Paul Howard junior did say that there were a couple of factors that went into this charge and one of them was the idea that for so ever many minutes forty minutes twenty minutes whatever it was that Richard Brooks was just calm collided at one point I even jovial with the officers because remember he he fell asleep in a Wendy's drive thru he was hammered in point one oh wait we have with the blue on them which isn't hammered no but it's a point oh eight is your limit to above the limit bit would would get him a D. Y. likely there would be a chance that I suppose they just say Hey park your car call friends don't dwell he did tell them that he was within walking distance the distance of his home that he could just walk home but the thing is none of none of that I know what the DA's doing in terms of explaining that this was a calm thing made tents by the officers but none of that plays into the moment of the shooting and in those three or four or ten seconds before the shooting because as they went to handcuff for chard Brooks that's when he started to fight back that's when the wrestling happened that's when he grabs one of the tasers and then runs away the officers are chasing after him but as Richard Brooks turns around and tries to shoot the taser it one of them that's when the shots were fired that eventually put him down this officer could get life without parole the this officer could get death yeah but the question is is the DA gonna be able to prove the underlying felony of aggravated assault with a deadly weapon I'm because there are at least three aggravated assault counts and will it matter I mean it's it's it's very rare that officers are charged with a crime as very human more rare that it's murder in the line of duty and even more rare do juries convict them but is that changing well because of the big change that we have seen over just in the past few weeks I remember that the other specific and ends earth changing seeing in this case is that that second officer is going to testify against Garrett Ralph in this this was the day that is that is his aggravated assault charge for after the fact after he was shot yes so that's why he is not being charged with murder because he wasn't in the commission of a felony when he was shot and killed it we're after the fact yeah so that second officer still faces three charges including aggravated assault but he will be testifying against the guy who did the shooting we have had something quite remarkable happened in this case and it involves the testimony of the other officer David Brosnan because officer browse than has now become a state's witness he has decided to testify on behalf of the state in this case are what he has said to us that is within a matter of days he plans to make a statement regarding the culpability of officer Ralph but he indicated that he is not psychologically willing to give that statement today officer browse them hi ever has admitted there he was in fact standing on Mr Brooks's body immediately after the shooting the G. V. insanity that is the world of Dr Barbara Ferrer who wants to keep everything shut down indefinitely she's the one that came out and said end of July may be and they had to walk that back Jennifer van Laar has been talking off the record to several people that I've worked a long time in the LA department of public health barber for is only been there a couple of years and she talk to them into writing an open letter and I'm going to read it to you now this is an open letter from public health officials unlock the Los Angeles pandemic and they are failing to protect the most vulnerable while the firestorm of the pandemic in Los Angeles county continues in our nursing homes and accounts for at least half of all Kobe deaths in the county we need to step back and ask who led us into this mess and while I have the most vulnerable populations been needlessly exposed to this virus most heads will turn towards Barbara for rare a PhD in social welfare the current director of the department of public health an issue of ports to staff touted jurist having come from the Kellogg foundation and before that the Boston health department as the commissioner there but in truth none of her experience qualified her for the job here in Los Angeles where over the years we have faced and effectively manage serious communicable disease health crisis seats as Mrs for rare stepped in the role of director she replaced a career employee in the department Cynthia Harding who has had a very strong epidemiology background and who had actually done the job as acting director for over two years with doctor Jeffrey guns and Hauser as acting health officer for the same time period following the retirement of Dr Jonathan fielding during this Harding's tenure she consistently deferred to the health officers the face and lead medical decision maker for communicable disease outbreaks in our communities utilizing some of the county's top epidemiology and infectious disease physicians as well as experienced field public health nurses Dr fielding's legacy of open an active participation of experienced staff and managers during public health threats while also intervening to alleviate health disparities in disadvantaged and high risk populations is no longer the case in the department of public health under the current leadership communicable disease is no longer a departmental priority once miss Ferrer was appointed as director one of our first motives was to notify all department program directors that she was the only voice and contact with the board offices this broke down a chain of communication in place for many years that allowed local public health managers to assist constituents that compacted that contacted their local board offices about a variety of health issues and act quickly on public health threats ms for rare knows that they're not calling your doctor for Erica she's not a doctor is the only control point for board questions and communication in the department even now many managers complain that they don't know what's going on and are not being well utilized for the pandemic our only communication with them our occasional chips and salsa sessions or virtual town halls these questions need further investigation once the pandemic is quiet again this is an open letter for people that work at the department of public health who have had it up to here with the knot of Dr Barbara Ferrer here are the questions wanted barber for rare leave the Boston public health department and why did you leave the Kellogg foundation where she meeting number four why the series of highly experienced managers been transferred mysteriously loaned out of the department of public health the other departments or retired and number five did Barbara Ferrer mandate a large budget cuts to the communicable disease control unit in the months just prior to a pandemic remember Dr Barbara Ferrer does not come from a background of disease or epidemiology her platform for public health in Los Angeles is racial equity which I don't really see how it's a public health issue it's an issue but it's not we're nestled fairly related to public health if you ever watch these bloviating LA county press conferences the first thing Barbara Ferrer wants you to know after she tells you how many people they tested how many people got it and how many people died is the break down by race that's not the most important question at least in my opinion back to this open letter from employees of the department of public health that have had enough of Dr Barbara Ferrer but here the most important questions now as we are in the middle of this mess here in LA here's some more questions why did Barbara Ferrer ignored early warnings for infectious disease physicians when that apartment and broader public health community said Hey there's a problem number two and we've asked this question quite a lot here in KBC what was the LA marathon allowed to take place number three why is it county health officer Muntu Davis and M. D. in charge of the public health response number four why is Barbara Ferrer the incident commander for the pandemic as well as the chief spokesperson number five why weren't the nursing homes in early point of control for the spread of sars Kobe too particularly after seeing the reports of what happened in Washington state in that nursing home number six why we're nursing home employees allowed to work at multiple nursing home facilities at the same time even before any testing was available and continue to even do so now number seven why did the department of public health director nursing home operators to accept covert nineteen patients rather than utilize the reactivated Saint Vincent hospital I think that's the hospital that they re open that they could barely get anybody to go to but now we put them back in the nursing homes why were nursing home staff were a symptomatic but tested positive allowed to remain at work why did apartment a public health get the rare I'm the mayor of recommendation to house homeless in city rec centers against the CDC recommendations why didn't miss Ferrer request National Guard medical corps from the governor to assist in disease control in these nursing homes which again if you look at the numbers is more than fifty percent of the deaths in LA county came from nursing homes and Catherine Barker didn't take her long to throw Dr Barbara Ferrer for miscalculating where we should've been focusing our response a couple more questions that the employees of the department of public health have here why did she hire an outside firm to process the data she uses rather than rely on the internal epidemiology staff at the department of public health why do we have sufficient data on nursing home deaths including at the state level what is the county extended contract doing outside M. D. to manage testing rather than rely on the staff that they have with successful community organizing for mass vaccination outreach efforts we have a public health department leader that expects a relatively small cadre of physicians and public health staff to control over four hundred nursing home outbreaks involving thousands of nursing home patients and outbreaks in shelters nearly sixty thousand homeless in our county current staff engaged in these outbreaks are exhausted and carry on valiantly without the consent of department level leadership instead relying on what they understand is good public health practice working long hours and making headway in this effort they deserve our support and thanks anyone with a depth of public health experience in dealing with outbreaks will tell you the controlling hot spots such as nursing homes would have been first on the list of community controls to stop the spread of cove in nineteen instead of making such pronouncements as quote you can walk on the wet sand but not on the dry sand at the beach deeply concerned local public health professionals there are people working in LA county that know what they're doing barber.
