I've been talking to UCLA Law Professor James Park about the SEC cracking down on the crypto industry by suing its two biggest players. So before the break, Jim, we were talking about why the SEC seems to be regulating by enforcement rather than issuing clear rules. I think the SEC's defense in this situation is that these are laws that are on the books and they are deliberately vague. They are deliberately vague because we don't want to provide a roadmap to people who are committing fraud as to how they can evade regulation. Congress made the definition of a security deliberately vague because they understood there are going to be a lot of things that people would try to structure in order to avoid regulation through the federal securities laws, and that's how the federal securities laws are built. And so, to some extent, some form of regulation by enforcement is inevitable. I would also say in the SEC's defense that the problem of crypto has been extremely challenging because if you think about the technology, you can create 50 billion crypto assets with a single program and distribute it widely almost instantaneously to millions and millions of investors. This is a far different world. Thank you. Thank you. Thank you. And I think the SEC has been scrambling over the last five to six years as to how they should respond with respect to the boom in crypto assets. So I think that the industry has a point to some extent that perhaps at times the SEC has been a little bit clumsy in terms of the message that it's sending. Maybe it's been a little bit deliberately unclear in a certain way because it it wants to avoid being put into a box. The SEC's response is, well, that's just how the security laws are captured, I mean, we're just trying to understand the issue and problem and it takes time for us to do this. And that's why we're not giving you clear answers. We're trying to figure it out first and we don't want to preclude any speculation by taking premature positions that are not well thought out. Gensler has compared the crypto industry to the wild, wild west. I mean, is that pure exaggeration or is that true in many respects? I think it is. And it's something to be concerned about. And I think retail investors, you know, young people, for example, are very sort of into these digital markets and they're on social media where these coins are being touted. And then there's a concern that a lot of money is going to be lost to people who are essentially stealing it. That's not a good thing. And I think that there has been a tendency by the industry to push the boundaries, to push the boundaries of regulation. And I think that the idea that it's sort of the Wild West, it's an apt description. Looking at these cases, do you think that they're hard cases for the SEC to make? There are challenges with both cases. In the Binance case, you have more problematic conduct. So that's in favor of the SEC. On the other hand, only a portion of Binance's operations are clearly in the United States. So there's kind of a question of the SEC's jurisdiction and to what extent can they regulate operations that are completely overseas. The SEC is making the argument that these overseas operations clearly have an impact in the US because they are basically soliciting US investors and encouraging them to sign up for trading on foreign platforms, even though the foreign platforms are not really supposed to have US investors. There's some allegation that they're encouraging potential US clients to log in with an internet connection that doesn't identify where you are logging in from in order to allow that person to get through the various themes that are meant to keep out US investors. So certainly there is an argument that some of these other operations should be subject to US jurisdiction, but that could be a bit complicated to establish. With I Coinbase, think the challenge for the FCC is that they've only identified about 10 or so crypto assets that it maintains are clearly securities, and so certainly Coinbase may try to dispute in court that these crypto assets are actually securities under the Howey test. They may dispute that. The FCC may have to defend its position, crypto assets by crypto assets, and that's sort of the utter question of what does the FCC want in the Coinbase case. Are they trying to say that Coinbase should be shut down? Is there an alternative registration option that they think could proceed? Could Coinbase argue, hey, we'll just stop allowing trading in these 10 to 15 things that you see are securities? And if we do that, maybe we're not an exchange, and so we don't have to register going forward. So I think that these are very carefully thought through, thoroughly investigated cases, but there could be some complications if these exchanges decide to litigate in court. Maybe you can make this clearer. If there are only those few in the Coinbase case that the SEC The SEC is asserting our securities. Is this then not an attempt by the SEC to assert its jurisdiction over the crypto industry? They are still saying though that your entire exchange has to register with us. And so that's a little bit puzzling to me. I just read the complaints. haven't I really had a lot of time to think through the legal issues in doctrine, but that's something think that it seems seems a bit odd a to me because clearly there are crypto assets trading on Coinbase that are have not got half of the trading volume is Bitcoin and Ether and the SEC the same. And so there's kind of this issue of well if only a portion of of the trading on your exchange relates to securities. Should you have to register with the SEC and the SEC is saying yes you do. And so I think they are asserting authority over these exchanges. And I think the question is whether or not there may be some questions about the legality of that as you know there might be intermediate solutions where you could kind of jettison those crypto assets that are securities and argue that you're outside of the SEC's jurisdiction. But I think it's clear the SEC in the lawsuit they do want to regulate Coinbase and Binance as changes. So if Congress doesn't act in this area does that mean the courts will be deciding what is a security and what is not? Yeah they'll be deciding a couple things right? They'll be hitting taste by taste are these crypto assets that the SEC claims are securities are they actually securities? And then secondly they're going to decide the broader issue of when do you have to register with the SEC as a securities exchange? I think there are a couple of major legal issues here that the courts will look at if Congress does not act and Coinbase and Binance decide to litigate these cases. Some people say these lawsuits could transform the crypto market do you think I think they could if the SEC wins then I think we're going to have a much more regulated crypto market. When you register as an exchange the SEC has oversight the power to shape the rules on the exchange and their obligations on the exchange to look for market manipulation and fraud it's going to be much more of a regulated industry if SEC the succeeds that may not be such a bad thing for exchanges to comply with SEC oversight and this is not unprecedented in that you think about the New York Stock Exchange more than a hundred years ago it starts out as a private initiation of individuals who are interested in making a marketplace it becomes you know this great institution a private institution and you have the federal government in the Securities Exchange Act of 1934 basically taking jurisdiction over this private organization and so we can have a similar dynamic here in the crypto industry and that you know in the long run could be that a good thing for crypto and it might be it might be something that gives the crypto markets a bit more legitimacy to the extent that they are regulated. "You're going to lose if the other side has the courage to stand firm. And the fact is that for over 100 days, McCarthy kept saying, and he went to the news media, he got more press coverage. If you go back and look at it, it's amazing how clear he was in communicating through the media despite their liberal bias because he just kept saying over over, and you know, we want to get this solved. And the key there was that the House Republican Conference actually passed a debt ceiling bill with real reforms. And therefore, the Senate Republicans, to my great shock, came out and said we are for McCarthy. And Mitch McConnell, who negotiated many of these deals, said, I'm not in this. This is McCarthy's opportunity. We're going to back McCarthy. And that in put a him position, and the reason I think this really matters in the long run, Mark, is if the center of gravity in Washington becomes the House Republicans, they are the most conservative group in the city, more much conservative than the Senate and obviously dramatically more conservative than the Biden White House. Now the question be will between the investigation process and the effort that they're going to put into the appropriations bills. Can they build on this? I tell everybody, if the debt ceiling was the final deal, I would have voted no. But if it's the first step in setting up a rhythm of winning, we keep so getting more and more goodies, then it's a very important yes. And I say that because if you read, the Mark, majority, you'll figure out, you know, we didn't jump to a balanced budget. We had three years of constant work, gradually inch by inch, getting Clinton in a position where a once balanced budget became possible. I think in this case, I don't think Biden's going to last three years. So the question is, can we get through 2023 2024 and be in a great position in January of 25 with a Republican president, Republican House, Republican Senate, to really drive dramatic, bold, deep

Why Elizabeth Warren Is Wrong About Crypto and the Fentanyl Epidemic
"Featured story is an opinion piece by CoinDesk's Daniel Kuhn. Our piece today is entitled, Why Elizabeth Warren is Wrong about Crypto and the Fentanyl Epidemic. For a while, crypto's role in the illegal and gray area drug trade seemed swept under the rug, or at least it was not getting the attention it could have, which is good and which the Fed shuttered back in 2013. It's good because some people have a tendency to moralize about drug use, and the less crypto is linked to crime in general, the less the entire industry will be stigmatized. However, it would arguably be better to be upfront about such things, assuming they're going on, as data now suggests. If crypto ever has a shot at finding a killer use case, or mass user base who understands why blockchains are important. U .S. Senator Elizabeth Warren, a Democrat from Massachusetts, is calling for a greater crypto crackdown following new research from blockchain analytics firms Chainalysis and Elliptic that found Bitcoin and Tether, or USDT, have become cornerstone to the global fentanyl trade. These are the same research companies that put out annual reports showing a fraction of a fraction of crypto transactions can be tied to illicit use. Quote, crypto is helping fund the fentanyl trade and we have the power to shut that down, Warren said, continuing, it's time. End quote. The Senator is a longtime critic of crypto, who recently made an incomprehensible anti -crypto army campaign part of her re -election bid. But does the Senator have a point? I already know what the crypto faithful will say. Chainalysis estimates less than 1 % of total crypto transactions are related to crime, so it doesn't matter if Chainalysis is now saying there's evidence. At least $37 .8 million worth of crypto was sent to drug manufacturers in China since 2018. But hold that thought, we'll get back to it. First, let's try to place crypto's alleged use for drug sales in the context of the global drug trade. To start, it's difficult to judge just how large the fentanyl economy is, because it is, by nature, kept mostly out of sight. But if Chainalysis and ellipsis figures are to be meaningful, they need context. According to one source Chainalysis cited, total quote chemical exports, end quote, from China, assumed by most authorities to be the largest manufacturer and exporter of black and gray market drugs, surpassed $100 billion in 2021 alone.

"A seemingly unstoppable force meets with an immovable object. I know, I know. Your Twitter feed has probably been drowning in threads and tips from AI bros who've discovered 99 ways for you to save 99 hours every week using chat GPT or some other list of 99 AI apps. I'm sick of it too. Trust me, especially considering most of these AI experts were Web 3 experts last year, NFT experts the year before, and DeFi or crypto experts before that. Trend hopping at its finest. That's not to say there's no value here to be found. Somewhere beneath or behind the almost deafening noise coming from these influencers, there is a possible paradigm shift and a genuine set of use cases. We've seen some already, of course. You can chat with these models to reason out a problem. You can summarize thoughts and ideas, find correlations between ideas, search for some information better than you could with Google, and of course, build more linguistically functional chat bots. Perhaps the best use case thus far is the Dev Assistant tool, but I get the sense that we've not yet seen the Uber moment. There is also, somewhere beneath and behind all the scary talk of AGI and the idiocy being proposed by bureaucrats and would -be regulators, a more human -centric, human -enhancing use for these tools. The idea of a language user interface as the next step from the thumb tapping we've been used to over the past decade is fascinating, and what we should be thinking about is how to make these tools new, quote, bicycles for the mind, as Steve Jobs said about computers. It's very important we push back against doomer narratives that lean the world toward approved AI, quote, unquote, in order to avoid such tools becoming yet another appendage of the state.

And yet the FBI does nothing with the information. That is so strange. That is so weird. It's almost like the FBI is a political action committee operation oppo covering up for Joe Biden. This is the key line in the Margot Cleveland piece. The source was an apparent source trusted FBI folks. What's that song? I don't know much, but I know I love you. I don't know much. Does McCarthy Have the Votes to Pass the New Debt Ceiling Plan?
"And you can roll right through to the radio show. That's up to you. But there is a lot going on. One quick quick note. The House is meeting ahead of a vote on a debt deal, which is supposed to happen shortly. I am really bad stuff. That the Republicans in this case, amazingly, I don't want to indict them all. You know, Mike Lee and Rand Paul and others have been speaking out about the debt deal. That the Republicans have again managed to snatch defeat from the jaws of victory. Listen, man, I'm not into pylons, but. It's just so pathetic sometimes. We already limit, save, grow, which was not a great deal, but was a better deal than the one the on table now. We already passed it. The House already passed it? Yes, it was already passed. So, why are we negotiating against ourselves? Exactly. Hell, even Nancy Mace Ace is, you know, whipping against this thing. Nancy Mace. So, what I'm hearing now is that because McCarthy's having trouble getting votes for this deal, is which not a good deal. It's not the most horrible deal and we don't have the Senate. We don't have the White House. I'm a realist. I'm not dumb. I know a lot of these Republican, oh, that guy bought Geno as a flamethrower. Really? Have you ever run for office? No, you haven't. So, you can shut them up, okay? I've actually put my name on a ballot. I know what I'm talking about. I understand we don't have that. We don't have the Senate and we don't have the White House. James B. Comey: FBI Did Nothing Wrong in Trump Investigation
"Okay. Okay. Okay. Dan, you have ADHD. I know it's a problem. I get it. I know. I want you to listen to Comey's clip here, it was this pseudo fake apology. And then when asked at the end, he's like, Oh yeah, but I don't really think the FBI liked anything wrong. This is an agency full of like, integrity and fidelity and bravery. They were just caught making up and completely fabricating a case to spy on the listen to this. Check this out as for the Durham report, 300 pages, four years investigating the investigators. One of the things that did come out of it was that procedures, regular FBI procedures were ignored, that steps were missed along the way in this investigation. In fact, director Ray said when the report came out, yeah, we acknowledge that a couple of ago, years and we've changed all that, those changes are already in place. Do you acknowledge perhaps that some mistakes were made along the way? Oh, definitely. And they were found four years ago by the inspector general. So there's nothing new in this new document. What were some of those mistakes from your point of view? Oh, that the FBI didn't communicate clearly the status of certain sources. They double checked certain information before putting it in a court application for a foreign intelligence wiretap and a bunch of others. And so do you believe now as these, some of these politicians call for defunding of the FBI, that that has been corrected and that now the procedures are in place to avoid those kinds of mistakes in the future? I think so. But in complex investigations, there's always going to mistakes. be It doesn't mean the FBI is incompetent, honest, and independent. So director with some distance now from from your time there with that investigation and everything that came into that 2016 election. Are there things that you wish you had done differently? Prosecutors Address Criminal Charges Against SBF
"U .S. criminal charges against Sam Bankman -Free don't warrant dismissal, prosecutors say. So basically, his lawyers tried to get criminal charges dismissed, and these include technicalities around his extradition back to the United States of America and campaign finance violations. In May, he filed pretrial motions to dismiss most charges against him. His defense argued procedural issues, the relevance of some U .S. laws given FTX's non -U .S. location, and that charges exceeded the great extradition terms. I actually want to toss this to Jen. We're dealing with a large amount of money here, and I don't think it's going to go away based on some technicalities. But I do think that we can expect the team to continue to like throw the ball, see what sticks, see what kind of charges they can get thrown out. I just don't think it's going to work for Sam Bankman -Free. He is accused of some pretty serious crimes. Zach? Lawyers going to lawyer. That's what I see when I see this story. They're going to lawyer. This is the procedural dribs and drabs before the show goes live in October. We're all waiting for that season to kick off, and it's going to be a big season. This is someone who's alleged to have done some pretty significant financial crimes. So the idea that they're trying to knock this down is reasonable, right? "This week's AP religion roundup. The archbishop of Chicago wants more information from the Illinois attorney general about newly uncovered cases of abuse. In an interview with The Associated Press, archbishop blaze sewage urged the attorney general to provide information about 125 newly uncovered cases of priests, who sexually abused minors. It really does highlight the terrible tragedy that took place in so many lives by priest who acted to responsibly, but also leaders in the church who did not respond appropriately. Cardinal sewage says he would gladly include the cases on his list of credibly accused clergy if the claims were substantiated. In his first interview, since the report was released, the cardinal expressed surprise that the report contained names he had never heard of. We are genuinely perplexed by the use of the word undisclosed reports because as far as we know and we verified this also with the state's attorney, we have gone ahead and been very careful about making sure that any accusation any allegation of sexual abuse of someone in the church has been reported to the state's attorneys. The nearly 700 page report said investigators found that more than 450 Catholic clergy and Illinois 6 diocese had sexually abused nearly 2000 children since 1950. It depicted the problem as far worse than the hierarchy had acknowledged in 2018 at the start of the state's review. The newly revealed cases wouldn't necessarily have been handled by the archdiocese, but rather the religious orders were the pre served. During the 5 years, we have constantly asked the attorney general. If you come across any accusations that have been substantiated, that we don't have who are religious orders or others, please tell us, and we will look into it and do it. So we were surprised by the new names on there. We thought we had that kind of relationship with the attorney general. And so our disappointed that we're hearing these for the first time. Super acknowledged that the report laid barrow problem in the way the Catholic Church has handled abuse cases. Religious orders such as the Jesuits franciscans and Maris often escaped scrutiny since they keep personnel files on their priests, not the diocese and leadership. I'm Walter ratliff.

I think it's like 16 something billion dollars, and it would come with at least that five cent gas tax. The goal there is to make sure we have this transportation package and get the work done on our bridges or roads and every division in the carbon build, saying that unless that transportation package Over that the carbon thing won't take effect. Until that promise. Transportation passes passes, okay, that would have put off the carbon system for another couple years, then, right? That's the way it wasn't a billet wasn't going to start until 2023 that that was the provision that I had to stay in there. They have to get that transportation package passed by 2023. So that's gone now and so you have two different things because you have the Low carbon or the captain Invest bill where he just beat up that progression, which was in there as well and then the second one, the low carbon fuel standard, which is a line item. It's a subsection of a section, which is illegal in the state, according to the all the lawmakers who came out and said they're going to take him to court, but in the staff tells me that they disagree. So that sounds like something for the courts to decide. Yeah, well, the governor says you can't. You can't use one bill to determine the fate of another bill, I think was his argument, right? Well, that's another argument and one that they again, his staff said is possibly unconstitutional, so they think that they're going to possibly win out there. But at the same time you have the Captain Invest, which Some say it could also lead to that kind of a situation for your your home energy bills and then Doug Ericksen. Republican Doug Ericksen also came out, complained that length yesterday saying that there is a warning out there now that these policies could lead to blackouts across the Pacific Northwest blackout in the summer Times. I do, Mike, I'm doing great. Good morning. Good morning. How's the start here? You're going. I know it's it is. Yeah, It's it's you know, it's more of the same. It's um you know, I think everybody thought, Hey, you know, 2022 2021 was into this magical moment. It's kind of more of the same with it just I just think it in our whole world. But Yeah, it's been a year spent starting off. Good. Um, you know a lot of the same themes from last year continue in the real estate market. A lot of demand very little supply. Low inventory rates have been a little bit volatile. They bounce around a little bit because of some of the political unrest and things that have happened around there. But Stiller at you know, at or near all time, historic lows, And so it's so far so good and looking forward to 2021. Yeah, You know, I was looking forward to January, especially because when we look historically a January we always have a pretty slow listing month in December. Just because people don't you know they're not being about putting their homes on the market. They're not wanting people that Trips through their homes during the holidays. They want toe wanna decorate they want enjoy their their holidays. They want to focus on all of that stuff on. Don't worry about moving. We're looking for a new place or selling their place after the holidays, so typically in our markets were always much busier with listings in January, as opposed to the end of the year, and I know I know other markets, especially up North. They don't really get busy with new listings until April. But ours really aren't really starts about January in January is usually one of our top three listing months of the year, which which is usually a surprise to some people, but I was really looking forward to new inventory in January, you know, getting out there hitting the ground running and just, you know, getting all these new listings so we could. We could have a lot of inventory for buyers. And you know the market would start moving a little bit. But I'm gonna tell you about halfway through January now and It's still really tight with the story. I thought, I thought our phones to be ringing off the hook toe list and Yeah, there. It's definitely busier than it has been. But Compared the last January and I don't know if it's because everything is going on. We're still a little slow with inventory, but you know it's picked up, but I'm you know, I'm really looking for the inventory to loosen up, and I hope that it does soon because, you know, I even looked up there just to get a feel of the market in some areas, and it's just like everything's pending. I don't know how much tighter Yeah, I was going to say this is anecdotally. But just in the neighborhood that I live in, Um, I noticed because I noticed these types of things being in the real estate market, the mortgage world. That a couple signs pop up and you know, so I try and kind of follow him just to see what's going on in literally In both cases, they went pending within 48 hours, and, you know, maybe that was, you know, online, right, So maybe it was probably even quicker than that. But it took that long to get online and it's just the properties just they go on the market and they go off the market. I'm miss quick as they go on. Yeah, And I do think especially when the market is really tight with inventory. I think that it is always attempting thing to think. Oh, man, I could just go out there and I could just Stick a sign in my yard and, you know, have all these calls and get all this done. And I'm gonna save all this money. But I'm gonna tell you that I think that when the market is really tight like this, I actually think that it's Ah lot of times. It can be even harder struggle on an even harder thing to overcome to actually get the home sold and to get it closed, especially if it's something that you're trying to do yourself and I don't mean to. Ah, To sound like I'm you know, using a scare tactic. It's just that I I see how much how much work is going into closing a lot of the properties that we have. And it's work from, you know, putting it on the market, making sure your vetting the buyer's getting the most money, usually with multiple offers figuring out how you can leverage those offers to get the cellar, you know the most money, but that's just the beginning. You know, then it's going through the inspection process with buyers who because they're paying a premium. They expect that the house to be an absolute premium. Sure, you know, uh, people that are, you know, scrutinizing the appraisal, you know, because the markets at the top, you know, sometimes getting through an appraisal issue, making sure the buyer has the best Linder possible, you know, making sure the buyer has all their ducks in the row in order to qualify. Um, because sometimes when the market's hot, it's like everybody clamps down on qualification, and it's just It's a lot To get the process to closing, and I feel like you know when the market's really hot That's where the work is. It's not actually getting the property under contract right away. But it's getting the most money and then getting all those steps all the way to closing, which turn out to be sometimes a really long process. And I know that you guys probably see that.
