How Can You Justify Breaking the Law?

"I want to talk in this segment about the concept of natural law. And I want to do it by looking at an article, one of my favorite publications, the quarterly journal called first things, and the article is by POJ named David Novak. Who is a chair of Jewish studies at the university of Toronto. The article is called the bottom line. And it gets to the some of the conundrums around this concept of natural law, which I think a very illuminating. So Novak begins by talking about reading Martin Luther King's letter from the Birmingham jail. And he says what's really interesting here is that Martin Luther King is breaking a law. It's the segregation law of Birmingham. And yet Martin Luther King is arguing that he is right to do this. He's right to break the law. So David Novak raises the obvious question, how can you justify breaking a law? And Martin Luther King answer is, in effect, I'm breaking the law because the law itself is wrong. The law is unjust. So since the law is unjust, it is just to violate the law. Now, if I'm punished for doing that, so be it, but I am in the right and the law is in the wrong. This is king. It just law is a man-made code that squares with the moral law of the law of God. So here's Martin Luther King saying in effect that there is a law above the law. Well, what law is that? A kind of a higher law. And this is a very direct appeal to natural law. The concept of natural law is nothing more than the idea of a higher law, a kind of a God given law, a law embedded. You may say in the code of nature itself and what king is saying is that our ordinary laws are positive laws, so called laws that are passed by legislatures and so on need to be judged themselves by this higher by this higher standard.

Yes it could be. Hey or straw. Or anything that it's all been kind of harvested and it's been put across the field in these kind of like a t piece of of of of the whatever it is. They're actually harvesting yes. And it's not. It's simply that you know that the picking on and then winding it round and setting it up. That's the game yet and she could be obviously a particular type of crop that they had. So it's it's just it's just the description of the way that each of those little things and so people will be much more familiar with the big black huge bales of hay bales yet but in different it's different crops are are kind of placed in the field in different ways and then another track to become on it all up so is it. Because her father was a gardener she lived in farming rural community and so everybody went out and it was all caused by hand. Yes yes and these are the words that as writers yet we can try to keep in current dylan. I kept saying to rosie. How do you spell that. When i come across even and i grew up we we live here three miles from my rosy grow up you know we live in this unity. The different words you know the thing that always make everybody laugh about sussex we all sussex people and it tells you a great deal the major of life is that when you get a book of sussex don act. My next book is a book about a history about putting women back into history but as it spine. I'm using the story of my grandmother who turns out to be a novelist but he was kind of vanished from the record and the idea of how easy it is for women's Achievements to to find it from there will be. It will be women from all over the world periods of history but actually writing an extra pair of hands. I really fell in love with writing narrative nonfiction. Yeah so now juggling the big new novel and the big new piece of nonfiction. So hopefully i'll be back at birmingham to talk about one or other in person that back to real event fulltime bent as well. "An extra pair of hands. Because i felt i had a voice i was asked by the wellcome trust and that it was important for all of us who are in this position to raise our voices together with a north. Allow the fact that our circumstances are different. I'm never what makes us feel that. We have no right to speak for other people. Actually we're not speaking for other people. We need to speak as thirteen million now. Yes unpaid carriage in the uk just in the uk and the vast majority of those women and yeah the politicians are not addressing these social care and so therefore i felt it was part of my job. If you like is a character. Put my voice with other taras empty huge numbers of emails. Letters of phone calls events that i've done. Everybody has a different experience. But everybody's going. We all need to speak vow. This we need speak loudly about this. Exactly and i really encourage people to read it a for the beautiful writing and be for the devastating statistics. Because that it's a it's a really wonderful call for this. And and the the the impact on women on and emits the pandemic which has hit women differently for men as well. All of that is very awfully put in book and and as you can imagine if it hit somebody with with a comfortable situation like this then how does it at somebody without one. It's really really powerful. And that's and that's actually positive. Job of people customer writers but also have had these experiences of Thinking about caring for people living and dying unda and but all of that is the we need to look after our carris. Yeah there's some people who have not had a day off in from from the carrying responsible for eighteen months because all of these care services shot down and they had to. We saw the absolute disregard for older people and people with disabilities show in by the government. And it this is not a party. Political point making. It's the government is in charge regardless of their political color. And it but this is. This is a crisis that has been coming down the road for very long time and of all times when it now should be being raft. It is now and that it's still not right because it will it will pieces. Am i saying that. I don't think the families should be the primary cares if they can't be of course i'm not in almost every case spoken to people are very. They want to be the primary carrots. But what about the people without any support. What about the people who carrying an eighty year old woman. Who's carrying for a ninety two year old man was about. The people had a child whose child died on about all of the. What about and should the sign of a civilized. Good society is how we care for the people who need us most not the people who make the most money. Yeah and so our priorities around this have got very skewed and it's a brilliant thing that our populations eleven older. It's a sign of why the nhs's so extraordinary and why it matters that people don't routine died in the forties and fifties as many words of history. They did but that does bring with it. The idea of how people live well as you know. And how we approach the business of dying and support care. So i do feel very strongly and you write in. You know. we're not quite in the same field. But we kind of all in this writing. And i think that every book that comes out every moment that somebody who's in a position can pick up a book like yours or mine and see their own experiences reflected. Make somebody a little bit less alone in trying to deal with these things. That are very complicated. Yes and i think it's also it's partly. It's partly the connecting with people on where you are together and it's also partly opening a window on how things could be exact and i've always been a campaign a as a Positively so like okay. There is a problem here. What are we gonna do about it. Yeah and let's go forward. Hopefully yes you know. And i think that's really really important again. I'm very lucky in that because one that is my nature secondly all of the things in terms of the caring responsibilities i have. I love my mother-in-law. There were many people who are caring for people who don't wanna like by much. Yes who are not very nice into the idea. That has older is much nice. We know is not true people themselves. It's the age equivalent. Of in beano veritas. People get older. They get more themselves right and some people that are not pleasant and some people to care for people that did not care for them. That's right but whereas is wonderful right you know and it's very interesting people's fast reactions if they don't know crazy and they don't know me they don't know family and my husband restaurant when you say you have your mother knew people go ou know they automatically put a face. That's tricky imagining. The the mother-in-law joke mother no check but of course at behind that his very deep strain misogyny yes. That's right which. I power play continent you know. Don't sign up to them in any way. Whatever yeah let me speak for the writers who may be listening who probably are listening in all of this. How do you protect your writing time. Yeah well you can't is as simple as that. You know it's Absolutely you can't with a novel. One of my novels called citadel. I was writing that when my father was dying. And i looking back now i company but kept going. I should have just run option. Say you know this is not gonna come yet but the problem that everybody knows about caring for older people in particular or equally younger people with life limiting disabilities. But that might be. You might became for a long time. His you never know when the significant moment is coming until it happened so with everybody. Who's akara there will be many false alarms. When you think it's the end and then it's not and so what do you say to your publisher icon. I'm going to live this book late. I just can't do it because my father had there were several moments over a period of about nine months where it looked like he was going to die and then it. That wasn't the time it wasn't his time. And so when do you stop and so in the end it was more acute even with my ma who had a condition called. Copd shipping smoker for many years. And she but she also had issues with a heart. He was incredibly healthy wonderful except for the fact that she had this really big issue she looked perfect was wonderful and she had. There were many times when she had to go in for oxygen or be looks after there was no sign at all the the weekend that she died he was going to die. None at all. And i was i was writing and working and was due on stage to do some interviews and all the rest of it and huge work situation going on. I was on the phone. And what have to send really sorry. It's going to have to go and call you back because doctors here but that wasn't again it wasn't any different from other times that had happened and then suck me. My wonderful beautiful. Mother was was dominant. So i think that is what is impossible about protecting writing you really. Can't you just have to play it by ear. But be brave enough and i was only brave enough after the event with with my dad's death what i went back to that novel. I looked on the page that might grief at his loss. He's imminent loss was on every single page of that novel and it didn't belong there. It was i. It didn't belong had to say you know i just need to take some time. And after my mother died. I couldn't even read a tool. It.

"Absolutely delighted to be here talking with kate. Moss novelist playwright and author of an extra pair of hands a story of carry aging everyday acts of love kate. Moss is an international bestselling novelist playwright and nonfiction author with sales of more than eight million copies in thirty eight hundred renowned for bringing unheard and under her histories to life. She's a champion of women's creativity. She's the founder director of the women's prize for fiction sits on the executive committee of women of the world and is a visiting professor of contemporary fiction and creative writing at the university of chichester. Her latest novel city of tears was published in january. Twenty twenty one. She lives in west sussex with her husband and mother-in-law and she's there right now ready to talk with us locate. Hello good morning. good morning to you. I i am so pleased to have impaired with you. Have the chance to read an extra pair of hands and It's very close to my heart as as it is to. I think a lot of us in our these end. Thank you said in another interview. You're approaching sixty m. yes sixtieth birthday. topa right. And i i remember very alba ably when i when my parents parents were dying and And thinking they're talking to their friends all the time. Their friends are also going through this and my friends and i will also be going through this at the same time and so i would like the the first thing that struck me in reading him very early on right in the first pages of this book where you said the many things said it's about and the one that really pierced me was trying and failing simultaneously. Yeah can you see that and you see that very human duality that tension in your fictional stories as well or was that very applicable to you in talking about just your own life. That's a great question. Actually addison about you know because one of the key things as one of us who writes in different genres is how similar. The skin is for writing each different type of book and there is for me it was very liberating writing non fiction i've written some nonfiction before but this is by far the most personal book i've ever written but actually the skill of the way that i went about writing. It was the same as the way that i go about writing awful. Which is you need to put couches on the page. You need to put him motions on the page and so that particular thing about trying and failing and succeeding simultaneously everything. Existing in the moment is at the heart. I think any human experience in that we all are whether it's an made up carrot or acid. Our lives mostly. We're trying to do our best and often you can have that wonderful feeling that you got it right. You know you did the right thing at the right time. But particularly when you're writing about care when as you say there is no. there is no no alternative ending. yes the ending. If your character is almost always going to be in the death of the past newcastle living. Well undying went the same story dying. What is positive of living and it will come to. His doesn't matter who we are. How immortal we feel in the end. It will come to us. So i think that that is at the heart of what it means to be a cara but obviously in the piece of fiction. I can't decide the can change the ending. I usually finish before my characters die. Suddenly the lead characters or next. That's part of the story. And so i wanted to have that sense that whatever you do will never will never change. Things i could do is make a horrible. It's much overused at the moment. Time obsessed with the olympics and what appears on every interview the journey right but all you can do as a carry is make the journey a brilliant as it can be for the person you're carrying four and by association yourself. Exactly 'cause you're not the doctor your comforter and the lift and i quote in the book is full of literary allusions and authors and writings and and things like that. But you know. It's the idea that old age there is no cure for that. There is no cure for a nor nor debbie. I mean the united states the span of a person's life well. I'm glad you mentioned the literary references throughout that was a great joy and it made me wonder clearly. Reading has been a way of getting through life for you as well as writing so reading must have come. I in in writing this book did you. Did you have moments where you're like. Ooh i remember. There's a poem the fits perfectly here. Is that what happened throughout yet. You know in a way. I mean as as you can't be a writer if you're not a region yeah the best writers a great readers and it starts like that all of us and it's about expression and reading is about Reading the words of other people who are expressing things that we're feeling more excitement that we wanted to feel and sometimes it's about making sensitive difficult emotions but often it's about sharing wonderful motion to you know it's it's everything it's the same thing. It's the full gammit because all of our emotions are part of what makes us who we are. It's not just the good stuff that makes us area. Yeah so i've always been passionate reader unto always carried a lot of other people's words in me if you like So a lot of the poems in particular that i quote total songs that i quote our check them that i was getting them right but many of them were things that i read ten years ago. Twenty years ago forty years ago And thought i knew that. I know that that author has put precisely what i'm feeling better than i can. So let me go and find that quotation. It's people who are who are condensing. The essence of things isn't show exactly right and i think also that we have completely different experiences. All of us in carrying us in life but when we all read a particular poet i finished with the philip larkin poem that remains of us is love. An extraordinary poem arendal tomb. The article team is actually in chichester cathedral my home city and ditched cathedral as a place that i love done many many many many events there over the years. It's a place that is at the heart of the music in the school community as well as a faith community And i didn't even realize the rental tomb was there until i was studying at school. You know half a mile down the road. And then i'll teacher said you know the actual to is his veto but when i used that quotation so many people have read that line. What remains is love and it has meant something to them. So it's about obviously we are always connected as reader and writer through any book but then when you share quotations that means something to you you're connecting to uneven wider range of people who've come across the same words and it and they have resonated for them so that's partly why i share so much other writers because we all become a bigger and bigger and bigger community every time. We say enough that too until i wanted to do that. Because everybody's carrying experiences is different and everybody's reading experiences different de recall correctly that Sometimes you need to granny rosie. Is that right or is it. Somebody you were reading to kitchen table i.

It is now we still we still have the focus on neighborhood of violence Nation, We still have to focus on decreasing gun violence. And investing in our infrastructure as well. Um, He likes to instigate things, so I'll take you next caller that has an actual genuine question. Okay. Do we have any buddy lined up else? Other than that, John Vector for the mayor. Let us know if we get somebody calling in here, so your position with the border situation obviously is a complete nightmare. And more and more people seem to be getting into this country under Biden's administration, and these people are going to be spreading out. So if your legal is coming to our city, what's your position on that? Well, um, I think a couple of ways to answer that question, uh, anything related to the border. I think we know it's not a marriage. I think that's related to the federal government. And I think the federal government is doing everything it can snow different and in your president, President protect our state, our country's borders so I'll continue to listen to what they're offering in form of that protection. As it relates to cities. You know again, there's no rights. They're all that is controlled by the state. So if somebody is illegal in the city of Birmingham, you're you're not going to be like one of these cities like the West Coast Portland, San Francisco That's going to not cooperate with ice and cooperate with what's going on. As far as enforcing our federal laws on a local level. Well, our administration and plan enforces laws the same time. The city of Birmingham is a welcoming city. Um are BP is not going around checking anyone's immigration because that's not our job. Our job is to make sure there's growth in the city economic vitality in the city. All right, Let's talk about the crime in the city here. Obviously, it's a big concern. Not only here in Birmingham, but obviously around the country in some major cities. Uh, what are the efforts going on right now? As far as bringing that down the violence here we've seen every other day We see people in communities going. The violence has to stop. The violence has to stop. What's the chief? I have to say about ways to combat that along with yourself. I think the given. I think you have a national crisis right now. Urban cores across America related to gun violence. I think related to other crimes, Uh, victims of gun violence on the only victims of crime, their second survival rate. Assault burglary tests. And in all those categories city of Birmingham, Messina continued decline, with the exception of gun violence related to gun violence. You've taken over $5000 of guns off our streets over the last Three plus years, but I think it's gonna take a multipronged approach. We're not going to be able to arrest our way out of this. And you can't have an enforcement lands. Only think we have to consider Things around prevention measures, such as conflict resolution long term as well as ranchers, measures to make sure those who were but can rib rehabilitate back into our city limits. And don't do the same thing that got them in state or federal custody in the first place. Job training, etcetera. Right, Right. Alright. Well, Mayor, I appreciate your time this morning.
