A new election has been ordered in North Carolina. According to the New York Times North Carolina officials on Thursday ordered a new contest in the ninth congressional district after the Republican candidate confronted by evidence that his campaign had financed an illegal voter turnout effort called for new election. The unanimous ruling by the five member board of elections was a startling and for Republicans embarrassing conclusion. So a case that has convulsed North Carolina since November, and then followed testimony that outline how political operative had orchestrated absentee ballots schemes to try to sway the race in favor of marquess the Republican candidate it is now the single undecided. House contest in last year's midterms. Robert, Cordell, states board, chairman cited the corruption absolute mess with the absentee ballots when he called for new election. He said it was certainly tainted Harris had nine hundred five vote lead over his democratic opponent. Dan mccready? "North Carolina State board of elections. Just finished a three of a public hearing that it's trying to get to the bottom of what happened in the states ninth congressional district last year the outcome of that race still hasn't been called state. Election officials accuse a political operative named McRae. Dallas of running an illegal scheme to collect absentee ballots. He was working for the Republican candidate Mark Harris in what was very tight race NPR's miles parks has been at all three days of this hearing, and he joins us now. Hi miles. So understand today's session revealed tensions within Harris's family over the decision to hire. Dallas. What happened? Yeah. We heard some pretty compelling testimony from Harris's son, John Harris, who's actually an assistant US attorney in North Carolina. He testified that he had looked at previous election results from two thousand sixteen and noticed a disturbing pattern of results based on somebody who is hiring this political operative this McRae. Dallas basically he saw public records. That indicated ballots were being returned for this candidate in batches leading him to. Believe that somebody in bladen county where this investigation is centered somebody there was collecting ballots, which is a legal. So then his father in two thousand seventeen comes in and says he's thinking about hiring McRae, Dallas. And he really has an issue with that investigators show an Email where he even forwarded the North Carolina statute that said collecting ballots is a legal North Carolina to his father. What have we learned about this scheme that investigators say Dallas was running? So for the past three days. Former employees of Dallas described how they collected ballots and one employee even said she filled in multiple ballots down ballot races, which is a legal North Carolina. Again, it's illegal even just to collect ballots, North Carolina. They also described how they were instructed different ways to make sure that state and local officials. I didn't get any red flags about the operation, and the consultant who paid Dallas his name's Andy Yates, he said a number of times that he didn't have any warning signs about Dallas. That's even though the state investigated, Dallas and. Thousand sixteen and there were a number of. News reports about that investigation. Harris said that he knew of no illegal activity on behalf of his campaign. So what does today's testimony mean in light of that? Well, he can't really say anymore that he was not warned. Here's how his son John Harris put it I raised red flags at the time. The decision was made to hires Dallas. That's what I did. But he also says he thinks McRae. Dallas lied to his father about what he was doing to get out the votes. Andy Yates, testified that doubts that he was only registering people that he wasn't collecting ballots. John Harris says that he thinks his parents believe McRae Dallas, and he did not. He says also added at the end of his testimony that his father did things in his campaign differently than he would have these hearings were initially scheduled to just last two days. This was three that just wrapped up in. It seems like there's more left to uncover. How long do you think this is gonna last and how long before voters in the ninth district has a member of congress to represent them? So at this point if definitely looks that this could like this could last the the rest of the week if not longer we still haven't heard from Mark Harris, he's set to testify tomorrow morning. And his campaign says he is very ready and eager to do that. If the state board they're going to vote at the end of this hearing, whether or not to hold a new election order certify, Harris, if they decide to hold a new election that process could take months North Carolina ninth district voters in North Carolina's ninth district could be looking at not having representation in the house until late summer early. We are joined now by our North Carolina reporter who covers North Carolina for battleground state news AP Dylan, welcome AP. So we we only have ten minutes and in this segment. I can you unravel. What's going on in the ninth congressional district for us in ten minutes? So where do you like me to start? Well. Election day. What Mark Harris won the election by nine hundred five votes. But he's not been certified what's happened since election day. There's been a lot of back and forth. The current board was dragging its feet when it came to Montaigner investigation being transparent about what they found what they hadn't found why they weren't certifying it. So they set a hearing for for late December, and then they canceled that hearing and rescheduled it for January eleventh that one got rescheduled again and immediately following that the Harris campaign. I said, yeah, we're not gonna wait anymore. We are upset with the lack of transparency here. Cancellation of this latest hearing we've been cooperating and we're not gonna wait anymore. So they follow the rid Amanda Mus yesterday. And that basically says to a court they're asking a court to wait in and say, hey, can you please certify this? This sport is not doing their job. And there's nobody in place right now to actually do that job because one board has been dismissed and the other board won't be appointed until the end of January, according to legal changes in the law that were made back in December. Is it the case? Yeah. Is it? So there are now three hundred and four hundred and thirty four members of congress have been sworn in one is not. And that's Mark Harris who who won the election, according to the county election boards in eight counties that comprise the nights congressional district by nine hundred and five votes, supposedly, then what on November twenty seven th or so the the then existing North Carolina State board of elections and ethics enforcement said, oh, we're not going to certify because there are these reports of election irregularities. But as you point out did they present any of that evidence? What did they do? Provide any evidence that there was there were allegations that there was ballot tampering. Had to do with absentee ballot harvesting by a man named Leslie McRae. Dallas Dallas has a history of this kind of activity that goes back, you know, almost a decade and he's had involvement with another group who was pointed out in two thousand sixteen for alleged ballot harvesting, so to speak in that group was the bladen county improvement pack pack is received thousands and thousands of dollars from the Carolina democratic cardio. So these are democratic tactics. And now that the a a Republican candidates consultant hired him to engage in those. They they they found some complaints. And but they never acted on them. So that's how they know what they did. Because that's what they've been doing. All this time AP, right? Right. Exactly. And in fact, what's funny is Dallas himself as a candidate for soil monarch compensations conference. Con messiah conservation supervisor in blatant county. What would I do if I had a time that actually works, right? In two thousand sixteen he ran and then he said that there was some Hanky panky going on with balancing his particular accused a group, I'm doing harvesting when it came to absentee ballots in his own race in two thousand sixteen that case got turned over to the North Carolina State board of elections and eventually dismissed the case citing a lack of substantial evidence from a violation of election law or other regularity or misconduct sufficient to cast out on the result for the election. So Dallas actually had people with affidavit swearing that. These people went through nursing homes and things in collected these ballots, which was legal in the first place. And he he provided that information because he's done it himself. The NTSB. Dismisses that and turns it over to the feds really didn't do much with either from what it looks like. And yet in this case with less evidence. The state board of elections ignored the the the election results and refuse to to to certify in this case a democrat who wanted to go to congress lost. So we're gonna take a better closer look at us in the election hasn't given any information. What's the weather whether or not this new balance, if they were thrown out, or if they had to be recast, or if it would have been kicked the election one way or the other we're not saying anything so that board was dismissed a new board is going to be put into place, and what's interesting is put a gentleman named Malcolm. Meanwhile, the state election board charged with investigating the scandal has been ordered by a panel of judges to dissolve because of a case having nothing to do with the scandal. Few rusty Jacobs politics reporter for WNYC is in Chapel Hill, high rusty. Hi, Robyn, and we've talked about this scandal allegations from voters that nice lady came to their house and said she'd fill out their absentee ballots that lady is the stepdaughter of Leslie McRae. Dallas a political contractor working for Harris, the Republican do we know how far the board got in the investigation did. Candidate harris. No, for instance. Well, congressman candidate Mark Harris says he didn't know there were any improprieties. He has said that he did. In fact, higher Dallas that he was steered towards Dallas by state and county Republicans who claimed that Dallas was very effective at getting in harvesting Republican or I should say harvesting absentee ballots in helping with that effort Harris lost a primary in two thousand sixteen to a candidate who got most of the absentee ballots in bladen county in his favor working with McRae, Dallas. So he he knew that the Dallas was effective at helping with absentee ballots. He says he did not know that he was engaged in any kind of impropriety side. And so this board that had been investigating. I'm presuming we don't know what conclusions. They met may have come to write. And now they've been ordered to dissolve because of another case, correct. So without without making this too convoluted back in two thousand. Sixteen just before democrat governor ROY Cooper took office. The Republican controlled legislature rewrote, the law governing the ethics board and the elections board. And they rewrote it to that. They had more power on appointing members to that board governor Cooper challenge that in court last October, a three judge panel in Wake County determined that the makeup of the board was in fact, unconstitutional and would have to be dissolved. They they stayed that ruling giving the board time to complete its investigation after the board delayed the hearing that we're expecting on January eleventh about the improprieties in the congressional district. The ninth congressional district. They decided that it was time to dissolve the board. We are now without aboard. We are not without a staff though, investigators legal counsel who are still continuing to look into possible improprieties. But are we without hearing? Because as you said it was scheduled for the eleventh, all I can tell you is the spokesman for the North Carolina. The state elections board has said that the staff continues. To work as if there will be hearing on the eleventh. But certainly there cannot be determination. Whether there is enough evidence to warrant new election without aboard in place. I will tell you the governor Cooper is standing by his or his staff's legal analysis that what should happen is the law should revert to a twenty fifteen law that predates the unconstitutional law. Democrats are taking over the leadership in the house and say they won't seat the Republican candidate Mark Harris who got nine hundred more votes than his democratic opponent democrat eighty because of the scandal over how some of those votes were collected. Meanwhile, the state election board charged with investigating the scandal has been ordered by a panel of judges to dissolve because of a case having nothing to do with the scandal. So he knew that Dallas was effective at helping with absentee ballots. He says he did not know that he was engaged in any kind of impropriety. And so this board that had been investigating. I'm presuming we don't know what conclusions. They met may have come to write. And now they've been ordered to dissolve because of another case, correct. The Republican controlled legislature rewrote, the law governing the ethics board and the elections board. And they rewrote it to that.
