"Prosecution can ask for it but it's up to the judge to say well was there sufficient evidence to allow this jury to come up with manslaughter or murder to make Anna Christie is kind of market when you get into the recklessness negligence and so on and this this judge same judges before a terrific jurist he said yeah I'm gonna give the option but they they didn't need it the animals unanimous for murder trial you know I think and I'm and I'm not talking about this because they're still appeal rights and things like that but I think jurors generally get it right you know I mean if you if certainly I look at the cases I've been involved with including the ones I've lost although I didn't think they got it right that day right as I'm driving home I start thinking yeah I think they got it right and all the things that you've seen do you agree with me oh absolutely I mean I think the people log give jurors a hard time because you get so into it and you have such strong personal opinions L. Robert Blakey did or didn't do it and then kill half the people are going to be ticked off when they hear the actual jury verdict but when you look at how hard these people work how many hours and days sometimes months they take out of their personal lives to devote to the public good you know it's easy to second guess some and sometimes in press conferences after the trials they say things that do you think I don't know if I would have said that but I don't think it's fair to second guess it because let's face it the jury system is the absolute best engine for justice people have ever come up with time you had a tremendous fabulous a level of success convincing jurors of the correctness of your position so in a sense I made maybe a little biased but the fact is they are free in every case to accept or reject any lawyer's argument C. you know you've you one more more times than you've lost by a huge margin and so I can see how you'd be you'd be somewhat biased in favor of the jury system but the fact is we all should be biased in favor because it no matter how big or powerful person or company is he can be hauled into court by anybody and the jurors get to decide who wins you are listening to champions of justice with your host Tom Girardi and James o'callaghan and that is our guest attorney royal oaks and James we've been kind of an alkalizing the conversation up to this point wanna make sure you get a chance to get in here well I've enjoyed what's been said so far so but I did I did have a question a and that had to do with the use of gag orders in these help high profile trials what do you think of those you know what find it what's a gag order Jim you know I think it's it's it's an order that the judge says we can't the lawyers and the parties are instructed not to discuss this case before the media yeah it is really really good question Gemma that's one of my favorite topics good example Thomas elected Michael Jackson molestation trial of the judge realized that things were just so into it was drenched with publicity and so he said look doggone it I'm tired of people trying this case in the press I'm going to have a gag order meaning the parties like Michael Jackson and the district attorney and Michael Jackson's lawyers and the key witnesses may not speak to the press about this now it sounds like a good idea in the sense that it tamped down the publicity and it sort of minimizes the frenzy the problem is the reason I have a difficulty with it representing a lot of the TV and radio stations on the reporters and are always looking for a good story the problem I have with it is you know it does kind of shred the first amendment it prevents people from speaking their mind and what it does Jim is it tends to allow the people who weren't really involved in the case the secondary folks who were two and three levels removed they're the only source of quotes and information and gossip and hearsay information and so I tend to think that in the absence of really extreme circumstances were a fair trial seems really in jeopardy it let people talk and you know folks can just make up their mind with the makes sense or not okay here's the problem criminal trial for civil trial I'm a defendant all of a sudden the plaintiff has a bunch of bad stuff that is not legally permissible I can show the guy was Bubba blah blah blah blah blah correct and no judge would let that evidence in because it's irrelevant to the case on hand on the other hand believe me it would affect the way I look at this party now then if you guys out there in the press not use a lawyer now thank you guys in the press if you can if you can go tell the public that the jurors read that believe me every juror knows more about what's written about the case then anybody else does even if they're admonished not to read about it somehow the reading about it now all of a sudden roiled the very things that you and I stand for is lawyers that certain things are admissible certain things or not all of a sudden inadmissible evidence which could be very damaging can be given to the person is going to try and what do you think about that well I I'll grant you that it is a problem of the jurors do often ignore the instructions with the judge and and sometimes they're just potential jurors there who haven't even been picked yet they're just in the population generally so I'll grant you it's a problem a couple things come to mind though first of all because the defense has an opportunity to sort of infiltrate their minds and sell his or her read her stories well and sometimes you've got some very high profile you know big time Ashley Bailey type criminal defense lawyers who might have an opportunity to sell their story of may be inadmissible inflammatory hearsay information to a greater degree than those of poor rob prosecutor on the on the on the public payroll so he kind of goes both ways the other thing that comes to mind is that his I mentioned to Jim if you prevent the key players from talking what you do is you elevate the secondary folks to the spokespersons and they can kind of get the word out it's a big problem I mean Jeff Tom just think about the OJ Simpson case last fall is on trial in Vegas for for a robbery you remember the whole deal with the memorabilia in the hotel room five people on that jury Tom five of the twelve admitted during jury selection that he thought OJ was a double murder got away with it now that is in the case of course a gag order in the word getting out actually that's just part of the pop culture you know everybody has an opinion about OJ but J. is argument on appeal and I'm not saying he's going to win but yeah it isn't ridiculous for him to say the Nevada Supreme Court folks it wouldn't have been better if we didn't have five people on the jury who admitted in open court they thought I was a double murder who got away with it now they convince the judge they could be fair and open minded and set it aside but in all that kind.

"Coming in the great American thank you very much for joining us this afternoon in about thirty minutes or so aptly Bailey whose in Cincinnati for a legal seminar will be here to talk about the doctor Sam Sheppard and also what occurred with Patty Hearst the Boston strangler and also of course OJ Simpson as of view point on Johnnie Cochran mark Fuhrman Robert Kardashian and more but until then as you may in the American people one thought came to mind as I read the news as you know I get up every morning nice and early I read all the local and regional newspapers I listen to the radio and television talk shows I go online to the drudge report which has become quite liberal also newsmax WorldNetDaily dot com check out the daily wire daily caller ESPN just to begin my work and the story out of Kentucky has received some national a claim in some quarters and criticisms and others for what governor Matt Bevin did the last week he was in office as you know any Bashir beta by a very slim margin he ran about two hundred thousand votes behind the lowest vote total for other Republicans because he was a controversial character who often was quite abrasive especially dealing with teachers no one can claim teachers are overpaid teachers should never pension there's maybe a way to reforming the pension system without insulting them but none the less we assumed it was a conservative Republican and we assume he was a kind of Republican conservative that Donald J. trump would enjoy that's why I came here at least once at the end of a couple times before that to kind of campaign for Matt Bevin compared to anybody here who promised to give a hundred thousand a convicted felons voting rights which we can argue about that but most of us have to say that the convicted killers pornographers human traffickers child rapist sure almost never get out of jail we we can agree this is an Republican or Democrat this is an male female what this is is common sense to keep I child rapists from Kent County locked up as long as possible one does not change a proclivity to wanting to have sex forcibly with children because you spent two years in jail you come out with the same idea that I want to have sex with children and you constantly put yourself in a circumstance where you're around children then one thing leads to another another child is right the odds of a child rapist from Kent County Clermont county whatever having commit one act one time get caught the one time is almost nonexistent child rapist wants sex with a child about as often as a twenty five year old male one sex with a female which is almost fourteen times a day so child rapist are critically critically impinged individuals who should never get out of jail I had the Corsa Kent County prosecutor rob Sanders on who I think it was a Wednesday might have been Tuesday I think was Wednesday might even yesterday I want to get it back on tomorrow and that this is like the number one supporter of Matt Bevin in northern Kentucky was rob Sanders he liked him you know one met with them talk to them it's not politically he wasn't the best politician in the world but none the less it was as far as getting northern Kentucky to vote Republican that is a given in today's political climate used to be a ever they're all Democrats now much like sections of Hammond county it's like in northern Kentucky all Republican in Albany County is becoming all Democrats this story broke today at a local and yesterday it rob Sander said that I I think I'm hearing that might be dozens and maybe hundreds of pardons and commutations or not sure because the secretary of state's website is down and I'm getting information from social media the thieves rapists and murderers are like walking around the streets today and said it can't be true the local Currier journal and the Enquirer mainly local Currier journal has a story listen to this on Friday of last week there was an order to pardon commutator four hundred and twenty eight convicted criminals four hundred and twenty eight the BET beneficiaries include one offender convicted of raping a child another hard hit man to kill his business partner and a third who killed his parents among the most egregious is out of independence Kentucky on his last day in office governor Matt Bevin pardon the sentence of an independence man who was convicted last year of raping a child Bevin pardon my cut shoal toll S. C. H. O. T. T. T. L. A. forty one years old convicted last year of raping a nine year old child in Kent County he was sentenced to twenty three years in prison he was convicted of rape sexual abuse by Kent County jury he was sent so I twenty fourth of twenty eighteen by a judge Patricia sumi so twenty three years in jail for raping a nine year old match diamond how long should be spent in jail not Simons he said life well whatever it is gonna be a long time to continue he rob Sanders says that the shuttle was convicted of a heinous crime based upon testimony that was supported by physical evidence can county attorney rob Sanders at his office was given no warning that Matt Bevin was gonna pardon a child rapist he said quote to the local newspaper quote so I guess Matt Bevin think she's smarter than the twelve citizens that heard the actual evidence I've got news for him child molestation really happens in front of witnesses or lease physical evidence wouldn't pursue these cases ninety nine percent of child rape is whenever you be prosecuted on quote centers of the pardons regurgitate false statements from defense attorneys that juries obviously did not believe prosecutors office said the victim testified at the trial this is a nine year old boy hello shuttle sexually assaulted and there were some medical experts also testifying that it occurred from children's hospital and also doctor a steward Bassman who specializes in psychology of sexual assault and it's sad yeah I think it might get worse and this is where there might be a criminal investigation and the behavior Matt Bevin one of the parties that Matt Bevin commuted the sentence what is a guy who was convicted of murder Matt Bevin along with many others pardon a convicted murderer his family according to this new story out in Knox County was home invasion race twenty one thousand five hundred dollars at a political fund raiser last year to retire debt that is that's Matt Bevin raised that the brother and sister in law of offender Patrick Brian Baker gave the Bevin campaign four thousand dollars on the day the fund raiser a photo of a governor Matt Bevin attending the July twenty sixth nineteen I'm sorry twenty eighteen fundraiser would been what about a year and a half ago at the home of Eric and Katherine Baker in Corbin was published six days later in a local newspaper comma with attorney Jackie Steele the prosecutor Patrick Baker another defendants for the twenty fourteen death of Donald mills told the the Currier journal on Wednesday it would be an understatement to say I'm agree by Bevans pardons ila data five Patrick Baker is the brother very Baker who hosted the Bevin fund raiser at the corpsman home so you have a family giving the governor four thousand dollars to help retire the debt of the Bevin campaign that had accumulated the three years he was the governor before the fundraiser then you have the governor issuing Hey ya a pardon to the murderer and the family paid Bevins campaign four thousand dollars the prosecutor believes the Bevin I'm sorry that Baker was pardoned by Bevin while the others remain locked up because Baker's family had given generously to the governor is it possible that's true and of course in this case once again you have numerous Commonwealth attorneys all over from Fayette County from Boone County all over the place saying that it's impossible that the Bevin could let this guy go so these are four hundred twenty eight pardons and commutations for the worst of the worst given out by a so called conservative Republican as he's exiting office seven pardons include convicted killer whose brother hosted campaign fund raiser for him also on a low convicted child rapist from Kent County pardoned by governor Matt Bevin how is it possible but those of us who believe in constitutional conservative principles to endorse could speak with her in some cases give money to I I didn't give any money but I certainly endorse Matt Bevin because I assume the president will not come here and so vociferously endorse him of Randy but sure unless there is good reason and if you're going to do this do what any Bavand offsite any do it any way but shared which is say I had a time that if you elect me as your new governor what I'm gonna do is I'm gonna give voting rights to one hundred thousand convicted felons who can't vote and guess what he did first day in office he was sworn in yesterday he said you know what I'm gonna do try to restore voting rights to one hundred thousand Kentucky fell in so they can vote what are the odds of Matt Bevin getting hardly any votes if the voters knew that justice is leaving office he's giving commutations or pardons the four hundred and twenty eight individuals that the among whom that group our child rapists child molesters convicted drug dealers and murderers murderers whose family gave the Bevin campaign four thousand dollars how is that possible that that could happen I know right now rob Sanders another Commonwealth attorneys are mad as a wet hen that they can't believe this happened in the Commonwealth and these are the guys men and women supporting him because they didn't think anybody share would do is go to job this is Bevan and so when the supporters go after you you know you got a serious problem so I'm gonna see how this plays out the next couple days and I'll be with you on this topic either Friday Monday or Tuesday of next week to pick up the pieces and lastly and we have a flea Bailey making his way in he'll be here in about fifteen minutes on there with you Ashley Bailey you heard Jason Williams on with you and I talking about this about how voters generally don't know who they're voting for the vote our or D. and that's it that's all they need to know the great American is told you you don't vote in this country what you do is cast an informed balance it is up to you on election day or election month to know who the candidates are what their history is what are the qualifications for the job what did they say they're going to do which often has no relationship to what they do and then to go into the polling place or in many cases get the ballot in the mail and send it back and then we get the government we deserve there was no way on god's green earth that Democrats wanted seventeen to March to be have a county commission the Democrats endorsed somebody else in the primary because she wasn't qualified to do the job because of a background in Lincoln heights she was not up to snuff on what the issues were she's engaged in alleged personal behavior that mater I'm qualified to be a county commissioner in the first month in office our chief of staff Paul so he is suing dentistry house and Todd por tune for sexual slash racial harassment Apollo so he so there's there's something loose going on upstairs but because she had a D. next to her name in an accounting and not in our Chris Monsell by every objective standard did a good job endorsed by many Democrats including Todd por tune thought the Chris Munsell done a good job okay but it didn't matter was already out of a comes in the fact that the media and others tell everyone you got a vote you got to go and vote souls to the polls whatever it is you got a vote no you don't have to vote if you don't know what the issues are don't vote it dilutes the values of those who do vote Democrat and Republican and know what they'll be talking about dole voted you don't know what the hell's going on and so in this sheriff's race Jermaine McGuffey is on the so called quote Brady list and that means that you're a person whose credibility can be questioned by attorneys suing the sheriff's department and what she says cannot be believed when a law enforcement official is on the Brady last that means they can't get security clearances and I mean they can't be hired but there's an anomaly in state law that says.
