Here are the big things we're watching on Monday, march 6th. Politico colleague, Betsy Woodruff Swan, has an eye popping story up in this morning's playbook on the previously unreported DHS domestic intelligence program, as she writes one of many revelations in a wide ranging trench of internal documents reviewed by Politico. Those documents also reveal that a significant number of employees indeed as its intelligence office have reached concerns that the work they are doing could be illegal. Under the domestic intelligence program, officials are allowed to seek interviews with just about anyone in the United States. That includes people held in immigration detention centers, local jails, and federal prison, teach us intelligence professionals have to say they're conducting intelligence interviews, and they have to tell the people that they seek to interview that their participation is voluntary. But the fact that they're allowed to go directly to incarcerated people, circumventing their lawyers, raises important civil liberty concerns. According to legal experts, that specific element of the program, which has been in place for years, was paused last year because of internal concerns. The details on the overt human intelligence collection program are just one revelation from the documents concerning the department's office of intelligence and analysis, which is right, but see reports with the widespread internal concerns about legally questionable tactics and political pressure. We know that they're looking at many crimes besides records act violations. And records act violations are not to be sneezed at. I mean, they're important part of how we run our government about transparency, it's also about protecting national security. We know he leaked information the Russians. From Israeli sources. So he's not above leaking. Now the president can declassify. So anything that he has there, maybe he declassified before he took him out of The White House. Once he's out of The White House, he doesn't have that power, but he declassify him. You know, I don't know. It doesn't since he lies about everything. Is there a way we know when he declassified that if he did the class before you know? No, there isn't. Yeah, because it should be because there is a process for declassifying and marking things as, you know, if you off the classification marks, so maybe there is a way to find out if he's lying that he did it before, but that's tricky. But that's what you're right. He does think he has like Spidey sense and superpowers after he left The White House like executive coverage. And he doesn't. So you're right. If he said, I did it when I got here. It's like, no, you weren't present anymore. That's right. The minute he got on that plane at 12, well, maybe he got on before the inauguration started. But he's the one you lose your baby. He was not president. Right. Sorry, whiny loser baby is a technical legal term. Yes, I think that's a good one. I think that's a good one. And by the way, I should have, of course, that it was when we said Republicans, it was your father's presidential running mate who went to The White House and said, you will be convicted in the Senate. If you do not resign. Yeah. So that's, you know, score one for your father. Yeah. Right? It was John dean that wrote the original, what was Barry's book? Conservatives with conscience and conservatives without conscience. Yeah, interesting. Well, anyway, yeah, I mean, I guess I'm just, we're just curious at what stage what investigation is because we don't even know what all is going on. And that's the important thing to note. We don't know. I originally said, oh, they would never issue a search warrant for these documents because there are so many other steps. Well, prior to doing that, that was my first reaction when I heard it. Now, as I read the reporting and Betsy Woodruff Swan at yesterday on a panel, I was on that, you know, she had definitely confirmed that that was what it was. And as I said, I haven't seen it the search warrant, so I can't say that that's what it says. But I think she's a very credible reporter. And so I take her point of view and think, well, then maybe it is just that. Yeah, you mentioned national security and we were saying, is it Russia stuff? What would Paul Manafort finally admitting what we all knew from the beginning that he shared polling internal polling data with Russia? I mean, he's finally, so I'm just wondering, you know, what stuff we're going to find. What's in there? Russia's stuff, incriminating, but something that may impact national security. It could be who knows it could be related to Ukraine, which is certainly his withholding when for a day, and it was more than a day that he withheld weapons that they very much needed in anticipation of what has now materialized into this horrendous improper attack. Is really terrible. Maybe it has something to do with that. We just don't know. The thing about government documents is there's seldom only one happy. Unless they're his handwritten notes. There's someone else who needed. And Jill real quick. Since you brought that up, the Secret Service and Homeland Security and Pentagon texts. Is your take that we will find those that they are somewhere or yeah, I mean, unless it was done so deliberately by a real expert, things don't disappear. Let's go from a to B and we also have the senders and the recipients. We know who the agents are who were on duty at the time. Supposedly we now do because the government has turned over the phone numbers of those agents. And so that means they have the names of those agents. Let's ask the agents what was going on that day. What's your memory? Yeah. And let's do it sooner rather than later before memories fade. Maybe they got the expert that acid watch Hillary's risotto recipes. Okay. These are the jokes. Yes. I mean, it would take a real expert to actually make them superior from the cloud. And of course, that is a clear violation of the records act. Yeah. Because you can not wipe a phone clean without uploading them, because everything on that phone is a government record. There's a clear violation. "The steering wheel or an agent, the agents are prepared to say so under oath. It's the next tweet. It's the next, this is the LA times. This is the Disney LA times. So Cassidy, Smollett, tells the story that the actual players involved say, according to CNN and an anonymous member, anonymous sources were great in the Trump era. They're no good anymore, apparently. An anonymous Secret Service official has said or not I was willing to go on the record. I know from people too that this story is false. It's fake. But again, instead of writing an honest, I'll give you an honest headline if you were a journalist. I mean, I'm not a big headline writer. But you get the point. Here's what Nolan mccaskill and Freddy Brewster, if they had any dignity for the LA times, here's what here's what they would write. They would write something like. Trump, you know, Trump White House staff members, you know, testimony challenged by various sources or something like that. I mean, you know, you're doing journalism. You're not doing hysteria. But that's not what they're here to do. They heard a cover for Biden at all costs. Now it gets even worse. Politico, which must have pained them to write this, political Betsy Woodruff, Nicholas Wu and Kyle chaney, who like, can't write more left leaning headlines ever. It must have killed them to write it. Secret Service, colon. January 6 panel didn't reach out before Hutchinson's explosive Trump testimony. The agency said it got no outreach for ten days before the committee aired testimony about Trump's behavior in the presidential vehicle. Folks. This is why we have adversarial hearings. This is why we have professionals. Can you imagine the level of stupid, the level of imbecility? The level of moron, you need to be. To put in front of a national audience in an emergency hearing, triple hearsay, Cassidy small a said she heard from Tony ornato who heard from Bobby engel. Can you imagine, I'm sorry, double hearsay, right? Can you imagine putting that in a courtroom? The reason that stuff is not allowed and professional law enforcement officers. When they're not acting like partisan hacks like Peter stroke, professional law enforcement officers who were trained to do this, don't do this stuff, is precisely because of stupid like this. Liz Cheney didn't even think to ask the Secret Service if the story was true. Folks, they're not civilians. They're GS 1811 federal agents that work for the government. They can be administratively forced to testify. Not legally, they can resign. But administratively, they can be said. It can be told the agency the Secret Service can tell and get up there and testify. Liz Cheney never thought to get their testimony? This is why we have, again, professional nonpartisan law enforcement when they're doing their jobs the right way. And we don't let political hacks, like Liz Cheney, tyrants, and totalitarians, like this disgraced human being, Liz Cheney. This is why we don't let her conduct investigations because Liz Cheney doesn't care about the truth. Liz Cheney cares about one thing. What I addressed in the beginning of the show, holding on to her seat and the power of it so she can attend high powered lunches. That is all Liz Cheney cares about. Liz Cheney doesn't give a damn about the truth. She could have went to the Secret Service and said, hey, we're hearing a rumor from Cassidy small a here. That Bobby engel was attacked by president Trump. We'd like to have Bobby engel testify. You know why she didn't do that? Take a guess, folks. Why didn't she do that? Liz didn't do that because Liz was afraid the truth would come out and Bobby engel would say, nah, that didn't happen. So she put Cassidy small lay up there to give a one sided story. Now judge jeanine, who I respect who was actually a judge and was in the legal profession, one off on this yesterday, Jim queue up for me come one. It's a little bit long, it's about a minute 20 seconds, but it's good. It's worth your time. A couple things in here. She blows this whole thing out of the water. She says, this is why we have cross examination. So when you say dumb things like this, another party can ask you the question. Second, she brings up something at the end about the beast. And I want you to listen to Dana perino who I worked in The White House with. She has remember I told you nobody calls it the beast, Dana knows, and that's why you'll get this reaction at the end, but check this out first. What do you do to test whether or not someone is telling the truth? You have cross examination. It's an age old test that has served us well for centuries. There was no cross examination of this woman. Number two, she talked about hearsay. Now I talked to two sources today from The White House at that time. They both say that she was so low level. She wanted people to believe that she was in the center of in the center of the room. Major things were being discussed. She was not that person. That's factually untrue. They also tell me that the Secret Service, along with the lead agency, the drivers, they are willing to come in and testify that what she said is not true. In addition to that, they say that she says and I have a quote and I looked at Tony and he said did you hear what happened in the beast? She says, again, Tony proceeded to tell me when the president got in the beast. These people tell me the president was not in the beast. He was in an SUV. So she's lying about that. She's lying about what she said. Are you taking umbrage at this? No, no. No, I was trying to remember if the president's vehicle is always called the beast, whether it's the vehicle. It's an SUV. No, the bees, my understanding, according to this. Okay, okay, okay. That was very Joe Pesci, meet the wedding day. Okay, okay, Leo, remember Leo. "The White House is looking to Virginia senator Mark Warner to help thaw out its frosty relationship with senator Joe Manchin in hopes of resurrecting president Joe Biden's build back better plan. To senior Senate sources of that Warner, one of Manchin's closest friends, and its former housemate will be involved in any future BBB talks. Manchin has said publicly that he's not negotiating with The White House, privately, he's been even more pessimistic, so to source close to Manchin, quote, he's not in the mindset of moving forward. Mention is complained about a lack of quote effective outreach or reset by top White House aides and blamed them for making the BBB negotiations to personal. Manchin has spoken to Steve rochette, Biden's hope whisperer, once since Christmas, but he's still angry with chief of staff Ron klain, who he believes told press secretary Jen Psaki to quote unleash the dogs in a heated White House statement after the senator announced on Fox News Sunday that he was no on the BBB. Spokespeople for both Warner and Biden demurred about the specifics of their Virginia senator's exact role in the effort to win over Manchin, a Warner spokesperson told playbook quote, senator Warner and senator Manchin are good friends, the toggle regularly, sometimes about policy, and sometimes to just shooting the breeze. I wouldn't call those conversations negotiations. Said White House spokesperson Andrew Bates, quote, a wide range of members are working on build back better. But senator Warner's not negotiating on behalf of The White House. However, they want to characterize the effort, they're still far from having mansion on board. The source close to ancient told playbook, I don't think they'll be able to coax him back into the BBB. He'll listen to Mark Warner, but he won't do what he wants. Also training the mansion lobbying effort, former president Bill Clinton, earlier this week, the big dog pitched mansion on supporting both BBB and voting rights reform. Still, Manchin seems unmoved. In meanwhile, a senior Senate source said that The White House discussed repackaging build back better by breaking off a piece or pieces of policy to revive the talks, adding that negotiations are still ongoing. News outlets flooded their feeds with coverage commemorating the anniversary of the January 6th insurrection, debating its effects on American politics and even occasionally shedding new light on the horrors of the day. "Presented by blue cross blue shield association. Hey, what's a playbook or something to fall in? It's Monday and good news for people who like bad news. It's the return of debt ceiling drama. This is your political playbook daily briefing. Here's your scoop of the day, Politico's Betsy Woodruff's swan and Meredith McGraw report that, quote, a former D.C. National Guard official is accusing two senior army leaders of lying to Congress and participating in a secret attempt to rewrite the history of the military's response to the capital riot in a 36 page memo, colonel Earl Matthews, who held high level National Security Council and Pentagon roles during the Trump administration. Slams The Pentagon's inspector general for what he calls an error riddled report that protects the top army official who argued against sending the National Guard to the capitol on January 6th. That delayed the response to the insurrection for hours. Matisse's memo sent to the January 6th elect committee this month and obtained by Politico includes detailed recollections of the insurrection response as it calls two army generals, quote absolute and unmitigated liars for their characterization of the events of that day. Matthews has never publicly discussed the chaos of the capital siege. You can check out the rest of that story in today's playbook. Lawmakers return to Washington this week for what could be the trickiest issue of the month, the debt ceiling. House democratic leaders have discussed adding a provision addressing the dead ceiling to the final NDAA and voting on the as soon as this week. That's according to a senior democratic aide. That's assuming, of course, that compromise NDA language is ironed out between the two chambers. Senate minority leader Mitch McConnell has privately signaled to majority leader Chuck Schumer that he could go along with this idea, which would end their months long stalemate. But there are serious questions about whether this defense debt ceiling sandwich could pass the House. And much of that is because of one man who might typically be aligned with McConnell, but on this issue appears opposed. Kevin McCarthy. Before we get there, let's take a look at the tricky math. On the left, there are 38 House Democrats who voted against the NDAA, the first time it came to the Florence of timber. That was namely progressives who have long opposed the overall size of The Pentagon budget. Democratic leaders believed they could pick up some of those 38 if they tack on the debt ceiling solution, arguing it simply has to pass. The question is, how many do they get? They don't know yet. On the right, democratic leaders expect many of the 75 House Republicans who help pass the NDAA earlier this year will pill off if they added debt provision. That's especially true if they receive pressure from maga world, the freedom caucus or even GOP leaders to oppose the pairing. Still, Democrats who are a fan of this idea hope, a mix of defense minded GOP hawks, loathed to oppose any defense minded Bill, and more moderate Republicans eager to avoid default could compensate for any progressives they lose on the vote. They also acknowledged that this proposal could fall totally flat, leaving them scrambling to find another move this week. House minority leader Kevin McCarthy panned the NDA Dutch elling idea twice last week. Albeit rather gently. He said he doesn't think Democrats could get the votes and encourage the party to raise the debt ceiling on their own music reconciliation. As McConnell has been saying for months. Democrats seem to be hoping that McConnell can persuade McCarthy to give just enough GOP lawmakers and inconspicuous green light to vote for the combo and send it to the Senate. That seems naive, but he wants to be speaker and will almost certainly come under pressure from the far right to take a position and enforce it. We reached out to McCarthy's team last night to find out if he intended to whip his members against this bill, but didn't receive an answer. Here's the question, is there a plan B if this fails? Should wear McConnell's offices have been very circumspect about their ongoing dead silly negotiations? The two haven't been out there bashing each other or making demands on the issue the way they were a few months ago. Notably, McConnell hasn't been heard lately insisting Democrats need to use reconciliation to address it. Perhaps that's a good sign, but good feelings alone won't get the job done. Get ready for another crazy week. Here's what's up in Washington today, starting with The White House. President Joe Biden and vice president Kamala Harris will receive the president's daily brief. They have the documents that are being asked. The requests are directed to the current officials. who head the different agencies. That's important because these are none of these people obviously are trump apparatchiks now the steps that trump could take and which are statement. He put out tonight indicates he probably will would be to sue to ask a judge to block those different components of the government from participating and from producing these records. How hard the department of justice lawyers work to shoot down. The increasingly harebrained legal strategies that reached the president's desk trump brought up the fifty four page legal document in a phone. Joe Arpaio a law enforcement officer who is targeting Latinos for harassment and using the power of the police deliberately against a minority group and he pardoned him of criminal contempt of court that the way in which he plays with this. I think Dolly Elliptic who some times on this show referred to the `constitutionalisation of narcissism is what we face in this country. Yeah IT DONALD. Trump wants credit of also doing first step back kinds of criminal justice reform. He wants credit for that. But but do you sense in the pardons that he's doing especially today that the real message here is his own power right that he's essentially saying if you're powerful and you're my friend that is actually how you get a justice not by being somebody who was falsely accused of a crime or got too long of a sentence for having marijuana or something like that. That's why there's absolutely the absolute absence of any sense that the people pardoned held they compared with the culpability and the sentences of the tens and tens of thousands who remain in federal prison. The idea that he can act on on Mir welcome. I think something we've never seen the president before you know. Some people are going to raise the a Bill Clinton's pardon of financier and fugitive Bark Rich. And that was the worst thing. That's now closed into Andrew McCabe and the judge literally said that the fact that trump was tweeting about McCabe so often the fact that he appeared to be interfering in that process created the appearance of a Banana Republic. So the thing to keep an eye on both the president of course granting clemency to people who he views as his political allies in part because he sees them on Fox News and the inverse of that which is the president encouraging DOJ to weaponize itself against people who he sees as his foes. And I'm glad also that Mister Diligent Joe Arpaio because they're also sort of symbolic arden's of people who are hurting the People Donald Trump's base wants to see hurt.
