Yeah, Jacob has a, what is it? Stress fracture in his shoulder, am I getting that right? He has a stress reaction. Stress reaction. Well, let's show better than a fracture. Yes, considerably. And that's fans were like, oh no. What happened? Did you get worse? I guess a fracture is a type of reaction, but a reaction is not necessarily a fracture. A stress reaction. Distinction. But so bad. Reaction. And his right scapula, scapula, scapula is a funny word to say. As Jeff passon reported it, the positive, no damage to the muscles, tendons, or ligaments in the shoulder, which is a profoundly complicated joint prone to all sorts of problems. Found. Wow. But still not good. He will be shut down for up to four weeks before he starts throwing and is reevaluated. So he is set to miss a significant amount of time to start the season. Really, really a bummer. It is. It's not a total shocker, I guess, in that he has had a variety of injuries though, going back a bit, and I guess the greater worry was his elbow, right? It's not his elbow. It's his shoulder, maybe you'd rather have it be his elbow, it's not good either way, but all of my fears about degrom have been borne out. I was just always worried like he's too good. He's flying too close to the sun. He's throwing too hard to sustain this and he just has been breaking down constantly since then. So sucks for the mets, obviously, and for him, and it's his contract year, too, is walking here, right? So maybe it's time to assign Johnny Quaid over something or just the time to be happy that you signed Baxter's or a new trade for Chris Bassett already. But they have depth, but there's no replacing the best pitcher in baseball when he is on the field. No, there really isn't. And you know, I think that we all acknowledge that if there was going to be an issue with this staff, it was that they have not always been a great at staying on the fields, but you know. As people who I think enjoy being right, this is an area where we would have been quite content to be wrong. Absolutely. Well, we will be previewing the NL east next week, so I imagine that this could come up again. But in the meantime, mets fans, I guess you're used to this sort of news, but you never want to hear it. So we'll just do a quick little news roundup here because we are devoting most of this episode to emails and we will be joined by a listener and Patreon supporter Stefan lund for that portion of the podcast and a stat blast as well, but quickly here there was an interesting trade between teams who seasons we have already previewed. So on Friday, the White Sox traded Craig kimbrell to the Dodgers for AJ Pollock and then subsequently the White Sox announced that Garrett crochet, it sounds like we'll be having Tommy John surgery, so more bummer injury news, which it's always more of a bummer when we're like a week away from opening day or less at this point, and it's like, you're so close, just preserve everyone in amber at this point. I know that they all need to get up to speed and build up their strength and everything, but you're so close to just running them out there for that opening day start or the opening day lineup and then it's snatched away from them and from you and it sucks every time. But this trade is kind of intriguing, right? Because of course kimbrell was on the block and was a likely trade candidate. They held on to him for a while and then now it's just a straight up deal between contending teams for established veterans and there's no cash in the deal, the cash kind of equalizes. It's fairly close because they both have one year left on their deal, but then Pollock has an option with a buyout after that. And so if you include that guaranteed cash, the money is roughly equivalent, although this is one of those cases where as Ben Clements recently wrote the new CBA changes things slightly with this kind of deal just because of the luxury tax complications and calculations. It's basically like now if you trade someone like the competitive balance tax hit is recalculated at that point based on the remaining dollars in years in the deal. So it's not just the average and real value, but it's what is the remaining average annual value, essentially. So if a person's contract is front loaded or back loaded, then that could actually change the size of the luxury tax footprint for the team that is acquiring that player, essentially. So there are implications that saves the White Sox, I guess, a couple million here, maybe cost the Dodgers a couple million more. It's not a huge thing, but it's a new little wrinkle in the CPA and I'll link to Benton's blog if you want to see the details about that. But the interesting thing, I guess, is just that the Dodgers allowed can we Jensen to leave? Right. And now we're trading Pollock for Janssen equivalent in kimbrell who was dominant early last season and then kind of fell apart after he was traded across town in Chicago, so I guess the Dodgers are banking on the dominant kimbrell being back. And maybe people are questioning, well, why not just hold on to AJ Pollock and resign? Can we do it? And then I guess the answer is because that would cost more money. And the Dodgers are already spending a lot of money and this would have taken them over the newest and highest penalty or what the 290 million dollar penalty put a trigger the very highest tax rate and they wanted to avoid that. Yes. I have to note two things, which is that when we are discussing White Sox injuries, we can't say it's a bummer injury because that might actually concern Aaron bummer. But yes, it is an interesting trade for the reasons that you highlighted. I think that if you're Gavin Lux, you have to be thrilled because it's just opens up more applying time for you on the roster. I can appreciate how Los Angeles would look at this and say, we are trading from surplus in much the same way that the White Sox are although some of that surplus is obviously a bit more strained on Chicago's part now that we have this news around crochet. But we can trade from a surplus. We have we can not credibly be accused of not spending enough money. No one can level that claim against us, that seems like a lot. This seems like a good way to address a bit of an organizational issue you can have try and go back to really high leverage moments and be deployed as he needs to be and was to such great effect last year. And then you're going to just continue to have a really good baseball team. I feel a little bit bad. I imagine that this is purely about destination and not being sure. Kimbrell seems so happy to be on the Dodgers. When he just seems jazz, which I imagine is not in any way an indictment of his experience in Chicago, but it's like, if you know that you're a prime trade candidate, you don't know where you're going, right? And sometimes you go to a team that isn't as good as the Dodgers are, which, you know, would be easy since most teams aren't as good as the judges are. So it seems to make a good deal of sense from that perspective. Yeah, I don't know. And now I have to return to the injury thought and it being worse so close to opening day. It's like if you've gotten through most of being a character in the mist and then you haven't reached the last ten minutes of that movie yet. Right. Yeah, and I guess also kimbrell is very much a stickler for defined roles and specifically a closer role in this case. It seems to like that a great deal. It seemed like he attributed some of his lack of success with the white text or at least that was a speculation that maybe the fact that he was not closing could have contributed.

"Ben how are you? Doing well. Good. We are also joined by other bands. Ben Clements, Ben, how are you? Doing well also. I'm so glad to hear that. It's a big day. Big day. Huge you guys. Everyone's been waiting. The questions have been pouring in. When and where is the minor league free agent draft? Well, here it is. It's in your feeds right now. You are currently listening to it. The 9th annual effectively wild minor league free agent draft. Wow. When I fire most story traditions, yes, and then this will be your first minor league for agent draft. How are you feeling? A little nervous. I mean, not nervous, 'cause it's a minor league free agent draft, but a little nervous. It's an institution. It is a podcast institution. So you should be nervous. I'm nervous. We're all nervous. This means something. This has huge stakes, bragging rights. Look, I just would like to say the following, which is that I made a compelling case for Kuzma when we did this last year and you just happened to scoop me and I would like to say, I don't think you had the conviction increased month that I did. But you got to reap the rewards and this after I generously gave you the first overall pick allow for you to take faulty. So wow. So I drafted him, but you wanted him more. So really you deserve that playing time. Yeah, I mean, I remember saying, I think there is a sneaky path for him here to be a starter even though the padre's rotation is stacked because of injury history, and who was right. I was right. Me. Yep, I evidently had more faith in him because I drafted him before you did. So we'll get to the results of last year's Mario week for age and draft and just a moment, a little bit of banter first on our last episode. We had said that we might talk a little bit about the specifics of MLB's proposal to the Players Association because those had not yet come out when we were recording. As it turns out, I don't know that they're all that illuminating or in lightning. Impression at the time was that this was not an offer that moved the needle much. And that still seems to be the case even though we know about a few of the specifics here. So Ben, I don't know if anything in particular about what was reported caught your eye here, but it seems like this is just a way to click the can down the road, I guess, just to do something for the sake of doing something and I guess put pressure on the Players Association to essentially negotiate against themselves. Yeah, I think if you told me that prospects who played a full year and got rookie of the year votes would give teams extra draft picks and asked me what that would do for when prospects got called up. I don't really know if I think it would get them called up earlier or later. So it seems to me like it's just window dressing like it's something fancy that they can do and people will talk about, but I don't know. It doesn't really seem like actually an economic proposal so much as here's an interesting different way we could do things. Yeah, I have said several times on this podcast that I think that we deal perhaps too much in incentives when it comes to things like service time manipulation and trying to provide disincentives to service time manipulation and it strikes me always as the action of people who don't really want to do anything about it at all. I understand that crafting rules that address every edge case to make sure that prospects are promoted when they're ready has some difficulty to it that takes some doing, but like just write a rule that says you can't manipulate service time and at least have the grievance process address that directly rather than trying to carrot and stick your way through this, you know, it's just like embrace regulation, it's everyone's favorite thing. Yeah, and it included universal DH, of course, and there was 14 team playoffs, of course, and there was potentially an international draft, shoehorned in here, which was very taxes going up or the CBT rather going up from 210 million to a whopping 214 million which only 5% slower than if the inflation rate exactly. It's actually lower than it was in effect. Real dollars. So yeah, doesn't seem like this is going to get a deal done. I doubt anyone expected it to. But they did something. So they ended their 42 days of doing nothing. They have technically done something. And so now I guess the Players Association has to decide if they want to budge because the owners appear pretty intractable here. So maybe it's just going to be another game of chicken for a while and we'll see if there will be an immediate counter proposal or if they just sort of stand pat and say make us a real offer. Yeah, I did enjoy that Gigi Cooper at baseball America sort of dignified the prospect portion of this with some actual analysis and he found what I think we could all into it, which is that this isn't the top 100 prospect patina that was put on that piece of this is sort of unnecessary because typically the guys who are getting rookie of the year votes and MVP votes in Cy Young votes are guys who were ranked prospects anyway, who were top 100 guys introducing the potential rigmarole and conflicts of that process seems completely unnecessary and not really pointed at trying to alleviate service time manipulation at all. I also will say, I think there are a lot of public facing prospect writers who do a lot of really, really good work. And have an accurate understanding of who the guys are who are going to contribute the most to their big league teams. And I also don't think it's really appropriate for those folks to be involved in the process to this degree. So quit outsourcing your assessments MLB seems a little bit, I don't know why that's been a trend amongst the proposals that we've heard about so far, but I'd like it to stop, please. Yeah, I guess they largely dissolve the scouting bureau. So I don't know how you would do that. You can't use teams internal ratings really. So maybe you just shouldn't do that at all. But that was an interesting wrinkle. I mean, it's kind of a waste of time to dive deep into every point of every proposal because they're all just sort of markers along the road that hopefully will eventually lead to some sort of deal that probably won't really resemble the proceeding proposals. And all of those specifics. Yeah. More to come. We hope. All right, so a couple other non labor related things that we wanted to address. There's a new big Bill James study out on Bill James's website. Bill James online and it reaches an interesting conclusion and Bill seems pretty pumped about it. He tweeted about it and asked people to share it. And I think it reaches an interesting conclusion, although I don't totally know if I buy the magnitude of the effect. So essentially, he did some research into Hall of Fame elections and he found that players who jumped from team to team may reduce their chances of getting into the hull by 50% or even more compared to a similar player who stays with one team. And he didn't do this just solely looking at one team career players because there aren't all that many of them really, but he kind of quantified how much of a team switcher you are. Did you go to a ton of teams? Did you play for one for most of your career? And he found that it makes a huge difference. He said, if we take all of the one team players in history, they have 44% more Hall of Fame selections within the group than would be expected based on those players performance numbers. He also concluded that a player is more than twice as likely to be selected to the hull if he spent most of his career with one team than if he moved from team to team, at least within a certain threshold or below a certain threshold of value once you get up into the upper tiers then it may not actually matter. But if you're kind of on the border, then a single team player seems to be more likely to get in..

"It was a good game had pace. I guess like the first thing that comes to mind is like. Hey adam wainwright like we don't dislike you. He looked very good yesterday. He looked he looked quite good. I guess i'll say my piece on that now. Because i'm sure it's not going to do it on twitter. Like hey like half of us picked you go to the pussies. And before the year. And the way our playoff odds get calculated during the years like we don't augment them by hand and say like the cardinals cyclists like round like. We're not doing that any you know. What every athletes gotta do this thing where they put chip on their shoulder because playing the game on. Its own doesn't seem to be enough for them. Maybe that's the thing that you know. Adam wainwright's do at his age. I think he's an he is a great player. He's an awesome analyst. I look forward to what his career brings afterward. Yeah i think it's kind of young and dumb that he you know approaches thinking about stuff like this. The way he does that he feels the need to miss. Apply some sort of malice on our part to what the cardinals playoff odds were and it took a seventeen game winning streak and the poverty is absolutely tanking for you to sneak into the playoffs as the second wildcard which is like i said this yesterday. I'm going to repeat it today. Like it is what pluto is the planets. The second wildcard team is the playoff teams. So you know. I don't know how much he proved other than you don't know how playoff odds work and the only out of disrespect i have for rate. Has you know percolated in the last seventy two hours or so and none of them. None of none of it before like nothing. But universal love for adam wainwright. Yeah the paragraph people. So i'm an email this podcast episode with the time signature to bunch of people in the cardinals so they can get this to his ear holes. He's got plenty of time to listen to it now. so boy. yeah. I know. I got salty there at the end. Yeah you kind of did. I'm surprised i'm surprised that you got a little salty. I got. I'm going to stick up for my like. This is where. I work right right like this is. These are my teammates. So i'm going to stick up for them. Yeah i think that we like as human beings struggle with probabilistic thinking. I do not think that it is a natural mode of Moving through the world for a lot of us and so and it's not as if people talking about the site is bad for the site right. Even if i wished that the origin of the mentioned we're more positive. But i do think that it is the thing that we just as human beings are not very good at. I think this is a low stakes example of that on a relative basis. I think the the behavior of some people over the last eighteen months is a much higher stakes example of that. Which is why stuff like this. Tends to me out a little bit. Just because i wish we were better society at helping people kind of process these things which isn't save it again. Like adam wainwright drawing inspiration from us is like a really low stakes example of this but it does provide an opportunity for us to talk about how this stuff works so that as people are trying to better understand it they can and as i said yesterday like no model is perfect and we know that there are places where we could stand to improve our playoff odds but i think when ben clements looked at just how well those odds have done over the last couple of years. He put it really nicely. Right like a low probability. Run doesn't mean the probability is broken. It means something incredible is happening. And i think that the way that the cardinals ended the season certainly qualifies as that. And you know. They don't really have anything to be ashamed of in terms of their performance yesterday. Like when ben rhodes recap p put it. Well it's like it took until they're the dodgers like last possible regulation at bat for them to to get it done so he pitched well. Yeah i don't wear it is. It is a g like he's awesome. Yeah so disappointed. You know but this is just one of those unintended aspects of doing job like. Oh yeah this guy really doesn't know what the hell he's talking about but he's misdirecting anger generally at us and i don't know how you know it's just weird to think about how you handle that as a person. I know it was weird for me. It's like you imagine if like david lynch was like yeah the fan graphs. People there. I'd be upset for a long time. Yeah yeah well. Hopefully we will see him in the booth in the future and Have the opportunity to chat about the playoff odds. We would welcome it but we will. "By far patriot supporters. I make rally a fan graphs. And i am joined to ease you into the ben limburg. List month ahead by another bed. Ben clements. hi ben. How're you are you. I'm doing well i. I'm feeling some like stirring a fan feeling and it's it's unusual. Spent a little while since i've had that experience we're going to talk about some of the the work that you've done for the site over the last week in a little bit here but i thought before we talked about. How good are playoff. Odds are we could talk about the current state of the playoff race because despite the divisions all being pretty well decided except for the west we have something of a of a barn burner here late season barn burner this very exciting to burn. No we frown on that now but as we are recording this on friday we currently have a three way tie for the well. We have a two wait. I we have three teams in wildcard position. In the american league the yankees are holding onto their first wildcard spot and the mariners having not had to play yesterday had a great thursday and By virtue of boston losing to the orioles have have snuck into tie the red sox for the second wildcard spot in the blue jays. Losing is a big deal to the blue jays are now officially a game out. They were not able to pick up any ground against the yankees so well and then i guess before we before we get to the al. We should also note that. The dodgers the poor dodgers. You feel so sorry for them. Just keep winning keeps them. Yeah and it keeps not matter because the giants keep winning two despite the best efforts of some good team. So let's start with the american league. I guess the first thing. I'd ask you ben is like what are. What are your expectations for. How this weekend is going to play out. Well probably the red sox will lose a game. They shouldn't yeah. That seems to be the thing that they do their inability to move anywhere in the standings. Like they've just dropped a lot of very winnable games at times and it looks like they could just pull it the orioles series for example. But i feel like they've done that. A bunch yeah so. I think that they'll probably lose a game. They shouldn't let the right way to say it but just feels that way. I think the angels are pretty checked out. But you know they're they're going to put a whole team out there and shohei otani is pretty good hitter. Even pitch right. I don't think i'm smarter than a coin flip. But i'm gonna say. I want the mariners to win. So that's right but it'd be a lot more fun. Yeah i where do you stand on the sort of attractiveness of chaos are you rooting for tiebreaker. Games is that something that is exciting to you or are you a tiebreaker gay. Just one hundred percent unless my teams and then shirt. And you don't have to deal with that then the last time you were on this podcast when you you filled in for me in co host duties arizona vacation i think that other been. Oh now see. He is other ben while he is on leave. Now you are the prime ben. Must i think he asked you if you needed to talk about. The cardinals and your impression was that no. You did not need to do that. But that is accurate. May have been hasty. Yeah 'cause then they ripped off a seventeen game win streak in secured the second wildcard before we go back to the undecided races. Like how how you feel bad. It's pretty great. I'd feel better. If the dodgers weren't just looming a tough wildcard game but it's one game which is the ideal way the face the dodgers right. I'm glad that's gonna be adam wainwright pitching. Yeah and it's gonna be really fun. I'd i'd. They're obviously not favored in that game. But it's going to be great to watch and there's a lot of cardinals. Dodgers postseason clashes through the years that i have fond memories of. I hope i get another. But i don't expect..

With pressure mounting on President Trump, there's a new focus on a question that has come up since day one of the Trump administration. And he pardoned himself NPR legal affairs correspondent Nina Totenberg reports. Even before he was elected, Donald Trump had a grandiose view of his ability to defy political gravity. I could stand in the middle of Fifth Avenue and shoot somebody and I wouldn't lose any voters. Okay, It's like incredible. His lawyers would later argue that same kind of legal immunity in court and from the early days of his time in office. The power he appeared to relish most was the pardon power. It's near absolute. He need not consult with anyone. And early on. As the Russia probe began to unfold, Trump was asking aides whether he could pardon himself. It's a question he reportedly has returned to in recent weeks. The president does indeed have broad but not completely unlimited pardoning power. The Constitution gives him the power to pardon others for federal crimes. But he can't pardon himself from impeachment, and he has no authority to pardon for crimes committed under state law. Finally most, though not all constitutional law. Scholars believe he cannot pardon himself. Michigan State University law professor Brian called, has written extensively about the pardon power. While some scholars argue that that power is absolute, he says that allowing full pardons would violate that principle that no one could be the judge in there. Okay? Indeed, that was the formal legal opinion rendered by the Justice Department in 1974 during the Nixon presidency. But President Trump has openly enjoyed violating long established norms and pardons have been no exception. Harvard law professor Jack Goldsmith has examined all of Trump's pardons and sentence commutations. We determined that at least 85 of the 94 have some personal or political connection to trump and were self serving in that way. Goldsmith, who served as head of the Office of Legal Counsel in the George W. Bush, Justice Department. Observes that party controversies are hardly unique. What's new is the massive extent to which Trump has circumvented the Justice Department office charged with processing pardon applications. Trump loves to exercise the hard powers of the office of the presidency, and he especially loves to do so if he thinks there's something in it for him personally. And if he thinks it will make the political elites heads explode. Until now, no president has pardoned himself. Nixon contemplated it. But faced with his own Justice department's legal opinion that it would be unconstitutional. He didn't do it. Now, though, there's concern about creating such a precedent.
