FBI Wasted Hours on Jan 6 Investigation
"I was talking about these J 6, mostly peaceful protesters. Some of the J 6 rioters, the FBI devoted 16,000 more hours to them than they did the BLM, the BLM rioters. And you've just written an article concerning some of these adjacent protesters. Talk to us about that. You mentioned something on the break that just shocked me. I mean, I look forward to reading it here. So yeah, so a new issue in some of these January 6 prosecutions. I mean, it's always been a bit of an issue is exculpatory evidence or what they call Brady evidence. So there is a case back in 1963. It's a landmark Supreme Court case called Brady versus Maryland. It's in criminal law one O one. And that case held that the prosecution can not withhold any exculpatory evidence because that violates their due process rights. So all along, we felt like the DoJ was withholding evidence or just not giving all the evidence. They can't just say to a defendant, well, here's the evidence that we're going to use the prosecute you because who knows how much evidence they've overviewed that might show that defendant in a good light or might show that he wasn't really there. And so they can't just withhold that from you. So I worked in criminal courtrooms for 20 years. So I kind of knew a little bit about this.

Aaron Rodgers Emerges From the Darkness
"Who's been a top contender for Friday's finest for the last few weeks. Has been the mercurial quarterback of the Green Bay Packers. Aaron Rodgers. Now, deciding that he did not want to retire under the same year Tom Brady did, and he wanted to continue to play. He's following that great packer tradition of leaving the Green Bay Packers and going to New York. It looks like if things can get everything settled. I mean, is there ever, I mean, this is almost like the Howard Hughes of football. I mean, just this reclusive, I'm going to sit in the dark for two weeks and then come back out and talk. And then when he actually came back out this week and said it on the pat McAfee show, well, I'm going to play and I intend to play with the jets. Well, I loved the I don't know if I'm going to try to I think it's a direct one. He said, I came out of the darkness and something was a little bit off. Like, yeah. Okay. The real world, buddy. You know, I just, I feel like every fan of every other team in the NFC north wants to hold a press conference to thank God for getting Aaron Rodgers out of their division. But realistically, it's something that bothers me. I think this is, this goes for pretty much anything. This is not, we don't even have to keep this to just sports, but the idea that he knew that he knows that he has enough power to a if they want to get rid of him, he can take as much time as he wants. If he really wanted to stay and cause a stink and their organization, he could do that as well. But now he gets to make demands to the team that's looking to get him. Think about all the power that that one man has because he can throw a football 60 yards without blinking.

"You're a former terrorism prosecutor for the DoJ. So we've got the footage here that Tucker's team released of Brian sicknick, the puts to bed, for example, that he was murdered by the January 6 protesters. We see him after he was allegedly murdered, walking around the capital. Do we have the footage, Eric? But Brian sicknick should not be reduced to a prop for the political ambitions of the Democratic Party. He was a human being. The facts of his life matter, including how he died. To this day, media accounts describe sicknick as someone who was slain on January 6th. The video we reviewed proves that is a lie. Here is surveillance footage of sicknick walking in the capitol after he was supposedly murdered by the mob outside. By all appearances, cyclical. So we see he's fine. He's walking around in a helmet. We see the footage of Jacob chansley, this quote unquote James shaman, being a Scottish through the building at times by up to 9, 9 capital police officers, you're the former prosecutor, are there any forget politics? Are there any legal ramifications? Can we get this guy out of prison who's given 41 months? What happens to everybody else? You're the expert. Is this just a political win or is there something deeper going on here? Well, there's got to be analysis look as a former federal public defender who challenged the DoJ out DoJ on so many cases in federal court about what we call Brady violations, violations by the DoJ prosecutors for failing to intentionally disclose exculpatory evidence and evidence of impeachment. So it's called Brady and giglio. Let's put the legal parlance aside. What due process the constitution the Supreme Court demand prosecutors in the DoJ must turn over all evidence that even might be evidence of innocence and evidence of impeachment. They don't have to use their judgment to answer the question. It's just a maybe. 41,000 hours of videotape said is evidence.

'Spill' of Classified Info Derails Proud Boys Trial
"There is a sedition trial going on in Washington D.C. involving one of the Proud Boys, his name is Ethan nordean. And in the middle of this trial, an FBI agent named Nicole Miller was testifying and three bombshell pieces of evidence were uncovered that have thrown the whole trial into a tailspin, the judge actually ordered a halt to the trial to resolve these issues. And the indication is that the government and the FBI is involved in very serious misconduct. So let's look at the three things that happen. Number one, Nicole Miller testified that she was ordered, ordered by her boss to destroy her word. Quote, 338 items of evidence. Wow. I mean, this alone. I was ordered by my boss to destroy 338 items of evidence. Number two, it became clear from her testimony that Nicole Miller had all kinds of information. That is relevant to the defense. That was never turned over to the defense. This is sometimes called, well, this is called a Brady violation. Why? Because in a trial, the defense has every right to see the information available to the prosecution. And in this case, the information was hid, it was deleted. It was not turned over. In one particular case, one of Nicole Miller's fellow agents sent an email to her to say that he wanted his presence at a meeting or his presence on a kind of an email chain to be deleted. In other words, I'm quoting the agent requested to Miller, quote, edit out that I was present. Take me out of this chain. So in other words, what is this called? This is called tampering with evidence because an FBI agent can't do that. You're hiding now from the defense, the fact that this guy was present at a meeting.

To not just that clip, but this idea that finally the American people can get educated and informed of what happened on January 6th. And while you're at it, tell us about potential Brady violations as well. So Charlie, that's very similar to the response that I got from a lot of people. Even people who have been sort of following January 6th that they were expecting some bombshells, but not to the level that what Tucker presented on Monday and Tuesday. Jacob chansley, as we now see walking peacefully around building accompanied by numerous capital police officers, that was January 6th on January 11th, 5 days later, a grand jury in Washington D.C. handed down several crimes against Jacob chandley 5 days later. It's like this was preset ready to go this DoJ D.C. U.S. attorney's office had all of the charges collected that they were going to use against these people. Kyle Seraphin: The Significance of Exculpatory Evidence
"You have very specific expertise as a former 1811 federal agent and FBI agent with things like exculpatory evidence I addressed this in the beginning of the show but given that you did more criminal work than I did a lot of protection work too You guys this is supposed to be the domain of the FBI supposed to be the premier federal law enforcement agency Can you just reiterate to the audience How important and critical it is that if you have exculpatory evidence evidence of a subject's potential innocence and you don't turn that over IE a video of you being escorted around the capitol by the capitol police and a Chewbacca costume as they're claiming you're involved in an insurrection that not disclosing that or trying to play cute with it bar burying it in thousands of hours of video that's a pretty big deal right I wasn't just my experience as an 1811 right No that's everybody That doesn't even take 1811 to be part of this right It goes all the way This is every law enforcement officer every sworn officer in this country which is possibly a million people And anticipation of doing my show later I was doing some prep So I've actually got the case up It's Brady V Maryland which many people know from 1963 So not a new finding by any means And the primary holding from that particular case is the government's withholding of evidence that is material to determination of guilt or punishment of a criminal defendant violates the defendant's constitutional rights of due process So it's a due process violation to not give what we call and you've accurately named Brady material And that includes exculpatory material even if it's demos your case If it dynamites the case and you no longer have a case because you thought you had it and suddenly you see video and you go oh this explains everything and it provides the reasonable doubt You still have to turn it over In fact I would say that would be the proudest thing you can do is to discredit a case and someone who really is fair as a federal agent That's one of my proudest moments was actually blowing up one of my own cases

"From Santa Barbara has a question Charlie, what do you think of Tom Brady is he the greatest of all time? So there's some questions that honestly don't even need to be debated, but amazingly, this guy who gets paid to spew nonsense on television. What's his name never heard of him before? Mike Francesca, I never heard of him. Says, no, I mean, Tom Brady's overrated. Play cut one 12th. Tom Brady made himself great. He wasn't great. He was in great in college. He lost his job, which is what fueled them his whole life. He's the most competitive person anybody has ever met. And he worked harder than anybody ever to be this good. He made himself this good. He didn't he didn't start out that way. He was drafted lady at a terrible body. He took him time to do it. He's not the best regular season quarterback I've ever seen, Peyton Manning was. He's not the best Super Bowl quarterback whoever lived Joe Montana is. What he is, though, is the guy who played the longest, and he won the most games. He won the most Super Bowl, so he will be remembered because nobody's going to play 23 years, and nobody's probably ever going to have a chance to win that many super bowls. It's almost impossible to do. He was in the right place with the right coach and he was that competitive, so is he the greatest of all time or not, Mike? Right place right time he's absolutely nothing, okay? So basically his argument is that he's a system quarterback. I mean, not only does Brady have the most career passing touchdowns, most career passing yards, most career completions, most career wins as a starting quarterback, most seasons with 4000 or more passing yards, but he also has won the most super bowls. 7, is it really 7 that's so hard to believe? 7 super bowls? The first football game I ever remember watching as a human being. Was Tom Brady versus the greatest show on turf.

Is A.I. Taking Over Humanity?
"Says Charlie, AI might be able to write and do some fantastic things. However, creativity isn't one of them when it comes to creative writing in my opinion. I write fiction as a hobby. I know that my writing comes from within. I don't follow any rules or guidelines. The story writes itself, I'm just described. It's this nuisance that makes the difference. Now, Don, I understand that, but if the technology continues to progress and the technology is able to, for example, upload 3 million different fiction books and read it within a minute and then see patterns of what is most popular, language, combinations, diction, syntax, vocab, and then regurgitate it, it will crowdsource its own evolution, and it will learn how to write fiction.

"So I think it's fair that after ten years that organizations that are involved in gun reform are involved in this movement kind of take a look and reflect at the work that they've accomplished from the beginning up until now. Of course, Brady has been around forever too, so they probably have more data than anyone. And I see Brady having more and more and more survivor leadership as well, so I know they've reflected on this. But looking back and just seeing where have we made mistakes with people who've experienced trauma and how do we try to prevent this from happening again? So we've kind of got the lobbying and the activism and the advocacy piece down. You know, we've got these programs that are doing that, and that's running well. Why don't we look back and see what more we can do for victims and survivors? How can we decrease the harm that we're doing? And after a decade that feels like a very fair question and maybe difficult question for some organizations, but I think it's super important and survivors being able to continue doing this work kind of rests upon people learning from their mistakes. I think JJ, I realize you weren't asking me to pick up on something that you just said. In terms of bad faith too, I think when people organizations like survivors lead, it's not saying only survivors can support gun violence prevention. It's more lead is the operative word and following and listening to people and I'm someone who thankfully I have not lost a family member to gun violence. And so I think that doesn't mean that you can't advocate, but it does mean you need to listen and protect and care for people and it's kind of the same. I love what you asked earlier about what other social movements have not included people who are closest to the pain and you're right. Obviously there's so many social movements like the civil rights movement where it was led by black people, but there were allies.

Thank you all history. There's a lot of things that the Supreme Court has said shouldn't happen or can't happen that we are living with today. Isn't that the truth? I just, the thing that I keep coming back to, I think, are the points that were brought up repeatedly by all of our panelists, which is just that, you know, these decisions, these decisions have far reaching implications that are going to be felt. By all of us, but that there is going to be an undue burden placed on particular populations and that it is our job to try to make sure that we live in an equitable world and correct these problems. Yeah, I love that. And how that came up multiple times. And a big thing for me is something that John said and also something that Leia said, putting together, which is that John was saying, the Supreme Court doesn't take that many cases a year. And that is true. They don't. And so that means that even if people will sue and try to use this decision to invalidate gun laws, doesn't mean that we should stop pressing forward. And to that end, I love what a Leia said about thinking locally. And thinking about your community and what you can do there because I think that's also really important. Position number 8, it's my Second Amendment right to own a gun. Any attempt at regulation is going to lead to a destruction of my rights, my American way of life, and a spread of tyranny. My name is John Lowe and vice president of legal at Brady. And how I answer this question is, first, the Second Amendment has always allowed for sensible gun laws regulations. Well, regulated is even in the Second Amendment itself. And protecting families and communities with strong public safety laws is an important part of the American way of life. We care for each other, or we should, we protect our children or we should, it's the tyranny that most Americans are concerned about is the tyranny of indiscriminate gunfire of being shot when you go to church or shopping or concert or school. Americans are not more criminal or mentally ill or suicidal or dangerous than people from other countries. But we're subjected to so much more gunfire because the gun industry is allowed to run amok and our political leaders have failed to enact common sense laws that have been shown to work in states and other countries. That is destroying our most important right our right to live. Statement number 9, this is all about a lack of security. The solution is to harden schools or grocery stores or other targets. "It's the unregulated and relatively easy access to firearms that sets us apart. Statement number 6, it's too soon and disrespectful to talk about gun laws after a mass shooting. My name is Liz dunning and I'm the VP of development at Brady and the way that I answer this question really starts with the fact that I'm a gun violence survivor. What that means practically is that I think about gun violence prevention and its impact on my life and the life of my kids every day. I also recognize and can feel every day that most people don't, and they don't have to. And I'm glad they don't. But when these horrible tragedies happen that forced gun violence from the daily experience of so many of us to the news cycle, I really do view it as an opportunity to wage a little bit of a fight against hopelessness. I think the pain and the hurt that's on display right now. It's pretty overpowering. I've certainly experienced that feeling of pain and trauma firsthand. And the week that we've just had has been hard for me in that way too. But I view that whether it's the work I do for fundraising or whether it's the work our team does around advocacy. That is about bringing people in at the moment that they're ready to be in. It was a long time between when my mom was murdered and when her killer was brought to justice and that was a whole long period when frankly, people weren't quite sure what to say to me. It was hard to make those connections. I think these moments when it's in the news and it's on the cover of the newspaper. It's easier for people to feel comfortable raising their hand and say, I want to give of my time. I want to make a phone call. I'm worried and I'm scared and I want to know what to do..

"Let's be clear, no other country has to deal with losing over 40,000 citizens to senseless gun violence, statistics don't lie and gun violence prevention laws are proven to work. We can't simply be pessimistic when it comes to passing evidence based laws. If we continue to have this mindset, we clearly have a bigger issue on our hands. Point number three, we need to use the laws that we have already on the books. My name's anneliese dickman, and I'm the Midwest program manager for the combating crime guns initiative. And how I answer that question is yes. We absolutely need to use the laws we have on the books. But we have to do so equitably. So too often we only focus on the demand side of the gun violence equation, and we enforce laws in such a way as to exacerbate mass incarceration. And we should be focused on the supply side too, holding accountable those who supply the firearms, the gun industry, I think that's imperative. But unfortunately, historically, there have not been enough federal or state resources devoted to enforcing the laws that regulate the gun industry. And the result is not only a flood of guns into our communities, but persistent inequity in our criminal justice system. Statement number four guns are overall better for the U.S.. More guns, equal less crime. I'm Josh sharf, senior counsel, director of programs at Brady, and I lead our combating crime guns initiative. To be honest, I don't get that question a lot. And I talked to a lot of people, people in law enforcement policy makers, folks that live and work in impacted communities. And I don't get that question a lot because I think intuitively most people know that more guns does not equal less crime. And when I do get that question, it's often coming from somebody who has a preconceived notion about the roles of guns in society, how I do answer that question is first to say, look, the overwhelming science and literature out there on this topic does not support the notion that more guns equals less crime. In fact, most of the literature says the exact opposite. But if you're not persuaded by the science and the credible literature out there on this topic, I'd say use your common sense. There are more guns in civilian hands in this country than there are people in this country. And if more guns equaled less crime, we would have one of the lowest crime rates in the world, and that's just not the case. And beyond that question of just crime and guns is also the issue about the lethality and violent crime. When guns are introduced to crimes, there are more injuries and more death just because of low lethality of guns themselves. So looking at violent crime as a measure is also particularly important and crime that leads to significant injury and death because we know that when guns are introduced into the equation that those numbers go up. Point number 5, we need to talk about the real causes of gun violence. Things like social media or video games or rap music. Yeah, okay, well, I can't wait to dive into this one..

From grocery stores to schools to hospitals and beyond. After these mass shootings that gain national attention, a lot of questions come up in conversation. Some of those questions, though, posit that gun violence prevention methods aren't the answer. That gun violence is the product of things like poor mental health or video games or just plain evil. How do we, as folks who care about gun violence prevention, how do we best answer those questions? So in this very special episode, we're bringing you 12 very common questions that are raised after a mass shooting and the answers that we, 12 different staffers at Brady, given response. So like I said, everybody, extra special episode, how this is gonna work is I'm gonna drop a commonly asked question and then one of our fantastic Brady panelists here, they're gonna introduce themselves and they're gonna give you the answer that they use to it. So sit back, get your pens ready. We're all about to learn how to do some messaging, okay? So statement number one, we have a mental health problem, not a gun problem. My name is Colleen creighton. I'm director of N family fire for Brady. I think we do have a mental health problem in the United States. We do not have adequate funding or access to mental health here throughout the country. But I do think what we're seeing now is we have an access to lethal means problem. And so far too many people have access to lethal means and this is the problem where it all comes down to. And statistically across the board, those with mental health issues are more likely to be victims than the perpetrators of a lot of crimes. And if you look across the board, if you look at the number of incidents across the country, the majority of deaths by suicide are by firearm. So I think the latest statistics showed that 53% of all suicides are by firearm. So a lot of times providing that just length of time and access to lethal means when in a time of crisis can save somebody's life. But I also think there's unintentional. So we across the country, we lose 8 children a day to unintentional injury. And that means a kid gets into a firearm within their house. Or while playing with a neighbor or grandparents, and then they don't know it's not a toy. They're playing with it and unfortunately it takes their life. "Its approach to gun sales. And I don't think they waited until the conclusion of this litigation to do so. Even throughout the course of litigating it, there were new policies and procedures and training that had gone into effect. That would allow them to sell guns the right way and not. And screen for straw purchasing. So I think that's really important that they recognized early on in the litigation what they had done wrong. And I think an interesting thing about our case is the more that we were able to dig into it. Be stronger it became exactly what went wrong in this case and it really provided them a road map as to what they needed to do to reform their business practices. And they now know that you can't sell a gun. You can't have a child sell a gun. You can't have a child. You can't sell a gun the same way you sell bananas and ice cream. It's different. It's regulated. And you need to adopt practices to be able to sell guns the right way. Bill and Judy, you've been so brave, not just to bring this case, but if it's a come on here and to share a little bit of dawn and ladonna with us, I'm wondering if you could share a little bit more with our listeners, you know, is there something you wish that folks out there knew about what it's like to bring a court case after losing someone like this? I wish people knew about Brady more about Brady. I mean, Brady's famous. For a lot of good reasons. But I wish people knew that they were in the same situation we were in. That their receptive to your inquiries. And think what we were able to do, you know, because of Brady and Covington and everything. In fact, when this first initiated for us and we went to Washington and we met with everybody among we walked out of there, we looked at each other. I think we were sitting on a bench. Near The White House to be honest. And we both said, we're going to do this. These are very, very competent individuals. This is going to be a crusade. We're going to get this done. And as I've said before, to you, I've told Aaron this before. We're just thrilled with our association with you folks. It's been wonderful. And that's what I really wish people would know. That there is a place to go. You're not, you don't have to just sit in your room and cry. You know, there's a place to go. I mean, I know Aaron and John and others would say also that you all have a huge part to play and our heroes of this story. So I just wanted to be able to call that out as well. And I'm wondering, you've been through this experience, as you said, Bill, it's still ongoing. And I'm wondering, you know, what would you like to see happen in the future when it comes to gun violence prevention laws and how the industry is held accountable? And I mentioned this, I think when you think of the recent settlement on the sandy hook experience. I think that's a step in the right direction. In other words, and so I think we have to have a few more tools to, for instance, background checks. And different things like that. We live in Pennsylvania. And the number of guns here, it just defies understanding. And so I think that through the legislative process, there have to be changes or simply have to be. And I won't see it in my lifetime, I don't think. But you young people, hopefully you'll see it. So Bill and Judy's decision to bring this case on behalf of their loved ones has made a tremendous difference, not only to this individual gun dealer, but also to God dealers all across the country. Gun dealers hear about these horrific incidences. They hear about how they happen. And it encourages them in a ripple effect to change their own practices so that this type of incident and this type of a legal stress sale is less likely to happen in their store. And as a result, it protects the safety of the entire community. So these lawsuits send a message to this store, it's a messages to gun dealers across the country. And as a result, these impact driven litigations really do create real and meaningful change. Yeah. Well, thank you so much, Erin. And thank you, Bill and Judy, again. For everything. And I hope we do see change bill in your lifetime. I think it's what we're all working for, right? I am so grateful that people continue to fight. Not just for their loved ones, but for people everywhere to keep us all safe from gun violence. But it's still breaks my heart hearing about their loss. "And it was the first case of its time where a court held that a manufacturer could be liable under that theory of negligent trust. Well, and Laurie, you've mentioned that this case had a big impact on other legal cases, but do you see it continuing even today to have an impact on court cases or suits that go up against the gun industry? More broadly? Yeah, I mean, the decision that the manufacturer could be liable for supplying a dealer who then supplied a shooter in here to kill people. That had not been done before. It certainly had not been successful before. And then, you know, you get ahead of ourselves. After that decision, we fairly promptly got a settlement against the dealer and the manufacturer. And that was the first time that a gun manufacturer had ever paid money for a crime to victims of a crime. Using one of its guns and incident like this, a criminal shooting. And so we hear about the great settlement in sandy hook case well this was 20 some years before that and it was the first settlement like that. And what was it like when you find out you all won this case? And first, let me tell you that this was some time ago. When we settled the case, I still remember very distinctly, some of the most memorable days of my 25 years at Brady because I we had mediation, which is how cases often get resolved and we had it in Seattle..

We're gonna do everything we can't mobilize as many people as possible to call your senators. We are mobilizing so many people hosting virtual rallies in the only way that you can keep track of all these as if you follow all of our social media's and make sure you're keeping up to date for when we host our large mason when we are mobilizing because our organizing team is in full force ran out. We are so excited for the opportunity that this is actually going to be. It would seem at a vote on the senate floor and that is something that has happened in a very long time. Fortunately but we're going to do everything in our power even though are you. The united states said it is not the most welcoming place for us. We don't care. We are going to bust down the doors in not in hit insurrection. His way but in a win were working to make our voices heard because we understand the importance of democracy in to highlight. The importance of wild should end things. Like the filibustered. Why he's teaming up is a part of such as just democracy are so important especially right now. Needs need to do something to change. How government represents the people because right now so for those that are really concerned about the current gaps in the background check system who may be listening. What can they do after they finish with episodes kushner change plays. This is still a representative democracy and it really does matter for your members of congress to hear from you and we hear about this all the time with my contacts with members of congress. I just got off calls today with members asking me. What are you doing to mobilize making sure people hear your voices hall. Call your member of congress your number in the us house of representatives and call your senators. You have to them and tell them that. They need to enact these saving bills. It may feel like that doesn't matter. And i'm getting a voicemail or i'm not hearing back from people it does matter. They ask their staffers every day. I used to be one of those people for many years. However the calls coming house the volume of calls. What's trending like we need to flood the members of congress both in the house and the senate. The senate is next to act now. So don't forget your two senators and tell them you want these bills to fix the gaps in the background check system. You want them past and you'll be paying attention to it. That will make a huge difference. I have to thank you in advance for doing that. Taking five minutes to call to make that happen. And i'm just going to do a little democracy plug here For people like me who lives in dc and people might be puerto rico that if you don't have to senators you can also engage democracy forum and that will also go a long way towards making change like once a chris mentioned around filibuster and just generally making democracy more representative. So there's a place for us in this as well. What i think too. It's it's been made really clear. I think especially by stephanie is that we should all be checking out. Team enough inbreeding social so active enough. And everybody's just to keep on top of information about all of these bells and also you know things what people can be doing at home to to activate themselves on this issue and now. Ac that owns baby has woken up. So i think that's our sign actually to finish are now back on duty so thank you all so so much for for coming on this. Neither of these bills will do anything to solve that problem. And the problem that he's referring to there being gun violence If congress is serious about the safety of law abiding citizens it should have passed concealed carry. Reciprocity end quote. And this is a statement from their executive director. Jason old net. Hey that's laughable because concealed carry prosperity basically means that if someone has a concealed carry permit in one place they could carry back on anywhere. So if you're enrolled text that you would be able to take your concealed weapon to new york city or washington. Dc basically holding the whole country to the lowest standard for a concealed. Carry permit which okay nra. Yeah i'm more than that. It's like the passage of these bills addresses. Things like the one in five guns that are currently sold without a background check. It addresses the charleston. Loophole it gives more time for background. Check to be processed like those are things that help to prevent gun violence and we desperately need these pieces of legislation to prevent future tragedies and also like more to the point like i get. You can't really do that tweet right. That's the whole point of them. Which is why. I think they should mostly be used for cute pictures. But you know sary's of show that more than ninety percent including a majority of gun owners themselves support a larkarna background checks for all firearm purchases.
