But this, they could, you know, you know what, my greatest concern about yesterday was Eric Trump carrying an interview with Sean Hannity. Eric Trump said that the president's attorneys were not allowed to observe what the FBI was doing inside Mar-a-Lago. My concern is not what they took out of Mar-a-Lago. I had forwarded to him from a respected lawyer former inspector general for Don rumsfeld. And then they also took a video quickly where I was on Fox News talking and I was on Maria bartiromo show and the video clip started off with me saying January 6th is the ultimate data significance in a presidential contest. What they left off was the sentence right before that where I said the late justice Ruth Bader Ginsburg said that January 6th is the ultimate date of significance in a presidential context because that's when you actually approve the electors. And that changes the entire context of that statement. So we saw that and then, of course, maybe the most important was when Zoe lofgren I remember the committee said, we don't corroborate witnesses testimony. And they didn't ask pat cipollone when he was deposed if what Cassie Hutchinson said about him was true. And his lawyer reported afterwards that if he had been asked to say it wasn't. So that's 8 different false things we've gotten from this committee. And Todd, we don't get to see the evidence. We don't get to sitting on the depositions. We don't get access to the transcripts of the video, the documents they have. We don't get any chance across examine. And so imagine how many other lives they've told the American people if we've caught him in 8 with that limited amount of ebb and we get to see.

And he's wearing, I mean, he's a heavy set guy and he's wearing a bright orange vest and a gas mask that looks like one of those orange cones that you would see at like a, if they're doing some traffic repairs. And then he's got a yellow construction at. In other words, if I saw somebody like that, walking around, that would catch my attention. But nobody seems to know where this guy is. And you've got what was it, oh yesterday, we had Bernie Carrick on the show, the former NYPD commissioner said, look, they've got what 55,000 police officers walk in the streets. And I think they're going to find the guy. But there's a good chance that he's already long gone. But this guy, the suspect. He is a Frank James is the guy's name. And they can't find him. Among the victims, a bunch of kids that were on their way to school, young teenagers, I think of the 12 year old was the youngest and a pregnant woman, and you know, we talked a lot about the bad things that are happening in this country, and no doubt that was a horrible tragedy yesterday. But the images I saw that impressed me were just strangers coming to the rescue, they were there helping they were doing what they could to comfort the victims and they stayed. Just what during rush hour a couple of hours ago now, in the 8 o'clock eastern hour, a masked gunman opened fire inside a subway car. And the latest information we had, the latest Intel 13 people are 13 people have been shot. And we know a lot of people have been hurt. So there is a manhunt underway at this very hour for the gunman who is described as a black man about 5 feet 5 inches tall, wearing a New York City MTA uniform. That's the subway system there. The metro transit authority wearing a uniform and wearing some sort of a gas mask. Now the New York City fire department is telling us that they uncovered a number of unexploded devices. We don't know what kind of devices those were. It looks as though from the video and we have video up on our website Todd stern's dot com. It looks as though from the video that there was some sort of a smoke device smoke bond that was detonated. It was very smoky inside the subway as people and the video we have on our website, the video shows people just literally running out of the subway car as soon as it came to a stop. Now, if you are unfamiliar with New York City and rush hour, I can tell you that it is normally wall to wall people. What's weird about this attack, it did not happen in a tourist area. So this happened in an area called sunset park, which is in Brooklyn, so this is a large neighborhood. And the people that were on that subway were heading into, they were heading northbound, so they were heading into the city for work. So if, in fact, this turns out to be a terrorist attack, and at this point we don't know. We're going to be speaking with the former New York City police commissioner, Bernie Carrick, he's going to join us and give us an update later on also any second now we're expecting New York City councilmen, Joe borrelli to call in to give us the latest Intel and what he is learning boots on the ground. and vice chair of the House committee investigating the assault on the capitol on January 6th said the committee is learning more about what transpired The White House during the 187 minutes from the start of the siege to former president Trump's eventual suggestion that his supporters leave the capital I've been talking to former federal prosecutor Robert minz a partner mccarter and English Another thing the committee is trying to do apparently is trace the funding of the rally how the organizers and the vendors were paid what was happening in that war room So what did that lead to if it's found that some members of Congress or perhaps the former president were involved in funding of the rallies Well I think what the committee is trying to do is to create a thorough or record as possible about all the events during the insurrection and leading up to it And that includes funding that was raised privately They have been raised in conjunction with some Congress may have been raising in connection with some elected officials but they're trying to figure out exactly how this event unfolded And what were all of these steps that were taken that led up to this interaction So one of the key things are looking at is the money They want to know where did funding come from to help plan this rally perhaps to bring people to Washington perhaps to in some way assist in what ultimately turned into a violent insurrection So they're trying to trace that money But even if they can show that people were involved in the fundraising they really need to show that there is some link between the fundraising and the ultimate violent acts that occurred on January 6th So tracing the money will be illuminating It will show how these events unfolded but it's certainly not enough to show that anybody involved in fundraising was necessarily involved in any criminal conduct unless there was some evidence to show that those people who were involved in raising money also knew that there could be some kind of violent acts on that day There's been evidence of this grand plan and also Bernie Carrick turned over some evidence over the weekend And one thing he withheld was a draft letter from potus to seize evidence in the interests of the national security of the 2020 elections which people are saying is to seize voting machines If there was a grand plan to seize voting machines I mean what would it have to be to reach a criminal level Well again I think the fact that there may be some evidence out there of plans potentially to seize voting machines there was the infamous PowerPoint that has already been turned over to the committee a plan in order to try to deny the electors in order to affect the electors and to allow vice president Pence to choose different electors But there is no evidence so far that has been revealed by the committee that shows that former president Trump took any action to further any of these proposed schemes any of these steps that could arguably have been used in order to in order to overturn the election But we haven't seen evidence that the president took any step to further that and that's really what the committee would have to find And I think that's why they want the information that the president and that former president Trump is continuing to withhold to know to try to determine exactly what was said to the president and what his response was But still at the end of the day regardless of the dialog that may have gone back and forth the committee will have to live with the acts that were actually taken as opposed to conversations that may or may not have taken place And so far there is simply no evidence that president Trump decided to take any action despite the fact that he was apparently presented with a number of plans that could ultimately have interfered with the counting of the electoral votes So you mentioned the possibility of a criminal referral Some experts say that it's dangerous for the committee to make a criminal referral Because it might set a precedent for future presidents and a precedent for future lawmakers Well it is something that I think the committee needs to be very careful about because congressional committees are not criminal investigatory agencies They don't investigate crimes that is not their function Their job is to conduct investigations in order to consider future legislation to deal with issues that may they have the right to investigate incidents that happen but with the goal towards writing legislation to prevent those incidents from happening again in the case of the insurrection that occurred on January 6th So the concern here is that if it appears as if this committee is more of a criminal investigatory agency rather than a congressional agency looking to try to determine what type of legislation might come out of this hearing might come out of these hearings in order to prevent future conduct it does set a dangerous precedent And the committee has requested for example interviews from a couple of Republican congressmen Scott Perry of Pennsylvania Jim Jordan of Ohio Both of these individuals were allegedly involved in the event on January 6th Jim Jordan with respect to his conversations with president Trump on January 6th Scott Perry allegedly linked to unsuccessful efforts to get president Trump to get the Department of Justice to intervene.

All states that had a GOP legislature is the fix in a good sense. Is it being fixed? What else is left to do? And is the GOP up to the jobless of stopping the Democrats next time? That's the big question. And I think some good things have happened, but not enough. And it's really kind of two part, right? And this is kind of why it's ridiculous to say, oh, just look to the future. You can't just look to the future if you don't fix what happened in 2020 because it'll happen again, it will happen on a more massive scale if there's no accountability. So one thing I really want to see. And there have been a couple Texas passed a bill. It's usually a good sign of Democrats flee your state. If they run away, they run away and hide before a vote. It means you're probably doing the right thing. That's a very good metric, please. You're right. So I'm happy about what Texas did. They really should have had an audit though because I mean, let's not kid ourselves. I mean, president Trump won that state by a huge amount. But there's cheating there too. And the real problem is they keep the goalposts to make it kind of acceptable because they're planning ahead of how they're going to cheat. So they did it in Georgia. They say, oh, this could be a toss up, you know, Democrats might have, oh, this could be trending purple. That's a very long view plan of what they're doing in getting these corrupt consent agreements in changing the rules in manipulating the voting process. That game plan is also a foot in Texas. Texas is not trending blue. It is redder than ever. But they need to make sure that the cheating, which I believe a lot of it has to do with the voter registration rules. There was just incredible hearing in Wisconsin that exposed how inflated the voter registration rolls are a 119,000 active voters have been registered for over 100 years. And the amazing thing is, all these cities and all the counties in Wisconsin, they are voter registration roles are totally inflated right before the election and then after the election, all these voters suddenly get switched to inactive. And then they get turned back on before the next election. So there's a lot of manipulation going on. So number one thing is keep exposing 2020. And make prosecutions in Arizona, there was an incredible audit that showed tens of thousands of potentially fraudulent ballots. Just open and shut really. Evidence also of them destroying election records, which is a felony breaks the state law as well. We need prosecutions. We need the attorney general, the district attorneys to bring these charges like we did see in Wisconsin with the local sheriff doing that investigation of the battle harvesting and nursing homes. If there's no accountability, people are just going to do it again because they can with impunity. In weakness is provocative, right? And so if you don't punish people for clearly violating the law, they're just going to get more emboldened and do it worse next time. So we need to pass reforms in the state legislatures. We need to do more Georgia's Bill was okay, but they really didn't shore up the mail in voting system. They basically moved the drop boxes from outside to inside. That's a joke. We need to get rid of mail in voting like France did back in 1975. No, absolutely. I have one request, please forward it to the president. I'll tell you when I see him next as well. We are not the red party. The only party that thread are the communists. Flip the colors 15 years ago just before he died and everybody agreed with him across the planet conservatives are blue commies are red. So guys, let's flip the colors back. We.

That's how they treated a small company in their hometown. China got rich off of deals like that two cents, three cents, one cent. No national loyalty, no commitment to your fellow countrymen just profit seeking enrichment. And you know who else got rich off China? Hunter Biden got very rich, and so did the Biden family with us, who knows a lot about that Miranda Devine who is just spectacular and really special Miranda. Welcome back to the Charlie Kirk show. Thanks so much. Charlie, great to be with you. Thanks for having me. So your book is doing very well, laptop from hell, very direct to the point. Tell us how the book is doing. Remind our audience kind of how and why you wrote it and then I want to talk about Biden's connections to China. The book's done very well. It hit number one on Amazon day one. And I ended the week number two overall. So I think there's a hunger out there for the truth about what was on Hunter Biden's laptop. At the New York Post, we tried. We image our Morris, my colleague, wrote some brilliant stories, three weeks before the election last year with some of the most damning emails about Joe Biden that were on the laptop and which were denied by him and which showed that he had met Hunter Biden's business partners, something that he denied during the election campaign. So I think that people want to know one way or the other, and I've tried to write it not as a polemic, but just as a straight piece of reportage. Using not just the laptop, but information from Tony bobinski and also from the Senate inquiry by chuck graslie and Ron Johnson. Yeah, and I hope if Republicans take back Congress, they will depose Hunter Biden for some of these questions. This very serious stuff. So let's separate some of the kind of chatter online fact from fiction. There are some people that say on the laptop, there were potentially compromising or illegal images. Is that true? Did you find that in your journalism looking into this? The very least there were probably some unsavory images, but tell us a little bit about that. If you are referring to the chatter online about pedophilia, could affiliate images. No, I didn't find anything like that. I mean, there was a photograph of a young girl aged 13, 14 at the time. And this was obviously taken in like a school bathroom with some friends. They were all putting on makeup in the mirror. She's seen in the background getting changed. And the image just captures part of one of her breasts. And that was, you know, enough to scare Rudy Giuliani and Bernie Carrick. Rudy Giuliani when that picture was brought to his attention by one of his staff that was going through the laptop. He asked Bernie Carrick if this was a notifiable image in terms of you have to notify the authorities if you find child pornography. And Bernie Carrick former commissioner of police said, yes, under New York law, technically it was. So that frightened both of them enough to take a copy of the hard drive and deliver it to the Delaware police. And they were being scrupulously careful in that case. I've written about that. I think that that is one of several images, not several. Thousands of images that were downloaded onto will upload it into the cloud as part of a family sharing situation of photos. And there were a lot of pictures of children from school outings and various things that kids do with their friends, sporting activities, and so on. That really had nothing to do with time to very childish stuff that was just part of, again, his big part of this family sharing operation. I think they were downloaded onto his laptop, which had tens of thousands of images. Some of which were just completely random and had nothing to do with his life. So I've laid that out, but I don't see any evidence that Hunter Biden has a taste or an interest in underage women, all the sex, he filmed himself having sex with hundreds of women and somebody uploaded onto websites like Pornhub, but all these women were fully grown. So none of the others, some doctored images online. I think there's and I don't like dishonesty being reported about the laptop because there's such wrongdoing on the laptop. And if you make up something or you exaggerate something, you're taking away from the wrongdoing that does existence for which there is evidence. No, I totally agree. That's why I asked because there's so many rumors and nonsense and chatter at times. And so let's just talk about the significance of this. Here you have a laptop from the now president's son that almost no one in the media cares anything about. I mean, you've been in this world for quite some time. Can you talk a little bit about this before we go into more of the details of just how extraordinary the effort has been to ignore this? I mean, it takes more effort to ignore it than to report it. It really does. We saw that when the New York Post first published it in October, we saw the heavy hand of big tech Facebook and Twitter came down and centered it within hours of it going up online. And that gave an excuse to the Biden friendly media, the anti Trump media to then ignore and introduce our reporting. And then on top of that, you had this extraordinary intervention by John Brennan, the former CIA director and 50 of his fellow former intelligence.

Okay, let's talk about the latest iteration of the targeting of conservatives by law enforcement. We have the January 6th commission. We have the narrative of an insurrection occurring. The only people who died were protesters, a woman shot by a police officer and other woman who according to Julie Kelly, assume we will have the evidence was beaten to death by or crushed. Crushed in the cross will be one of the tunnels underneath the capitol. That story is about to erupt. And then we have hundreds of people who have been tracked down geolocated thanks to Verizon AT&T accused of misdemeanors like trespass and then put in solitary. Can you talk to us during Victoria on the latest developments, the subpoenas against people like my former colleague Steve Bannon and others? And the approach of mock Meadows because he's taking an interesting tack isn't he with his response in the commission subpoena? Well, Mark Meadows was originally cooperating with his lawyer, but then they began to raise issues of executive privilege and the committee said they wouldn't recognize those. And they said they were going to then Mark suspended his cooperation. And then they said they were going to have a vote and refer mark for criminal contempt prosecution, which the Garland Justice Department will no doubt put into play because they are politically completely politically motivated at the Justice Department. Now under Garland, I'm very very, very sad to say. So wisely, meadow has filed a lawsuit in United States District Court, challenging the legality of the subpoenas claiming they are overbroad that they do not really constitute the legitimate means that Congress has at its disposal. But he has another issue. And that to me is the more important one, because I don't know that the courts are going to get involved in whether the subpoenas are over abroad. This is a little your courts to interfere between the branches. But he's challenging the legitimacy of the committee in the suing. His father civil lawsuit in the United States District Court stopped the subpoena but one of the issues is, this is not a valid committee, because the Nancy Pelosi the first time in the history of the country rejected the people the GOP recommendation. Yes. That Kevin wanted to put on. And he said I'm putting my own people on it, which is the Cheney and what's his Kissinger? We hate Trump the most, of anybody in the world people. And so it's not a legitimate in my house. It's not a legitimate committee. They would have been smarter to have said, okay, we'll take our four Democrats and you have your three Republicans, and then the four Democrats could have voted to subpoena him, and you wouldn't have the issue. If it's an illegitimate, can you put this into context with, for example, the left darling of Watergate? How talk about how overreaching? We're talking about the chief of staff of the president of the United States. And they want chapter inverse his communications, have we ever seen anything outrageous before? No, because this is so different from Watergate where there was evidence there were tapes with Nixon's conversations. There's nothing like that about Trump. There's no direct testing about him doing anything wrong planning anything being involved in anything illegal. So what the committee is doing is this is a political activity. This is a strategy to create campaign material for the Democratic Party for the 2022 election. And that's fishing expedition. A fishing expedition, and that's exactly what Victoria is alluding to. I think actually they have a very good chance of getting some limitations placed on the committee because even the case is back in the 1950s for contempt against the communists. The Supreme Court went out of its way to say that Congress's power in this area is not unfettered. There are limitations. You just can't investigate private citizens. And that's what they're doing here in essence. But they are doing it even worse because I had my telephone records taken by Adam Schiff. On the one justification. He doesn't have to. And I talked to some Republican members of Congress and they can't remember one it was ever done. John Solomon had his. Well, definitely. Devin Nunes. They took cash Patel. It's a Justice Department does it. It has to go through a judge in the judge has to determine they have to establish probable cause for a reason. This is just a request to the companies and the companies that really want the phone. With an instruction that they are not to notify the telephone customer. So no reason and then they can publish it, which the Justice Department can't do when they get it by grand juries. You've mentioned some of the other people who've been subpoenaed. "Yeah. After the Secret Service, escorted Pence out of the Senate because of the incoming violent insurrectionist mob. Jacob, emailed mister eastman to criticize him for pushing the vice president to stop the proper certification of those votes. Jacob wrote to eastman, thanks to your bullshit, we are now under siege. Eastman responded to siege is because all caps you and your boss did not do what was necessary to allow this to be aired in a public way so that the American people can see for themselves what happened. Apparently referring to former president Trump's false claims of voter fraud. After the insurrectionists were cleared from the capitol building in pence and the joint session of Congress returned to the House chamber, eastman still did not relent. Instead, he kept up his pressure campaign, writing another email to Jacobs, saying that Pence should still not certify the result and in fact should use the insurrection as a new justification. This is astonishing to me. Eastman said, look, you're already in violation of the electoral count act because you allowed debate to extend past the allotted two hours and you did not reconvene immediately end quote as the statute requires. So you should now use that as a basis to say the electoral count act doesn't matter. Like, since we're in violation of it anyway, I just get to decide. That's astonishing and terrifying. And next that eastman then, of course, lied about all of this in public. I already mentioned he did a little tour of Fox News and he there was a puff piece in the national review that was repugnant that they allowed that interview to go forward. Eastman then says basically like, well, you know, I was just kind of kicking around some ideas. And, you know, it would be crazy to actually do them. The evidence is overwhelming that that was not the case. He was not just like, you know, sort of throwing out, you know, somebody might argue X but was in fact actively attempting to persuade Mike Pence to lead a coup. The arguments were that he advised that it was, quote, a fact that the constitution assigned to the vice president exclusive and unreviewable authority. And that's the whole point of kicking out the electoral count act, right? The idea is, okay, you get rid of this law that Congress passed and who knows what that means. The vice president has the inherent power one to violate the electoral count act of 1887 and the concurrent resolution of Congress incorporating it by two receiving certificates from governors of states that Biden had carried, even if there were no competing slates of electors from that states. And three, adjourning the joint session, number four, over the objection of both houses of Congress and without subsequent judicial review. All four points of those are wrong as a matter of law, objectively wrong on the order of saying the president could be 12 years old, right? Like it is. They are not found or they are direct, they're directly contradicted by the plain text of the constitution. In his public statements, and this is a really good illustration we've talked about like how you can argue conditionally. Eastman has offered three defenses to these charges. First, that the memorandum do not accurately reflect the advice he actually gave. And I'm going to speak to that in a minute. Second, the advice he gave was accurate. And third that he gave the advice in good faith. So I did say it, but if I did, I was right. And in any event, I did so in good faith. These are all and again, it's okay that they're contradictory. The argument he's saying is, well, I put this down on paper, but what I said to people was, this represents an extreme, almost crazy. And I keep using the crazy because that's the word he used in the national review. That was his description of his own memoranda. And he's like, look, lawyers, like, kind of outline stuff all the time. You were like, oh, we could kill a guy. That's what I said in the memo. But what I said is don't kill a guy. Yeah, not even with Eli, okay? And the memo to bar council accurately cites cases and points out that look a responsible lawyer does not put advice into writing that they then undercut and contradict in terms of rendering. It's the opposite of what you would do. You'd be like, here's what putting my memo follow the law, judiciously, do nothing wrong. Biden is actually the president. And then what you'd say is, let's do an insurrection, right? Yeah. Well, I don't know if I would call you a responsible lawyer at that point. You'd be better than John eastman, though. You'd at least be a believably believable, bad Lloyd, like a believable evil lawyer. Not this is not believable evil lawyer so far, right? So so there you go that all of that I learned from reading a bar complaint. Stop that really has not been synthesized in the public these are sources that are otherwise available, including a great Jacobs. But this also, I think helped me understand. Why was Bernie Carrick in that first round of subpoenas? I mean, other than, you know, he's a Giuliani henchman. But no, it's more than that. It was he was there in the war room. And they had a war room for an insurrection. Okay, all right. I'll bring myself. Who can get in trouble for this and how? You know, like I just, are you allowed to anybody break the law by having a war room for an insurrection? I don't know. Who's liable for what? Anything? Something? Look, there are sedition and treason statutes. And, you know, we don't have enough information for me to confidently say, you can make a case against eastman for sedition. But it sure looks like it. I absolutely would refer that over to the DOJ to investigate. At the very least, is he gonna be disbarred? Do you see? If he is not disbarred, you know, again, these things move slowly, but you know, we have seen, and again, it has to do with this is the community of people that are your peers, right? And you hear the instinctive. It's not just the partisan aspect. You hear the revulsion and the anger that I have that that, you know, people can say when I introduce myself to somebody at a party and I say like, yeah, I'm a lawyer and they're like, oh, like, Sidney Powell. That's offensive to my core. And that is offensive to the core of the people who are in charge of rendering out this kind of discipline. So when I say I'm a podcaster and they're like, oh, you mean like every single white dude and I'm like, yeah, like jokes. Yeah, exactly. That does fit. I do get that what I lead with the podcast. Do you get like 50% of the time? Oh, like Joe Rogan, and I'll be like, kind of like the opposite of that. I do everything I can to desperately not tell people that I do a podcast. Because I don't want to talk about it. I don't want to hear their politics, you know what I mean? I just don't want to get into it. Interesting. I lead with it because leading with I'm a lawyer is even worse. Who would have thought? Who are they not? The deal with government. Should I tell them I'm a Harvard educated lawyer or should I tell them a podcaster? They're a microphone. You mean like Alan Dershowitz? You mean like Ted Cruz? You mean, yeah, no, you're right.
