"The Senate passed a bill forcing a labor agreement between national freight railroads and their unions averting a major rail strike. That Bill now awaits President Biden's signature after the House passed it on Wednesday. Joining us live as CBS News chief foreign affairs correspondent and host of face the nation on CBS, Margaret Brennan. Margaret well a strike has been averted here that issue of paid sick leave is still unresolved. Is there anything President Biden or Congress can do about that at this point? Well, there is a separate parallel bill an argument over that. So it's not completely dead. But the crisis that was seen here with the potential strike hitting just before the holidays at a moment when inflation is high. Really led to this sort of panicked action. So the big Bill averting the strike seems to be headed very swiftly to the president's desk. In fact, he had said he wanted that settled by this weekend. So that's the sort of headline of it. That paid sick leave has been the main point of disagreement between the railroads and the unions. And I know Bernie Sanders and other senators have said they are still going to continue working on it. So do you see any significant blowback for Democrats typically, they get strong support from the unions. That's right, which is why it was such a unique and sort of uncomfortable position, frankly, for the president really have to force this in his view. Something he had to do because of the timing and the calendar and the moment we are in. But that's where we are. The approved bill passed like 80 to 15. So it's going through. But the talks have stalled. There's an attempt, of course, to say we can continue negotiating, give us more time. I mean, there are ways through this. But it is an uncomfortable position for The White House to have been put in to have to go to Congress to force workers back to stay on the job. What do you have coming up on Sunday? A lot. We have a number of things that we are chasing. We have a good lineup so far. We have incoming house. What likely I should say incoming house Republican chair by Turner for the intelligence committee, congressman Pete Aguilar, highest ranking Hispanic in Congress now in the new democratic leadership. He will be joining us for his first interview since his election to that position. And we'll talk to him about what that means in terms of his priorities. "Steve Bannon has been convicted of refusing to show up and refusing to honor a subpoena. To Congress. So Bannon was summoned before the January 6th kangaroo court and like a God fearing American patriot. Steve Bannon told them where they could stick that subpoena. And now the latest information coming out of Washington is Bannon just moments ago. Was found guilty of two counts of contempt of Congress. And he is facing a four month sentence and a $6500 fine. Now, the Biden the Biden administration wanted him to spend 6 months in jail, and they wanted a $200,000 fine, Bannon is going to be able to stay free while he appeals the judges, the judges ruling. Each contempt of Congress count carries a minimum of 30 days in a maximum of one year in prison. Now, here's what you need to know about this. There is a double standard when it comes to justice in our nation's capital, ladies and gentlemen. There's one set of rules for the Democrats and another set of rules for everybody else. And I say this because former Obama attorney general Eric holder faced the exact same charge as Steve Bannon, except a little bit worse because Eric holder was accused of harboring documents and Eric holder was also accused like Bannon of refusing to honor a subpoena and show up to testify. But Eric holder was not sent to jail. Eric holder was not fined. Neither was Lois learner, one of the most evil women in America. The woman who single handedly attacked and personally audited pro life groups, Christian ministries, and yours truly.

It says the house has voted to hold attorney general Eric holder contempt of Congress over his failure to turn over documents related to the Fast & Furious scandal. The first time Congress has taken such a dramatic move against a sitting cabinet official. The vote was 255 to 67 with 17 Democrats voting in support of the criminal contempt resolution, which authorized Republicans, leaders, Republican leaders, to seek criminal charges against holder. The Democrats support came despite a round of behind the scenes lobbying by Senate or senior White House and justice officials, as well as pressure from party leaders to support holder to Republicans, blank blank and blank blank. I'm on my way to Nashville to do the Mike Huckabee show. And they could have stopped me at my door. It could have taken me there. Instead, they let me get all the way to the airport, and as I go through the ticketing and get in the jet, what they call the jet way, right? They close everybody else in the back, trying to get on the plane and send three FDI agents behind me and two guys are waiting at the door of the plane and they rush me and you're under arrest, mister Navarre. Now, here's what's really important, rich. And this is going to I filed a motion on this today. This is going to become a key element in the case. One of the first things I said to the agent was that I wanted to call somebody for legal advice, which at that point I urgently needed, okay? And I said that more than once. It's like the Giordano. I want the call somebody to legal advice. And they denied me. That right. And then they gave me what I would say would be a informal reading of my Miranda rights. And they confiscated my phone, took me down out the gate down onto the tarmac, but slapped me in handcuffs. And then I went off to FBI headquarters. And then from there, this is where the real horror show. When I was with the FBI, I don't know, maybe 20 25 minutes, but they take me over to effectively this dungeon. You know what? Hold on to the dungeon. I want to hit a pause and then we'll come back and we'll pick up on the dungeon because I think this is, we want to give it enough time. Folks were on with Peter Navarro, former White House trade adviser to president Trump, Peter Navarro, was arrested last week. It treated like a criminal just for not complying with a congressional subpoena. Mind you, this is something that former attorney general Eric holder did, and he was never arrested. "This is all things considered from NPR news I'm Michelle Martin We're going to spend some time thinking about the ripple effects of that Supreme Court draft opinion that shocked the country when it was leaked earlier this month It signaled that the justices are poised to overturn the decision that legalized abortion roe V wade the leak of the draft opinion has reignited debates over the power of the high court and whether it needs reform But it's not the first action by the court to provoke that debate It's just the latest And one person who's thought a lot about this is former attorney general Eric holder Holder who served in the Obama administration and was the first African American to serve in that position is just out with a new book it's called our unfinished march And in it he argues in favor of changes including significant change to the process for appointing justices When we spoke he told me what brought him to that conclusion The Shelby county case in 2013 where the court essentially gutted the 1965 Voting Rights Act which is the pearl of the civil rights movement And did so in a way that was inconsistent with the findings that Congress had made thousands of pages of evidence thousands of pages of testimony near unanimous authorization or reauthorization in Congress both at the House of Representatives in the Senate Signed by or the reauthorization signed by a Republican president and yet 5 justices decided to turn their backs on all of that And came up with a rationale as expressed by the chief justice that America has changed The court has shown itself I think to be ideological not necessarily partisan but ideological in a way that's inconsistent with what their duties are And that's one of the reasons why I wanted to write the book And you're very correct in saying my concerns about the Supreme Court predate anything that the court might do with roe versus wade You offer very specific proposals to reform the court One is to institute 18 year term limits Another is to ensure that every president picks two justices in each term that they are in office given what you know about Washington and giving it what you know about the politics of the current moment and politics in recent years why would people who think that they're winning by entities ideas They won't agree to it I mean that's just the reality But the reality also is that they are in the minority And that's what people need to remember You know we talk about a variety of things in the book Gerrymandering you know you look at partisan gerrymandering which allows for these unpopular not popularly supported abortion laws that anti abortion laws that the court is now considering Because of gerrymandering you can as a state representative vote for an anti abortion law that you know your constituents don't support and not face any electoral consequence And so it's incumbent upon those of us in the majority here to express ourselves as we talk about in the book as other people ordinary citizens so called ordinary citizens have in the past When we have had systemic problems systemic changes that were necessary to implement I still think that capacity exists within the American people to become involved and to be change agents in the way that our predecessors have been But understand there will be fierce opposition from that minority But what exactly should people do right now You could see the argument that some have made In fact frankly people who are progressives have made And that other people have made is that this is a political failure on the part of Democrats and progressives in failing to focus on state legislatures in the way that Republicans have in failing to focus on the court as a galvanizing issue in the way that conservatives had and this is the end result So if that's the case what do people do Well you know some of that criticism is justified And so what do we do Get in the game Get off the bench So it's a question of being active being engaged understanding that elections matter even when there's not a president that we are in the process of selecting What you said is exactly right Focusing on elections at the state and local level are just as important as what happens at the federal level And I would actually argue that state legislatures have an impact a greater impact on the day to today life of American citizens than the United States Congress does And we need to understand that and focus our attentions on those lower level so called lower level elections That was the former attorney You're a black president. You could tell the people burning down the city to get their butts back in their houses and to stop it. You know? Not only has our time come for those who supported my campaign, your time is over for those who want to carry on an advocacy rooted in racial grievance. The election of myself to this highest office proves that the institution of the state are legitimate and open to all comers. I think Barack Obama when the SHIT hit the fan, if I had a son, he'd look like Trayvon. I deeply regret that he said that. He's president of the United States, the color of his skin and the color of Trayvon skin. The correlation between those two things. If I had a son, he'd look like Trayvon, now he says, when he said it, he only meant to sympathize with the parents. But in fact, when he said it from the highest office in the land, and then sent his attorney general Eric holder out to enforce this narrative, he doubled down on a racial narrative that I think is actually false. I think the story that systemic racism in America as reflected in policing that terrorizes black people because of the color of the skin is demonstrably false. I think that the central threat to black lives is violent crime, perpetrated largely by black people against other black people. I think there is such a thing as police brutality and I think there are reasons to have regulations of police, but I think it is a second order issue. In terms of the quality of life of African Americans, I think Obama could have told the people who, after Freddie gray, died in police custody and a van in Baltimore and undertook to burn that city down to get their asses off the street and go back to their apartments to stop it. I think he could have said in the aftermath of Michael Brown being shot dead by Darren Wilson in Ferguson, Missouri, and there was a grand jury deliberation that elected not to indict officer Wilson. And people took the streets in that city and stood on top of vehicles and so forth and so on. He could have told them we don't mob around courthouses in this country. We respect the rule of law, get your butts off the streets and back into your apartments. He didn't do that. So to push back a little bit. Yeah, good. Push back. I think you're asking Barack Obama the first black president of the United States to do the thing that I think should be done by the second black president of the United States. I think his very example, given the color of his skin, was the most powerful thing..

You went to Columbia, one of the best universities in the country. And then what are you doing? You're part of an uprising. On campus. Did they think of you as being really ungrateful both to the university and to them and to your country? I can encapsulate their reaction in this story. Somebody comes to my dorm room the night of the takeover and says, hey, we're taking over the ROTC office. We're going to form a lounge, you know? It's going to be for black kids. And so I'm there. I go. Just go, leave my dorm room and I'm there. The next day, I have to come back, get some clothes because we figure this is going to be a long siege. And my phone rings. And it's my mother. And she says, hey, what's going on up at Columbia? I understand some black kids have taken over the ROTC office. And I said, yeah, I'm one of them, mom, and she's like, yo, what? And she gave it to me like, I didn't raise you to do this kind of thing. Your father and I save money so that you go to this really great school. You worked hard in high school and you're going to put it all at risk for some stupid thing like a black lounge. I don't want you going back there. And I got out of the conversation, got my clothes and went back to the lounge, but you asked what my reaction my parents reaction was. Luckily, my father wasn't on the phone. My mother is excited as she was, didn't threaten me in any way, other than to express extreme disappointment in my father, probably would have said, I'm going to come in and break your neck if you try to go back there..

His new book is called our unfinished march. The violent past and imperiled future of the vote. We'll be right back. This is fresh air. Your parents were from Barbados. You grew up in Manhattan or in Queens? In Queens. Queens in New York. Did your view of America growing up in New York City, differ from your parents having moved here to the U.S.? I think different in this way. My parents as immigrants loved this country unquestioningly. My father came here as a 13, 14 year old boy. His mother moved here a couple of years before him, then sent for him and his sister. And he always thought this was the greatest country in the world. No questions asked. He served in World War II, and while he was in uniform in this country, first in North Carolina, he was told to get to back of a bus while in uniform in war. While he was in Kansas, I'm sorry in Oklahoma. He was told to go to the back of a luncheonette to get a hamburger or something like that again in war while he was in uniform. Those for me, the child of the 60s, would have been shattering consequential. Differing ways in which I might have viewed my nation. But for him, they were simply things that had to be overcome. And so that was, I think, the difference between us. I grew up born in the early 50s, come of age in the 60s when we were questioning everything. And it was something that presented a bit of a schism between me and my father. Again, I questioned everything. It wasn't that he questioned nothing. He was a proud black man, and he understood that there was a need for progress. But he really had a faith in this country that was unshakable..

"You watched Malcolm X get assassinated Martin Luther King, medgar Evers, you saw a tax on citizens just standing up for their right to vote. As the first African American attorney general, who was serving under the first African American president. Did you think a lot about assassination threats because you were at a very impressionable age when black leaders were getting killed? And I don't know if I've hit on a very sensitive subject that might be difficult to discuss, but I thought I'd ask. Yeah, it is not something that you allow to be front of mind. Because it could be a crippling thing. And yet, yeah, there are those thoughts. I grew up, as you said, at a time when medgar Evers was killed when doctor king, who was killed. When civil rights workers, James chaney, Andrew Goodman, Mickey schwerner, were killed when John Lewis was beaten. Interestingly, Malcolm X lived on in 97th street in 23rd avenue in Queens. I lived on a 101st street in 24th avenue in Queens. He lived four blocks away from me. I knew Malcolm X's house. I first saw Muhammad Ali. He was in cassius clay in front of Malcolm X's house and got an autograph from him. That's just a little side note there. And so it's not something that I talked about much with Barack rather than kiddingly, every once in a while. But it was something that we were cognizant of. He was ably protected by the Secret Service. I was ably protected by the FBI, and I think there was some extra measures that were taken that we don't really discuss, but I felt that with the protection that I had, I didn't have to focus on those concerns and I could just go about doing my job. Did having Malcolm X live just a few blocks away from you, make him this iconic figure more real to you. He wasn't somebody on TV. Only. His home you'd pass it in your neighborhood. And I'm sure you might have felt the shock of his assassination more as a result of being. And so in such close proximity to his home, what impact did that have on you? You know, it's an interesting question because I did see him occasionally. And not a great deal, but occasionally. And he was just this guy who had a funny last name. I totally understand that as a kid. Different religion, he didn't go to any of the churches in my neighborhood. But I understood that he was a man of significance and a person who was to be respected, even if my father who didn't agree with, you know, who Malcolm was and the things that he espoused. I heard that in my house as well. It wasn't until his assassination after his assassination. And I got to high school, and I read the autobiography of Malcolm X that I really understood. The significance of him, the greatness of him, and the promise of him that was taken from us. That is a book that I considered probably the most influential book that I've ever read. But I think he was poised to be much more important figure for the world at large and for white Americans at large..

"Let's get back to my interview with Eric holder. He was attorney general under president Obama. His new book is called our unfinished march, the violent past and imperiled future of the vote. You know, you said that you started to think of the court as being more ideological, not more partisan, but more ideological. Now we're expecting the Supreme Court to basically. Undo roe V wade because we had a preview of the decision. Now it's only a draft, but it's likely to the final versions like to be likely to be a variation of that draft. What are your impressions of the Supreme Court now in the light of that likely decision? Yeah, I mean, I don't think we're likely to see the opinion that was leaked that had that caustic, heated over the top language. I'd be very surprised if much of that opinion itself survives or the language of that opinion survives. I think it's likely on the other hand that you will probably get 5 justices who will vote overturn roe versus wade. And that'll be a seismic thing for this country. And I think a continuation of the court acting in an ideological way. You know, the court is supposed to respect precedent. Apply facts to that precedent. And then jurisprudential come up with an appropriate decision. I think what the court is doing here is deciding by personnel. The only thing that's different about the cases or the Mississippi case, the Mississippi abortion case at the court is deciding in other cases that are coming before it. Not the facts necessarily. I mean, these kind of statutes would have been slapped down quite easily by a prior court. The only thing that's changed is who's on the court. And that's a really dangerous thing. Precedent is the glue for our judicial system. If you replace that with who serves on the courts, what is the majority of Democrat Democrats or Republican appointees or conservatives and liberal if that becomes the focus, then you get what I think the nation is about to experience. It's the first time ever that we have had a right taken away from the people of this country. This is something that people have relied on for almost 50 years. And we're going to see a sea change in the way in which women's reproductive issues are dealt with in a wide swath of this country. You were an advocate of marriage equality. Do you think that the basis of the Supreme Court's probable abortion decision, you know, the draft of the abortion decision would lead to the overturning of marriage equality. Even though the draft says that this interpretation of privacy only applies to roe V wade, not to other decisions. But in another case, a code applied to other decisions, right?.

"The question of race, the question of inherent implicit bias, but it's something that as a black man, I had to learn to deal with and then try to try to navigate. And so if you were in the 5th floor of the Justice Department with me and you were part of my staff, you would have seen the real feelings that Eric holder was feeling on that day. If you'd seen me in the conference room when the cameras were there, you would have seen a much person speaking in much more measured tones, but trying to convey as best I could in those measured tones, the depth of the depth of my anger. You read that your silent protest against the court's decision was that you weren't going to appear in that Supreme Court. During your tenure as attorney general, what did that mean exactly? That you wouldn't ever walk into the court that you wouldn't want to argue a case yourself, which I'm not sure an attorney general ever would do anyways. Like, what did you not do that you might ordinarily have done? Yeah, it's actually a tradition that every attorney general argues at least one case before the United States Supreme Court. The solicitor general. I didn't know that. Yeah, this list of general as I say in the book picks basically the easiest case that's up for the term. So that the attorney general will go in there, have to deal with the easiest questions and get a close to guaranteed victory. And I actually kind of looked forward to the possibility of arguing before the court. When I was the Deputy Attorney General, I remember watching Janet Reno go to the court and you have to wear the appropriate clothes. And she had what she described as a pretty good interaction with the court. And of course, she won. I didn't want to do my argument during the first term out of concern that something might be said or characterized. It might hurt the president, so I was going to wait for the second term. And after Shelby county, which happened in the second term in 2013, I decided I was not going to go to the court given what I felt they had done in the Shelby county case. And in some ways, legitimize that tradition. I wanted to at least make clear among those who knew at the Justice Department that this attorney general was not going to argue a case before the Supreme Court. Solicitor general, people who had served as solicitor general before dawn, tried to convince me to do it. And I told him I just wasn't going to just wasn't going to go up there and argue a case. "A part of that. While you were attorney general, there was the now famous case, Shelby versus holder, where Shelby Alabama challenged the constitutionality of part of the Voting Rights Act. So just to refresh people's memories, explain what that case was about. Yeah, the Shelby county versus holder case arose in 2013. Shelby county, Alabama, filed a lawsuit that essentially challenged what's called the coverage formula in the 1965 Voting Rights Act, which has legitimately been called the pearl of the civil rights movement. There is a coverage formula within the act that sets out the basis by which certain jurisdictions are covered. And if they are covered, then they have to if they want to make changes in their voting procedures, they had to go to the Justice Department to get something that's called preclearance. People in the Justice Department and the civil rights division would look at the proposed change and if it didn't impinge on the rights of the citizens in the jurisdiction would pre clear it approve it. If there were problems, we try to work them out. He couldn't be worked out in the Justice Department had the ability to file a lawsuit. The folks in Shelby county challenged whether or not that formula was still valid. It had been put together in 1965. This is now 2013. And the Supreme Court in a 5 to four decision sided with Shelby county and said that the coverage formula was not historically correct. And that therefore, the ability of the Justice Department to pre clear that which shall be county wanted to do was unconstitutional. The problem with the Supreme Court ruling, chief justice Roberts, a very famously said in the majority opinion that America has changed, which was definitely true. The America of 2013 was fundamentally different and better than the America in 1965. But America had not come far enough. And as a result of that decision, we saw very quickly states that previously had been covered by the act, putting into place a number of voter suppression mechanisms and techniques as then justice Ginsburg. Death lawsuits from the family members of employees who died as a result of contracting corona virus. Well seven managers at that plant have been fired and one of them is speaking out because he thinks it's important for everyone to know that they're not bad people there actually great people who were just trying to make the work environment fun especially when they were taking bets on how many of their employees would get sick by contracting corona virus so former tyson manager don merged mersch brock said managers conducted the office pool last spring within minutes following mass testing of the plants. Roughly twenty eight hundred workers county officials said last may that more than one thousand workers tested positive for the virus which hospitalized several and killed at least six now. The family members of four of the employees who had died are suing in wrongful death suits and merce brock says. No i mean we're not again. We're not bad people. we're just trying to boost morale. This is exact quote he tells the associated press. it was a group of exhausted supervisors. That had worked so hard and so smart to solve many unsolvable problems. It was simply something fun. Kind of a morale boost for having put forth an incredible effort. There was never any malicious intent. It was never meant to disparage anyone and just to give you some more details on what this pool entailed again. It was a pool among managers at this meat packing plant in waterloo iowa. The office pool involve roughly fifty dollars in cash which went to the winner who picked the correct percentage of workers testing positive for the virus. He also added that. Those involved didn't believe the pool violated company policy and that plants. Positively and the plants positivity rate would be lower than the community rate due to their mitigation efforts. So let me just quickly mentioned with. The mitigation efforts were Based on the allegations these lawsuits there were none. The employees are alleging that they were told by their employers to ignore any symptoms that they may have as a result of contracting corona virus They were pressured to continue working. And they were of course packed into tight quarters as they were working with no social distancing and again the allegations include the fact. They didn't provide protective gear like masks to prevent contracting the virus. So those are the mitigation efforts that this former manager who's been fired from tyson wants to point to so guys. I don't want you to miss something really important in this story Which is a tyson china. Whitewash what's happening here by blaming the managers so it doesn't mean the managers weren't guilty of and i i mean i don't mean that in a legal sense i just mean in a sense of moral culpability. They're likely to get corona virus and then afterwards will blame you guys For not getting enough production and having too many people get sick but wait a minute was executives decisions not even the managers but executives higher in the company that made that decision so are they more culpable absolutely and so in this particular case.
