"Welcome to the Jim bohannon show I'm John trout filling in for Jim tonight Our phone number 8 6 6 5 O Jimbo That's 866-505-4626 coming up tonight Jay McDonald one of the premier executive coaches mentors and business advisers will be here to discuss recession proofing your business And then later the book is called no names to be given author Julia brewer daily discusses her novel an Amazon bestseller and a compelling story about adoption My first guest joined the faculty of Harvard Law School in 1964 and three years later became the youngest law professor to be granted tenure in the university's history Noted attorney Alan Dershowitz welcome back to the show Hey I've always a pleasure to be on with you and with Jim bows Thanks for having me Sure the January 6th committee is holding their first public hearings on prime time TV We'll talk more with you about that for the must see or not CTV But let's go back to the formation of the committee over a year ago originally it was Nancy Pelosi who would not permit some of the Republicans that House minority leader Kevin McCarthy had selected to be on the committee Jim Jordan of Ohio a Jim banks of Indiana And so the two Republicans ended up being Liz Cheney and Adam kinzinger both of whom were not exactly Trump supporters Does the Speaker of the House get to approve all committee appointees Well certainly she shouldn't The tradition of the house has always been that you have a committee that's comprised of people of both parties and people of all ideologies are reflecting the proportion of one party and the other party So if you have one party having 55% of the members and the other 45% of the members traditionally the committee consists of 45% of the minority in 55% of the majority If this was a fixed committee from the beginning and no one should take seriously it's conclusions It's absolutely Nancy Pelosi guaranteed that the committee would have no credibility that the hearings would be a show trial that they have already probably written their conclusions and their findings They know exactly what they're going to find You know this is a new version of what I remember growing up It was called nan mccarthyism And at that time it was called the House and American activities committee And it too was loaded loaded often with virulent anti communists in people who had no sensitivity to civil liberties And nothing that they ever concluded was given any weight or credibility by any serious person in what I've said to my listeners is you when you listen to this thing or watch it If you do ask yourself what questions would have been asked if Jordan or some of the others had been on the committee You know when I make a closing argument to a jury in a criminal case I know that the prosecution always gets the last word So what I tell the jury is as the prosecution is making its closing argument which I don't get to respond to put yourself in my position be Allen Dershowitz and think of what you would say in response to that And that's what I think should be done when people watch this show trial Right Now Liz Cheney and Adam kinzinger oddly enough those pair that group voted to impeach Trump right after the capitol riot and suddenly they're on the committee so we've got 7 Democrats and two Republicans two of whom voted to impeach Donald Trump Well that's exactly what Nancy Pelosi wanted that she wanted to give it cover by having two Republicans but from this point of view the point of view this committee it makes no difference whether your Democrat or Republican your anti Trump you've made up your mind about January 6th Look I didn't vote for Trump I voted for Hillary Clinton and then for Joe Biden I'm a Liberal Democrat but I don't like what the Democrats are doing in Congress I don't like how they play up to the hard left wing of the party And I don't like them denying due process And I certainly don't like what they did to Peter Navarro who was fundamentally denied The most elementary due process Peter Navarro he was a trade adviser to president Trump he worked in the Trump administration as national defense production act policy coordinator This past Friday Navarro was arrested for defying a congressional subpoena issued by that January 6th committee What happens when somebody refuses to comply with a subpoena Typically he did the right He did the right thing Imagine if I was subpoenaed And I represented the president On the Senate floor I really defended the constitution on behalf of the president What if I was subpoenaed and said hey you're a lawyer What did he tell you Tell us the details of everything you said What if they called his minister What if they called his doctor What if they called his wife What if they called his personal lawyer Of course none of us would comply with the subpoena And the government would have to go to court And ask a judge to resolve the dispute between the executive branch and the legislative branch that's what the courts are supposed to do under our system of checks and balances But instead they decided to take a shortcut and just indict him without a court order So this subpoena for Navarro the subpoena was it one that required him to be in court in front of the committee on a certain day and time I don't know I haven't seen.

I unbelievable the hot dogs, Cachaca. Finish the whatever. Oh, my God. The chickens. I don't know it. I don't Mikey. Thank you. I don't know that one. I used to go to Edelman's on Kings Highway many, many years in Brooklyn. I know that the mill Basin has a good deli in Brooklyn. And if I want a good hot dog, I got only things all right. We did ask much about his friend Michael Abenaki. He did say one thing That was correct, He said, you know, said you and I both have a lot of friends in jail. He actually said that And that's true. We do. I don't go visit like he does. He's up notice for business and these guys like Michael Cohen, but he's right. Uh, some of the folks that we know have Organa straight. That's fine. That's you know, I don't I don't judge people's characters on that. But he, um he made it sound like he, you know, he wishes the guy the best lucky, kinda distance himself. But if you don't know the story, Michaela Bernardi, the attorney, Stormy Daniels attorney, and then he goes out there he starts talking about running for president in 2020. Media members are saying he's going to be Donald Trump's worst nightmare. And as it turns out, he tried to extort millions and millions of dollars from Nike. You know he's going to prison or deserved prison sentence will serve at least 2.5 years. So many is so good at this. Many goes back to the you know to these liberal networks, MSNBC, CNN and all these folks that used to fawn fawn over Michael Abernathy..

"Surging toward the capital. One expert says it's difficult for network executives to decide not to air what is being shown on the floor of the U. S Senate Well to discuss that video and also House manager Jamie Raskin, the lead house manager from Maryland, who burst into tears when recalling how is 24 year old daughter said she never wanted to return to the capital. After being there on January 6. We spoke with Greg Walters, vice news political reporter. That video was absolute. Damn it. Even Trump's lawyer, Bruce Castor, told the entire room that he thought that the other side did a better job than they had been expecting. One of the reasons that that was so emotionally impactful, perhaps for Jamie Raskin is that he recently lost his son to suicide on New Year's Eve. Jamie Raskin, of course, is practically local. He represents Maryland's eighth District, which includes parts of Bethesda and Chevy Chase and Rockville. What about beyond the 30 Minute video that you said was so powerful showing scenes inside and outside as that riot unfolded? What else about the Democratic argument? Did you find compelling? The Democrats laid out a pretty strong case that basically aligns with what most constitutional scholars say is the case that yes, you can proceed with an impeachment trial against a former president. They're arguing that it doesn't make any sense to say that you can't impeach a former president because one of the punishments that you could bring down with impeachment is stopping the person who's being impeached from ever holding office in the United States again. They're saying it doesn't make any sense to think that basically January at the end of any president's first term is sort of YOLO month when you get to do whatever you want, and you can try to break the law or sparking insurrection, and there's nothing that Congress can do about it. So they're suggesting that the idea that impeachment doesn't apply here just really doesn't make any sense. Greg. If this was a prize fight, there are some who suggests there was a knockout in the first round. So what about the arguments made by the former president's two attorneys? That free speech reigns Supreme. They actually have a court that doesn't want to convict him. But did they actually help her hurt? The former president today? Trump's defense got off to what you would charitably call a very rocky start today, Attorney Bruce Castor from Pennsylvania who signed on to this job, just a little bit more than a week ago, came out and rambled not quite incoherently. But he really beat around the Bush For a long time. You saw senators leaving the room, shaking their heads and candidly admitting to reporters they had no idea what he was talking about. Trump's former impeachment. Attorney, Alan Dershowitz, went on two news Max and said he had no idea what Bruce Castor was talking about. He called it Pablo and said that this was not the way that anybody should be running on impeachment defense. You saw similar criticism from the likes of John Cornyn, Republican senator from Texas, he said. I thought the president's first lawyer just rambled on and on and on and didn't really address the constitutional argument. So you're seeing some pretty bad reviews and reports out of Florida from Mar a Lago that even Trump himself was very distressed with casters argument. The ultimate question, though, is even if Democrats continued to put on this so called perfect case, and the presidents of former presidents, lawyers continue to stumble. Is there a conviction? That is really what the Democrats are looking for? And that may be a tougher hurdle to to jump over. The short answer is there almost certainly will not be a conviction. Republicans have signaled that they are simply not ready to go there. At least if you look at the vote that they cast both before the impeachment trial started, and then again today, first you saw 45 Republican senators voting that this whole thing should be considered unconstitutional. Critics argue that that is an argument that they're hiding behind because they don't want to address the substance. So there's simply saying this whole thing is invalid. But today you saw one Republican senator switch his vote. That's Bill Cassidy from Louisiana. He went from saying This should not go forward to today, saying it should so the votes to possibly Convict. Trump may have jumped from 55 to 56, but that's still very short of the two thirds number they would need to convict Trump, which, if everybody shows up on the day of the vote would be 67. It needs to be two thirds of the senators who do show up for the vote. Vice news political reporter Greg Walters joining our Del Walters and myself earlier this evening. 10 15 sports.

"O'Donnell. Later, Bill Cassidy, a Republican, has sided with the Democrats. He's the first Republican senator who has voted differently than he did on the previous Motion. Earlier, dramatic video from the attack on the Capitol echoed on the Senate floor as House managers tried to prove Trump incited the violence on January 6th. CBS is major Garrett can't separate the things that happened before the election of the president said, And after From what happened on January 6th and to do so. Is to ignore common sense and also to ignore the primacy of the president itself. You are the great law signer in this country, your words matter, And they matter more than anyone else. CBS NEWS Special Report. I'm Lisa Matteo and joining us now via Skype to provide some analysis is vice news political reporter Greg Walters and Greg Note no relation. But that 13 minute video of what was happening inside and outside the Capitol during the rite was compelling. It led House manager date Jamie Raskin. Maryland, who would one point actually burst into tears when recalling how was 24 year old daughter said she never wanted to return to the capital. His family was there on the day of the riot. What was the impact? That video was absolutely damning. So what about the beyond the 13 Minute video that you said was so powerful, showing scenes inside and outside as that riot unfolded. What else about the Democratic argument? Did you find compelling? The Democrats laid out a pretty strong case that basically aligns with what most constitutional scholars say is the case that yes, you can proceed with an impeachment trial against a former president. They're arguing that it doesn't make any sense to say that you can't impeach a former president because one of the punishments that you could bring down with impeachment is stopping a president stopping the person who's being impeached from ever holding office in the United States again. And they're saying it doesn't make any sense to think that basically January at the end of any president's first term is sort of YOLO month when you get to do whatever you want, and you can try to break the law or sparking insurrection, and there's nothing that Congress can do about it. So they're suggesting that the idea that impeachment doesn't apply here just really doesn't make any sense. Greg. If this was a prize fight, there are some who suggests there was a knockout in the first round. So what about the arguments made by the former president's two attorneys? That free speech reigns supreme They actually have Ah, court that doesn't want to convict him. But did they actually help her hurt the president today? The former president? Trump's defense got off to what you would charitably call a very rocky start today, Attorney Bruce Castor from Pennsylvania who signed on to this job, just a little bit more than a week ago, came out and rambled not quite incoherently. But he really beat around the Bush For a long time. You saw senators leaving the room, shaking their heads and candidly admitting to reporters they had no idea what he was talking about. Trump's former impeachment attorney, Alan Dershowitz, went on two news Max and said he had no idea what Bruce Castor was talking about. He called it problem. On said that this was not the way that anybody should be running an impeachment defense. You saw similar criticism from the likes of John Cornyn, Republican senator from Texas, Hey, said. I thought the president's lawyer, the first lawyer just rambled on and on and on and didn't really address the constitutional argument, So you're seeing some pretty bad reviews and reports out of Florida from Mar a Lago that even Trump himself was very distressed with casters argument. So the ultimate question, though, is even if Democrats continue to put on this so called perfect case, and the presidents of former presidents, lawyers continue to stumble. Is there a conviction? That is really what the Democrats are are looking for? And that may be a tougher hurdle to to jump over. The short answer is there almost certainly will not be a conviction. Republicans have signaled that they are simply not ready to go there. At least if you look at the vote that they cast both before the impeachment trial started, and then again today, you saw first You saw 45 Republican senators voting that this whole thing should be considered unconstitutional. Critics argue that that is an argument that they're hiding behind because they don't want to address the substance. So there's simply saying this whole thing is invalid. But today you saw one Republican senator switch his vote. That's Bill Cassidy from Louisiana. He went from saying This should not go forward to today, saying it should. So the votes to possibly convict Trump may have jumped from 55 to 56. But that's still very short of the two thirds number they would need to convict Trump which, if everybody shows up on the day of the vote would be 67. It needs to be two thirds of the senators who do show up for the vote. Again. That is great. Walters with Vice News, Greg Love the name. Thanks for being with us tonight. Hey, Thank you..

Donald Trump second impeachment trial. It will start next week. The former president by the way, he said, Nope. He's not going to come testify under oath he was asked to his former impeachment, attorney, Alan Dershowitz, told Fox. It's the right call. The reason I'm not a lawyer in this case is I'm either an actor or a politician, and they're just it's showboating. They wrote the letter in order to get the president to say no which they knew he would do. Yeah. Now they can use that against them. They say they will. Legally It doesn't mean a thing, but they're going to showboat with it, and they're going to try to smear him. That's because the Supreme Court has enacted where it shouldn't acted where it shouldn't have carry pollen with the Texas Conservative Review says the possibility of Democrats packing the court has led to this some ways, intimidated the Supreme Court justices and being reluctant to take actions where They should in order to defend the constitution, especially when it comes to the election and how that played out. Pollen is concerned about what happens if this gets any worse than it already is. I think we could see more of a BLM and teach this stuff from the left and the right. And obviously that's not a good thing for the country. You know the words more violence caused by more people who feel disenfranchised. Yeah, not enough just to neuter the Supreme Court. They're on a mission that Democrats and this is a quote to repair the courts. This is after Republicans confirm more than 200 judicial appointments under President Trump. Democrats in the White House wanted work quickly and fill every available vacancy before the 2022 midterms. Here's Senate Majority leader Chuck Schumer, talking to MSNBC's Rachel Meadows. There are a lot of judges Democratic appointees who didn't take senior status while Trump was president, too, now will and they stay on the bench, but then we get to fill it so first we can fill up a lot second. Traditionally, we have increased the number in the lower and circuit courts. Even if that happened. Appellate law expert Byron Henry believes that's still not enough. If they don't get retirement from the Republican judge is the only way to do it with me. They're convinced enough senators and House members to get Law that actually add seats to the appellate courts, which hasn't happened in a while, and I don't think it's likely. Henry says. Who have a track record of picking the winner. The abraham accords rows between mid august and mid december. We're the most significant diplomatic breakthroughs in the middle east in twenty five years as the region. Girds for a prolonged confrontation with iran which the biden administration hopes to make sure that iran is stronger as they go into that confrontation. These guys do. They actually love america at any level. Here's mike pompeo on this. Nifty abraham accords maria for the protection of the american people indeed stability and peace in the middle east. I hope that they will There were two things that set the conditions for the prosperity and stability. We created in the middle east The first one is the president's decisions with respect to israel weather was the golan heights. Are recognizing jerusalem as the right for capital of the jewish homeland. Those things Made clear that we weren't going to allow the conflict between israel and the palestinians to stand in the way of peace and prosperity. The second thing we did was to withdraw from the jcp away and put enormous pressure on the regime. In iran those things allowed the countries that are impacted most by iran. Saudi arabia bahrain the united arab emirates kuwait. All amman all the nations there in the middle east that live with iran as neighbor appreciated the work that we did and so many of them have joined. the abraham accords others have begun to ease restrictions and doing business with israel. I think this trend will continue but it will require those two central underpinnings those two understandings about who the real bad guy is there in the middle east. The nation that is fomenting the tear for meaning the instability that recognition is central to permitting these countries to continue to expand their relationship with israel and to expanding peace and prosperity all throughout that region. In you know what if you don't hit the button nothing changes on the screen time. If i just wait just won't change i. i got actually anyway. I gotta be ready right so anyway. The the middle east thing is. I'm laughing a little bit here at this at some of the technical stuff but this is really a. It's a big deal the The iranians and for those of you who don't know the persians. This home horton people in the west people in our part of the world and by our part of the world. I'm in seattle right so people in in in the us and often much in europe but in the us for sure. People look at islam as a monolith and they think that the iranian muslims and the arabian muslims are the same. And they don't understand that these guys they're enemies. The iranians see the saudis as interlopers. Who don't belong in mecca and medina. The iranians see all of the soon as illegitimate why they had a war with iraq. Their neighbor okay. That's because they believe that they're the rightful. The persian empire is the rightful muslim empire. And all of the non persian muslims the arab muslims which is every everybody but iran. Maybe some of the people in azerbaijan or armenia were borders. Iran may consider themselves to be heard and muslims. But the reality is that that there's this war setting up between all of those people and what what the genius of the abraham accords was. They brought israel into the same family with the arab muslims because they understood. The trumps trump team understood that israel and saudi arabia and jordan and oman and the united arab emirates and bahrain. They all were threatened by iran. And so what trump did is unified all these people together and so what does the biden administration trying to tear it. Apart tear it apart strengthened iran. Get the iran. Deal back gone. Let's get the enemy stronger over there because why war inc right the neo dream. This is the lincoln project Rhino people there the john bolton's of the world. They're the same as the joe biden's world when it comes to this war inc program. They just can't wait war war war. That's what we want. That's what we do. So the trump administration. I shouldn't say administration the office of the president. You office of the forty fifth president. What they're calling. It has a new legal team and think rather than break that up. I'm gonna take a quick break and we come back. We will Delve into the legal team. That is going to face the impeachment hearings as they come and by the way i'm going to do my best to cover all of that or to carry it all live and so we can experience together. Gimme just two quick minutes To grab all this and then be last break for program will go into the new trump legal team and what i think it means about their strategy which who knows probably wrong. I've been wrong a lot. So i know you're listening to republic keeper and now a republic keeper with brian kelly to put our thinking caps. Here you don't have to think a little bit. We're at the puzzle out. A couple of things means figured out. There's moves you're the president of the united states has the art the forty fifth president of the united states. You know. "No legal briefs were filed in his behalf. They just voted and they had the votes. Alexander Hamilton federalist 65. Said. The greatest danger not the second greatest danger the greatest danger. Would be to use impeachment just by the numbers. Whoever had the most numbers wins that would normalize impeachment and turn it into an ordinary aspect of the political process. Look already a young Republican congresswoman. Said that she on day one will issue a resolution to impeach biting right. I would oppose that. Just a strongly you shouldn't use impeachment as a political weapon. It said. Actually what I'll ask you this you you have mentioned a couple of times. Now that I've seen you over the last week, the possibility of civil Case being brought against President Donald Trump. So if that's the case, if I'm president Trump the last thing I do when I leave the White House is part of myself. Yes. No, because the vulnerability he has is mostly in states cases and civil state cases. Okay, and he can't pardon himself and state cases only federal cases and I don't see his vulnerability and in federal cases, you know they can try to indict him. Or inciting an insurrection. But his speech was core protected political speech comes right within the doctrine of Brandenburg vs Ohio, the leading Supreme Court unanimous decision. Protecting speech. Just compare Trump's speech where he said peaceful patriotic protests with the speech of Brandenburg. Brandenburg was the hooded Klansmen, a Nazi who was surrounded by people with guns and hoods. And he said, Take revenge is on the Senate and the House and the justices and, you know, kill the Jews and send them back to Israel and send African Americans back to Africa. It was a horrible, horrendous speech. Nice. You know. Unanimously, the Supreme Court reversed the conviction and said it was protected core political speech. Look how many times in the capital if we had labor leaders Feminists, radicals, leftists of civil rights activists say cake, you know, take over the Capitol confront them. Show them. We're strong. Let's fight back. You know those are fighting words and fighting words apart of political rhetoric protected by the Constitution. So this impeachment obviously ah, you stayed is an assault on the president's First Amendment rights, Essentially, and he got no do due process in this impeachment here, this snap impeachment as you call it, no hearings. None of that stuff. No defense. Now, the question is this Alan Dershowitz. Let's say for some reason, according to reports, this is going to happen on inauguration. They they have this Senate trial. Have you been contacted? Would you consider defending President Trump as you did during the Ukraine impeachment hoax? I don't think the Senate has any jurisdiction. This is political theater, and I'm neither a politician or an actor, so I don't see a role for a lawyer. I think this is I want to defend the First Amendment in the court of public opinion. You say that Trump's First Amendment rights have been violated. No. All of our First Amendment rights have been violated. We, the listeners and the viewers. Have the right to hear diverse and different points of view. And there's nobody not my colleagues at Harvard. Nobody not the A. C E o U That's standing up for the First Amendment today because Trump is so controversial and unpopular. And I'm going to continue to stand up to the First Amendment. But I don't see any role that I would have. As a lawyer. It's unlike the first impeachment with ahead of trouble last several days. Had arguments presented. Can't do that after he's left office last one. I know you've got a busy day ahead of you, the great attorney Alan Dershowitz, talking about First Amendment rights. I know this doesn't really apply because it's a private company. But Twitter booting Donald Trump for life basically and going after other Republicans, and now you're seeing businesses, airlines and Forbes out there saying, If you work for Donald Trump, you should never work again. The what's happened here since the capital fall out specifically that Donald Trump with Twitter and folks that have been around Donald Trump that to me may be the scariest thing I viewed in my 53 years on this planet. Less biggest is only 53 years. If you're is old is me you'd remember McCarthyism. This was exactly like McCarthyism. Do you know that Harvard circulating a petition now? Yes to try to withdraw the degrees that were earned after four hard years the degrees of students who graduated If they were part of the Trump administration. It's pure McCarthyism. It's right out of the playbook of old Joe McCarthy. And people should be ashamed of themselves for emulating McCarthyism. You know Hillary Clinton voter, the lifelong Democrat by the Voice of reason. Alan Dershowitz, Alan, It's gonna Be tough. A tough summer for you on Martha's Vineyard. No, no, it's gonna be easy. Remember, I have my own podcast. Now it's called the Dirt show and it's on Rumble because Rumble doesn't sensor. So if you want to hear more from me go on my podcast every day, five days a week and you'll hear my views of the Constitution. My views of impeachment in my views of censorship and what's going on on rumble or YouTube or any of the platform? I've actually heard that podcast and brilliant, But my fear is that Twitter and Paller and Even though again you're not a Republican, you argue. What's rational? What if rumbles next? I believe me. They'll be in court. I'll see them in court. What that happened, Man. You are one hell of a great American Alan Dershowitz on the Bernie and Ciccio the dirt show a rumble YouTube or whatever it is about the podcast. Alan. Thank you so much. We appreciate it. And good luck. Godspeed. I love being on your show. Thank you so much. Wow. That's a huge compliment. We love having you the great Alan Dershowitz. Still lots more to come. "I'm Mona Rivera. The Justice department is being put on notice about the special counsel report house intelligence committee chief Adam Schiff, we will obviously subpoena. The report we will bring Bob Muller into testified before congress, we will take to court if necessary and in the end, I think the department understands they're going to have to make this public shift on ABC's this week where attorney Alan Dershowitz, a Trump supporter. Agreed. It would be a mistake to keep Muller's finding secret. If his information is not released to the public, and then goes to congress to conduct the investigation. I think there'll be a question of credibility to report on Russian interference into the two thousand sixteen election is
