Today's guest is Thomas Brazile, founder of 117 Partners. Welcome, Thomas. Hey, Laura. Good to see you again. This week, FTX sued Joseph Bankman and Barbara Fried, the parents of former FTX CEO Sam Bankman Fried. Alleging that Bankman was intimately involved in a number of the allegedly fraudulent schemes, such as silencing someone who threatened to expose the alleged FTX fraud, the purchase of property in the Bahamas, Barbara Fried encouraged the use of strong donors as campaign finance laws, or allegedly, and both were accused generally of either knowing or ignoring the red flags that FTX was insolvent. Was this development surprising or expected? Thanks for having me on, Laura. Good to see you, as always. Was it surprising? No, I don't think it was that surprising. I think what was in the lawsuits in bankruptcy referred to as adversary proceeding, but what was seen in the adversary proceeding was probably a bit shocking, the actual details, but I think people knew that they were pretty involved. I think that was some of the heat they were getting post him getting a criminal complaint against him was that, why is he hanging out with his parents? Weren't they involved in a lot of parts of the business and people were saying things like that. I don't think it's that unexpected. People, I think, long knew that there were some real estate transactions where they were gifted or given some certain real estate in the Bahamas, but to see it all laid out in the complaint or I should say in the adversary proceeding was interesting. Which items in particular really struck you? I guess just the involvement in the actual day -to -day stuff. I mean, if you come from a corporate background or were a tax lawyer, which his dad, I guess, was and is, that there wasn't more, I don't know, structure to the organization. I mean, the dichotomy between what people thought pre -petition, what John Ray sort of said post -petition and now some of the revelations coming out about the pre -petition activity. I mean, it's just kind of amazing to think about people that might have been a more corporate background and saying like, if the business was so profitable, why were you cutting corners? To be fair to these guys, like in the light of day, sunlight of bankruptcy court, which as people in bankruptcy say, like my parents would say, the last place you want to be as a criminal is in bankruptcy court because there's so much sunlight and everything. Everything gets scrutinized. To be fair to people, sometimes the stuff gets overly scrutinized and they cherry pick stuff that went on. But it seems pretty damning, some of the stuff and there's, let's see what the responses will be. I mean, it's good for the estate and it's good for creditors because I'm sure they want to see sort of retribution. But in terms of recoveries, I don't think it's going to be incredibly meaningful, 10, 20, 30, 40, 50 million dollars. I mean, that's, I don't know, maybe two months of bankruptcy fees. And so, earlier when we were talking about like how some of the things are particularly damning, like if you were to kind of say, FTX will win in court for these reasons, like which were the particular acts that you think probably will put things over the edge? Oh yeah. I think almost all the stuff though, the win on the merits of the fraudulent conveyance. I mean, these are all fraudulent transfers potentially while the debtor was insolvent, potentially while it was coming with funds, so clearly all that money has to come back. I think that's pretty easy. The question is like, what's it worth now and who can actually pay it back? Like if money was given to a charity, can you actually go and get it back? Like meaning, is it there? Has it been spent kind of stuff? And you can only squeeze whatever rocked so hard. So the question will be, what is the real estate in the Bahamas worth? The 10 million bucks or whatever that was gifted to them, where did that money end up going? Can they trace it? So, these things cost money to do and then the question is like, how much of an effort do you want to make? And of course, all that can be stopped by a criminal investigation, which there isn't a complaint, but clearly some of the activity could be considered criminal. And I think, I won't pretend to be a criminal lawyer or a lawyer at all, but when you're bringing lawsuits, I mean, basically these are kind of like preponderance of evidence standards versus like higher standards that you might have for criminal complaints. So, it's easier for John Ray to like stitch together some stuff they know and slap an AP and sue these guys, but it's a little harder from a criminal side. But all of it, just facially, I mean, of course, as my lawyer likes to tell me, like, facts matter Thomas. So, if more discovery happens than they take discovery, we'll see. But on the face of it, I mean, it looks pretty obvious that it's sort of slam dunk. Just the question is what they'll actually be able to recover. Yeah, I think one of the ones that stuck out at me, simply because I could very easily imagine myself in a similar position with my own parents and I could just picture what my mother would say. And it was when they purchased the Bahamas property and everything was just getting billed or allegedly in the complaint to FTX. And the parents didn't even make an attempt to pay to furnish their home themselves. And I could just imagine if something similar was happening with my mother, she would be like, wait, is this okay that we're doing this? Like, you know, she would have so many questions about the money and like what was okay, what was kosher, what was not. Like, I could just practically hear her in my head. But at least, you know, from what the complaint described, it didn't feel at all like the parents had any of those qualms. So that was... Yeah, it wasn't 100 % owner of FTX. So it is bizarre that those red flags wouldn't have been, or people wouldn't have been like, hey, I know that you think this is okay, but I don't. Like someone would have said something, maybe they thought it was a drop in the ocean, but if FTX was so wildly profitable and Alameda was so wildly profitable, they didn't need to cut in corners and have them picking up the checks. I mean, it would have been easy for Sam to just be like, no, I'm picking this up personally or something. Well, one thing that I also noticed is that the document hedges its language saying things like, quote, Banquin and Freed either knew or ignored bright red flags revealing that SPF and other insiders were orchestrating the scheme. And again, you know, I saw later again, it was like, they either knew or blatantly ignored. So, yes. Right. That's because the standard for these civil cases is much lower. You know, like if you were trying to criminally try them, you'd have to like really show that they knew because they're going to say they didn't know, they didn't know, right. But the standard for like breach of fiduciary duty or, you know, kind of unjust enrichment, it's a much lower standard. All you have to basically show is a reasonable person should have known, you know. Oh, oh, I see. Yeah. So, that's why they keep saying that. So, you're saying – So, basically, they don't know whether or not they knew, but it doesn't matter for what they're trying to do. Is that what you're saying? I will respectfully say that I'm not a lawyer, but a stress investor and what people usually say – is the standard is usually what a reasonable person should have known, steps a reasonable person should have taken, best practices that a board should have taken. So, like a board of directors, if somebody runs off with money in a company, they don't have to necessarily show that they knew the person stole the money, but did they take any steps a reasonable person would have taken to like verify that the money was there or that the person wasn't absconding with money or whatever. So, it's this reasonable person standard that I think you trigger under Delaware and there are a lot of jurisdictions for breach of fiduciary duty or breach of loyalty, duty of care that you have, mainly in the boardroom, but also I think as a C -suite executive and it sounds like he was sort of melding between the two. So, basically, yeah, they're just trying to meet that standard for their purposes. They don't need to go beyond. And Barbara Fried, you know, also – so, as far as I understand from reading this, you know, Sam Pinkman was definitely involved more in the day -to -day, you know, he was often listed with FTX management. He could make executive decisions on his own at one point saying, oh, I'm just going to make this decision without Sam, like we don't need to involve him, that kind of thing. So, Barbara Fried was not involved at that level. However, it did say that she was a key influence on the campaign donations and I wondered what your takeaway was in that regard in terms of, you know, her involvement there. campaign finance fraud. Yeah, I don't have too much to say other than it's just bizarre that, you know, so many corners were cut in regards to stuff. I don't have a real view on – again, it's like it helps them build a story that they can, you know, just slam dunk, take back any money that was taken out of the estate at any point in the last couple of years by Barbara and the husband. But I don't think that – I don't have a real view on that. Yeah. Okay. Yeah. And as far as I understand, I don't think they're married, they're domestic partners. Just to clarify, yeah. All right. "Hello, welcome to The Elone Show. I'm your host, John Mayelone. In this episode, don't have regulars because reasons, I guess. As for our guest, he is from Alexandra, Louisiana. He's an entrepreneur and founder of Ugly Muck Marketing. Ladies and gentlemen, I give you, Wayne Mullins. Thank you so much. I'm excited to be here. Me too. So, how's life? Life is fabulous. I think, you know, I'm learning to embrace every day in every moment. To embrace the moments, whether they are what some would consider beautiful or what others may consider ugly. To learn to be present and in the moment. And I think that's the best way to possibly live life. Fantastic. And have you been up to much recently? I have. We are on the work front. We are busy growing. It's our busiest season of the year. So, we've been busy there. My wife and I and our kids were in the process of building a house, which is a little bit deceptive. We're not doing the building, obviously, but lots of decisions around building the house and the finishes and all that kind of stuff. Ah, all right then. Very good. And what was the inspiration and the idea of Ugly Muck Marketing? Yeah. So, the idea and inspiration behind Ugly Muck Marketing was simply this, that I wanted to create a marketing agency that is focused on results as the number one thing that matters. So often in the digital marketing space, in the ad agency space, the thing that so many get distracted by is trying to win awards. And Ugly Muck Marketing, the name actually stems from this quote that is, I would rather an ad that's ugly and effective over one that's beautiful, but isn't. So, that is the mission and that is the calling for what we do at Ugly Muck Marketing. Ah, I like it. And what was life for you growing up? I grew up in, I guess you could say more of rural Louisiana, not across the river, not far from where I'm at right now in an area called Pineville, Louisiana, population roughly 15 ,000 or so. So for me, it was growing up, spent a lot of times out in nature, in the woods, building forts in the woods and just had a lot of fun with friends and yeah, it was great. Okay. Very nice. If you could live anywhere in the world, where would it be? I would live where I'm at right now. I'm a firm believer in this idea that we as human beings, we aren't trees, meaning we can get up and move at any point in time. And I think it's not good for us mentally, emotionally to always long to be somewhere different than where we are. And, you know, if I really wanted to live somewhere else in the world, then I'm of the belief that I should make that happen, that I should get up, that I can move. Yes, there may be obstacles, there may be challenges, there may be all kinds of other things that, quote unquote, get in the way. But again, anything is possible. And we live in a world now where it's easier than ever to up and move to a new location. Couldn't agree more. What's your favorite ice cream topping? I'm going to go with probably strawberries. Interesting. Have you heard of a drink called banana friche? It sounds familiar. I don't know if I've had it, but it does sound familiar. Oh, is that so? It is. I don't know where or why I would have heard of it. OK, interesting, because every guest I've had, I've asked this question a lot to most guests and they said, no, I never heard of it. You are the first person to at least heard of it to some extent. So that's a surprise to me, in my opinion. Yeah, we need the bells and the whistles and like the streamers going off or some fireworks or something, at least, right? Yes, that calls for a celebration. Absolutely. So fill me in. What is it? So it is like a banana flavored drink, which is part smoothie, part milkshake. It's called a tingly sensations that you could possibly think of. Sounds delicious. It sure does. Would you rather never use social media again or never watch another movie or TV show again? Well, I'm going to choose TV because I actually really don't watch TV at all at this point or don't watch movies. And I often joke with people when they meet me or get to know me. I say if you begin the sentence or you begin the question with, have you seen the answer is already going to be no. So don't even ask the question. OK, that makes sense. I would say I would say never watch TV or movies again because I'm mostly on social media looking at stuff anyway. And also, you can watch full length feature films on social media, which is kind of multiple parts. So that's the ultimate cheap code. Yes, indeed. I love it. What's the weather like today where you currently are right now? It is overcast today in a high of only 84 degrees, which is actually a break in the heat from where we've been. So we're we're enjoying the overcast and cooler temps today. Me too. It was pretty hot the last few days, but now we're reaching autumn temperatures now, which is pretty cool. Literally. Well. What is the most comfortable piece of clothing you own? I would say it's a T -shirt that my wife got me for my birthday and it's by a company called One Golden Thread. And I don't know what they made the shirt out of. It's some cotton blend, I believe, but it is incredibly comfortable. Ah, very nice. Do you think a hot dog is a sandwich? I would say absolutely. It comes between two slices of bread or two pieces of bread. But I guess if you want to get really technical, the bread is still enjoined on one end. So you can make an argument in that case that is not technically a sandwich, but there are sandwiches that go in a similar style or similar type of bread. So I'm going to say it is OK. That's a good point, I guess. What hobby would you get into if time and money weren't an issue? Time and money weren't an issue. I would get into surfing. Nice. What could you do a 40 minute presentation on without any preparation? Marketing. That makes sense. Would you rather not be able to open closed doors or not be able to close open doors? That's a tough one. I'm going to go with I would rather not be able to close open doors. Nice. It leaves opportunities open for you. Absolutely. Yes, I love it. If you were given 400 acres of land, what would you use it for? I would take some of it. I would make it into a small farm of sorts, enough to produce enough produce for my family and friends. And then I would have a small portion for maybe some farm animals. And then I would love to leave the rest of it very wooded and maybe put a few trails, hiking trails, biking trails through some of that land. OK, that'd be pretty cool. How much time do you spend on the Internet? Way too much. I spend most of my work day on some form of the Internet, whether that is Google Docs, whether that's email or a social media channel. And then unfortunately, I spend too much time of that on social media or on various forms of Internet in the evenings as well. So way too much is the answer. OK. Yes, I agree. I would certainly say the same thing. What is the best way to start the morning? The absolute best way to start the morning is with some meditation and some gratitude. Sweet. Is that all? Or is there more to it? Well, those would be the best. I also love doing some journaling first thing in the morning and reading something that is inspirational, encouraging, something that really helps me set the tone for the day. I believe that our morning is kind of like the rudder, if you will, for the day, like a rudder on a ship determines where the entire massive ship goes. That one little rudder in comparison to the ship. I believe that our morning routines act in that same way. And unfortunately, for so many of us, we are unintentional with our morning routines. We allow the alarm to go off multiple times. We hit snooze, we rush, we hurry, and all of those things fill our minds subconsciously with worry, with stress, with thoughts of I'm late, with thoughts of I'm not going to be on time. All these words and all these feelings that, in my opinion, have a very negative connotation. So, yeah, I think that's that's the rudder for the day. Okay, yes, couldn't agree more.

We've got a fun show for you today. We are talking about the National Association of Realtors member profile. Julie and I picked out what we feel are the 10 most interesting points from the member profile and I think point number seven, maybe even point number eight will really surprise you. So Julie, we have a lot to go through. Let's just jump right in. Yes, this is about all of you listening and the agents that you deal with day to day. I think I had a few little mini surprises, but let's go through these relatively quickly. First of all, the typical realtor had 11 years of experience. That's actually up from eight from last year. I think that that's probably surprising to some of you because you know, there are a lot of new licensees and some of you deal with each other all the time, but 11 years of experience is the average. Now we're going to just remember as we go through these points, Julie and I are going to do our best to sort of decipher, I think in a lot of ways, some of this information because when it gets to, for example, they're going to, we're going to talk about average income for the average agent and all the rest of it, but they don't think it's confusing to be honest with you. I can't really understand and maybe somebody who is more knowledgeable about this stuff can put in comments, Nara will often say things like the family income or the household income of the average agent, but I'm not so sure. I mean, does that mean like for example, there's a guy and his wife is a brain surgeon and she makes like $14 million a year and he makes like $4 a year selling real estate, you know, and so obviously that's going to affect the average agent's income. Again, I'm not sure I'm reading the question correctly, but let's just get right to it. Yes, that's right. We'll translate as best we can with the information we've got. So next is interesting because with the market shift, a lot of people like to say, oh, everybody's going to get out of the business and yet 76 % of realtors were very certain that they will remain active as a real estate professional for at least the next two years. Now, Julie and I predicted that when the COVID hit and all the rest of it, that there would be no major drop off in the number of members of a national association of realtors. And those of you who've been attached to us for a long period of time, you will remember us telling you why, and I'll for the rest of you tell you why now, because in previous, you know, fortunately there wasn't a slowdown following COVID, but in previous slowdowns or recessions or all kinds of other things like that in the economy, there hasn't been a decrease in the number of agents, but an increase. And so Julie and I went back as far as we could find from national association of realtors looking at the number of members, and it was very clear that what we theorized was correct just simply by looking at the numbers of agents joining during economic slowdowns. So why do people get real estate licenses during slowdowns? Side hustle. That's true. They need to make more money. Or maybe, you know, if you go back to the sixties and seventies, there were a lot of ladies that were looking to get into real estate that maybe hadn't had out of the home employment before and things of that nature, retired people, but really the real reason why Julie and I knew there wasn't going to be a precipitous drop in the number of, you know, members of the national association of realtors was demographics and demographics ultimately is going to run the show for the real estate industry for the rest of our lives and beyond. The number of humans in the United States that want and need to buy or sell real estate is only increasing. And it didn't make sense to us that, uh, just because there would have been hypothetically because of COVID some kind of slowdown, which as all of you know, there was not quite the opposite actually. Exactly. And just a flash forward to today, we now see that again, Julie and I's theory was correct and you notice all the other naysayers that were, uh, predicting doom and gloom about the number of agents dropping dead, like, you know, 2014 levels or whatever. They're all wrong. And the total number of agents did decrease, but I think it was, it was by basically nothing. And now here's another prediction. Wait for it. We are expecting the number of people getting real estate licenses will start to increase over the next 12 months. I'm following, I think what was a lot of people deciding to, you know, should I get a license? Shouldn't I get a license? And here's how I know that's true. The number of emails and the number of texts I get from people who are getting real estate licenses who want to join Julie and I at eXp royalty is through the roof. Absolutely. And I would also concur from my own private elite coaching clients. Many of them have gotten their adult children licensed, their transaction coordinator licensed, their assistant licensed. You know, there's a lot of things that happen, um, with a change and doing more volume that just, you know, people want to have their family work in the business. There's lots of that going on about 6%. By the way, I did read that about 6 % of current licensees, uh, got licensed as a result of doing something during COVID, you know, supplementing their other job, for example. That's a good point. I mean, there also was a baby boom, you know, so between studying for the real estate test and the, you know, the other thing, I guess there you go, Oh, and I'm sure a lot of those babies eventually get licenses too. In the market that is going to start happening, we're going to guess the next 6 to 12 months it's going to feel very much more like a real estate, frankly, recovery if not a surge. All right, next surprising point. Well, next, in last year based on the NAR report, the typical agent had 12 transactions which was the same as the previous year. Now what was the sales volume? Well, the median sales volume for brokerage specialists increased to 3 .4 million from 2 .6 million, so things are looking up there as well. Now they always do a survey about how agents perceive what's going on with their prospects, right? Let's go back to that point, okay? So again, this always goes back to the interesting things when you dig into the numbers. So if the average agent and we are talking about 12 transactions, right? I'm looking at your notes. So 12 transactions and the average home in the United States is $400 ,000. So if you did, for example, I mean, if it's you guys, whatever your market commission is, but let's just call it $10 ,000, $10 ,000 times 12 transactions is $120 ,000 a year and you wonder why real estate is such an amazing business to be in. I mean, come on, it's incredible because during inflationary times, yes, everything is getting more expensive, but so is real estate, which means your average commission is also increasing. Look how smart you were to be in real estate where most everyone else is suffering from inflation and the cost of living and all the rest of it. You actually have a built -in pay increase year after year as things start to inflate even more so in real estate. So there you go, go you. Exactly. And related to that, 17 % of agents sold 10 million or more in volume, 4%, 15 million or more, and 5%, 20 million or more. Some of that you can chalk up to higher average sale prices, but again, go you because it's baked in that you're going to make more money doing more deals at a higher price, right? Okay, so let's look at the next one. All right, so at 32%, lack of inventory remains the most important factor limiting potential clients from making a purchase followed by housing affordability and difficulty finding the right property. I think difficulty finding the right property is the same as lack of inventory.

Today's guest is Thomas Brazile, founder of 117 Partners. Welcome, Thomas. Hey, Laura. Good to see you again. This week, FTX sued Joseph Bankman and Barbara Fried, the parents of former FTX CEO Sam Bankman Fried, alleging that Bankman was intimately involved in a number of the allegedly fraudulent schemes such as silencing someone who threatened to expose the alleged FTX fraud, the purchase of property in the Bahamas. Barbara Fried encouraged the use of strong donors as campaign finance laws, or allegedly, and both were accused generally of either knowing or ignoring the red flags that FTX was in solvent. Was this development surprising or expected? Thanks for having me on, Laura. Good to see you, as always. Was it surprising? No, I don't think it was that surprising. I think what was in the lawsuits in bankruptcy referred to as adversary proceeding, but what was seen in the adversary proceeding was probably a bit shocking, the actual details. But I think people knew that they were pretty involved. And I think that was some of the heat they were getting post him getting a criminal complaint against him was that, you know, why is he hanging out with his parents, weren't they involved in a lot of parts of the business, and people were saying things like that. I don't think it's that unexpected. People I think long knew that there were some real estate transactions where they were gifted or given some certain real estate in the Bahamas. But to see it all laid out in the complaint or I should say in the adversary proceeding was interesting, you know. And yeah. Which items in particular really struck you? I guess it's the involvement like in the actual day -to -day stuff. I mean, if you come from a corporate background or were a tax lawyer, which is that I guess was is, and that there wasn't more, I don't know, structure to the organization. I mean, you know, the dichotomy between what people thought pre -petition, what John Ray sort of said post -petition, and now some of the revelations coming out about the pre -petition activity. I mean, it's just kind of amazing to think about people that might have been a more corporate background and saying like, if the business was so profitable, why were you cutting corners? And, you know, to be fair to these guys, like in the, you know, in the light of day, sunlight of bankruptcy court, which as, you know, people in bankruptcy say, like my parents would say, like, the last place you want to be as a criminal is in bankruptcy court because there's so much sunlight and everything, you know, everything is good scrutinized. And to be fair to people, sometimes the stuff gets overly scrutinized and they cherry pick stuff that went on. But it seems pretty damning, some of the stuff and, you know, let's see what the responses will be. I mean, it's good for the estate and it's good for creditors because I'm sure they want to see, you know, sort of retribution. But in terms of recoveries, I don't think it's going to be incredibly meaningful, you know, 10, 20, 30, 40, 50 million dollars. I mean, that's, I don't know, maybe two months of bankruptcy fees. And so, you know, earlier when we were talking about like how some of the things are particularly damning, like if you were to kind of say, FTX will win in court, you know, for these reasons, like which were the particular acts that you think probably will put things over the edge? Oh, yeah. I think almost all the stuff though, they'll win on the merits of the fraudulent conveyance. I mean, these are all fraudulent transfers, potentially while the debtor was insolvent, potentially while it was coming with funds, so clearly all that money has to come back. I think that's pretty easy. The question is like, what's it worth now and who can actually pay it back? Like if money was given to a charity, can you actually go and get it back? Like meaning, is it there? Has it been spent kind of stuff? And you know, you can only squeeze a, you know, whatever, rock so hard. So the question will be, you know, what is the real estate in the Bahamas worth? The 10 million bucks or whatever that was gifted to them, where did that money end up going? Can they trace it? So these things cost money to do and then the question is like, how much of an effort do you want to make? And of course, you know, all that can be stopped by a criminal investigation, which there isn't a complaint, but clearly some of the activity could be considered criminal. And I think, you know, I won't pretend to be a criminal lawyer or a lawyer at all, but when you're bringing lawsuits, I mean, basically these are kind of like preponderance of evidence standards versus like, you know, higher standards that you might have for criminal complaints. So it's easier for John Ray to like stitch together some stuff they know and slap an AP and sue these guys. But it's a little harder from the criminal side. But all of it, just on facially, I mean, of course, as my lawyer likes to tell me, like, you know, facts matter, Thomas. So it is more discovery happens than they take discovery. We'll see. But on the face of it, I mean, it looks pretty, pretty obvious that it's sort of slam dunk. Just the question is what they'll actually be able to recover. Yeah. I think one of the ones that stuck out at me simply because I could very easily imagine myself in a similar position with my own parents and I could just picture what my mother would say. And it was when they purchased the Bahamas property and everything was just getting billed or allegedly in the complaint to FTX. And the parents didn't even make an attempt to pay to furnish their home themselves. And I could just imagine something similar was happening with my mother. She would be like, wait, is this OK that we're doing this? Like, you know, she would have so many questions about the money and like what was OK, what was kosher, what was not. Like, I could just practically hear her in my head. But at least, you know, from what the complaint described, it didn't feel at all like the parents had any of those qualms. So that was. Yeah. It wasn't 100 percent owner of FTX. So it is bizarre that those red flags wouldn't have been or people wouldn't have been like, hey, I know that you think this is OK, but I don't like someone would have said something. Maybe they thought it was a drop in the ocean. But if FTX is so wildly profitable, I mean, it was so wildly profitable, they didn't need to cut in corners and have them picking up the checks. I mean, it would have been easy for Sam to just be like, no, I'm picking this up personally or something. Well, one thing that I also notice is that the document hedges its language, saying things like, quote, Banquin and Freed either knew or ignored bright red flags, revealing that SPF and other insiders were orchestrating the scheme. And again, you know, I saw later again, it was like they either knew or blatantly ignored. So right. Yes. That's because the standard for these civil cases is much lower. You know, like if you were trying to criminally try them, you'd have to like really show that they knew because they're going to say they didn't know, they didn't know, right? But the standard for breach of fiduciary duty or unjust enrichment, it's a much lower standard. All you have to basically show is a reasonable person should have known, you know? Oh, oh, I see. Yeah. So that's why I keep saying that. So you're saying, so basically they don't know whether or not they knew, but it doesn't matter for what they're trying to do. Is that what you're saying? I will respectfully say that I'm not a lawyer, but a stress investor. And what people usually say is the standard is usually what a reasonable person should have known, steps a reasonable person should have taken, best practices that a board should have taken. So like a board of director, if somebody runs off with money in a company, they don't have to necessarily show that they knew the person stole the money, but did they take any steps a reasonable person would have taken to like verify that the money was there, that the person wasn't absconding with money or whatever. So it's just this reasonable person standard that I think you trigger under Delaware and under a lot of jurisdictions for breach of fiduciary duty or breach of loyalty, duty of care that you have, mainly in the boardroom, but also I think as a C -suite executive and it sounds like he was sort of melding between the two. So basically, yeah, they're just trying to meet that standard for their purposes. They don't need to go beyond. And Barbara Fried, you know, also, so as far as I understand from reading this, you know, Sam Pinkman was definitely involved more in the day to day. You know, he was often listed with FTX management. He you know, could make executive decisions on his own at one point saying, oh, I'm just going to make this decision without Sam, like we don't need to involve him, that kind of thing. So Barbara Fried was not involved at that level. However, it did say that she was a key influence on the campaign donations. And I wondered what your takeaway was in that regard in terms of, you know, her involvement there. Campaign finance fraud? Yeah. Again, I don't have too much to say other than it's just bizarre that, you know, so many corners were cut in regards to stuff. I don't have a real view on. Again, it's like it helps them build a story that they can, you know, just slam dunk, take back any money that was taken out of the estate at any point in the last couple of years by Barbara and the husband. But I don't think that I don't have a real view on that. Yeah. Okay. Yeah. And as far as I understand, I don't think they're married. They're domestic partners. Just to clarify. Yeah. All right. Yeah, I moved to Los Angeles 22 years ago to pursue my childhood dream of being an actress. And I had small parts on huge shows like Friends, CSI, and 24, and I never got that big break. So I supported myself at children's acting schools and the children were busy during the day at school. So I would attend spiritual lectures with great teachers of the law of attraction like Michael Beckwith, Esther Hicks, Louise Hay, Wayne Dyer, and I started applying it to my life and I got immediate results. I was making six figures working part time at a kid's acting school. And I didn't quite apply it as well to my love life. I had a series of really painful breakups with emotionally unavailable men. And I even married one thinking he would change. Three years later, I filed for divorce and my marriage was slowly and painfully unraveling as my dad was slowly and painfully dying in a nursing home. A highlight from "I Would List My Home, But I Can't Find A Home To Buy!"
"Welcome to Real Estate Coaching Radio, starring award -winning real estate coaches and number one international bestselling authors, Tim and Julie Harris. Listeners, have you ever heard this before? Have you ever heard a prospective seller tell you, I would happily list my house with you, but I can't until I find a home to buy. Boy, is that ever a conversation ender. Yeah, I would list my home, but where's all the inventory? You know, sellers can go online. They're searching all the time. Everything they see is pending. There's not a whole lot popping up. I would give you my listing, but where am I going to go? Now, here's the thing, with record low inventory nationwide, realtors seem to be hearing the same thing day in and day out, which we just said, I'd move, but where would I go? For most agents, unfortunately, that's the end of the conversation, simultaneously ending the possibility of taking a new listing as well as facilitating that buyer side. After all, nationwide inventory is at all time lows and according to Altos research, it bubbles up between 400 ,000 and 500 ,000 actives. When you take the pendings out, we're still at least a million listings shy of being in a balanced market. Okay, does not include all new construction, number one, but number two, here's something I want you guys to keep in mind. Your sellers who want to obviously buy something else once their property sells, whether it's more expensive or less expensive, they are, guess what, not worried about the interest rate. That is not what's holding them back. What's holding them back is the lack of something to choose to purchase. That's what their issue is. Why is it not the interest rate? Because most of the sellers in your marketplace, half of which have homes with no mortgages, roughly speaking, and the other half have mortgages where they have 50 % equity. So virtually all the prospective sellers that you're working with don't really care too much about the interest rates because they're going to have so much money down, their payment is not going to be that significant anyway and or they could buy the interest rates down. Do not get stuck in the emotional mental mud believing that this market, especially with sellers, the slowdown is rate driven. It's not. Now, first -time buyers? Yes. I agree. First -time buyers, they are definitely having a mortgage rate payment shock issue and to that, it's just going to get worse because rents are going to increase. So all the while they're hoping and praying the mortgage rates decrease, their rents are going to increase and a lot of times those first -time buyer types are going to be stuck in a long -term renting cycle which can last their lifetime. So we've done lots of podcasts on that, how to present to those types of folks so that they can essentially move themselves out of payment shock and into the reality that housing is expensive and it's not getting cheaper. You might as well own the house yourself versus basically renting it. But again. With regards to the first -time buyer question, but this podcast we're really focusing on, I would list with you, but I'm not convinced that there's anything to buy. I'm not going to sell it just to be homeless. So don't just answer with, yeah, there's really nothing on the market. I mean, everything in the MLS is already pending, Realtors. Stop saying that. I'll put you in my search widget and we'll watch for something to pop up together. I'll drip on you. I'll drip on you. Okay. Well, that's one method of maybe someday possibly finding something for your would -be sellers to buy. You can't end the conversation there and expect to actually do any business. Market forces are working against you. Rates are higher. Inventory is scarce. Add some inflation, the specter of possible recession and overall uncertainty. And now you've got a transitioning market. And if you're just going to roll over and say, well, yep, there's nothing to buy. You're done. You're not actually in real estate when you talk like that. But it's all those points amplified because when is the last time you went to any source, any media source, and they were making you feel optimistic? Never. Never. Right? I mean, everything including alien visitation is now essentially making the headlines. It's discouraging people from feeling optimistic. So you're going to have to understand that most people don't listen to our podcast and don't know the importance of having media -free mornings, media -free days, media -free lives. In other words, purging all that stuff. So you're going to have to remember when you're talking to folks that a lot of times you're going to have to help them move past their hesitance that's being constantly reinforced by their friends, their family, the news media, and all the rest of it. So just keep that in mind. Well, you do have a choice to make. You can either wait for the market to bounce back or you can create your own opportunities by being more proactive. We prescribed the mantra, hope for the best, but plan for the worst. Assume you're not going to wake up to three and a half percent interest rates and double the inventory. That is not going to happen. Back to our conversation with that would -be seller client who won't list with you because they don't want to become homeless. Here are the top five solutions that go beyond waiting and watching for magic inventory to arise. Okay. Good news for all of you. Solutions to when they say, that's an objection, I would list with you, I would move. But where am I going to go to? Okay, top five solutions so you can still take the listing. Number one, consider building a home instead of chasing after the scarce resale inventory. There are several advantages to this option. First, many builders are buying down interest rates and using their in -house financing. The buyer can lock in a better rate this way, thus giving them lower payments. Next advantage, the house is new. No rehab for them and no inspection nightmares for you. It's all good. Your client can get their home on the market a couple of months prior to the completion and not have to move twice. And finally, when your client builds, they aren't having to compete in a bidding war. It's all good. Now your points were mostly geared towards production builders, but if you're not having a market with a lot of production builders, the big, you know, Epcons and well, I mean, you know. MI and KB homes and all the big ones, right? That's fine. Just go to a builder and most of the country, there are builders that build ones and twos and threes houses here and there on your land. Align yourself with those guys. You can have the same result. Very well put. You have to go look for it. Be proactive. Okay. Number two, consider. And again, these things, these five things are playing into your conversations so that you can counsel with your sellers who your buyers are would be sellers. Maybe they could consider buying first closing and then listing the previous home. Don't assume that your buyer seller prospects won't or can't utilize this option. They may have a down payment saved that's not actually in their home equity. They might use a bridge loan to borrow their equity, close on the next home and then sell the old one. You don't know if you don't ask. The advantage is that your client can make a non -contingent offer, secure their home and deal with their old house later. Make sure that you know lenders who offer bridge loans and understand how to explain this option. There's a lot of those out there. You should at least run it up the flagpole and see if it makes sense. But a lot of people can purchase their next home without actually having to sell a present one. The underlying point of Julie's point number two there was don't assume that your perspectives on finances and risk is the same as theirs because you're not going to approach the perspective seller about purchasing something with all their options. So let them know. You have several choices on how we can move forward, Mr. Seller. Here's one, here's two, here's three, here's four. Which one is best for you? That's the point of this podcast is to have those conversations instead of saying, yep, there's no inventory. We'll just drip and wait for something to drip on you. I mean, what is it? 30 % of all the home sales are it's our new construction, right? And that's going to be at least 50%. It's 30 % and rising for sure. Okay. So number three, and so, you know, some of these, these five possibilities, it also goes to how the seller's mindset is. Are they somebody that has no problem buying first and then selling second? Are they a little bit more risk adverse? So this number three goes to that point. Consider selling first, then renting for a while and taking time to look for the right home. The advantage here is that the seller has cashed out their equity and is ready to pounce on the right home, but without the pressure of organizing closing and possession dates. Who are your go -to leasing agents? Consider both traditional rentals, short -term vacation rentals that may consider a lease, as well as apartment complexes. Many have some great amenities that could work for a short - or longer -term lease while you help your client find the right home to buy. Again, you don't know if you don't run it up the flagpole, do you? Okay, number four, consider getting the seller's home on the market now, but make the acceptance of an offer contingent on seller finding suitable housing. The buyer will probably want a specific time frame, but you can usually get 90 to 120 days to secure the next home for your seller who is now a buyer. Many buyers in today's market are just anxious to find the right home and will be flexible with the seller's situation. It's still, in most places, a seller's market. The advantage to your client is that they won't have to move twice, and you've negotiated for them enough time to look for the next place. A seller lease back to that buyer, the new owner, is another way to handle that. Just depends on the time frame. Okay, so let's give them the sticky details of this one. So if a lot of your buyers are putting enough money down and are paying cash for the house, they can easily do lease backs to the seller. Yeah, they're just happy to get the house secured. And the seller's happy to know what money they're going to have for their next one. So they can do lease backs that might even last a year, right? To Julie's point, they're just happy to have the house. And so you have to have these thoughts bouncing around your head, otherwise you're not going to be able to offer these different options to your prospective sellers. That's right. Well, that's why our coaching clients get a copy of this, so they can turn it into a leave behind when they have these conversations and use it for their scripting. Well, look at that right now. Combine number four with number one, right? Someone's building, it's going to be done in say 12 to 18 months. You can then basically put their existing house on the market, obviously sell it, have the sellers receive the proceeds from the closing. They become tenants of their former house that they owned.

"Welcome to the SBF trial, a Coindesk podcast network newsletter bringing you daily insights from inside the courtroom where Sam Bankman -Fried will try to stay out of prison. As we gear up for Sam Bankman -Fried's and unpack what happened in late 2022 that got us here today. It is one of the most consequential documents in financial history, given that it caused the collapse of a $32 billion empire in just nine days. And now to a highly anticipated criminal trial. It is the infamous balance sheet of Sam Bankman -Fried's trading firm, Alameda Research. Its explosive content served as the basis for a November 2nd, 2022 story by Coindesk's Ian Allison. The article raised questions about how sturdy the company's financial underpinnings were and by extension, how safe Bankman -Fried's better known crypto exchange FTX was. It turns out not at all. For the protection of our sources, we are not publishing the document itself, but rather describing its contents in finer detail than ever before. Labeled consolidated balance sheet 2022 Q2, it gets into the nitty gritty of Alameda's naughty empire. Much of that empire relied on tokens of projects Alameda was unusually close with, particularly the formerly white hot crypto startups it invested in. For example, it led eight figure investment rounds in the closely linked projects, Oxygen and Maps .me and counted nearly $600 million worth of those projects tokens locked and unlocked on its balance sheet. When FTX went bust, it stranded 95 % of those projects token supply in a state of limbo that seems to continue to this day. Those projects tokens have since lost much of their value, but even back then they were unlikely to be worth that much in practice. Attempting to trade them at scale on the open markets would have shattered their value. Alameda had multiple ties to Bonfita, the popular wallet naming service in the Ethereum ecosystem. It was the primary market maker for Bonfita's native token FITA. It acquired millions of FITA tokens by investing in that startup. Notably, Bonfita developers inherited development duties over the purportedly decentralized Serum crypto exchange, another FTX production. In SRM, the bounds of reality and believability began to break down for Alameda. It was a token that FTX group coders had conjured out of nothing for the benefit of Serum. The SBF founded trading infrastructure for much of Solana blockchain -based DeFi. Alameda reported holding nearly $183 million worth of locked SRM and $300 million unlocked, plus nearly $320 million in SRM collateral and an additional $330 million in locked SRM as a liability. But it was Alameda's miles deep holdings of FTT, the exchange token minted specifically by FTX, that proved to be the empire's undoing. CoinDesk's November 2nd, 2022 article authored by Ian Allison revealed that billions of dollars of FTT backed up Alameda's largesse, a fact that spooked market participants and eventually set off a run on FTX. It was during that chaos that people began to realize that the emperor had no clothes. Four days after Allison's story came out, Binance CEO CZ tweeted that, due to recent revelations, his exchange would sell its hefty FTT holdings. That quickly drove down the price of FTT, putting Bankman -Friede's companies into a tailspin. Bankman -Friede was forced two days later to seek a bailout from Binance. But that proposed takeover fell apart in a day, something another Allison scoop revealed was likely to happen hours before it was made official. Then, on November 11th, Bankman -Friede's companies were forced to file for bankruptcy protection. Allison's initial scoop on the collapse. Thousands of news stories credited CoinDesk for setting off the chain of events, including pieces from high -profile publications like The New York Times, The Wall Street Journal, Bloomberg, The Financial Times, The Verge, New York Magazine, CNN, and NPR's Planet Money podcast. CoinDesk journalists went on to win a George Polk Award, one of the top journalism honors, for their FTX coverage. And their finalists for the prestigious Gerald Loeb Award. So in today's show, we are going to be focused on your real estate daily success schedule. This is, I have to say, it's a topic you and I talk about directly and indirectly all the time because at the end of the day, your life is rooted in a schedule. A lot of people, myself included, hate having a schedule. You as well. Sure. Nobody likes it. Everybody does. But the thing is, even if you don't have a schedule, a formalized schedule, you have a schedule. You just may not be acknowledging it. You just may not be acknowledging it because your life is basically being run around certain milestones throughout the day. So given the fact that you have a schedule, despite the fact you don't necessarily want one if you're a butthead like Julie and I, well then look at the facts. Why not make a schedule that's going to be conducive to the betterment of your long -term physical, financial, spiritual, educational wants, needs, and desires. At the end of the day, guys, you can accomplish everything you want to accomplish, and this is the best part, I think, and you're about to learn more why this is true, in less than three hours a day, usually first thing in the morning. So Julie, without any further delay. That's right. So there's not nine million things you have to do with your schedule, but there are some key things that you've got to adopt and adapt and turn into your daily minimum standards that you do as habits. And again, I love what you just said, because really at the end of the day, if you've accomplished three to five things, and we're going to really drill down on what those probably should be and you can adjust accordingly, if you do three to five things at a high level every single day, even if you don't get a real obvious listing contract or closing or something like that, that particular day, you're building positive momentum, which is going to result in really great things, maybe 30, 60, 90 days down the road. Indeed it will. All right. So what should you have in your ideal schedule? Number one, use and update your visual accountability whiteboards every day. You should be tracking all of the following based on your goals. These are on your wall. These are whiteboards with pens. You guys can visualize that. When our private numbers page on Facebook, they will oftentimes, yeah, well, it's because if your real estate magic number, and we're talking Harris Coaching speak now, but bear with us. If your real estate magic number is 10, you need 10 listings at all times, and you've been able to hit the number 10 for the first time in your career. You're proud of that. Hell yeah, you are. You're posting it everywhere. Exactly. Yes, and you're getting a lot of love and support from the Harris certified coaches and your colleagues that are working on the same things as you. So what do you track with your visual accountability whiteboards? Leads, active listings, buyers, pending closings, and closed transactions. So for example, if your business plan, your real estate treasure map calls for you to do 22 transactions this year, on your closed transaction board, you're going to have one through 22, and you're going to fill them in. They travel through your boards. Everything starts as a lead. Then it's either a buyer or an active listing. Then it becomes a pending, and then it lands on your closed transaction board. You literally can visually see, are you on track ahead or behind? Think about this from an emotional perspective, finances are intertwined with emotions. If your goal is to earn, I'll just pick a very simple number, all of you should be able to wrap your arms around this, $100 ,000. Let's say your average commission is $10 ,000. This should be obvious that you have to sell 10 houses. For you to sell 10 houses, how many leads do you need? That's the whole process. How many contacts are you going to be needing to make per day? I'll give you the answer, 10. If you make 10 contacts per day, if you have 10 listings at all times, you will sell at least, you will get and sell at least 10 listings or 10 houses per year. Probably it'll be split between buyers and sellers. That is the very least amount of transactions and money you guys should be making in this market or any market, frankly. It does work like clockwork like that. That's the point of the treasure map is to show you that. Then number two, what are we doing on your daily schedule? Look at your finances every day. Yes, look at your finances every day. Use mint .com as your dashboard of key performance indicators or KPIs, your savings, your checking, your credit cards, investment accounts, investment properties, and everything else financial are visible using mint .com. This includes your credit scores as well as your upcoming bills and your actual budget. Mint .com is not an official sponsor. Sure enough, there were some just rando charges that just popped up that worked from things we canceled over a year ago. Those merchants were hoping that we were asleep at the wheel and wouldn't contest the charge which we did, so you're going to have to pay attention to all that stuff and really be watching out for it. Unfortunately that happens. Sometimes it's a clerical error on their end, but nonetheless, make sure you're paying attention to your money. The other thing that happens is a lot of people have a direct negative visceral reaction when they're thinking about money. Even frankly, Julie's voice goes up when she talks about money, so if we start talking about money, you guys will hear it in her voice. It's kind of funny. It's a subconscious thing that gives her a little bit of anxiety. understand. I completely Most people feel that way, but if you increase their frequency of checking in on your money, so it's not like every time you log into your checking account, it's like seeing a ghost. If you're going there frequently and you're familiarizing yourself with the patterns of how your finances work and you become more comfortable with it, then it's not obviously going to have that same emotional reaction because you will have jumped in the deep end. These money things, guys, are very easy to move past.

Yeah, I'm excited to chat. You just came out with your book, Number Go Up. Congratulations. Tell us what it's about. Number Go Up. I've started out as it's my the story of like the two years I spent going down the crypto rabbit hole. And when I started out, I was just kind of curious and skeptical. And I was arguing with my friend about the reasonableness of a betting on Dogecoin. It's like the height of the pandemic. And I don't know, I got kind of sucked into investigating crypto. Two years later, I was cut to I'm in the Bahamas, going to Sam Begman Fried's penthouse just before the cops showed up interviewing him about the collapse of FTX. And so you said that this was your period of going down the crypto rabbit hole. What had you been doing before? So I've been an investigative reporter for Bloomberg for a long time. And at Bloomberg, I generally write about kind of the shady side of Wall Street. So I'd written exposes of predatory lenders, penny stock scams. One of my favorites was about a Patriots fan who stole the New York Giants Super Bowl rings after the 2008 helmet catch game. So I'd always been looking for like wild stories to tell in this world of business and finance. But I kind of resisted crypto as a potential topic. I just didn't really see it as like, I mean, you're going to laugh at me now, but I just didn't really see it as like a good target for an investigative reporter. And it wasn't because I thought crypto was like the future. It's just like this may be hard to believe if you're like a big time crypto guy, but actually maybe not because I'm sure you talk about it with your family and everybody. But like outside in the traditional finance world, a lot of people are so skeptical about crypto that they were like investigating a crypto company and finding out something bad about it, you wouldn't find anything surprising. I don't even care about that story. But what I realized was that my first crypto conference was Bitcoin 2021 in Miami. And I showed up there and I just met, I realized there were so many crazy characters in crypto. There were so many people that I'd love to write about. And I'm like, these are the kind of people who I need to get to know. One of the first people I sat down with was I met Sam Bankman -Fried there. I met Alex Mashinsky of Celsius, who was very prominent there. I had Michael Saylor saying all sorts of crazy things about Bitcoin. And I came back and I told my editor, like, I was wrong. There's all sorts of weird stuff going on in crypto. This would be a great topic and it'll be, you know, it'll be a long time before. There's too many stories to choose from. Yeah. Yeah. And it's funny in terms of the years that you, quote unquote, went down the crypto rabbit hole. Those were two of the craziest years and in a way, like some of the more unusual years of crypto, I would say. Just so before we dive into, you know, the different escapades you underwent in your book, you mentioned earlier that you were both curious about crypto, but also skeptical. So, you know, before we dive into what you were looking into, I wanted to hear your overall take on crypto. You know, when you say you're a skeptic, how much of a skeptic because there are some people who are skeptics and they completely dismiss crypto, but I didn't get that feeling from reading your book. I'm sort of like a skeptic in general. I'm skeptical of everything. That's why, like, I'm an investigative reporter. So if somebody tells me, hey, like Alex Mashinsky did, hey, I'm going to pay 18 percent interest. And if you want a loan from me, I charge like as low as zero percent. This is like in the world of traditional finance, a very backwards business model. When you say something like that to me, I'm going to say, yeah, I'm kind of, can you provide some evidence, like what, how are you investing your money? How does this how does this make sense? But I tried to keep like an open mind. And the question I was always asking was, what does your product do when I meet crypto founders? Can I see it in action? Can I talk to your users? Is it being used in the real world somewhere? That's one of my favorite questions, because as a writer, it's hard to write about things if you can't see them being used. And so that took me to El Salvador to see the Bitcoin experiment there. But it also took me to Ape Fest to see what it was like to be a member of the Bored Ape Yacht Club. And I was pleased I got one of the first reviews for the book the other day from Jeff John Roberts in Fortune. And he's, I think, feels fairly positively about crypto. He thought that my take on crypto was a little shallow, but that the book was so funny, he didn't care. And I'm like, you know what? I'll take that. I think we can all enjoy reliving these last two crazy years. And like whatever your take is on crypto, like there are crazy things that happened that we have all just like so much has happened. There's no way to like remember it all. But I have done the work of writing it down so you can go read it. Yeah. Yeah. No, it was definitely it covered the range of events. But let's actually talk about one of the main through lines. And I believe, you know, correct me if I'm wrong, that this was actually meant to be a book about Tether. And because I remember like a long time reading that it was coming out and I think that's what it said. And you kind of keep saying this to yourself that you keep saying it yourself in the book that, you know, you're getting these tips about Tether and you're trying to investigate them. You keep coming up against these dead ends. So before we go into all that, why don't you at least just tell us, so what do you feel were your main findings about Tether and like what were you trying to resolve? So probably old for like most people listening, but Tether is a big stable coin. Each coin is supposed to be worth a dollar because each coin is supposed to be backed by real dollars that are held in a bank somewhere. And I when started out, I wrote like a story for Businessweek about Tether. That was sort of the start of this project. I always thought as kind of like a good jumping off point, I pitched the book as like, this is the craziest financial mania we've ever seen in the world and it's not going to last. And I want to be there to chronicle it. And I see this like interesting central mystery that is going to like take me through. And that was Tether. At the time when I started, Tether said that they had, I think it was around 50 billion dollars in the bank. It was weird because on the one hand, it was pretty widespread to be, and correct me if I'm wrong, if I'm describing what crypto people think, because you probably know better than me, but like even people who are pretty into crypto in when they were talking to me, they'd be like, yeah, I'm not so sure about their assets like this. I don't know what's going on with Tether. This is like a good question to be asking. And it was being asked at like the highest levels of the U .S. government. Like Janet Yellen called a meeting of all the top financial regulators and the topic was like, what's going on with Tether and like, could this affect the world And I just thought it was a little when I started looking into Tether and I saw that, you know, among its co -founders was a child actor from the Mighty Ducks. I was just like, what is this in that the company I write in the book, the company was quilted out of red flags, like in the world of traditional finance, you did never you would never find a company with so many weird things to look into. And yet here it was like at the center of the crypto world. And I just thought it was it was funny to me that the heads of state were discussing this coin that was like dreamed up by a child actor from from the Mighty Ducks. And I was like, this is my kind of mystery. I want to dive in. I'm going to try and find Tether's 50 billion dollars. I see. So, you know, as we mentioned at different points in the book, you do talk about how you feel like you keep coming up against dead ends in your investigation. So what's your conclusion about that fact? Like, do you think it means that concerns about Tether are overblown? Does it make you more convinced that like the company is just really hitting everything really well or like what are your thoughts? Right now, Tether has only grown bigger. Midway through my reporting, I found that Tether had invested a lot of its assets into Chinese commercial paper. And there's kind of like this conflict of interest at the heart of Tether's business model, which is that if you give your money to Tether, you want them to keep it really safe. So it's there when you go to cash in your Tether tokens. But Tether doesn't pay any interest in the way that Tether makes money is they can take the money that you trusted them with and they can go invest it. And so there was this theory that especially when interest rates were very low, they might be doing weird things with your money in order to earn higher profits. And that so I found that they were doing some unusual things that included the Chinese commercial paper and also making loans to crypto companies like Celsius and others. So to me, that seemed like that's kind of risky. What's going to happen there? And as I followed along in the summer of 2022, like crypto companies fell one after the other and Tether did not. And there was even like a little run on Tether where users cashed in, I don't know, five, 10 billion dollars of Tether. And I'm sure if those people did not get their money back, like we would have heard about it. Right.

The firefighters hero that's uh some big big shoes to fill so Diane tell us your story first of all welcome thanks for being with us I actually watched a movie yesterday that you sent us and I had to pause several times because I was so overwhelmed and so pissed off a couple times good um yeah so we'll talk about the movie but first tell us your story can you give us your background a little bit sure thank you I'm glad to meet you ladies finally in person big follower of the show I love it I love what you do I love that spouses and significant others are involved because um that's what I am that's all that I am it's a it's a fire wife I have no formal education I did get my hairdressers license some years ago and I was the worst hairdresser in the world so I didn't go far but I stayed at home and raised our children until they were about 10 and 11. Paul got on the fire department in 1988 when our son was two months old and our daughter was 18 months old our son is now a firefighter in the same department my husband served at now works in the same station in Worcester they had a beautiful beautiful life we embraced everything that we loved about the fire service his friends became my friends their wives became my my best friends we vacation with them etc. Paul had spent 25 years on the rescue in Worcester he had a 28 -year career at age 55 he decided it was time to climb the ladder so he took the lieutenant's exam and he made lieutenant and he was pretty disappointed because that meant that he'd leave his crew and he had worked with this crew you know on the same shift for 25 years they'd gone through a lot together the Worcester warehouse fire they've gone through so much together at any event we went on vacation with our firefighter families to moosehead lake up in maine and we came back to a beautiful ceremony in Worcester city hall when my husband was promoted to lieutenant along with one of his best buddies and the rescue saw him off and it was wonderful Paul was getting ready getting prepared to go back on to a new rig and he had an appointment to see a doctor because he was going in for cataract surgery his pre -exam showed that he had just a very slightly elevated number in his psa for prostate he had that check regularly as he did a lot of checks for his health because he was a very fitness aware person at any event he did get the call to come in they wanted a biopsy and i thought nothing about a biopsy because to look at him he literally looked like a 45 -year -old at 55 he was very fit very very strong and the picture of health we went to the doctor's office and i can remember that day because i was just so adamant to get this over with this appointment because i had things to do and we were making small talk with the doctor and we were in the tiny doctor's office room the exam room and out of nowhere the doctor said yep it's cancer and in that moment that moment i can remember because i remember i screamed and i fell into the chair and Paul who's almost six feet tall he broke out in this sweat all over his body i could just see the beads of sweat come out from everywhere on him and he sunk into a chair he tore his shirt off and he sunk into a chair and i can remember the doctor talking for 45 minutes and i'm crying and Paul's looking at me looking at the doctor looking at me looking at the doctor and we didn't hear a word he said

"Welcome to the Teachers Impact Podcast, or better yet known as the TIP, where teachers can come to master their craft, use their voice, and enhance student learning. Welcome to the Teachers Impact Podcast, better yet known as the TIP. In today's episode, we'll explore how to use level design and class dojo for better classroom management. If you're as excited as I am, say woo woo! If you find yourself struggling with classroom management or looking to refresh your current plan, you're in for some valuable tips that will lead you to a more effective classroom management. If you don't know, Class Dojo is an online platform that allows students to earn points for developing pro -social skills and displaying good behavior. When I first started using Class Dojo, the novelty and newness of the award system kept my students engaged. However, like any exchangeable award system, the novelty wore off quickly. And so, drawing inspiration from my experience as a Google Maps contributor, where level design keeps us engaged by earning badges for accumulated points, I wonder how I could translate this idea to Class Dojo to keep my students engaged, just as I am when I'm doing Google Maps. So as part of my comprehensive classroom management plan, I introduced a treasure box where students can earn prizes. So instead of relying slowly on my discussion, I tied the prizes to the number of points they accumulated through Class Dojo. So these are the levels that I set up. You can set it up in the way that you feel best fits your students. So for level one, that's the easiest level that the students can get to. That was 300 points, and that would equal one prize from the treasure box. So level two is even harder to get to, which is 900 points. They can get two prizes from the treasure box. Okay, level three, you would have to get 1300 points, and you can get three prizes from the treasure box. So I'm still working on what happens as they go up in the levels. What I will probably do is to make it so that they're able to, one of the prizes or one of the things in the treasure box could be to sit in whichever seat that they choose or sit next to a friend. So I'm updating that this year, so I'll let you know how that goes. So what I did notice with that was once the students reached the highest level, they had the privilege of choosing their award from a selection of options. So students and students lost points for not following the classroom rules. So that's how I set up my Class Dojo using level design. It's really great. The students that I had last year were really into it. It was an incentive for them to really follow the rules and to keep the behavior, be able to manage the behavior more effectively. Definitely something that I would try out if you need something new to help you refresh into just something different for your students to keep with the novelty. And finally, my students did maintain their excitement throughout the year and they made every effort not to lose points. The system helped me to reinforce positive behavior and discourage those negative behaviors. While it may not be a foolproof method, it is an essential part of my effective classroom management plan. A highlight from Real Estate Agents: 6 Top Income Destroying, Time Wasting Mistakes

Three, two, one and Julie Harris. We are back. And today we're going to be talking about six of the worst income wrecking mistakes agents are making in today's market. But before we get to the first point, I think you have a really great story from our friend in LA, Federico. Yes. Who is not making the deal wrecking mistakes. In fact, this story, I hope the listeners pay attention because it's going to wind a whole bunch of things together. That's right. So we're starting off by telling you the story of what happens if you don't make six of the income wrecking mistakes with this story. And then we're going to get into the weeds as far as what you need to be avoiding. That's right. Okay. So this is a text from Federico who lives and sells in Los Angeles. He says, hi, Julie. This is hot off the presses right from maybe a couple of days ago. Federico says, I just finished showing clients a new construction community while the build rep was showing us the model, a lady walked in and asked if she could listen in on the build reps presentation. She communicated that she and her husband were looking to downsize and was asking the builder how the financing would work. Okay. So let's stop just for a second. How many of you listening in Los Angeles believe that there's no new construction around? We could just start with that point, but moving forward, uh, during that conversation, I asked her what her situation was and asked if she needed the funds from the sale of her property in order to close on the one she might be looking at. That led to the build rep stating that they would only finance her if her current home was in escrow. So there's a lot to that too. Which by the way, that's probably the build rep not really knowing anything about how to, you know, sell a house using financing because the reality of it is, is the builder wasn't actually using their own money. They were using a mortgage broker and she probably still could have worked that deal, but she was looking for the easier deals of people that had no home sale contingency. That's right. And we're using kind of a lame objection handler. No, you can't do that. Exactly. Which positions our friend Federico listening. That's right. Now, when the build rep exited the room, she thanked me for helping her articulate her points. This is the walk -in potential buyer and asked if I could email her all the information for the new build to which I responded that I was the agent for the other couple in the room, but that I would be happy to help her. That led me to, led me to asking her to, uh, how soon she needed to go on the market. When she responded, uh, we are still decluttering. I don't know where to start or how it all works. I asked her where the home was and what they were asking and asked when I could stop by and see it since I may already have someone. How many of you guys would have gone for the appointment right then and there? Think about that. She answered, that sounds great. We need to declutter first. So I won't, it won't be possible until at least later next month. Let me also work on my husband as far as the new purchase goes and then we can schedule an exact date for you to come by. I got her contact information. Another mistake that agents sometimes fall into. I got her contact information and stopped the conversation since I did not want to be rude in front of my existing clients there. When I left the showing, I called this lady. There's the immediate fallback, uh, follow up. I called this lady back to continue the conversation and to schedule a tentative day and time to go look at the property. She said that she and her husband will be going on a short trip and that we can circle back after my trip. We'll only be gone for a week. During the call, she asked me what commission I would charge. By the way, people don't ask that if they're not serious, do they? Okay. She asked about my commission to which I said, that's a great question. I actually have a flexible fee. What's the best email for you so I can send you a little bit about me and my team and about how we work. That'd be the pre listing package. That way when we meet at the house, we can focus on the items that are most important to you. Also part of the script you learned in premier coaching. It's a textbook. Totally 5 ,000 % textbook. She gave me her email, thanked me for helping her while at the new construction and expressed that she was excited to have me come by their house. There you have it. Now certainly by the way, dad, on what you said with regards to the people asking about commission that quick, 99 % of the time when they ask out of the gates like that, it's because they've got another agent in their back pocket, which it probably isn't a professional agent in the sense that maybe it's somebody they just know as their neighbor or uncle Bob who basically lists the house every thousand years or something like that, who will probably do it for free. That type of question was that the agent, I'm sorry, the seller was looking for a reason to take uncle Bob out of the equation because she really liked Federico and wanted to do business with him. Most importantly though, to your point, he used the scripts that we teach these guys to use in premier coaching and that was one of the obvious scripts that we use that you learn when you're presenting the pre -listening pack and the listening presentation. All this was woven together and what we're trying to express to all of you, so hopefully you're all understanding, is there's opportunity everywhere. You just have to go where the opportunity is and quit waiting for the opportunity to come to you. Which leads us, Julie, perfectly into point number one and remember guys, these are the top six income killing mistakes that agents are making now and frankly in a lot of cases have normalized. That's right. So point number one or mistake number one, and we're also going to have some action steps how to fix these problems ASAP. Mistake number one, playing the waiting game, waiting for the market to crash, waiting for interest rates to come down, waiting for inventory. Waiting doesn't get transactions into your pipeline, nor does it help your clients and prospects to achieve their goals. You must take control of your day, your week, your month, your quarter, and your year in order to defeat the waiting game. Say this at least 10 times, if it's meant to be, it's up to me, and then take control. We're going to give you some action steps here. All right, so first action step on this mistake, accept the fact that there are zero indicators that the market's going to crash. Zero. Remove it from your head. While there are some price ranges in some markets this year where it's set to, I'm sorry, where there are some price reductions is what that should say in some markets, this year is set to close with between five and 9 % increase in home values. I wonder how many people actually know that. I mean, with all these headlines that are supposed to basically make you think there's a housing crash, do you all know that real estate in the mainland United States is increased in value by at least 5%, in some cases around 10 % year over year? So yes, despite the headlines about prices falling, home values have still increased. That's right. Now, low inventory, stable demand, lots of new construction, and rising prices are not indicators of a housing crash. Those things do not exist in a housing crash. Now, if any of that changes, you can hear about it here, we'll let you know. So it's important that we remind them that we are at, what, a 20 or 30 year low for the number of mortgages that are in any sort of distress? Yes. It's like less than 3 %? It's less than 3%, a historic low, and that includes all of the forbearances and things that happened around COVID. That's all baked in at this point. Do you remember all the people that were, you know, of course, these real estate prognosticators were trying to sell you lists on how to get into REOs and all this other stuff? How they were saying, oh, you wait until all those people on mortgage forbearance, all those COVID mortgage forbearances, those houses are all going to default. None of them defaulted, did they? You see how there are some people, guys, who only think that they can make money, only think they can help people when the market's going one particular direction. So what they do is they wait around and hope and pray that the sky falls so that they can be right. And that is, I suppose, a business model. But the reality of it is you can help people make money no matter what direction the market is going. You don't just have to wait for the direction that it's been going. For example, a lot of you, to Julie's point, were waiting around for their interest rates to lower, waiting around for the mortgage stuff to clear, become easier, inventory to increase. Stop waiting around. There's inventory everywhere. It's not just where it's like what Federico discovered. It's hidden, in essence. You have to go to where it's at. You have to go to where the market opportunity is. Stop waiting for the market opportunity to show up on your computer screen. Yes. And when you go to new construction where he went, especially in those price ranges, go where the buyers are looking. You will also find listings. That's right. OK. So again, we're back to the waiting game. So you said that. So we have to drill down. Because I always have to remind myself and you that we have people that are maybe listening to us for the first time ever. And yes, this is the number one Listen To Dilly podcast for real estate professionals in the United States. Tens of thousands of people downloading it. But for the one person that's discovered this for the first time, defining what Julie just said, if you're going to, as Federico did, go look, essentially show buyers or go to a new construction area where the new construction is, say, $800 to, say, on up, chances are the person purchasing one of those new construction homes, they're going to have a house to sell. So that means that probably realistically 90 % of the buyers, air quoting here, that are interested in new construction actually also are sellers. But how many of you think like that? How many of you think buyer or seller? You can't be both. Always assume that your buyer is actually a seller and where you focus your energy is on the listing side of things, because that's what's going to be the juggernaut to them moving forward with any, you know, like they're not going to buy anything but to sell the home most likely. So you can't, if you just focus on the buy side of the conversation, you're never going to get to where the real opportunity is on the list side. Once you have the listing, you will obviously sell that house, well, we've done studies on this, you'll sell an average of six other houses off one listing. With a buyer, you will sell a buyer a house. So open your mind to the opportunities that are all around you. Stop thinking and stop sitting around waiting for, you know, something to change. You're the change that needs to happen if you're not liking your, you know, your project, your your momentum right now into the new market. Yes. And you uncovered another mistake, which is assuming that, you know, it's just it's another buyer. I already am up to my eyeballs and buyers and there's no inventory. So why would I want another buyer? You're missing the point. Buyers bring listings and in those price ranges in the right range, you can get buyers who have a listing that are less expensive than the new construction and more expensive than the new construction downsizing. You can actually work both ends of that. Well, it's a frustrating it's frankly the wrong way to go about it. If you're trying to sell a buyer a house and try to find them the right house, the perfect house, all the rest of it, yet they have a house to sell. I'll give you a little advanced coaching here. None of them are going to emotionally commit to purchasing something unless they happen to have the cash to pay for it, which is unlikely. You know, they're not going to have the cash without the sale of their current home. So they won't emotionally commit to anything until at least their first their existing home is listed for sale, let alone in contract. So this is the type of, you know, thinking you need to adjust towards and realizing that the best opportunity is always going to be on the listing side of the business. That's right. So here's the thing back to a point or mistake. Number one, waiting around. Well, what about interest rates? Interest rates will eventually get lower, but are not likely to go below five and a half to six and a half percent, maybe even for the rest of your career. What we just went through is not the norm. So stop wishing for the old market and embrace the new market. Now, that said, there was an interesting there are some political hubbub that's floating around about the fact that, you know, different politicians are starting to lobby for the idea that there's going to be I told you about this. I heard that crazy permanent 30 year mortgages at three percent, which I mean, it sounds great, right? Even if it were four percent, it would be pretty interesting. Well, yeah, they're going to sell like 100 year bonds and finance it and the whole thing and that could stimulate something. Oh, my gosh. But it's also going to well, so let's think about this. You're going to massively increase demand. And what that's what is that going to do to the cost of real estate as well as inventory available? Right. So you might have a low interest rate, but, you know, the four hundred thousand dollar house you're interested in buying is now worth two million. So anyway, I would circle the wagons back probably to new construction if that happens. We'll see. We'll see. We'll monitor that. OK, so the weighting gain. Learn about several ways to achieve a lower rate and a lower payment. What rates are higher than a lot of people want? Refer to last week's podcast about three ways to achieve lower mortgage interest rates. Learn about what the builders are doing. Many new home loans are closing today in our times where rates are over seven. The new construction loans are closing the mid five, five and a half range right now. So take action to find out where in your market is that actually happening? All right. So mistake number two, there was a lot wrapped up in number one, number two, expecting your buyers to send you what they want to look at versus finding the right homes for them yourself. We've done so many podcasts. I know, but this is such a mistake. You know, yes, we know that buyers can find listings online. There's five million different resources. But what happens when they take them to you? Isn't it already in contract? Aren't there already multiple bids? And then you believe there's nothing and you wait for them to go discover something. It is not their job to find something. And furthermore, well, let me get in my points. I probably talked about this. So get and use the buyer presentation, which drills down on specifically what your buyer clients desire in their next home. That can be a mistake is not knowing the specifics. What is a deal maker and what's a deal killer? Are both people on the same page? If you're working with a couple, can you handle objections like I want to wait for rates to come down or prices to come down or both? We talked about that previously. Now, once you know what they need, that they are motivated and they're qualified, it is your job to find them the right home. Think out of the box. Refer to our podcast series about how to find inventory. So, for example, consider changing the type of property, single family to maybe a town home or a condo or vice versa. And the price range, in fact, sometimes going a little bit down market can actually find good alternatives, expanding the geographic search or looking at new construction. And there's a counterpoint here. I've been working on this with coaching clients, OK, which is when a buyer does send you that magic listing. I got to see that. They're really juiced up about it. And that's the only thing they sent you today. OK, so why that one versus everything else that they saw? Ask them why that one and then have two or three backup houses set up. You can always cancel showing appointments. Right. Because what if they're wrong? What if the MLS pictures didn't have the power tower in the backyard? Have another plan. You have a showing appointment. Go sell something. Does that make sense? It does, of course. But I mean, I just we could talk forever about this point because there are so many different places where they can go and look for homes that are officially for sale. But really, I was thinking if I are coaching somebody right now, this you're gearing a lot of your points towards too many buyers, basically. Yeah. And your last point, I really like because you're in essence saying, well, make make it so that the buyers are working with because there's never a true have to buy buyer. There's always want to buy buyers. In other words, there's never a buyer. There's buyers will always change their mind. That's the problem. They're always going to say, I'll wait till next year to raise the fall, wait for pigs to fly, whatever it's going to be. Whereas if you're focusing on a listing, the sellers actually have to sell usually for financial reasons or, you know, whatever it just overall right now, obviously you're going to make more money and have more leverage and freedom if you're focused on being a listing agent. So what would happen if you decided to actually become a coaching client, actually follow our system, actually build up to your magic number of listings, which for many of you is maybe five or seven listings, sometimes depending on your price point, might only be three. And the only buyers you work with are those are the sellers that want to buy something. In other words, stop working with buyers that don't actually have homes to sell. Start valuing your time more and you'll get far better results. But it's also going to force you to become a far better listing agent, far better, you know, proactively generated for the sake of listings. And you're going to get vastly better at prequalifying because you're going to be, guess what, choosing who you're going to work with. So if you're finding yourself emotionally and financially burning it at both ends, it's probably because you just don't have any standards. It's probably because you're working with just about anybody. You're willing to pay referral fees. You're buying all your buyer leads. You're not really running a business, guys, in the sake that, you know, you're going to have any kind of, frankly, security going forward. So really pivot your thinking and ask yourself, would I rather be a really amazingly strong listing agent or buyer's agent? Every single one of you want to focus on being a listing agent in a lot of ways. You have to kind of choose because the buyers will suck up all your energy and your time. Now, if you want to transition from being one to the other, go back to the fact that, you know, you need to prequalify better. You need to actually ask those buyers if they have homes to sell. Depending on the price point, you're going to discover that most of them do. And then guess what you do? You pivot and focus on the listing side of it because that's when you're going to create the leverage. Joining our premier coaching program is free. Not having enough leads in the first place. Speaking of lead generation, if you're struggling with lead generation, it's time to get some help before it's too late. Now, more than ever, it's critical that you generate more leads than you think you need in order to do the business you need to do. To your point that no buyer ever actually has to buy. So you have to overdo your lead generation so that you can find those listing leads in particular. Well, if you want to sell, for example, if you want to sell 10 houses in the next six months or maybe it's the next 60 days or next 30 days. And normally, let's say you are you know, let's assume that you're somewhat efficient and you know, you have a ratio. Let's say, for example, if you have 10, well, let's say you have six seller leads, you know that statistically three or four of those are going to list with you in the next 30 to 60 days. You're going to need to double that in a market like this because people are there's going to be a lot of a lot of headwinds that you're not necessarily going to be able to control, mostly with lack of inventory. So you're going to have to pace out your expectations and increase the number of contacts and increase the number of leads you're working with. But it always goes back to really drilling down the leads you are working with. Otherwise, what you're going to quickly discover is that you have hundreds, if not thousands of unqualified, unmotivated, quote unquote, leads, and none of them are doing transactions with you. And why? Because you're not taking the time to go in there and prequalify them. If you're one of these agents who have falsely believed that the way to win this game is by having massive amounts of leads, I challenge you to do this. Go in, grab our seller prequalification script or our buyer prequalification script, which turns into the seller prequalification script, and call every single one of your leads. You'll discover many things. Number one, the ones you've been dripping on for a long period of time. Some of them don't even know why you're messaging them or have never even seen your messages, let alone know who you are. Number two, some of them already transacted months ago, but you didn't call them. So they didn't transact with you. Number three, you're going to find people that are actually motivated and they're waiting for you to call. You've been treating them like a buyer and sending them home buyer tips and all the rest of it through your drip campaigns. But now because you have them on the phone, they'll actually commit to working with you. You've got to stop being passive with your life, but especially with your lead generation. Well put. So that all goes back to not having enough leads in the first place. Was it luck and hopium or did you connect with those clients through a proven system or strategy? If it was a proven system or strategy, why did you stop doing it? How many leads do you actually have in your pipeline? To your point, what your story, you were just saying, what I was thinking is a lot of agents think that they're leads, but they're just contacts. They're just people in your database. Why are you calling them leads? You don't know if they're a lead or not because you're not talking to them. Now you also might have a lead conversion issue versus a lead generation issue. That's something that the coaches drill down on. Where are you spending money to generate buyer and listing leads and what is that conversion ratio and how many contacts are you actually making daily where you're speaking with a decision -making adult about real estate? That's just the beginning of great coaching questions to drill down on why you might not have enough leads or appointments. Well, where you're spending money to generate buyer and listing leads. I mean, obviously it was assumptive, right? In other words, she's not suggesting you spend money to generate buyer and seller listing leads. Uh, but she's suggesting that you actually go in and question, frankly, uh, whether or not that money that you're spending to generate leads from those sources actually makes any sense because we know you're doing it.

Well, in our previous conversations, we've kind of delineated what the battle is and who the enemy and some of the different ways he and those evil spirits, essentially the diabolical spirits, can assail us. But in this particular series of conversations, we want to talk about the commanders and our comrades who are just incredible in why the victory has been won. And it's so important because it's the warfare can be intense. And you start thinking about the power that the devil has and his demons and those kinds of things. It could be easy to get terrified or intimidated. But the good news is that he's already been defeated and that our Lord, by his passion and death and resurrection, has already defeated him. And that's why St. Paul could say to the Corinthians, thanks be to God, who's given us the victory through our Lord Jesus Christ. So that's so incredible. We would be lost without him. It would be terrible. You know, I think back to the days when my final days as an atheist and where I had begun to encounter demonic powers, but still didn't believe in God. And it shocked me out of my materialist position that all that existed was kind of what you could see in here, matter and energy. And I finally realized there are other things out there that are beyond this nature that I see around me and they're evil and they're out to eat my lunch. And, you know, came close to despair at that moment. If those things are real, I don't have a chance. And yet I realized, but, you know, the same people and the same books that told me so long ago that these things were real also said that there was a God and a Lord Jesus Christ who conquered them. I'm going to go back and read and I'm going to go back to those people and talk again. If there's a devil and there's no God, I'm really in trouble. But if there's a devil and there is God, then there's hope. And that's that's the message. There's hope because of our commander. In the manual for spiritual warfare, over and over and over again, you cite scripture passage upon scripture passage that really helps us to kind of like our Lord in the desert, just identify constantly what that is and then talk back to it in the sense that it's not our words, but it's his words. And of course, I mean with a capital H. And it is so much more powerful. There's, you know, it's one thing for us and our own words are important, too. But it's one thing for us to resist the enemy and tell him to flee or contradict what he says to us. But when we do it in the words of Jesus himself, our faith is so much greater, our confidence is so much greater that that what we say is true. And the enemy goes to accuse us and we take the words of scripture that the accuser of the brethren has been cast down. He is an accuser and he's been cast down or that in his glorious triumph he'll come with all the saints in the armies of heaven or Saint John's words, which I come to again and again. He says, you are of God, dear children, and have overcome him, the devil, because greater is he who is in you than he who is in the world. And how many times have I had to say that to the enemy? The one who's in me is greater than you are. So get lost. That's right. And that's something that we always have to remember. We had those two incredible witnesses, and in so many of the writings and scriptures, but in particular of Saint Paul and Saint John, Saint Paul says, it's not I who live, but it's Christ who lives in me. And here, just as you cited in 1 John, John the Apostle tells us once again, he who is in you, he is greater than he who is in the world. Who is in us? The great commander, our Lord Jesus Christ. In the end, the enemy is only a creature. He's a very powerful one. He has powers we don't have, but he's not some God of equal power to the good God. You know, so we're not dualists. We don't believe that there's a good God and a bad God who have to fight it out through history. He's a creature who went wrong, and even though he's very powerful, God is still God. There's only one God who's omnipotent, who's all -powerful and all -knowing. And as Saint Paul says, that he will soon crush the devil beneath your feet. And that's such a powerful promise to hold on to. And you alluded to earlier as well, those armies of heaven, which consist, as Saint Paul said in the letters to the Thessalonians 1 and 2, it's with all his saints and it's with the angels. It's that beautiful reference in Revelation that talks about Christ coming back as a warrior. And I know a lot of folks aren't comfortable with that image of Christ as warrior because we just think of him as the suffering servant and the lamb of God. And all that's true, but the book of Revelation shows him not just as the lamb who was slain, but also as the conquering warrior at the end who does finally totally crush and corral all the enemies of the saints, all the evil that we're fighting against. And talks about when he comes, he comes with the armies of heaven. And so you ask, well, who would be the armies of heaven? Well, Saint Paul then comes in and he specifies that in 1 Thessalonians 3, 13, he says he will come with all his saints. And in 2 Thessalonians, he says he'll come with the angels of his power. So those are like the two great divisions, you might say, of his army, of his host. Those are the comrades we have in battle. The queen of the saints, the queen of the angels, Our Lady, the Blessed Virgin Mary, she is also referred to as the queen of humility. And yet it's in that humility that the irony of it, can we say, that she is able to crush the head of the servant. You know, I think it's important for us to see that what Our Lady did was to undo what Eve had done and to undo what the devil had done. How did the devil fall? Through his own pride. You know, we get in the book of Isaiah, the words that I will ascend to the mountain of the Lord, you know, and he wanted to take God's place. And so his great pride gets undone. It gets overturned by Our Lady's humility, by, you know, his fiat was, I will rule, and her fiat was, let it be done to me according to thy word. And so her humility overturns his. And she undoes what the devil did. She unties that knot that the devil tied, so to speak. And you get that predicted, prophesied all the way back in Genesis, when the Lord speaks to the serpent, who, of course, represents the devil, says, I will put enmity between you and the woman and between your seed and her seed. He shall bruise your head and you shall bruise his heel. And that's why, of course, we have all these wonderful images of Our Lady, not just with the crown of stars above her head and the moon beneath her feet, as we get the image in the book of Revelation, but also with the head of the serpent crushed underneath her heel. Because though Jesus did the direct battle, she, by her fiat, by her agreement with the Lord, yes, of course, do what you want and I will bear your son. By that fiat, she also took part in that crushing of the serpent's head. And Eve gave a yes to the enemy's temptation and brought death and the devil's domination to the world. But Mary's yes to God instead of the enemy opened the door for the ultimate victory of her son over Satan. That's why we call her the new Eve. By her obedience to God, she undid what the first Eve had done by her disobedience. Well, one of the great saints that you mentioned here is not only a doctor of the church, but a loyal son of St. Francis, that St. Bonaventure, who writes so very strongly that, and he was a brilliant, brilliant, intelligent man, but even he had to acknowledge that men do not fear a powerful, hostile army as much as the powers of hell fear the name and protection of Mary. And we get that, you know, it's not just a speculation. There's all kinds of experience of that and exorcisms. A recent exorcist who talks about how an enemy, a demon, was protesting over the praying of a Hail Mary and saying every time, I'm paraphrasing, but every time you say that Hail Mary, it's like a hammer hitting my head. They have such a hatred for Our Lady, and they know that she's overcome them. She's the Queen of Angels, and as I say in one of my prayers in here, she's the Queen of Angels, and she's the bane of devils. They fear her and they tremble before her. Her name is terrible and powerful, it's the name of Jesus. Well, to them particularly, it's so beautiful that in the Manual for Spiritual Warfare, you have a whole section on prayers to Our Lady.

This is your host, Jon Safran. On today's episode, we're going to discuss what's happening with Genesis, FTX, and some regulatory mandates that are coming from China and a new bill that's coming from the UK government. So to kick this off, we're going to talk about Genesis and how they're going to stop offering crypto trading services. So Genesis has announced that it will no longer offer crypto trading services, and these include digital assets spot and derivative services. The development comes after it reached a credit agreement with the DGC or digital currency group. And the agreement allows a 70 to 90 % credit recovery. Genesis had to take the call to halt its crypto services after suffering massively from last year's collapse of FTX and the three arrows capital. So last year's crypto winter was horrible for the entire crypto industry, and its effect can even be seen in recent times. BTC currently is trading around $26 ,600, which is down from its all -time high of $65 ,000. The company has interacted with the media to clarify that the decision is voluntary and has been taken for business -related reasons. Genesis no longer offers crypto trading services, and Genesis additionally said in the media statement that they have been terminated from the DGCI. And the DGC has earlier announced that it was narrowing down its efforts to reach an agreement with Genesis in their Chapter 11 bankruptcy. The idea was to resolve the claims as soon as possible. Meanwhile, interest in the blockchain technology is growing across the world, with governments and financial institutions looking to explore the technology. And the objective is to facilitate cross -border transactions securely and at a lower cost. Ripple had claimed that the technology had the capability of saving at least $10 billion in cross -border transactions. However, that can only happen by the end of 2030. And also, financial institutions and customers are estimated to experience faster execution of a transaction. So Genesis and DGC, they claim that DGC owed $500 million along with $4 ,500 BTC. And the court documents have revealed that the actual amount may be somewhere around $600 million. And it dates back to September 7, 2023, when Genesis alleges that DCG borrowed $500 million across four loans from Genesis. And this happened in 2022 and was in addition to borrowing $18 ,697 BTC in 2019. So Genesis filed for bankruptcy in January this year, claiming that DCG and DCGGI were wrongfully in possession of property that actually belonged to the bankruptcy state of Genesis Global Capital. Loans have matured and are payable as of May 2023. However, DCG wants to convert them to open loans. And Genesis never confirmed agreeing to this and continues to seek repayment. On September 15, 2023, Genesis said that it is now shutting down its crypto trading services after reaching a conclusion with DCG. It's an ambiguous reason and has been given for a series of ceasing the services and stating that the voluntary reason has been taken for business reasons. Now, the community and media platforms wait for more specific reason. However, customers continue to wait for instructions about what they should do if they have deposited their funds and are in the middle of executing a trade or have executed the trade. Now, on to news with FTX and the FTX bankruptcy state is suing Sam Bankman -Fried's parents, Joseph and Barbara, to try to claw back some misappropriated funds. And the filing redacted in part asked the court to award the FTX estate damages the return of any property given or payment made to the parents. And the bankrupt crypto exchange has sued founder and former CEO Sam Bankman -Fried's parents, Joseph Bankman and Barbara Fried, to recover millions of dollars in fraudulently transferred and misappropriated funds. Now, the company said this in their filing on Monday. And the filing, which was redacted in part, asks the court to award the FTX estate damages the return of any property given or payments made to the parents by FTX in the past and punitive damages resulting from conscious, willful and malicious conduct.

"Hi everyone and thank you for joining us for the 479th episode of The Hollywood Reporter's awards chatter podcast. I'm the host Scott feinberg. And for those of you tuning in, we are recording this episode in front of an audience of students at Chapman university, where I'm a trustee professor. My guest today is a fantastic actor whose journey from 1980s child stardom in films like 1980 fours Indiana Jones and the temple of doom and 1980 5s The Goonies to an Oscar nomination this year for everything everywhere all at once is nothing short of incredible. A 51 year old Vietnamese born man, he was, as The Associated Press put it, one of the most incredible faces and voices of the 1980s, and as GQ noted, he was also at the time one of the only visible Asian faces in any western media, much less two of the biggest blockbusters on the planet. And then, for more than two decades, he disappeared from the public eye. But not from the business he loved. The story of his return to acting, which has resulted in Gotham Golden Globe critics choice New York Film Critics Circle Los Angeles Film Critics Association and national society of film critics awards, as well as a BAFTA nomination and pending spirit sag and Academy Award nominations could be a movie itself. Indeed, he is now poised to become the first Asian male to ever win an individual sag award for acting in film and only the second Asian performer to ever take home the best supporting actor Oscar. The first, since Hangzhou for the killing fields, 38 years ago. To quote a recent piece in the Los Angeles Times, F. Scott Fitzgerald famously said there are no second acts in American lives, but he'd never met kihei Kwan. Would you please join me in welcoming to Chapman university, mister Kwan. That's for you. Wow, this is incredible. Thank you so much for coming. Thank you. Thank you, wow. Thank you so much for coming. Oh, you know what? I was gonna, I don't know, man. I'm trying not to cry tonight, okay? But I think this is a bad start for me. So let's start at the very beginning. Where were you born? And what did your folks do for a living? Oh, I was born in Vietnam in Saigon. It used to be called Saigon. It's called hold you mean city now, two Chinese parents. And my dad is a businessman. He owned a factory that manufacturers trash bags. And my mom, at that time, only clothing store, but then when they gave up everything they had to get our entire family here to the United States, it was a tough for them. So to me, to this day, they are the heroes of my life. To the yeah.

"But I watched him play in LA on Thursday. And look, I've been hard on Christian wood in the past. I thought his Houston run was terrible, I think, you know, his defense has oftentimes been indifferent. Let's call it, to be charitable about that. But he just works in Dallas, like playing off of Luka Dončić, works for him. He's at least trying, I think, more defensively in Dallas. I mean, you saw, he had 5 blocks in that double overtime game against the Lakers, including one which I guess should have been a foul on LeBron at the end of that game, but you know, I bring wood up because he's eligible for contract extension now and there's been talk of the Mavericks trading him if they don't get a contract extension with him done so they don't risk losing him for nothing. At the end of the year, I know Christian wood wants to get paid. I would too. This is your opportunity. But he's got a good thing out there, man. He has got a situation where he is playing off arguably the best player in the NBA, a guy that draws defenses or defenders like a magnet and puts him in a position for wide open threes, which is what Christian wood does or lobs, which is what Christian wood does. So if I'm Christian wood, I'm not saying take a low ball offer here, but if your desire is to go into free agency and sign a four year max level deal with like Charlotte, I hope the money's worth it. Like the money, maybe it will be. Maybe you need that maybe you want that extra cash, but if there's a pathway to getting a deal done with the Dallas Mavericks, Christian wood needs to do it. Because he works there and he didn't work in Detroit and I'm not sure he's going to work anywhere else. It's just my two cents on it. Yeah, and that's the thing, right? Like he could get a big payday by some team that really badly needs an offensive minded big man who can do some things or whatever, a Charlotte or whoever. And, you know, it might be where he makes the most money, but it will probably be a place where he never gets to win at this level again. And that's a tough thing. It's not a lot about this over the years of covering this league and moderating my own position quite a bit. I used to really on some level it would bother my sensibilities if a guy went for the money instead of winning and I've changed on that. It's obviously one, it's not our lives to lead. Our choice to make. So there's that. But you know, yeah, winning is really important and we project this as media and fans we project this on to these guys. Well, they should all want to win at the highest level, even if it means sacrificing shots or sacrificing some dollars. Easy for us to say. I would not blame Christian wood if he went for the bag somewhere else if it were a bigger bag. But yeah, ideally for his career, you know, you said it. There's no better situation for him. And if he can continue to evolve defensively, try to be more accountable at that end of the court. He certainly has the athleticism and the ability to be a better defender. And playing off of Luca, and the Mavericks, perpetually one player away. You know, they get that one other guy whoever it may be and they're in business. So they don't even need they don't need not to make this a maverick's discussion, but they don't need a second superstar.

"We talk about every week and most of the time it's justified, but here we are at this point. Several things wrong with that. Number one, like, where's darvin ham in that situation? Like, you have a timeout left, like Russell Westbrook gets to stop. He's dribbling the ball up, and once you see that look in Russell Westbrook's eye, where he sees red. He sees Joel embiid standing in front of him and he says, I'm gonna go get him. Why darvin ham? Are you not running towards the referee and calling time out? You still would have given yourself ten seconds. You could have run a play. LeBron was 15 for 23 in that game. One of his best games of the season. That's the guy you've got to get a touch. You've got to get the ball in LeBron's hands. I do have a slight issue with LeBron too because if you watch that play develop, like LeBron kind of coasts up the floor and doesn't go get the ball. Like if I'm LeBron, I am stomping my feet clapping saying give me the ball. I know, look, not that he needed to take the shot, but the ball needed to touch his hand. Howard, on the same night, we saw the nuggets go out of their way to get Nikola Jokić the ball at the end of that game. And jokic, that wasn't a high percentage shot. Like that was a great shot, but it wasn't a high percentage shot. It was a step back three pointer from a 7 footer that was not, I don't care who you are. That was not a high percentage shot. But they made sure he got the ball. In those situations, LeBron James needs to touch the basketball. I just was flabbergasted by that entire sequence at the end of that game. And look, I understand DARPin Hamm has to support his guy. He has been staunchly in Westbrook's corner from day one, and that's really the only way you can keep him engaged with this team, but the idea that he would take that, what did he say? You know, 6 times a week and twice on Sunday, whatever he said. No, no, no. The ball needed to go in LeBron's hand. A timeout should have been called. They should have run a play and they would have had a chance to win a game that they may need in April come playoff time. That was an NBA TV game, so when the game ended at least on my TV, it went to the NBA TV studio and they had Terry stotts and Sam Mitchell there, both of course, you know, have coached a lot of years in the NBA. And they were dancing around a little bit, like Sam Mitchell initially went all in on the idea. Like, you got a call timeout and it was funny because he kind of went through this thing about how casta is still new to the NBA TV thing. And I don't know how many times he's been on this season or I haven't seen all of it or what he said, but he actually kind of said, initially it was kind of agree with Mitchell about that Darwin's got a call timeout, but then he was like, you know, we've got in trouble a couple of times for the things which were second guessing, so I don't really want to go there. Like he was trying to be very careful with respectful of darvin ham and they even went to the extent of saying, you know, this is one of

"If anyone's looked it up, but has anyone ever won coach of the year as essentially not the interim because they gave Jacques a contract. So he's not interim. But as the in season replacement and become coach of the year, it's been an impressive turnaround. It's due to a lot of things. We've talked about this, not to diminish anything as Jacques van has done. I think he's been the right voice in the right leader at the right time. But they got healthy. Ben Simmons started to get his game together, not so much recently. Let's see how they do with Durant out for two, three, four weeks, whatever it's going to be. That's going to impact how we view this. And right now, by the way, they're going to without Durant and kairi's been shrinking from the moment. So that's going to impact things. My next ban up on that ballot though, even possibly before Mike Brown might just be Willie green, they have seamlessly incorporated Zion back and as ions out, but bringing Zion in as a guy who had not even played with this group, right? It was almost like he was a new player to that team because they found their footing last season after the McCollum trade and the incorporated McCollum with Ingram. Then they bring in Zion. Now you got a big three, then Ingram's out. Zion's in. Like, a lot of youth on this roster. There's just a lot that Willie green has had to manage with this group. And I think he's done a fantastic job and then just to note this, the coach of the year race is always like 6, 7, 8 deep. Like there's always a bunch of good candidates depending on whether you're pulling from the top tier of teams or that middle tier where somebody's made a leap, all the guys we mentioned are going to be in this race. Missoula, as you mentioned, is in this race. I think Taylor Jenkins is in this race with the grizzlies. I think Michael Malone never gets enough credit for what the nuggets do year in year out, despite always having guys hurt, despite always having to reshuffle the deck despite a franchise star in jokic who you know is not going to be your defensive anchor. And you always have to try to patch things up around him. Like there's a lot of things that Michael Malone has to manage there that he just never gets enough credit for and probably should be on some balance as well. All right, so you would go Jacques Vaughn number one and just ahead of Willie green and Mike Brown, I think if we're doing the typical three man ballot. Okay. Yeah, yeah, look at that, that's a perfectly reasonable one thing. Jack bond's been instrumental to that team's success, settling that locker room, being kind of the respected guy in that locker room.

"Anything left. Well, I think it's illustrated that you bring up Isaiah Thomas because I think what it's showing is with the way the league is headed, first of all, the point guard positions loaded. Secondly, if you're a score first player and you're undersized or you've had injury issues, you have to either be a really good at scoring or bring something else to the table because you will just you can not hide defensively in this league anymore. And to put the canvas, the Isaiah's of the world, once that scoring falls off a little bit, the calculus on that kind of player becomes a lot different. Can they have a bench roll maybe for the right team, yes? Can they be a truly meaningful contributor to a contender? I don't know anymore. Just how difficult that position is in this league and how I don't want to say literally one dimensional these guys are, but when scoring is kind of like your far and away best attribute, if that falls off, even a little bit, you're in a tough spot. The Mavs could definitely use the help. I don't know that it's Kemba, but we'll see.
