Election Day 2020 holes open up a little less than 45 minutes ago across Arizona on this election day, 2020 and joining us now the woman in charge of making sure all the ballots are counted. Katie Hobbs, Arizona's secretary of state, Thanks thanks for being with us. I know you've got a busy day idea. Ah, but to more than 2.5 million people have already voted in Arizona. That's more than the entire turnout for 2016. What does that mean for Election day? Turn out. Some places are already seeing some decent sized lines. Well, yeah, I mean, we There are still a lot of people left that are registered to vote and eligible to vote and haven't cast a ballot yet. So we do expect steady turnout today, expecting that We'll see record turnout overall for this election. We've already started counting the early ballots right a couple of weeks ago. How realistic is that? That we'll know the results of atleast some of the races tonight. I think we'll have a good amount of results tonight and races that aren't close. Um the folks that are in the business of calling races will probably be able to do so We'll see. The early ballots have already been tabulated as well as the election day. Results tonight. I'm aware that discussions continue The president and the speaker about a larger package. Obviously, if that were to come over, we have to consider it and would Confederate six months have passed since Congress last approved economic relief, and an estimated eight million Americans have fallen into poverty in the interim, joining us now Congressman David Schweikert from Arizona's six congressional district. Thanks for being with us here, David the president seems to be open to the idea of a $2 trillion package, which is what House Democrats seem like they would be able to willing to settle on. Senate Majority Leader Mitch McConnell, not a fan. What's the president doing and his $2 trillion too much? Think it's just insane. We're still negotiating on this thing After this many months. But there's more going on. Remember. Last week, the Senate tried fording a package to help small businesses. You know the payroll protection and that was blocked by the Democrats in the 60 vote. Culture rules. So, So we have this sort of battling of what's going on in the Senate, where the Senate's been trying to put up money for small businesses and other things and that gets blocked. And in the House, the Democrat majority has had a $2.1 trillion package. A substantial portion of that money. Mom was going to municipalities, particularly back East, but also there was a big portion of their of renewing from state and local tax deductions. Which primarily benefits very, very wealthy on the coast. So you've had the sort of battling packages and then at the same time, there's what they call a petition to release the bill. That's been sitting in the house. Um, that would get 138 billion outfor the PPP loans. So it's juggling because we have the house talking to the White House, but no one's talking to the Senate, so hopefully we'll put everyone in the same room. You were talking to Congressman David Schweikert with us now on Arizona's Morning news. So here's what the American public things You guys really aren't putting us first as Faras making this a priority. Obviously, it's not that important. If the bickering is more important, right there be a relief package before the election. It's absolutely been infuriating. When you think about how many people are hurting you in particular for us in Arizona. How many people do we haven't worked for hotels are airlines or You know, tourism related, and they just had their heads kicked in. This should have been taking care of months and months ago, But politics got in the way it did is it always does Right? It's in Washington, D. C. That Congress David Schweiker, and he is speaking on the election. Early voting numbers are through the roof. So far has that changed how you're campaigning? Has that changed how others or campaigning, including the Democrats? Oh, this whole year has changed. We all campaign. Remember as Republicans, we would campaign in people's living rooms every weekend. You'd have little receptions with neighborhoods in the backyards and living rooms and telling your story and you don't really get to do that right now. So it's It's a different world. Maricopa County Attorney Alistair Adele Thanks for being with us answer what was the deciding factor and not charging Trooper Cervantes? Well, good morning and thank you for having me this sighting factor ultimate rest with me. But I had a committee of seasoned attorneys, staff members and now with my commitment to transparency. Committee members that gave a recommendation about charging or not charging in this case, and we just believed we had no reasonable, likely a conviction. We believe that Based on the facts and the evidence that Trooper Cervantes acted in self defense. So Yeah, I was going to mention that we see that Maybe I watched too many cop shows, but we were always here. Hey, look, there's no way I could get a conviction on this. We're not gonna move forward was that more of the way you were leaning or is it more like, Hey, this is just this looks like it really is self defense. In this case superstar Pontus saw Mr Johnson's car in a what we call a core point in the freeway. And he was waiting for backup after he had removed a weapon from Mr Johnson. Mr Johnson's car any smell an odor of alcohol and saw open alcoholic beverage containers. And so he was going to arrest him for d U I Before his backup could get there. He thought Mr Johnson moving was worried that ELISA, but he told him the face Police department that the driver, Mr Johnson was going to take off and that's where the struggle ensued. And so therefore he was in fear for his life when he was being pulled into the vehicle. We're talking with America County attorney Alistair Adele, who just announced her decision to not charge DPS Trooper George Cervantes for shooting Dion Johnson on the one A one a memorial day. And I have to ask you before you made this announcement. You had to be pretty nervous. I mean, seeing the civil unrest that's turned to violence in other cities and then knowing that we had protests of our own in downtown Phoenix. What were you feeling right before you made that announcement? I So appreciate this question because as a mother I can imagine. What? Mister Johnson, Mom? And family and friends are going through. The loss of life has never ever Easy so it would heavily on me. I wanted to make sure that I was not making this decision in haste. I wanted to make sure that I made this decision with empathy, and I wanted to make sure this decision was made with empathy. And I relied on the committee's recommendations and the law in our state and our ethical duties. So this was not an easy decision, and I hope that our community can come together. Because he may know if you look at the dates. This was the same day that George Floyd with murder two and changed the conversation in our community. And I believe that we can come together, have conversations and might not always agree, But we can do better be better America County attorney Alistair Del joining us about her decision to not charge DPS Trooper George Cervantes in the shooting death of Dion Johnson. It took several months to get to this decision. I may be. This is an obvious question A couple questions here. Would it have been a lot easier if a trooper Cervantes hadn't had been wearing a body Cam and if he didn't have a somewhat spotty record? I'm gonna give you a two part answer there. The first one is if he had given an interview right away. I don't know that I can't speculate the only difference, but it's no different than any suspect. Any person in the case. We respect their constitutional rights to refuse an interview interview later, but secondarily body worn cameras. I'm calling for a mandate on Body worn cameras on uniformed officers deployed in the field would have made a difference in this case again. I can't speculate, however. More information. It's always helpful for a prosecution for a defense attorney for the community. For those that one of our community are eternal justice system succeeds and so I am advocating for that. Okay, So how about how about Trooper Cervantes past record? Oh, I'm sorry. And I neglected the answer that party your questions. We did not consider his past record. Nor do we consider the past record of Mr Johnson. But would it have been easier to come to this decision? If Trooper Cervantes? I mean, could we have come to this decision quicker? Let's put it that way. If Trooper Cervantes didn't have anything, you know on his record. Well and and again. We don't We don't look at me like Mr Johnson's record in his past of being prior's stuff. We didn't look at Mr Cervantes. But quicker. I can tell you that again. I eliminated backlog of public records request and officer involved shootings because he had a stick in those in 2008. But we did our best that we could do to bring this case to the forefront as timely as it could, because we knew the public was very concerned, and the public need answers. So this actually was expedited. "Cervantes. That's the DPS motor officer who shot and killed Dion Johnson on the one on one free way on Memorial Day morning. Down in my heart. I knew that that wasn't going to charge him for my son's murder. And that's despite what Dion Johnson's mom says. While this is a tragic outcome, criminal charges against the trooper are not warranted because who else is there to tell the story? Van Trooper Cervantes and the witness who happened to be driving down the 101 when it all went down because You know they Dion Johnson's mama's saying they're only taking two per Cervantes story into account. But that's not true. You can't take the on Johnson story into account because he tragically and unfortunately is dead. S so That's why you have to rely on witnesses who happened to be driving down the 101 when it all went down, And it's why America, the county attorney, Alistair Adele, found the trooper acted in self defense. This is not a case where we simply took the officer's word to determine what happened and said We had substantial corroborating evidence. This included multiple eye witnesses whose observations supported the account given by Trooper, Sir, about this, by the way in just about an hour from now, less than an hour from now. Alistair Del. The Maricopa County attorney who made this decision is going to join us here on Arizona's Morning news. And even though I think she made the right decision that doesn't mean we're not going to question her decision, and we're not going no. Ask her some tough questions in all of this. One of those questions is holy Cow. Trooper Cervantes did not have the best history. Right. He's accused of doing some not so savory things in the past. Hey, did not have a body camera on. So how hard does it make this decision? A decision, but she said she didn't consider His history, criminal or behavioral or consider the criminal or behavioral past of Dion Johnson when making this decision. And I don't think either one of those would have measured up. No, I don't agree. I agree. And you know what? So you have to take it for what? The moment called for right, right, And ah and 9 11 callers, witnesses. And what they saw, right? And does it match up with the trooper story. And what was Indian Johnson's system? You know, first off, we know he'd consumed a lot of alcohol, but he also had ah, meth and marijuana in his system. I'm sorry, opioid fentanyl. And marijuana in his system. And so you've got a situation where a guy might not even have known That it was a trooper that it was a police officer who was reaching into his vehicle and might have decided to fight. Hey, Who's this guy who's getting in my vehicle? But that doesn't change. What Trooper Cervantes situation Wass. He's on the side of a freeway. He's actually you know, in that Gore point, That's where that little triangle that meets where the on ramp and the freeway meat. So he's in that little area, probably thinking himself. If this guy doesn't like, get his hands around my neck or something, maybe kill me. That way he might push me out into traffic. I've got to do something to protect myself. Legal advice I would imagine in pursuit of deciding whether or not to continue the Countywide governmental Requirement to wear a face covering while in most public places. I've said from the start that I don't like wearing a mask, especially after a guard garlic laden meal, but I still sucked it up and kept sucking in my own bad breath by wearing them before they were even required. I've also said that because I prefer a smaller government that doesn't have the rightto run much of how I live my life. I understand the constitutional arguments against some of these corona virus restrictions. But what I don't understand is why so many people have decided to plant their flag in this one issue masks mask wearing is the least inconvenient of the covert restrictions and the one that has been shown to keep the government from having to institute much more draconian regulations like closing down businesses and keeping my kids from going back to school. So my advice to the Maricopa County Board is too Yes gets your legal advice. But please also get some scientific advice before taking a vote on eliminating the mask requirement and the very latest scientific advice. I know the board has been hearing from voters like the guy I saw insist on walking into a donut shop yesterday morning, proudly mask free. I didn't say a word. Nor did I stick around to see if he got kicked out because this private business displayed its private property rights and made it abundantly clear that a mask was required to land a crawler. Now they will get the opinion of the lawyers, the county board. I don't know if that will change their minds now because of what the lawyers say, or follow the lead of some of the smaller governments around Arizona that have done away with her mask. Mandates like Or a Vista, a city of about 50,000, southeastern Arizona. The last I've heard of getting rid of mask mandates because the metrics have improved, but Maybe that's the absolute worst time to do it. I hope they listen instead to White House testing coordinator and assistant HHS Secretary Admiral Brett grow or about what he told. Good morning America. There's especially true here in Arizona, where we were already facing a teacher shortage. What happens the first time a teacher comes down with covert in in person. "For our community and Todd in some of these homes. They do have an Internet capable device. But with parents working from home or multiple Children needing to do online learning, it just isn't enough to have one or two, right. Give me your right and that's what we've seen over the summer. You kids have been able to use parents devices. Ah, little bit, but a lot of times they'll run out of the running minutes or they'll have to use it for work. And so we're really concerned that we could have 100,000 kids who don't have access to a laptop or device to be able to learn this the fall Wow 100,000 How far are we into that? You know, reaching that goal done. Well, I'd like to say we'd like to say a little bit further. If I were 1000 right now we need we need so much help, but this is a great way for the whole community to participate. 1000 and we need close to 100,000. Well, that's that's a neat is rape. Oh, yeah. So it's time to go through your closets and dig out the any Internet. Any Internet capable device right will help. Absolutely, And you know that we did that We first started. We ended up finding two that we just had forgot about. So you know, Digging. Mother could be a chromebook of lots of and I've had even a charger, and all you need to do is is to drop it off at any time. Did the doctors locations have 17 around the valley? They will like the hard drive. If you want to keep your harder That's fine, too, but they could make and refurbish it and get it to a student in need. And we've seen so many great stories of kids getting those laptops. I think you just said this, but I want Sure we emphasize is they don't have to be working, even do they? Absolutely not There. They do such a great job. But he had a process for this. So you could even do crypts. I'd pick up if you want to drop up if you want. They will get it running. And then we'll get to Ah to a school where a kid will be able to learn this this fall. And you know what? For those of you going into work? Why not ask your bosses or your companies if they have some old Devices that they condone eight. I know they get replaced every couple of years and a lot of places. You see why I work with her Todd because she's always thinks that stuff that I don't think of. That's that's awesome. She's absolutely right. Absolutely, And you know, we started looking some of the data. For instance, Hurricane Katrina. Obviously, a lot of kids were displaced, and it took about two full years for them to recover that lost learning. And if we can shorten that time to make sure our kids are hitting the ground running, it's it makes such a difference for our kids this year. Okay, so once again, you could drop off any Internet capable device working or not, especially looking for laptops. They there's a bit of a plethora of of desktops have been dropped off. So if you could find something other than that, that would be great. But they they'll take that too. "Stories on Arizona's new station, Katie our news. You know, not dealing properly with bad cops. And sometimes dealing properly with bad cops means firing bad cops that puts police departments and law enforcement agencies in much tougher situations than they need to be. And you know, trying to defend Someone who may have acted completely correctly, in an incident that comes under scrutiny means more scrutiny on how that officer or trooper or deputy had been dealt with. In the past case in point, the Dionne Johnson case the guy that was killed in the Gore point Of the Loop 101 at Tatum Boulevard. There was, you know, that might have been a case. It may be found that the trooper who fatally shot Dion Johnson was completely justified in shooting Johnson. By the way, I was just going mention Dion Johnson died on the same day as George Floyd. And so a lot of those protests were going on in downtown Phoenix work just for George Floyd. They were for Dion Johnson. But the past of this trooper puts extra scrutiny on DPS because the trooper apparently did stuff. You and I would have been fired for And maybe even have gone to jail. For there is an officer alone on a motorcycle that is having difficulty with the passenger and he is physically trying to restrain this guy in the driver's seat. I believe it was four different witnesses who were driving on the 101 saw. This. This trooper George Cervantes being pulled into the vehicle. One even said they saw his head hitting the door jamb. Ah, he's a 15 year DPS veteran. And in my first thoughts were while you know this guy was facing a really tough situation, and maybe he was and maybe he acted absolutely correctly in this Dion Johnson case, but this guy had been written up and punished for multiple instances of threats of violence. Here's what Here's what is included in his list of of bad behavior, stalking and intimidating and ex girlfriend while in his patrol car, threatening to shoot his ex wife's then fiancee. And this is this is disturbing to using a department issued Tasers on his dog. Multiple times for digging holes. You know when, when younger people abuse an animal, we say, Wow, That's a sign they may end up being a violent adult. When you've got a cop. You know, essentially abusing an animal. Why can I hear about all the other horrible stuff, But it's the one about chasing the dog only gets me. I know I know what you're saying. But it's all just bad. Right Last week, Congressman Greg Stanton introduced the cops of Accountability Act of 2020 looking for more body cams. But you know what? Body cams don't capture bad be past behavior. They don't and and I would say any one of those might be considered a fireable offence threatening Physical harm, threatening to shoot somebody. That's a very good chance that's assault. It's not battery, but that's assault. And ah, that is that should get somebody fired. You know, not just fired, but maybe even facing jail time because it's against the law. That's a felony.
