shift the court. So in terms of her asking thes questions that Paris and others if they feel like they're haven't been enough answers, But Republicans say that she's presented a complete picture enough to be approved to the to the highest court. Okay, So what's the timeline for the committee to vote on her nomination and then the full Senate? So we know to Republican Susan Collins and Lisa Murkowski. R potential. No votes, but But even still, is this a done deal? This appears to be a done deal from here. Of course, a week is eons away these days, so we can't say for sure what's going to happen. However, the committee has set that vote for next week to vote her nomination out to the full Senate floor so the full Senate could take this up sometime in the remaining days of the month. And in terms of who might vote against that, Yes, those two Susan Collins of Maine and Lisa Murkowski of Alaska are two potential no votes. Democrats are still hoping that they'll have more Republicans flip and vote against this and perhaps derail the effort. But right now it looks like this could be a done deal.

I'm glad to speak with you again. I'm happy to be here. Tell me what surprised you in the survey results Well, the standout data was the data on accountability. We ask people Do you think that a person of higher rank Who was found to have our asked a person of lower rank would be held accountable and what we found is that 64% of the people we surveyed said that in fact, that person would not be held accountable. I suppose that's the thing that surprised me. I mean, on the one hand, it's not surprising that we're dealing with such deeply entrenched culture and history here. On the other hand, it's been three years of me, too, in the spotlight, and many powerful men have been held to account. You're you're absolutely right. We've seen some very high profile cases. And what we want to make sure is that it doesn't stop with just a few high profile cases. We know that they are problems throughout. Workplaces, and we want to make sure that everybody, whatever their position is Can count on being heard. So that's one piece of this. The other is persuading people who believe they're being harassed, have been harassed that they have a safe path to come forward and report it. I remember interviewing you, Professor Hill. Always. And we talked about the the personal cost of choosing to come forward. What do you say to someone who's weighing whether to do so or not? Well, you're absolutely right. There are personal cost. But even when people are willing to take the risk, there are other things that they're considering. People don't come forward because they think they won't be taken seriously. Unfortunately, the Cavanagh hearing really gave the impression that the Senate Judiciary Committee Did not take Christine Bozzi. Ford's claim seriously, and people see that example and becomes, you know what they think will happen to them.
