According to a recent investigation about one in five complainants declined to submit to what has been. Called a digital strip search in every case, where a complainant refused to allow officers to download information from their phones, the cases were closed. They dealt with that year. The numbers are sobering. In twenty two percent of those cases involving a total of eighty four complainants officers made a formal request for access to digital information in one hundred percent of the cases where the complainant subsequently refused to hand over their mobile phone officers discontinued inquiry. That subset related to fourteen individuals. Admittedly, this is a small sample, but still the results are disturbing. The police digital consent form states that have access to this data is denied. It may not be possible for the investigation or prosecution to continue. It also says that if a prosecution does continue, the defense will be informed of the complainants refusal to handover material, and in order, requiring disclosure may be made big brother. Watch argues that these digital searches are highly likely to infringe victims, data, protection and privacy rights and are causing major delays to investigations. Digital processing notices which complainants asked assign were rolled out across police forces in England and Wales from April of two thousand nineteen. The forms are used to notify victims of crime, most commonly victims of sexual offenses and let the new that police will download that from their phone. A spokesperson for the National Police Chiefs Council said the digital evidence consent forms was introduced to bring consistency to the way forces were obtaining and recording the consent of victims and witnesses in providing their digital device for examination police have a duty to pursue all reasonable lines of inquiry in every investigation, and to meet their disclosure obligations under the criminal procedure and investigations.
