U.K. Supreme Court Hears Case on Parliament Suspension
"One of the unexpected side effects of the UK's decision to leave the European Union is that U. K. constitutional law the suddenly become interesting today eleven judges of the U. K. Supreme Court have begun hearing two appeals which could have a profound impact on the way the British government is able to operate whatever happens with the brexit process the cases relate to the reason given by prime minister Boris Johnson for the count five week propagation of suspension of parliament not long of course before the U. K.'s due to leave the E. U. on the thirty first of October opening the hearing the president of the Supreme Court lady Hale explained the limits of the judgment that the court will eventually reach it is important to emphasize that we are not concerned with the wider political issues which form the context for this legal issue. as will be apparent when we hear the legal arguments the determination of this legal issue will not determine when and how the United Kingdom please the European Union. we're joined now by our political correspondent rob Watson rob just remind us of the case is being heard. it's one case rarely and it's exploring this notion that Mister Johnson acted unlawfully in suspending PA month because in doing so he was essentially just trying to block parliament from doing what it's supposed to be doing it softens you say which was to scrutinize the work of the government to another what city was trying to avoid at the stresses that was not putting cold avoid disruption to his policy and that in the process he had misled the queen and indeed the whole country because he had said the reason for suspending parliament was to work on a new program of government so it's the moment what what have you been hearing well some details have been coming out well I guess there are two things which at which a striking one is that that central argument for the lawyers against the government that essentially that is that every government. every government the power that it has it must be exercised for a proper unlawful purpose and the try to get politicians as if your hair is clearly not a lawful and proper purposes they would argue I guess the other striking thing that came out was that was this reference to the fact that Mister Johnson marshals the prime minister had noticeably a failed to provide a sworn statements about his motives for for suspending Palmer's which Lawrence against the government so that was all rather suspicious and it's a question I suppose we've used many times over the last few years but rob just let our listeners know just how unusual this is this notion of the Supreme Court still a fairly young institution of course here in the U. K. at getting involved in such a deeply political case what will that is possible the arguments it is a band with him in as as the motivation for suspending Polemon something which happens every year is that any business of the judges but actually I think the really big issue have the bit where you really have to kind of potential self is the Boris Johnson a man who's only been leader of the Conservative Party for a few weeks and it's only been prime minister baffle for few weeks you pinch yourself he is basically in front of the court being accused of lying of misleading the country out of misleading the clean and this is pretty extraordinary stuff and and some of the politics of Mister Johnson and briefly on the timing because we're in this suspension period the moment not long until brexit day do we have a an idea yet of when the court might rule no we don't I mean I suspect it'll be sooner rather than later that they have the they gonna be having these hearings for three days it'll finish on Thursday slide through Beltre to shortly after that as possible and of course will be interesting to see to put it mildly what they rule I mean if they would set up hold the previous ruling of the High Court in Scotland that would mean Mister Johnson would have to call back parliaments it would also mean that it was sort of held up the identity of the. misleading the queen and country which is a full would be possibly a resigning NASA for the prime minister I guess if the colts throws it all out well still potentially oak for Mister Johnson because they may decide look this is not a matter for the judges but actually we're not saying anything about Sir the cleanliness of his motives if I could put it that way James as you did robots enough political correspondent thanks very

Also, if a loved the depictions kind of go towards both militarization and capitalization of Mars like in in science fiction because it costs so much money to go to space in our understanding of, you know, space exploration and our current physical ability to go there. You know, I have to wonder, you know, if a lot of times it's depicted as either a military zone or a capitalist zone because of all the money. It takes to go there. And if it's kind of just doomed to forever sort of live in these dystopia as I mean, maybe so it's it's funny. Because of course, you know, capitalism in the military kind of go together, especially when you're in kind of the early stages of occupying a space, and I always think about I I guess we're talking about aids tropes a little bit here. But total recall the original total recall where there. On Mars, and it is it's it isn't really a military. Just hopi. It's a capitalist dystopia, and there's certain people who can't afford air and who can't afford, and we see this expanse to like in the Beltre's who can't afford gravity, and it's this idea that yet, it's a harsh environment. Maybe it will produce super soldiers or maybe it will produce incredibly vulnerable populations who are kind of starving and and starving for things that we don't start for on earth. You know, like water and an oxygen although water we're gonna start needing to. We're starting to become Mars. Maybe. Yeah. I mean, so I guess a question I have is in your personal views, if if you Topi as and an even a slightly less than utopias like democracies are kind of just not things that seemingly will work when we think about the expansion of humans across the solar system are in in some science fiction the galaxy and you know, people being distributed and especially. In in the expanse. We see them distributed not only by distance. But obviously by gravity wells and Beltre's not being able to come back to earth without it being incredibly painful and things of that nature. You know, I is it something where it's actually kind of difficult to write about or think about Topi is or democracies when thinking about these sorts of physical limitations that space provides. Well, I think you know, there's people are always saying science fiction is written for our time. And I think that when you're talking about space politics, you can either go with that that like, okay? This is all a comment about what's going on now or you can kind of take the tack of. All right. Let's have a thought experiment about what really can be going on. And I think for most of history. It has been the former of like, okay, what's our concern or concern is the Vietnam war. So we're going to talk about you know, colonization we're gonna talk about the effects of on the psychology of the soldiers or. Is it the rampant capitalism? Okay. That's what we're going to be concerned with. And you know, I mean once you kind of realize that that is maybe what is going on it kind of puts perspective on things. I think a lot of the times people aren't always super concerned with what do we think actually is going to be the kinds of things that were considering I think the expanse may be a bit more than others because it is like very near future. It doesn't necessarily have like a strong ideological bent of like, okay, we're going to you know. Show the dangers of fascism or the dangers of capitalism or the dangers of communism or anything like that. And so that kind of allows you to tangle with those issues of okay, like, what are the resources that are important, and what would society be like? And you know, I don't want to give a plug for the show that I'm working on. But I think that do a pretty good job thinking about that. Yeah. Well, let's talk about things that are your personal favorite depictions or or things that get into some media areas that you've personally enjoyed you know, what are some depictions, you know, across books TV movie, you know, what what have you that?
