Supreme Court Issues Key Rulings on Trump's Finances

"On the final day of its term, the Supreme Court issued two highly anticipated rulings involving president trump's financial records. One decision clears the way for Manhattan District Attorney Cy Vance to potentially view the president's taxes. The other was a mixed decision involving congressional efforts to obtain the president's personal financial documents both were sent back to lower courts for further consideration. Joining me now with more details is our legal affairs reporter Brent Kendall. So rent. The court rejected the president's efforts to block New York subpoena seeking his tax records, but issued a mixed ruling in a related case involving subpoenas from House Democrats. Can you tell us more about these rulings? And why in the congressional case? It was a mixed ruling. On the congressional case we'll start there that the court made pretty clear that it was not at all satisfied with either president trump's position. which the court said would really neuter Congress and make it harder for the legislative branch to do investigation while also being equally dissatisfied with Congress's position here and said look. Lawmakers you're under the belief that you can just get almost anything you want under the Sun, and the the you know, the president here is different. This is about his personal papers, and we really do need to give more scrutiny here to make sure that these requests are targeted and limited and these. Don't harass the president or become a really burdensome on him in some ways that case ended up as kind of a draw, and we will have significant further lower proceedings, and it's. It's hard to know at this point at the end of the day whether Congress is going to get. Any some all of these records that it is seeking the one thing we do know. It's extremely unlikely that they're going to get any of them before the election in November The vans case with a lot clearer and a lot. More of a straight forward and fairly sweeping loss for the president who argued that he was absolutely immune from having his financial information, disclosed or turned over to state prosecutors Wyle. He was in office, and the court flatly rejected that claim and basically sided with newer prosecutors and all their basic. That case isn't completely resolved. either. The president still potentially has more arguments. He can make against the subpoenas which he will certainly try to do in the lower courts, but it did remove a big roadblock for prosecutors in Manhattan who are examining whether President, trump or people close to him violated any state record keeping laws. So these separate cases, both came down and seven to two votes, and the president's appointees neal gorsuch and bright cavanaugh were in the majority. What do you make of that breakdown? While I mean it's a pretty remarkable thing and most of the big cases here right at the end of the term, the chief justice avoided five four rulings, and so for example we had some big religious freedom cases that were issued on Wednesday and have been the kinds of cases in the past. We're liberal justices, all descended and they're. The just got to the Liberals to join with the Conservatives, and what is was a pair of fairly conservative rulings in favor of religious institutions, and then flipping things around today we had the chief justice in the four liberal justices, and the chief was also bring along justices, neal gorsuch and Brett Cavanaugh, who are both trump appointees and to the majority in both of these rulings, those two didn't agree on all the same reasoning, but joined the outcomes. We ended up out of the nine justices with only two dissenters justices clarence. Thomas Samuel Alito. Tell us more about what happens next. For these two cases, what questions are now left for the lower courts? especially as we're looking ahead to the November election, even if these issues won't be resolved by then. There are a lot more issues for the lower courts in the congressional cases, basically because the Supreme Court crafted a whole new set of standards, the judges should now look out for these kinds of disputes. I mean the disputes. Themselves are pretty rare, normally congress and the White House work out their differences when Congress wants to have people testify when they want information. But now the court is basically said you lower chords take these new standards. We've articulated that we think will provide some protections to the president as well as some protections to Congress and sort out who's got the better argument here. That's going to take time. The New York case may take a little less time. The president still has some arguments available to him to contest the criminal subpoena here to his accountant's but they're more straightforward at. That courts can deal with more quickly, but even there it's going to take time, and even if he loses and the accountants turnover this information to Manhattan prosecutors. This comes in the context of a secret grand jury proceeding, and it will be many months, if ever, before details of of what prosecutors learn would become public. And the president quickly responded to these rulings on twitter. We are hearing responses. Continue to roll in. Tell me a little bit about your impressions of what he's been saying well, the president has been frustrated with a Supreme Court on several of its rulings, including one day invalidated his cancellation of the Dhaka and program and right after the ruling came out today, and he expressed clear frustration on twitter that this case would continue and express his views that this is sort of a political partisan prosecution that's designed to harass him, and he said that it was not fair to him or his administration. While the president was frustrated with the rulings today. Sivan's in New York. The prosecutor who is leading this investigation was thrilled and said this was a day really where the Supreme Court affirmed the rule of law that is applied to the president, just like everybody else. And he said now his team would get back to doing the business that had been doing of investigating this case and proceeding as it had planned to proceed, while also knowing they're still future battles ahead against president trump and his lawyers as this probe continues. France it's been a busy few weeks as supreme. Court now heads into its recess. Any final thoughts that you're leaving with well. It was a really big momentous term, even though the court ended up hearing less cases than it had planned because of corona virus, but we had these major rulings today on presidential power. We've had blockbuster rulings on religious freedom on gay rights in the workplace on the DACA immigration case. A lot at the court has tackled, and so it will take at at least a little bit of a breather now while we all sort out what's on the horizon. Wall Street Journal. J. hope to do here our two main things really first they want the online platforms leading tech companies you take a more aggressive role in policing illicit and harmful conduct that's taking place on their website so either fraudulent online scams elder fraud drug trafficking ads for counterfeit drugs things of that nature they want the online companies to do a better job of keeping that stuff out and what they're proposing is that if they don't and you know somebody a consumer see the link for one of these things and buy the product or something and it's harmed that that that consumer would then be able to sue states Facebook whichever platform they saw the ad on in assembly to obtain monetary damages for the harm they suffered so that's one piece of it but what about the the idea of curving controversial comment but allowing other content to stay on board I mean it's it's asking it's a high bar isn't it for internet companies to be making decisions that DOJ's happy with well it is I mean that is the other big component here and so you know while in the criminal harmful context they want the online platforms to do more here when it comes to content moderation in a way they want the company to do last the what the what the department basically argues that that now the big platforms to sort of take down content whenever they want for whatever reason they want and that it's not always consistent well explained and so what they want to do now is say look if you want and unity and protection from lawsuits you need to have clear and fair policy that explained we know what your goals are and then you have to follow so you know if you if you're old art fair you take down certain post and don't treat other people the same way then you know the people who are disadvantaged in theory would be able to sue for having having their their poster content removed so justice wants to do this what has to happen for to actually take effect but the ball really be in Congress's court and just like president trump issued an executive order last month in the executive branch can't just strip communities from these companies on its own this legislation dating back to nineteen ninety six in the earlier days of the internet the protected internet companies so they wouldn't face crippling lawsuits at a time when you know the internet was just building and ended becoming sort of the powerhouse it is today so Congress will have to it would be up to Congress to pass any legislation that alters a rolls back the protections that were granted twenty four years ago Hey Brent thanks so much for being with us

"Oil prices are in freefall lockdowns across the world have dealt a huge blow to demand the US benchmark for June delivery plunged forty three percent today down to eleven dollars and fifty seven cents a barrel. That's a twenty one year low and it comes just a day after some contracts fell below zero for the first time in History Brent crude the global benchmark followed suit Brench for June. Delivery dropped twenty four percent to nineteen dollars and thirty three cents a barrel joining me now to explain as Wall Street Journal Markets Reporter Amorth Ram Kumar. So amorth put this in context for us. What are the economic implications here? The energy sector crisis has massive implications for everyday Americans in the world economy just here in the US. The energy sector has become a huge industry. And it's very important geopolitically and it employs so many people so the prospect of bankruptcies and mergers and acquisitions for some of these beleaguered companies is really staggering. We're seeing the focus of even stock market investors kind of shift now from the corona virus temporarily at least to this existential threat facing a critical industry. People think that oil demand and fuelled demand will go back up once measures to stop the spread of the krona virus or with did but for now people can't consume fuel and that's really driving this chaos. People say it's really an oil crisis turned upside down. So many Americans remember previous oil price spikes causing inflation eroding consumer spending now gas prices are cheap but no one can take advantage of it and that could really fuel a lot of chaos in the energy sector and when you start talking about widespread bankruptcies and things like that. That has the possibility of Stan spreading into banks which have learned heavily to these companies in recent years. Are we seeing this begin to impact? Us oil production at this point. What's happening there? Many producers are trying to curtail production but the measures are to. It'll to wait in North America in the. Us and Canada. Many companies have been forced to shut in productive wells. So when you think about that. That's pretty staggering. These wells that function normally and at certain prices are economic. But now the numbers. Just don't make sense. So companies are being forced to shut in that production and so that's lowering supply. But it's already to wait. The world is simply out of storage in many cases for its excess oil and a price war between Saudi Arabia and Russia that was resolved recent. We really made this all worse so for a few weeks that we supply was increasing as demand was crumbling. And that's made it all just really chaotic. You also took a closer look at how. This is impacting retail investors. What did you find retail investors trying to take advantage of the crude price slump and bank on a rebound have piled into risky? Etf's like the US oil fund which trades under the ticker USO. Hundreds of millions of dollars have flowed into that fund in recent days. And that's very risky. Because is tied to some very complicated oil market structures that make its price go down. When their differences in futures contracts basically the fund is collapsing towards zero and people are trying to buy it counting on a rebound but because of how the fund is structured. That might never materialized and say that's causing huge losses for regular people who are buying funds that they really shouldn't be or they might out fully understand that's again making us all worse kind of the repercussions are really now going beyond just the energy industry and that's something people are very worried about.

"Daybreak president trump vice president pence say they see signs of the corona virus outbreak stabilizing we are joined now by Dennis Gartman the economist a formally of the Gartman letter Dennis it's always a pleasure thank you for taking the time with us this morning we are seeing stocks higher today because of that optimism that we've been talking about this morning coming out of the White House what is your reaction to the move in the markets and is that going to last well I doubt that a show last very long there's no the markets have a tendency to to rebound fifty percent of what they have lost in in in in bear markets and bear market rallies tend to be very dangerous and very swift very volatile the fact that we have the the Dow trading into a trip down futures at twenty one seven hundred right now twenty one thousand seven hundred can we get to twenty four thousand in the next week or two on a technical bounce of course we can but are we likely to see new highs in the near future now or not I think this is a dead cat bounce one that can be played on the long side and I think that last week's lows if you're going to be a buyer you put your stops order stop order then at last week's lows but so this last for more than a week or two I doubt it one of the problems that we haven't come in in the in the stock market is a great buyer the then companies themselves have been buying their own shares for years and years have basically been precluded from buying some buying their shares back for years and years into the future so the great buyer is gone but is this a good bounce yes can be traded from the long side yes should you traded from the long side I doubt it and if you wish to be longer stocks better to be short of the bond market that's probably the better correlative trade as the oil did give up some of last week's rally it does look like it is starting to pare back some of those losses Cruz lawyer lower although what what do you think of oil prices turned the corner I doubt that oil prices have turned the corner also but but again just like the stock market a good bounce was required a good bounce has been had and watch the without getting too esoteric what's that the term structure the shifting nature the front month versus the second third and fourth month back beginning early last week when crude oil is on its in in the dinner on the downside the the the term structure began to now which was the first bullish sign here we have the the the the market having rallied from one nineteen ninety in nearby WTI to twenty nine dollars a day per barrel which is a huge balance if you think about it today the term structures actually turning somewhat berry so I think the the the rally in the crude oil market has probably run its course and if you're going to trade crude oil trade from the short side nitrate only from my own account my retirement account I'm in the market every day I don't have any crude oil position on right now but if you made me do something at the short of it the president has said that he doesn't think he's going to have to impose the tariffs on imported oil but he's also holding that option in reserve what would that do well that would clearly tighten up the with the WTI Brent spread you'd probably take WTI to a premium over Brent I think it would be an illogical and very badly designed very bad decision on the president's part any talk of any tears in any instance it's going to be deleterious to whatever to the to the to the stock market that ostensibly to the crude oil market dramatically but it be beneficial to WTI so if you if you're if you're a believer in putting those tariffs on probably the trade you want to put on his long WTI short brand but then I going to do that on my own account now it's your money well bonds are the haven of choice for a lot of people are they getting too expensive now bonds are way too expensive I I had I see no reason why anybody would want for the long term down ten year treasuries with a sixty five basis point handle sulfur again I trade only for my own account and on Friday actually went short modestly mater marginally small tiny for the first time in a long time but I'm actually short a little bit of a long and and my propensity is to add to it because I I do think if we get a a good technical bounce a good dead cat bounce in the in the stock market you'll get a correlative decline in the long end of the yield curve so I'm trying to get them short of the the bond market for my own account and thinking of adding to that position this morning I just can't imagine anybody wants to own for ten years a treasury security that has a sixty five basis point

But you're like just like you said what if the detective lines all up in like this is exactly how it happened right. How do you feel right? Why did this person break my heart? Well they suffered horrific abuse throughout their childhood. Yeah that's why they broke your heart like certain times the answers or another answer. They had their heart broken. And they're stuck in a pattern and they're scared and that's why they blew up that relationship right. You're you're in exactly the same space that you were. The answer is incredibly seductive. But it left you exactly the same place with a little part of your mind. Maybe slightly satisfied with that tidbit. But it's almost like the entire experiences inviting you to sake from your mind down into your heart and then feel it right and bear it and then you have the chance of coming out the other side. Is that some trans logic right there. Well I do think at least for me I am. I skimmed across the surface of things for years for lots of reasons. But just keep moving. Just keep silent just keep phenome- show just keep giving people amazing facts because if you slow down and feel it. Yeah who knows what that'll be so that's been over the past few years especially did you. I didn't I didn't know what to do with my anger. I didn't know what to do with my with the pain. Yeah they're just keep just keep moving in. Do you have a rubble? Do I have a rebel. Yeah do I have people that. With Belle isle. Yeah Yeah Yeah. Yeah I have lots of lots of people but I know rank. Yeah I don't think it's I I am. Somebody's like a girl who's higher up the mountain. You think about that way. It's terrifying when you can go there and you can follow it and it starts somewhere in you for me. It started with like I. I can go to therapy. And then that would have been fifteen years ago. I could go and then gradually you're starting to find out that these places within you you can you can dig it up and talk about it and and then gradually works. Its way outside so then I do not want to tell that person the truth I have been trying to keep people happy and I don't want to disappoint anybody so long that if I tell them the truth they might. I might be leading them down. They might so then ever-so-gradually. I started to be more honest with people. I called the last ten percent. Ooh and that's and that's that's how it's been like less gradual. That's why that's why the modern age really really created such which is what everybody has to extend themselves so much. Grace we had the birth of machines levers pulleys look these light switches so you just turn it now. It's on but soul spirit growth in your awareness and consciousness much better think about it like agriculturally like you plant a seed and it grows takes a while. Yeah and so for so many people that I just give me the four steps because this whole beautiful modern world with hospitals and airports and iphones and podcast recording equipment. You know what I mean. It was. It was built around. Push this button and make this happen. But the actual shaping of a person into a particular kind of person who can bear the immensity of life. Yeah and still smile that that takes a while so so your question is wonderful but when I look back there are these moments along. The way is also just to get another little insight. You get another somebody comes along and they helped you see another little bit and then you see somebody who's just doing something doesn't seem to care whatever the rules were in that little space. And you're like oh I guess there's less rules. There's even less rules than I thought it's like you're just picking up these little pieces bit by bit by bit. I love that sense. I think that's so important for people to hear that some of these things they take a long time absolutely and there are things right now that are blowing my mind like yeah there are places. I'm like I could be even more. I can be freer I could. I didn't even begin to understand that. Now I feel like I'm just ever so slightly. Yes feel younger and more curious and more blown away stuff. Yeah I yeah. Yeah Yeah I just finished a book yesterday I won't even that's a whole nother thing that just had me like what I don't hear. I tried telling Kristen. And she was like I was like I literally. Yesterday she was like Doesn't really connect with me because I was just like so excited but I hadn't even. I don't even know why this thing moved me so much. So identifying those teams early is is very important for us. I I think you know, like the patriots, for example, the they're always a public team. But they're not kind of like the the invoked team as you know, as much as you would think when the the. The chiefs, for example. I mean, when they they started out in how they ended their season last year was quite a quite a boom, I if you will on an issue that kind of you know, that trend continued and as soon as they had a couple of losses near the end of the season people were were quite sour on them right away. You talk about the Cleveland Browns, for example, that that's one of those teams that we probably could have responded to quicker. Once Baker Mayfield took over those numbers. We just kinda sharps had always found value in Cleveland, just because they were such a bad team. Whereas the public kind of got on that as well when Mayfield came out so just kind of being quicker, and Tim to responding to those numbers is it's kind of the trends of people where they're going Jacksonville menial how high people run Jacksonville.
