Files a couple of grievances over the city's failure to destroy complaint register files the same one, the Federal Court twenty years before same types of. The Federal Court had ordered not to be destroyed. So the F. O. P. is filing grievances saying what in not destroying these complaint register vials city denies both of the grievances and the F. O. B. initiates arbitration. Well it takes a while for things to get arbitration and The cases are still not her three years later in October two, thousand fourteen when the city gets a request under the Illinois Freedom of Information Act from the two big newspapers Chicago Tribune, the sometimes, and they want complaint registered files dating back to nineteen sixty seven. Sorts of different. Core proceedings. Result from NAP and a trial court ends up granting the F. O. P.'s request for an injunction barring. The release of complaint register files until the ARBITRATIONS, can't be half. That's December two, thousand fourteen. December two, thousand fifteen. We still don't have an arbitrator's decision and the Department of Justice, US Department of Justice announces that it's opened a civil a pattern and practice investigation, civil rights, pattern and practice investigation of the Chicago. Or the provision of the collective bargaining agreement. which required their destruction. And the court answers the question freedom of. Information, act wins. and. Let me read you a few sentences from courts a Banyan, and you'll see the courts were hashing out here. The court says quote. While parties are generally free to make their own contracts. This court has long held that when a conflict exists between a contract provisions and state will. As it clearly doesn't miss case state law prevails. This doctrine is based on common law notion that courts will not lend judicial power to the enforcement of private agreements that are immoral or illegal. That is the precise situation here where a provision in a collective bargaining agreement contravenes explicit state law. Now. The decision of the Illinois Supreme Court here is not alone Surprisingly, it doesn't look like the court recognizes the decision has been litigated in other states. It has, for example, by ten years ago. There was a very important decision from the Connecticut Supreme Core The dealt with the same question and to the best of my knowledge in every one of these cases, courts have reached the same result. that. A purging clause and collective bargaining Raina cannot require the destruction of documents that eight public records law or freedom of information while. Mandates be preserved. Now, there's if you're a union and you're worried about purging, there are some ways around that's by the way I think unions are very legitimately concerned about purging I can remember watts. dealing with an employer where it was a state police agency where a trooper had gotten into a backing accident. and the employer was claiming that it was progressively disciplined the trevor by giving the trooper five day suspension. What was the prior? Discipline upon which the progressive discipline was base. It was another accident. So you know potentially progressive discipline. That happened twenty three years before. and the whole notion behind perching clauses. As you know, we ought to be able to improve ourselves. We ought to be able to reinvent ourselves. I. Mean Heck we change just about every cell in our bodies every seven years we ought to be able to change our behavior and we should not be punished for things that happened long ago in the past. So I yeah, the rationale behind Persian clauses. and. If you want to preserve that rationale, I'll be it in a different form. The purging clause will not require the destruction of the documents. It instead would simply seal them off from us as part of the progressive discipline process. For X., number of years in the future whatever you know the time line is that you want now one last point about these urging clauses If you're in the law enforcement world, there's a big focus on these right now part of the police far.

Labor world and I do have some cases that I wanNA talk to you about most notably that Illinois. Supreme. Court. Case that details what happens when a public records law collides with purging clause in a disciplinary provisions in a collective bargaining of Raymond. But before it gets there, I have three smaller things that are not case related that I wanNA talk to you about. And, the first is mostly personal. It's what's going on in my home city of Portland. And unfortunately, the news is not good. We've had protests now in Portland. Forward. For. Well over two months. for a while the federal government sent various law enforcement. Officers into town and every night seemed almost like a ritual is dance. You'd have peaceful protesters out they'd be downtown based around the federal courthouse or in the park across the street from it they give speeches, some people dancing something they singing. And then about ten o'clock or eleven o'clock at night the other people were show. Those people would be ons who don't really seem to care about what the protest movement is all about or if they do care, there's no way of telling it instead what they are into something that is as close as I've ever seen in my life to anarchy. They said, wait I'm interested in any sort of discussion and he sort of solution to any sort of problem. May Not even be interested problems. So these folks and I'll call them. The rioters would start up at eleven o'clock or midnight, and they would attack the federal courthouse and they'd attack it in various ways that our government put a fence around the courthouse. The writers were tariff down usually successfully sometimes only try they would shoot fireworks and when I say fireworks translate that to. Bang mortars or commercial grade fireworks at the building they would light fires next to the building and whatever the building was enough in jeopardy the federal government will come out and it would disperse the crowd by shooting tear gas and less lethal weapons, and of course, because the peaceful protesters were still there, and in fact, in many cases were being used for cover by the rioters. The peaceful protesters would get hit by the rubber bullets or they inhale the tear gas or whatever it might be, and then there'd be all sorts of arguments that the federal government was over reacting that you would see the next day and then we would do this every single lesson nine. Without in terms of the business I'm in, which is representing police unions on two occasions. The protesters attacked the building that is owned by the Police Association. It's five six miles from downtown. It has nothing whatsoever to do with federal courthouse or anything like that the protesters. On. Two occasions actually were able to breach the Police Association belting. they have attempted on three occasions to set fire to the building. And one of those occasions was last night. By this point, the Police Union Building is completely boarded up. The protesters were able to break through the plywood that was on a rear door or down a glass door and entered a place that is used basically for breaks by on-duty police officers. So lots of chairs and TV's on the wall and that sort of thing protesters ripped. off-the-wall through it on grounded. Let Fire. And the result was that the police came out in force and we just gotTa General Best Front of the Police Association building including some shots being fired by who knows who? The police and a truck that was driving through the middle of the protesters. As all bad has been going on on one evening the people came to my office. Thank. They can't somewhere in the middle of the night ozark thirty wasn't a lot of them but at least a one of them or probably two of them had bricks and they threw bricks through the plate glass windows of my office. They also sprayed graffiti on the garage door to my office as three lines of graffiti and words were about two feet high each line about two weeks and the first line said K. O. P. With thanks A. Misspelled that they meant to say KKK The but only K. K. O.. And then underneath a a lawyer scum. Now, and that, of course, clean up all the as cost us thousands of dollars and it leaves you with a significant sense of insecurity MIDAS not the only Police Union Law Firm that has been hit by this sort of behavior. The mistake knee law firm down in Sacramento has been hit reports are three separate times I know of a law firm, Kansas, city, and another. That has been treated exactly the same wife. So my caution. For to all of the police unions out there who are listening to this and to the police union lawyers out there. Take care of yourself take care of the security of your buildings. and. That means among other things making sure you have off site electronic backed up and make sure that everything of any value is removed from your buildings. I can't tell you how much I hate giving that invites but unfortunately, that seems to be the world in which we are presently let. Hopefully this stops it must stop right. Okay onto the labour were. and two things. Of note about the Labor world. A first of all I'd been cautioning people for a long time about social media use and. Certainly with the protests, we have seen a huge uptick in discipline for public safety employees, firefighters, police, officers, corrections, officers, all of them are doing. A being disciplined for off duty social media years. It used to be that we would collect these social media article sir. The news trawlers that we have at L.. S. and you know we might get one or two a week or something like that. some weeks and the last two months we've gotten well over a dozen articles that usually have a headline light firefighter fired for off duty social media posts so. This is just a reminder to everybody. Please talk to your employees talk to your members. Make sure they understand. This is not the time to be expressing yourself on social media. And now speaking in particular to employees and their labor organizations, there's a big push an advertising push on the Internet from various companies that are helping employers, triage, their employees, social media use I just wanted to talk to you about one of them. There are others and we'll postal Mike here. So you'll be able to see it. This is to an organization that has called favorably. And Farrelly Prides itself in being a I, artificial intelligence powered social media screening, and they have separate pages for different industries. For example, there's one for law enforcement and what they will do is four not all that expensive fries is they will scour the social media use of all of your employees. They'll look for aliases they'll look for any information that they can get that. Your employees are using social media inappropriate. And if you don't believe that these sorts of organizations exist. In need to check out the webpage there were posting. So caution these sorts of tools not only out there they're going to increase in sophistication. As fairly says, this is what they pride themselves in and I'm quoting social media screening should become an integral part of the pre employment and ongoing recertification process using artificial intelligence. Public posts can be scanned and monitor for any red flags including hate speeds, threats, violent sell tar insults bullying, and more may even have a fancy alert system where they will let employers know that the employees may be abusive their social media accounts. "Sure. So what do you have for the first one I picked actually had the character of Nikola Tesla in there if I'm not mistaken, which was another Christopher Christopher Nolan movie the Prestige about the two magicians there and probably his most underrated movie that's worth watch right I would absolutely agree yeah, and then my second wine is. A lesser known Steven soderbergh movie from we would call it the first act of his career. His it's Kafka Stephen. COPCO, which is really dark and brooding and of that time period and like involves like these big Mac intricate sets that looks like this one has. So those were the two that really stood out to me here. Pure. Okay. I I haven't seen that one soderbergh one, but certainly the prestige I completely see that. Of course, like I said, imitation game is on my list. You know it. Again, it's like. Are they going to be telling the story or are they going to be telling a Hollywood is story that kind of gets a little silly you know or whatever you know I guess we're GonNa find out the other one I wanted to bring up though and this where I hope it kind of leans towards and it's a film from last. Year. It's Ford v Ferrari. I. Hope they are planning to go very like crowd-pleaser with the whole rivalry thing and maybe gets to be like a lot of posturing and like really trying to show each other up kinda thing and maybe there's a lot of that going on and I could see that being kind of fun in the world of science and Nerdy. Kind of tough guy. Nerdy. In a way. Yeah. That does sound fun like what else sounds Dave is there was like a movie about like a wizard and he went to like a wizard school but like his parents were dead. So he end to find out what happened to him and maybe like eight movies and if someone wrote a book about him and there was a made up sporting event and all these weird side characters and a bad guy whose name, we shall not speak so on and so more Dave I've only seen two of. Those movies the first two or did you just picked at random to at random? Really which what would you did? You see I bet you saw the third one because it's Corron right? Yeah. I saw that one and I think I saw the second the last one maybe I don't know that's a random wanted to pick so I'm currently watching the Harry Potter series with my daughter we're through the first four three and four are my favorites which is corona and Mike Newell's One. So after that we go to David yes. Well Jason I think this is fun I. Think we got a lot of movies to look forward to hear I mean August seems to be. You know there's there's a lot more that we could have picked for this this little conversation here. But. There's so much coming out and I'm excited see some of the and maybe we'll end up doing an episode. One of these. Once once it gets there, do you want to on anything I got Dibs on this whole project Dave On on these. I would like the one most interested in is I used to go here. "All right. Welcome to a special episode of piecing it together the podcast where we take a look at new movie and try to figure out what movies inspired it, and today on the show we are doing something new something special. We are not doing our usual format although it is tied to our usual format. What we're doing for the first time is taking a look forward at some upcoming movies that are. Coming out soon, actually coming out this coming month August two, thousand twenty and applying the puzzle pieces treatment to these movies just based on their trailers and what we think they look like and the idea we've gotten from the trailer just the general feeling these movies seemed to be giving off and you know maybe once they do come out, we will get around to doing some episodes on them and see if we. If our first thoughts were correct with these puzzle pieces. But regardless, it's going to be a fun way to look at what is coming soon and I'm really looking forward to doing it for this first one we've got Jason Harris joining me and you guys know him. He's been on the show a bunch of times and you also know him from awesome movie year and we had a great conversation talking about six upcoming movies. August is really stacked. Lots of great movies coming out what we don't know if they're great movies, lots of interesting. Looking movies coming out. So we had a lot to pick from, but we picked six and we're GONNA get into some trailer talk. How about you? I'm good I'm doing well and I am excited to look forward to some new movies with you. This is a new thing and I'm excited for you to be the first one to do it with me. I am honored and Dave. As you know, you will not be going to any movie theaters to see any of these. I am the advocate of the streamer so. Good guest for this one. That's part of the reason I picked you Jason I. Obviously I am not exactly happy that not all these. Some of these would have went straight to streaming. In the first place they were produced that way but a lot of these would have gotten at least a small theatrical release and I'm not happy about the fact, I? Don't get to see him in a theater but his life right now, I can't just complain about it every episode I gotTa move forward and just enjoy these movies as they come you know Dave as you know an awesome movie, we cover all these different movies I feel like you were alive in one, thousand, nine, hundred, twenty, seven, you would have been like. This with Al Jolson doing a toppy what Obama silent film I don't want any changes. I liked things the way the way they used to be is the way that we put. But today we're we're making a big change piecing it together just for this special episode, which if it works, maybe we'll do a monthly or something, but we're going to take our puzzle pieces approach to looking at movies and talk about some trailers for upcoming movies. All of these happened to be coming out this coming month in August twenty, twenty, some. Of them are on Vod I'll tell where they're going to be coming and win But all of them are either on vod net flicks, Hbo Max what one of the streamers, and so you're going to be able to watch this. You're not going to have to venture out into the theater and risk your life or anything. It is something to watch at home, and so we're going to kind of guess what these movies are inspired by just. Just by by looking at it and we're going to keep them a little bit breeds is going to be five six pieces. We're just going to do two pieces a little. It looks like this meets this and see how the conversation goes and I think we're going to kick this thing off I decided Jason I didn't tell you this added time but I'm GonNa do these chronologically in release order. So the first one on our list is actually the last one that you said we should add on it wasn't on the original list and that's an American pickle which is coming out on August sixth on Hbo Max. Star Seth Rogan and Looks Pretty Damn Funny Yeah. It does look It looks interesting if not that hilarious. But like one of those comedic emotional family journeys there. So where Seth Rogan plays an old man who is Encased in a pickle brine. I guess frozen for one hundred years and he then he gets on Brian and is living again now in the time of talkies and streamers Dave and. He meets his grandson and they go on some type of. Emotional journey together, his grandson who has also played by Seth, right and. Looks like the kind of guy who would love streaming movies for free in his apartment but. Aside from that, what do you got for your two pieces for this? What do you think this movie? Kind of reminds you of based on the trailer. I didn't less about the trailer and more about like different movies that have made me feel like Joe I picked Encino man because of course that is. I. Don't think this is totally like that at all other than that is as comedic. But you know that is about a a man from another time who has to live in the current time and space, and then the second one I of course picked was fiddler on the roof because Seth Rogan plays. Thousand nine hundred. And Eastern European from the nineteen hundreds, and that always reminds me of fiddler on. Absolutely I think those are great choices for this thing I hadn't thought of Filler on the roof but that definitely fits with the Seth Rogan thing I did think of Encino man which is on my list as well. I find it really funny though that Encino man is a caveman and frozen for thousands and thousands of years it such a big culture shock. This is a hundred years which I think is a pretty funny distinction between. Between that and this is just a little bit less of a major shock but based on the culture clash is going to easily multiply that that only hundred year culture shock the other one I was going to use and like you said, you are right. It doesn't seem like it's going to be total like crazy over the top. Funny. But I still put down the Sacha Baron Cohen Film Borat because it does seem like we're GONNA get a lot of like little bits of eastern European fish out of water weird kind of comedy and they're mixed in as well. All right. Hey since we're talking about it, how `bout a blast from the past wasn't that one where dude for sixties was Transported to today or something like that or yes networks because it's again it's like it's that that bringing somebody into the current time but it's it's not that big of a jump. You know what I mean think that's interesting place to come from. But yeah, those are cool. You know one last note before we move onto the next one. The Director Brandon Trust. Again, we talked about this just recently on our episode on Palm Springs it's another first time filmmaker the this Guy Brandon trust he is a cinematographer on like a ton of comedy is a lot of Seth Rogan comedies..
