"All right, so yesterday we closed the show on a fiery statement from kraken's Jesse Powell. I'm going to reread that tweet now. Jesse writes, I have a theory regulators let the bad guys get big and blow up because it serves their agenda. One destroy capital and resources in the crypto ecosystem. Two burn people in deter adoption, three give air cover to attack good actors. The bad guys are actually on side. Good guys are the enemy. If the bad guys can run long enough without blowing up, they might just kill the good guys for you. Bad guys operate with huge competitive advantages. They suck up users. Revenue, and venture capital that would have otherwise gone to good guys. Bad guys can always be jailed later. So today I want to dig a little bit more into what prompted this particular statement. And to do that, we need to talk about custodia bank. Custodia bank is a special purpose depository institution or SPDI in Wyoming. And has long had ambition to be a very different type of full reserve bank. The bank was originally called avanti and it was started by Caitlin long a few years ago. Now for much of its life it's been going through an onerous process to become part of the Federal Reserve system and get access to a Federal Reserve master account. A master account would give the ability to access wholesale payment systems from the fed without needing another bank as an intermediary. This is obviously hugely important to the development of the business model that they ultimately wanted to be in. Well, custodia was left waiting so long that last June they filed suit against the Federal Reserve, saying that it was unlawfully delaying their application. Custodia claimed that the fed's own paperwork says that a master account decision ordinarily takes 5 to 7 days. Meanwhile, by making custodial wait 19 months, the fed had quote clearly violated its one year statutory deadline. Still, another half year passed before the fed finally issued his decision. On January 27th of this year, of course, a couple months after the FTX collapse, the Federal Reserve announced their denial of custodial application to become part of the Federal Reserve system.

Takes a chop off to stick this in your mouth. It's going to change your life. And at that very moment i was like how in the fuck have i not had a lamb chop like this before. I've missed out on all these years. And now i've been actively trying to make up for lost time upsetting when you try something that you thought sucks or that has been cooked horribly for whatever the reason is and you're like oh my god. What an eye opening experience. I love lamb. I love it because it's different because it clearly is not chicken clearly it is not pork it is not be right it is. I hate to use the term. It is a little gamy but in the best sense ever. No it is so great and one of my favorite parts of lamb is the fat on the edge. La i feel like the whole summer. Always our pictures of grease people's new babies people's baby bumps like congrat- to everyone. But i kinda just over it like i it. Yeah the content. I wanna see and like we're finally starting to see like lot hayes even on people's instagram's because they can go to a coffee shop like i'm here for it but yes. I agree the hair and makeup artists. All these people that we follow on instagram. it's like their feeds are just popping off again and i can't get enough of it like i'm loving it. I feel so alive. -solutely we're not gonna talk too much about the met gala. Because i know that this episode is dropping like quite a bit later. I just have one thing to say. Though is megan fox morphing into deed. Avantis like i feel like she must have pictures of her on the inspiration. Where every time i hear i to do a double take what their faces a completely different. I think that whole like pinup style that she wore to the matt gala with the suicide bang and And the lips and her body is just really gotten sit. I personally was really inspired by all of the female athletes that were in attendance at the met gala and. I think that they're finally getting those moments to shine like. Simone biles was wearing a dress that weighed eighty pounds. Or something like that. And i feel like she probably does away much. More than that and yeah. We saw like naomi osaka and we saw a canadian. She's i'm like loving her right now. Leyla fernandez she was the runner up in the us open and she just have total blow up. Moment at the mcallen she was wearing this caroliina aurora dress. That was inspired by that. Iconic shot of venus and serena williams from decades ago now wearing that black and white dress in vogue. And i just feel like it's so amazing and meghan rappeneau with the purple hair. She's also shiseido ambassador now so just really great that we're seeing all of these different types of conic looks iconic women conic people serving up all of these beauty looks and you know it's just interesting to see all of these types of people go through the quote unquote hollywood machine and it actually reminded me of like a video that i was watching from tanks which of course is like tick talks big sister everybody loves chinks and she herself is kind of like morphing into a bit of a celebrity slash influence. Her like she got invited to every big party at new york fashion week. She's you know she's up the mikhail. She's like the one every brand wants to have on the front row rate l. and she's been reflecting a lot on she's like i'm fascinated when a real percent turns into a celebrity like that moment that it kind of changes transitions. Yeah yeah and so she was asking about the glam and how now. She's like addicted to glam. She hires hair and make up when she goes to a big shoot or she goes to vegas a weekend or new york and i just thought it was like such an astute observation. It's like i kinda saw it with these olympians and tennis stars. They got went through hollywood machine. And it's like damn like what. If i could go through that like. Wow we all looked so red carpet worthy like that. You know absolutely it takes a village. That's what we used to always say in the in the magazine days. Yep and a lot of spanks yeah or skims and speaking of new york fashion week. I know milan. Fashion week is starting today but have you been paying attention to any of the shows like new york london. I would just say thank you to all the front. Row editors who finally stopped filming the entire shows on their reels are other instagram stories. Like i just don't care like duct tape of content. I really don't care about. But i like seeing the behind the scenes i loved. Larry david he was front row at a show and he literally had ears plugged and was like covering his eyes wall. The models for may and i was like he's filming an episode of curb. Your enthusiasm like that does kind of mimic how. I feel sometimes watching when people would write like reams and reams of these models in these close with no contacts like. It just doesn't translate on instagram for me. Yeah but i do love that. All these hair makeup artists and people in the beauty have a chance to kind of flex their muscles again and show what they can do. And that i love. And that i am. Yeah erred by but do i care about what's going to be happening spring twenty twenty two. I can't say i do but yeah yeah. What do you think it's interesting because you were saying this to me. 'cause you know i've i mean i can't tell you. How many trend reports. I've produced that in the past that. Are you know times right after fashion week happens and looking forward to what will the trends be in the net. You know six months from now and you were saying. I do wonder if it's a bit of a mirage. I think atlanta looked like one of the worst teams in the nfl. I think we you know to be clear here. I have been higher on the eagles than most of the people here at the explanation. Nfl show i think they could finish high second in the nfc east and they look like a team that can beat up on the bad teams. Which is what they did. This is something you're supposed to do if you have a chance to be a good team. So good for the eagles. But the falcons holy crap. What a disaster. Yes i i looked at this game. And and this year ago was the two worst teams in the nfc east end or i should say the nfc and for for two of the worst teams in the nfc and because of that because of those results you saw the coaching changes right. You really could not tell you know what the dark brown ball. Whether or not he caught it the touchdown stood at. It's not like there was a big swing in the game based on the final score but just an interesting wrinkle definitely very excited to see what the eagles look like Moving forward will see how they play against san francisco. And i think that's where a lot of eagles fans probably are at okay. We got the win. That's nice But how do we fare against a real more legitimate team and more established team. After the eagles finale against washington and you know he was taken it all and he was one of the i think he was the last player that was on the field last year and now it seems like he's staying. Didn't it didn't happen so it seems like he's going to stay with the eagles now. If that's the case what does his fantasy value. I the thing is i don't really know i mean i think. Of course he's still going to get drafted. I believe. I think he's going to be stowed away on benches particularly in deeper leagues. But you know what do you do it soccer. It's i mean. I don't really know i think you probably have to stick with dallas goddard. Dow's goddard was the better tight end last year. Zakar it's coming off of twenty nine thousand nine season where he was absolutely fantastic and now you know last year really was not that good dealt with injuries and then of course you had the qb chain carson. I mean i definitely think that people are still going to draft him. But i think it's important not to reach for him because you know he's coming office season in which he really was not that good. I mean that is a good combination but right now i don't think it's fantasy values that high and it's definitely something that you know. Fantasy people are going to have to make a decision if they're going to want to take a chance on them. I mean again. I i think in terms of debt per depth purposes. It is definitely a nice move but again you don't want to reach on him but you know i it's gonna be a tough situation you know with zakar. It's i i think he's still somebody kinda want to avoid. I mean there's not a lot of weapons on this eagles offense. So i definitely think that the tight ends are going to play a very important role during the season. I mean obviously. The eagles did drift avantis smith. You know when they do have some decent wide receivers. But i don't think they're guys that are going to particularly be fantasy options. You know that you're gonna wanna start your lineup every single week you know so. We'll have to see how the eagles you know handle this situation. I mean of course. I think it speaks to exactly what we've been talking about about the denise grace foundation what we we know that an and with this particular this rebirth that we're we're seeing happened all around the globe particularly in america where people are really focused on diversity on equity on inclusion that we uncover and we shine the spotlight on those who have been systematically and traditionally left out of the story. So what. We're doing with the denise grace foundation is that we're telling those stories of great american heroes that we never learned about People never learned about that why people never learned about those stories. You know we just had him back in may thirty first. We just have this story about the tulsa race Mascot right one hundred years people didn't know about it right. You know people didn't know about it. we've seen the birth of loss of organizations. That are there's a wonderful woman by the name of hamid drake. Who's doing something called the unknown project and again it's about celebrating. Those great americans who have traditionally been left out of the story so we are going through the lens of music with the denise grace foundation so we look at somebody let who has served as inspiration for us and that is mary. Cardwell dawson hard. World awesome wanted to be an opera singer and so she graduate from the new england conservatory. Which is my alma mater. Nine hundred and five. She graduated as a double degree with voice with piano. Now took our longtime to get that degree because you know they difficult they were making it possible and would hoping that she would quit so by the time she graduates. She was thirty years old because they just kept giving her. They'll move finish line. He moved the goalposts throw. You can't do that anyway. Whatever she finished and then she wanted to get hired as an opposite would hire how so. She decided that she would create our own company. Like you've done. Look i've done. Yes seen so many wonderful mighty women due to say we'd look and see where there's a problem and how we're gonna six that problem right and if it doesn't exist and we will fill in that void. So she she created the national negro opera company Which is a building that stance is an old victorian home. The stands in pittsburgh still standing. Today it was the longest running the most successful run by this black woman. And what she did was. She gave jobs to over eighteen hundred singers. Just singers alone k then. She hired orchestras designers conductors. And the directors and all those people and then she had to find venues for them to perform all over the world and cheat all over the united states and she. She had chapters in cleveland in chicago in new york in baltimore in washington. Dc personal she created these national negro opera companies to give an opportunity to celebrate black. A artistry from these fantastic artists who were otherwise not getting higher and clearly just because of the color of their skin so then she also taught music says she taught she taught voice and she took piano and she taught languages and she starts stage direction and she had she taught over six hundred kids music. Right one of which was robert mcferrin. The father of bobby mixer amal jamal just pianist. Who still is alive today. Every ride all these ventured launched the careers of lillian avantis. She launched career of so many incredible people. And then this place this wonderful monument which still stands in pittsburgh today which we at the denise grace foundation are raising money for original wariness about to get this place rebuilt because it's nearly dilapidated. still standing. Some advancing has been declared since one thousand nine hundred four the number one on the endangered monuments list. So the young the historic preservation society. It is protected because it is a national monument but this place was also an access house in a safe house. So when jazz greats giants like like lena horne like count. Basie sarah vaughan like all these people would come. That was during the time of segregation. They had no place to stay on the tour. It would stay at the opera house. That's amazing that is amazing. So and but this is she's been called the first lady of opera and nobody knows nobody knows about her and they're hidden figure in another big. We're concerned with that. The denise grace foundation we are an organization that's about hidden figures about great american heroes know about bringing those stories to the public through the research through our programs through getting into getting educational model modules into the public schools into the music conservatories of schools of music. All kinds of things like that. And that's what we're doing. That's amazing and this conversation with you and one of your leaders of the organization ronald t smith. It was an awesome conversation and one of the things he drew out. And you brought this parallel out just into so much of what we're doing is parallel. And what miss mary did with. The opera house was away to say. I'll just include myself. I love that is what we have to do sometimes. It's exactly what you have to do because again again. If this is being controlled the wave of the country has been unfolding has been under you. Know a white dominance then. They're not going to see that they're not going to know that on until they do and i think that what's happening now is that we're seeing people who are as as we said earlier authentically sincere about wanting to make this country more equitable more inclusive more diverse and reflect who we are american experiment that we are an amalgamation of all kinds of different color and back is strain and is our beauty. Giving it to their customers would be considered money transmission, and so I think that we become so blinded to think that banking means crypto banking for crypto means the dirty Fiat side of it and not the awesome crypto side of it and a lot of the crypto related activities now can be done natively by a bank, which means that as a small startup. Become a bank. I don't have to become a crack in order to be able to do trivial thing I wanted to do with bitcoin or a colored coins. So I, just want echo that on the one side our experience on the show with trying to have a bank account. Well, we've actually been d platform because the word bitcoin is in the name right and that was for a while fairly controversial, and then on the other side of things, the work that I did with token Lee we often found ourselves without the ability to have a credit card processor because even the. Idea of touching tokens that were non speculative in nature that did not have prices that could appreciate. Well, that was still something that was on the other side of we know what we're talking about right and so you had banks that were just wildly uncomfortable with this and even the high risk tolerant ones you know the ones that specialize in dealing with really kinda sketchy applications, even those oftentimes wouldn't deal with noncontroversial uses of. So long as a company is following, the law banks can interact with them that I think is a pretty major statement and a major change from the way the banks have at least behave to this point. The best example is the universities that would like to receive digital asset gifts from alumni but are not in a position to accept them because there isn't a third party that's willing to work with them to provide the services that they need for example under an in in the US under the custody rule. Asset managers are required by law to have a third party store their assets that the the management of the assets has to be separated from the custody of the assets and again the big custodians are FDIC insured banks so as a result were in that catch twenty two where there was a log jam that needed to be broken. And so I was GonNa ask you like who your competitors would be but I realized in a way. Maybe it's set your sort of forming a new category. Or would you say like are you 'cause Gascoyne base does serve some institutions right with Coyne? He's custody and stuff like that. Sure source her. I think the difference is the definition of institution. There are a lot of folks in the crypto world who look at You know small. Twenty five million dollar Crypto Fund and say. That's an institution and technically it is. But what I'm looking at is the markets that I came from earlier in my career. The Pension Funds Endowments Foundations Sovereign Wealth Funds. These are the really big money. Investors for whom the ASSET CLASS UP UNTIL. This point has actually just been too small and not investable will. Now we're getting to the point where it to the extent that Bitcoin does continue to go up. It becomes a bigger asset class. It starts to become too big to ignore and then they start looking around and saying where's the infrastructure. One of the other points that that I've noticed is that the the institutional infrastructure in this market isn't ready for primetime with these very big traditional big asset owner institutions again. It's more more aimed at the the smaller. More risk risk-taking institutions like hedge funds or small small funds that already exist and most most folks when they say there are institutions in Crypto. That's what they mean again. The big guys really are not there. They have a much much much higher standard of professionalism that they require and when I looked around at the folks that are that are that are serving the institutional market right now first of all their trust companies from a regulatory perspective and there are two issues with trust companies for the big big investors. One is that they're not directly connected to the Fed because they're not banks and there's a reason why stay straight and Bank of New York you know in the securities industry are banks. They're connected to the Fed and that's what the institutions WanNa see And then the other is that the the trust companies are that you don't know what your status in bankruptcy is and again. This is another one of the reasons why the banks win from a regulatory perspective. But there's a there's also another issue that I I started looking at the terms and conditions of the folks that are serving the quote unquote the institutional market right now and it is it to be honest in in some cases it's a joke There there's one that serving the institutional market that defines bitcoin as quote a digital asset. If they all of a sudden wake up and decide that bitcoin suddenly bitcoin cash and the customers go to sue them. They would have no claim in court because the contract was so vaguely drafted. There was really nothing promised. The four policy is another one where I was looking at one again institutional firm and the Ford Policy said that they had in their sole discretion the ability to follow a fork. If any and again what's the legal legally enforceable promise in the language there there's nothing So when when an institutional attorney and again I'm talking about a pension fund type of attorney starts looking at the terms and conditions in the contract. They're they're going to say look that that's not even close to the standards that I need. And lastly there's another piece of this you alluded to it in in your question. Why Oh Ming defined the status of digital assets under Wyoming's commercial law. We're the only state to have done that. And that would therefore the only state that would be allowed to start a bank because you have to know what the status of those assets would be in in a legal dispute again. This gets back to institutions needing to have clear clear rights and obligations in the transactions. And if you don't know what the status of the asset classes in a legal dispute. You're taking a lot of risk that a judge is is Is is going to determine a lawsuit you rather than in your favor and institutions. Just can't take that risk they also can't take the bankruptcy risk and again if a judge doesn't know what the exact status of the assets are under the law. Then then you don't know what your outcome is going to be in bankruptcy so all these things are important building blocks that had to get put in place before we really go prime time.
