I hear him come in and walk up on stage and you could hear him walking up on the age and then he said vicky. I'm in here. I call out his name on the only called. I'm in here in the usually comes right. Meet his routine me. So i'm working in. He didn't have right timmy. And then a couple of multiple stage again. Vicky and and i said i'm in here off name again and he didn't come to me and i thought what is he doing so walk in there and i flipped on the light and no one was in there. I got my camera. "There's several others on trial as well. And here to talk about the case or cases is Mike Balata of a lot of law, Federal criminal defense attorney and former federal prosecutor. Good Morning, Mike. How are you? Good morning, Kevin. How are you? Good. The first thing that sort of jumps out is why is it taking 20 years to get this guy and the others to trial? Yeah, it really depends on who you ask Kevin. The the one side. The defense side would say that Nick They needed the time to do some torture of the various individuals to try to get information and that they've been stalling because they're trying to prevent these Defendants from coming forward in explaining what happened to them and others. So there's that point of view. But if you ask the government, they'll say, well, It took us years just to get just to get these. These classified documents declassified that the defense needs to participate in the trial and So it really depends on which side us and and the government will office point of the defense motions to to suppress or keep out certain evidence, so So so as this thing starts to happen, what? What are some of the key points? And what are some of these people charged with? And what are they facing here? Well, they're charged with obviously conspiring to attack the United States on the September 11th terrorist attacks. Conspiring to attack New York City considering to attack the Pentagon. Conspiring to attack the capital building, and they're looking at their looking at life and death. In other words, if it can be convicted of, you know if they're convicted in any of the principal charges they're looking at The possibility of a sentence of death. We have the federal death penalty in every state of the country to federal law. So even if even though Michigan doesn't have the death penalty, we have a federal death penalty. And that's what they're looking at. And so as as you look at this case, there's been a lot being talked about, and said about what evidence can be used in and can't be used specifically looking at confessions and how confessions were obtained by the FBI. There's been talk of torture and waterboarding and things like this. What one of the legal issues at stake when they they look into this? Well, what's important to notice early on, Kevin make the there were individuals that tried to challenge The, uh to fight for the rights of the people that were being detained. These they call them enemy conduct and say that the laws of the United States applied and that would include you know The rules of evidence, the rules of criminal procedure and such and in 2000 and three that the United States Court of Appeals for the D C circuit held that because Guantanamo Bay is not a territory, the United States Not in the protection of the laws. None of the constitutional amendments none of the right. In the United States apply to these individuals, So when we're talking about confession we're talking about. Normally, we're talking about hanging where their Fifth Amendment rights violated where they where they pressured to confess. With waterboarding or some other sort of quote unquote advanced, um, you know, interrogation method or enhanced interrogation of it, and and that just doesn't that that doesn't come into play here, and in fact, they're being governed by the rules of the Obama administration. Created out of whole cloth they created from scratch to apply to these proceedings, so it's unclear. You know what, if any protections these defendants are going to have when Of the military prosecutor decides to introduce the confession President Reports that the defendants were smiling and jovial in the courtroom. Uh, as a prosecutor, if you put the prosecutor had on what are some of the things that You're going to do to make sure that convictions come out of this trial. Well, you know, I don't think that there's really at least for the main defendant for KSM. I don't think there's really an issue of whether he's going to be convicted only because he himself has admitted. Multiple, multiple ways multiple different Florence that he was the mastermind of the terror attacks of September 11th 2000 and one so I don't think that that's going to be a you know, be a hard case to prove beyond a reasonable doubt. Even you know, especially in a military tribunal. What with You know the rules of evidence essentially suspended. Um and and they're being governed by whatever rules the Obama administration put into effect. Uh And certainly the fourth Amendment is not going to come into play and you know, as far as And recent searches and video here, so I think it's it should be a fairly simple The government to prove at least after the principal defendant ks out because Cheikh Mohammed to prove his guilt. What kind of message will this trial? Uh, send around the world? I mean, will people be watching this closely to see how how the United States handles itself? What comes of this will, uh, we'll you know we'll terrorists around the country act out if if, uh if and when this guilty verdict comes in You're talking about people watching it around the world. It's not going. You're not going to watch it the courses you're going to be able to come unless you're the lucky people that are part of the 53 people at Guantanamo Bay behind the large flat while or you're at Fort Meade. Based in Maryland, watching it on course circuit TV. You're not gonna see it. You're going to the general public is going to see a transcript that supported with a day one day delay. That any kind of classified material that was weeded out. And so if you're not really going to get to watch it or follow it, but to go to going to the substance of your question, I believe the message that it sounds. It is not a good one. I would have liked to have seen The United States handle this case like they handle the blind shade case. Omar Abdel Rahman, who was was the principal of the 1993 World Trade Center bombing that killed six people, and they actually tried The blind shake in a federal court in Manhattan in New York City, and they afforded him the protections and the trial went fine. And it was all done transparently. It was well done. And certainly there were classified documents and there were there are security issues there, but they were able to handle them. So we've proven that we can do it. And I think that the message we're sending now is network. You know, we're basically supporting this..

"The FBI Indianapolis bureau failed to act, according to a DOJ inspector general's report. Investigation shows reports were made to the FBI and the FBI failed to act on them. As a result, dozens of young girls were sexually abused. One FBI agent in the office, apparently at the time, was hoping to get a new job with the Olympic Committee. Should they be criminally charged for failure to act? Should people be fired? What needs to happen to make sure this never happens again? Join us now is Michael Balata of Balata law. Michael also worked for years as an assistant U. S attorney. Welcome to the show, Mike Thank you, Kevin. This is troubling on so many levels as you look at this DOJ Inspector General's report what jumps out at you? Um, um, a few things. First of all, Let me just start by saying that the FBI and I've worked with them for about 22 years. So the gold standard. Uh, an investigative Agents when it comes to criminal cases, So this is shocking to me, really when I read the report. And exactly on multiple levels, as he said, First of all the fact that they were conducting interviews of minors on the telephone and not recording In a written report what was said or what the allegations were. That's the first thing that jumped out at me and then, of course, And they sat on it for about a year. I didn't do anything with it. And meanwhile, additional victims were abused by Dr Net mask herself very troubling to me. What are some of the absolute initial steps that should have been taken that appear to have not been taken in this case? Well, first of all, doing what's called an FBI three to a report. Of someone talking about a crime that happened to them. That would be the first thing. Um, the next thing would be Reporting it to the assistant United States attorney assigned to that type of case in Indianapolis. It sounds like they did make contact with the U. S attorney's office who told them That they need to refer to use Lansing. There's an office the FBI, the office from Lansing, Michigan, for the Western District of Michigan. That's where it sort of going right away, and that would have been Back in July of 2015 when it was first reported. I'm sure that did not happen. Even know Apparently, that the, uh, special agent in charge claim that that happened and made false statements regarding that which was also very troubling. So many things that are troubling about this case. Yes, so typically. So when it sounds like when they contacted the U. S attorney in Indianapolis, they felt there's a jurisdictional problem. And they said, Look, this. This should go up to Michigan and so give them a call. And then somehow they dropped the ball there that that did not happen. If that had happened, what would have likely happened when the U. S attorney's office in Michigan got the call? Well when, when, when the U. S attorney's office and got the call they would have for sure contacted the local authorities because this type of crime and, uh Sexual abuse of of minor girls. This is primarily a state crime. It's a state crime of, uh unlawful sexual conduct criminal sexual conduct. In this event, which is a serious service crime. That's the primary crime in this case, so it's sort of gone right away to the local authorities right away to the Michigan State police. We didn't didn't get the, you know notice of it for another year, so they should have found out about it right away. And they would have had the case been reported to Michigan. Um As it fell to come. But I would note also that the Los Angeles According to the inspector general's report. The Los Angeles FBI was also notified about these reports. Sometime later in early May of 2016, and they also didn't contact the Michigan State authorities because there are federal crimes and state crimes, and these reports are clearly reporting. Crimes. And even if you think there's a venue issue or even a federal issue of whether there's a federal crime that applies you definitely see a federal having a state crying. It's clear as day criminal sexual conduct. You have to report that to the state authorities, and that didn't happen. But in this case, it's not like somebody called up the the number looked at, looked in the phone book called Up the number to the to the FBI. Or U. S attorney and Got somebody at the Switchboard in the Switchboard said You know what this is. This is a state crime. You really should call your local police. They began To look into this. They began to take information and still felt that That's right. They did they took they took ownership of the case. Because there were there was a case agent assigned who actually conducted two interviews over the phone of of these young girls. And who are victims of Mr Nassar's sexual abuse, and there wasn't even a report made. There were some notes. Maybe. But there was no report and so nothing even went into the into their system. No FBI three or two or three or to report was created. That was that was a huge dropping of the ball as you as you phrased it, so that that should have happened at Also lied to our misrepresented at the very least, to the USA gymnastics by saying that they did that that Indianapolis FBI said that they did. Transfer the case to the western District of Michigan. That's what they served on, but they didn't do it that they represented to the USA Gymnastics. They did. So that was another. Another failing Yeah. So when you look at the the failures, you know different things can happen one. You can change your policies and procedures, but Quite possibly the policies and procedures that are in place are adequate. But if it's individuals who are failing to follow those are making mistakes or possibly even lying, then that's a That's a problem with the people. What what should be done in this case when you look at these things? That's actually right there work. There was a problem with people if you put it because the the bump isn't in charge of the Indianapolis FBI, he actually lied. Um, to the inspector general during the investigation. And that's a felony. By the way, Kevin they haven't the department. Justice decided not to charge and that's I have a problem with that also because they were sentenced made where by the the head of the the FBI in Indianapolis. Where he lied about Reporting the case to Detroit. He lied about that. There was no evidence to support his claim that your appointment he also lied about trying to get a job with the Olympic Committee. He lied about that as well. So there were individual Fox, the head of the FBI and Indianapolis who who You know, you say are outliers because the FBI on the whole a fantastic organization, but he wasn't He was the outlier, in fact that he he committed a federal felony, a five year felony, which is continuously 1000 and one Lying to a federal officer. He did that crime and I might need to be prosecuted. But, um, far as sorry. Yeah, most cases I've been dealing with them for quite a bit. The FBI They would report it to the local authorities. They would realize that a serious, very serious state crime I need to report it. As far as changing things going forward, the attorney or the inspector general's report recommends and I strongly agree with it that they are they have more precise. And stronger reporting requirements, especially in cases dealing with minor Children. That in most reports to local and state law enforcement, because one time agents are thinking in terms of federal charges and how they could bring a federal case, and they don't always think about About the state side of it. But there has to be stronger and more precise reporting requirements, and there has to be training on those. So I think those those 22 recommendations in the inspector general's report are critical going forward, so this doesn't happen again. All right, Michael. Blot of a lot of law. "So let's say you get approached you set your pricing plan up. You know you wanna do this. Influence or affiliate marketing. What are some of the things that a business needs to have in place in order to make this successful like what are the things that nobody really talks about but you being in the industry and been around forever you know when when a company has these ten things. They're really successful. When they have five of the ten they have a mediocre resort. And if they have none of them that they they can. They're never gonna get anything. Like what are those five or ten things that you should have in place. As a company to do this influencers slash affiliate marketing. Yeah great question There's definitely a lot of things. But i would you know. Get it down to three to five things that you definitely want to have in place to be successful with it now. The first thing is once it's launched the one thing that you want to have in place proper exposure of the program because it's just like anything nobody knows it you have it. They're not going to sign up. You're not gonna get influences. So the proper exposure for the program. That could be done several ways. Isn't this with regards to recruiting affiliate recruiting influencers saw get with all the examples of ways to get exposure. No number one. Of course it's gotta be may prominent on your website That you have that available on the Easily navigate to it in clearly. See what you offer and having any of the easily sign up secondly what you wanna do in. We'll we'll focus now on. Just the influencers are in the end the affiliates so you have that probably on your website because believe it or not influencers. They're going to be looking around. They're looking for opportunities as well. They're going to be looking for keyword searches for certain things affiliate marketing program. And let's just say attache sir brands they may be looking for. Let's see so your butts. Why headphones so uninfluenced somebody. That's an affiliate may be doing. Keyword searches for affiliate program wireless headphones they're searching for all of these and so if you're not ranking for that you don't have the proper key words and you don't have a proper content for that you know you're not gonna come up. That's up chicago fashion bloggers and that's that's a specific term. Everybody is dropping that particular hashtag in the race so nine times out of ten. You're going to get people that are either bloggers. They're they're talking about chicago fashions and have some type of following. So when i did that. I think at the time at least five thousand results came up with people that use that hashtag and so you can use that hash tag to find out specific influencers that are doing posting on different terms that are related to your brand in chicago. Fashion bloggers sit example. So you're in another particular industry can do something similar to that. You just tailor that for your particular eats and that's another way you can you influences. The next thing is what we talked about earlier. is offering that proper incentive. Because if you if you're too low if you're offering a five percent commission or just totally out of the range in what the influencers are affiliates are expecting. They're going to walk by and they're just gonna pass up so you definitely want to make sure you have the right incentive in place to be able to track them in the new england when you think of the incentive you do have to be mindful of your competitors so you have competitors that are offering for the program see if you can sweeten the pot a little bit and offer something a little bit higher than what your competitors philip programs are as well so proper. Affiliate program is definitely necessary You want to be sure that you have the right technology in place to manage everything you know because mentioned of course getting this going of course And you know we talked earlier before we started recording this a lot of brands out there that kind of quote unquote say affiliate program. But they don't they really don't they don't have back in agent in place they just have maybe up of the a or they have somebody in their team. That's just tracking. These sales are referred by people that have quote unquote signed up for the report but they're just doing spreadsheets fan manually tracking mandolin getting commissions out. You know that could be done but it's not recommended especially these days. There's only solutions are out there such as ours affiliate of a great solution. If you don't have and you wanna have something in place. That's going to be able to allied effectively manage the the process from the sign up to the tracking to the dashboard that you provide to the affiliates. You wanna have all of this in place because you know as you grow your base of affiliates and influencers when you're talking about you're dealing with maybe initially you know a few hundred people and then it starts to grow.
