"Today, on the Southern California real estate report, we talk about a new housing project and downtown. Stay tuned. Good morning, welcome to the Southern California real estate report. This is bob McGuire and Danielle wise coming to you from seeing the ego California. So once again, in the news today, a new class a sounds like apartment building. So this site was next to the old, I guess we would say the new city building. So it's up on ash street Cortez hill. This was originally going to be a condo site, but Toll Brothers bought it, and they're going to do four rent apartment building that just got approved. So it's going to be one of the larger for rent buildings in the market, actually. It's 37 stories, 422 units. It's going to be basically branded as a luxury build. This is going to be a collaboration between PG IM real estate capital markets and Toll Brothers. They secured a $187 million construction loan for the project in that loan was funded through Wells Fargo and Bank of New York Mellon. This is going to be one of the things that's going to be interesting about this. This is going to be a marquee property. But more importantly, this is going to be one of the newest and probably one of the most environmentally constructed environmentally conscious constructed buildings that we've had in the market, right? So this is going to be a 100% lead certified and it's going to be league gold. This is going to basically so I believe the lead certifications are go up to as high as platinum. And I'm not sure why this is not getting it based on what they're doing, but the site is going to use all sustainable materials, all demolition materials are set to be recycled. So everything that they're going to do demo wise, they're going to recycle all the rainwater is going to be captured and that's going to be passed through a bio filtration system. Before entering any of the groundwater drainage systems. So, and that's a good thing. Look, you and I, your husband, myself, as ocean lovers and people that love to spend time at the beach and in the water. That is kind of a good thing for downtown. You and I were recently down down earlier this week. In an area of downtown that honestly, the amount of trash and street stuff that is piling up in some of these areas downtown due to some of the social issues that we have going on in the city are pretty unbelievable. So to see something like this, look, I'm a fan, if they can do it. And it still makes sense for the building, right? Yeah, I mean, capturing water sounds sounds interesting.

And it centers around their real estate operations. Which I think kind of leads into a little bit of maybe I don't mean it well. A little bit of a plug on our end because that's probably right. What? We've been right too. Yeah. Well, and also, you know, we're property managers who don't like to leave money on the table for our owners. I mean, look, so, you know, it's interesting. There's a lot of people that can say a lot of things about the operations. And this is not a political podcast at all. This is about economics, right? And the city, so the discussion in the news with the city and some of the missteps they've had with their real estate. So just to kind of go through them. And just show you how mismanaged the city is and it's not whether it was under faulkner or under Todd Gloria or under even before that. This is obviously been an ongoing thing. The city's real estate department is broken. And that's pretty obvious. So thus far, they've tied up a building up on ash street that was full of asbestos. That was a $125 million mistake. Mistake. So, and something that everybody could finger point here. But then so when you look at that, and we're in real estate, so we know we understand the process of probably what went down there, right? You and I have talked about it offline. And we're like, gosh, you know, who was the broker? Who did the due diligence? What did their legal department say? What about their committee?.

"They're doing search and seizure warrant type stuff where they're going in and taking all the hard drives out of the offices and taking all the files they went through. Jason marino's house in rancho santa fe. They've gone through the office of this developer. You know i mean this is this is you know you can say that. It's not a big deal but it certainly feels like a big deal. It's not it's not something that you typically want. I mean if everything was above board you might get a letter from a lawyer saying. Hey this is what we're requesting you know in the suit. This was like a secret. Pop up thing i don't. I don't think they got notice that this was happening. I think they middle of the morning. You know pounding on the door at five. Am you know and then coming into your office as the office opens and taking all the hard drives you know. So they're definitely going after this and we'll continue to follow it but this is not going to be something at this level. I think that's just going to roll over. I think that there's going to be probably some some serious penalties and some some you know some dollars that roll back to the city from this. That are probably going to represent a pretty big dollars. You know sell who knows what happens here but there is definitely a pending lawsuit. And so we'll keep you posted. You know i. What i have not heard is win. The city is planning to occupy this building or if they are still are they actually doing the asbestos abatement now or are they going to let this play out because it's a legal battle so it'll be interesting to see a thanks for listening today. So i don't know if he's marino goes out and lists a lot of office buildings but the that's that would be the reason why they would want something like that because they're getting upset that these bigger offices are basically getting probably they're able to double dip on the fee from the listing side and the transaction lee side that he's having to split that bell and i mean what does he just it and my question is to to jason and you know just only looking at this from the media and i. I don't have any ax to grind with hughes marino. I think they're probably a pretty good company and they've they've done a lot a you know. I know i have a friend of mine. Who's a big broker in denver and does a lot of office leasing and hughes marino just opened an office in denver and the rumor in denver is like in that guy going to jail. You know so so. That's how far this is travel. And i didn't. I didn't know that that was part of the conversation was even even at jail time or whatever it is well. I think it's pretty serious. Anyone from the outside looking that you're involved with the city and there's not full disclosure. The thing is this whole thing is a full disclosure discussion. That's what's going on here. That's why the city attorney's office is now going. Look i mean we've spent sixty million in lease payments and we have this this known professional real estate guy and the city is going. There was no disclosure of asbestos. We don't know anything about this. And we didn't know so they went to occupy and then i think somebody from the city came. If i remember correctly valley you got a bunch of us. Bestest in the hallways of the stairs out of curiosity with the owner of the building that that sold it to the city with dave had to disclose it was specis. Well i think it's just something that it would be either through that or through due diligence. So yes i believe that's why that the developers involved in it and you know who knows did.

"Their lawyers came out said the same thing but it goes on to say that you know there was a lot of you know of shady things going on here from a real estate perspective and obviously there are some serious disclosure issues right so and it sounds like most of it is is on the hughes marina side the developer sestak era. Who who knows what the relationship was that they had but i mean them being a seller. Jason can operate as a dual agency. He can in california but it has to be fully disclosed and the issue at hand is at the city is stating that it was undisclosed that he was working in the capacity as basically a consultant and it was a consultant of of basically a pro bono consultant. Jason's claim is. Hey i have a letter dating back to twenty fourteen telling the city. I intended on getting paid and obviously sister up paid him for whatever services he provided or whatever that was both hysteria and the other deal. So there's there are. it might have been both. Maybe there was a lease and a sale transaction got paid on both so. I have a question. So the here's marino has been. I mean they have a bit of the attendant rep company specialising turnaround specialize in ten. Obviously they don't just do ten up. But i wonder i mean they're all like there has been multiple things that you hear hughes marino's name in the you know trying to get more disclosures for dual agency purposes to basically make it harder to jill agent because they are simply tenant rat brokers i i would say that probably hughes marino's position is that hey were acting as transaction broker so we're broker to the transaction. So that's that's more than likely what their claim would be from i. It's funny to me. Because the last time i heard about he's marino being in the news do they. Were trying to p- rush some more disclosure information. I was required so companies like cushman and wakefield and graham knight frank or you know what are these companies would have a hard time in house being delayed so you know i it just throws for me this the irony those irony of the situation a little bit more into play. Because it's like they were acting as jill agent. Look we've seen this a lot this year right. This is not the first firm that we've seen is being implicated in large commission. Type things so they make in my opinion very stupid decisions to not sit down and disclose everything. What did he have that. Why wouldn't you for a company though that. Why wouldn't you when you're dealing easily gone to bat like like you know publicly to try to make it harder for people to be diligence that that's to me the whole thing. It's like you. i mean it seems. There's just something there that seems fairly. I don't know it seems off or a seems like there's something that'd be like noted that we have a company especially specializes in being agile agent. Who has made it more difficult to try to at least for companies to be till agents. Yeah so yeah. I mean look i mean. That's that's just competition right. I mean that's that's what people wanna do. You know the old saying as as as the organism grows it just becomes the only thing that it does is tries to protect itself right. So that's just jason hughes marino group just saying hey we want. "It's full of festus. So the question yeah. They can't occupy they've never occupied it. So now the question becomes okay. Wait a minute. So jason marino was operating on a pro bonus bono basis as the consultant for the city and did not recommend any due diligence. Or anyone look into an inspection hotness building to find said specis so what i've heard i'm certainly not a party to the transaction. Were only going off the information that we have from the media but we are connected to a couple of larger contractors in the city and one in particular who shall remain unnamed. Knew quite a bit about this property and said you know the asbestos was like it was pretty clear that it was like in the in the in the the fire walkways throughout the building so it was in the building core. Walkways so it was. It was relatively obvious you know to somebody who's in that industry so apparently when the guys came in they were like. Yeah that that right. There is a specis. They didn't need to do special tests or go. Search around for it was pretty obvious that it was in there so so that obviously was a huge red flag for this but by not doing the special test. They not get an accurate account for health benefits. This was was. I mean that i guess. Maybe that's my question so it was so obvious that the contractor that we know was saying it would probably be something that one would notice in a building to her. So when you came through. You'd if you're if you're walking you know your your inspectors and trades as you're as you're doing your due diligence and you're doing your your physical inspections anyone who is worth anything would walk through and probably notice some of these things and be like. Hey you should get that chat so my question is is that okay so you claim is it never got checked okay okay. Ms got checked or is the claim that it was so obvious that the city should have. I mean this and he knew about it and just decided to ignore it and did not realize how expensive it was to fix could be. We don't know right but what we do know is what's happening today. Why we're having this. Podcast is now the attorney. The district attorney's office is involved this and now they've seized they've they've done a search warrant on on jason hughes home in rancho santa fe the hughes marino office downtown the developer of the project who is hysteria they did a full blown. You know search warrant on those on those places so now the lawyers have all come out for these guys and they're going. Hey a search warrant is does not show criminal activity. A search warrant is just a way to get information to decide if there needs to be a case going forward and it's a way for people to get their information the more serious than that right. I mean clearly something right pretty much. The district attorney's office going look. We're not getting everything that we need. Systemic came out made a comment immediately made a statement and said hey. We've provided everything to the district attorney's office. We have nothing to hide hughes marino..

This is the property that the city of san diego bought from a developer. Here in san diego and there's a lot of different parties that are involved in this and there's a lot of finger pointing that's going on right now he yes. It's kind of the The melodrama of the real estate world right. Yeah it's quite it's quite a story and it's just like just keeps getting more and more and more juicy as it goes along because more and more stuff are revealed about how this thing went down and you know you know. It's i mean there's just a lot to it and there's there's a lot of there's there's a lot of there's a lot of unconfirmed kind of unsavory details right so probably the biggest thing is. Is that the two two of the biggest parties that are involved in this. There's really it's kind of a three part thing. So at the time it was kevin faulkners office and hughes marino was kind of you know. Say they were a consultant to the city and volunteer right. And so i was going to get that. So they're they're a consultant to the city and saying that they're doing it basically. If you're in the legal world you would call it. Pro bono right. So they're going to work with the city and help advise them on their real estate transactions which one assery was a transaction that was being contemplated by the city to relocate the city buildings so hughes marina stepped in and said yeah. We'll help you with this. Where your consultant and will advise you on this transaction..

They're very knew they were planted about a little over a year ago. They're doing really well. But now you know, some of the branches are very, very low on the trees, and they're sort of, you know, they look a little more like a bush than a tree right now. There may be like 10 12 ft High. Um and I was wondering, uh, you know when to prune how much to prune, and then they're also staked, and I'm wondering how long I should leave those three ST John. Thank you. So much for calling. It's a great question, and it's one that's probably affecting a lot of people. You don't want to do any of the low pruning on the ass trees this summer. Okay, they need all that folds to protect himself. And so to leave that alone, the only thing you want to prune on Ash Street this time of year. As if you have suckers or shoots coming out from the ground, you know, down in the bottom foot or so the rest of it, let it cook it and let it grow all summer. You can prune that off and raised the head high step. You know this this follow this one of the best time to do it really is in November December. And you can raise it up a little bit. How high should I? How should I go up? Well, the healthy area of the tree, you know it's going to grow lower limbs on a healthier treat, you know, And it's just a matter of taste and what you're trying to do. You know, years down the road or else they would come multiple arms and larger branch structure so I would personally try to leave everything you know If you want to have a standard shaped tree with a round head you can walk under, you could prove the limbs up to 5.5 to 6 ft. And you can do that. But not now. Let's do that. Like I said, well as they go dormant in the wintertime that way, we're taking all the storage from all the start of the food going back down in the trunk and the roots and then in the spring will come out and you'll get the advantage of that to come back, and also they have a chance to protect themselves for this summer. So you know if you want to raise it to 5.5 or six ft to the bottom limb, you know that's fine. If he raises up that high, you notice the sun is going to really hit the trunk, Go ahead and wrap the tree for the next summer to protect it. Okay? Okay? And then how about taking Well, what does it have for steaks now? Have 33 lines in sort of a triangle around the tree. Well, that's kind of like the first guy called in with his suggestion I was taking you know, and as long as the tree can move back and forth You know, that's excellent. You know the most important thing for that trees to build caliber strength, Okay, And that happens when it moves, and it moves in the wind, but as long as the trees, not steak, rigid with a single steak and can move back and forth in the wind. It's going to build caliber and get stronger as the season progresses. And you know what doesn't kill it with the wind does make it stronger. Okay, So would you say maybe two or three more years of staking or is there shouldn't be more than probably just this this season. You know if you have if you have the trunk loose enough where it can move back and forth. And we wanted to be able to move a foot or sell, you know up at eye level so it can move at least a foot or so. Or maybe even more. Maybe even two ft. At eye level and, uh, at the tree can move back and forth like that. The caliber the trunk diameter is going to get larger. And that's going to make for a stronger tree. And realistically, you probably can remove the all the brain of the cabling system that you have set up. You could probably remove that after the monsoon season. Great. "Going to your time. 8 42 Okay, one on one Ash Street. The city is trying to back out of two real estate deals negotiated by its former volunteer real estate advisor following the revelation that he pocketed a previously unreported $9.4 million From the middleman developer on the other side of both leases, right, So we're just trying to follow along at this point Voice of San Diego's Lisa, however, said, joins us, Um Lisa, is there any part of these real estate deals that make any sense at all? To anyone. I think I think some context to kind of bring us back to is this these deals? Both came about at a time when the city was looking for places to put city workers so there were some big leases that were expiring. And the city was looking for options other than a bunch of downtown leases and different buildings where you might have, you know, rising market rent. So the supporters of these deals have argued that the city saved millions of dollars on rent when you compare what they might have paid for. Multiple other leases in different buildings and the fact that with both deals the city would own the buildings and not need to pay rent after 20 years on these because they're leased own deal, but very big, but Given all the issues here and the current state of things. It's unclear that the city will ever actually put employees and one on one ash in particular, and obviously it's now trying to get out of civic Center Plaza. We're now hundreds of city employees are okay, So in the meantime, everybody has pointed the finger at everybody else. People are saying, Okay, this is Todd Gloria's fault. This is former Mayor Faulkner's fault. Where does the buck stop here? Well, you know it. Really, As you said, depends on who who you're talking to. Um, but one issue here that you know is at the center of this Is that Jason Hughes as far as you know, according to folks, um at City Hall, formerly a City hall. The understanding was that he was not being paid for these fields. Now, he says that he Disclosed that he, in fact wanted to be paid. Um, but there are a lot of questions about. Uh, so yes, For now, it's not usable. So who's paying for it right now? Who's paying rent? The city actually, last September, decided to stop paying rent payments under the argument that it wasn't getting a benefit. Um I won't go into all the state Constitution stuff. They're all Keep your listeners from having to listen to that. But essentially that they weren't benefiting from this and therefore they should not pay. Um, is that legal? For now? There's there's quite a legal dispute over that thing out of court. Um, but for now, the city is essentially been putting the rent payments into Another account rather than pay them to the landlord in this case, Wow. Now it's starting to do the same for civic Center Plaza. Um, just effective when the rent came due this month. Wow. Okay, so this is a huge mess, and it sounds like there's going to be A legal answer to it. But that could be 10 years down the road before they get through this. Yes, I would expect lots of battling in court over all of this and the you know what I would say it's likely that there could be other lawsuits that we haven't even seen or imagined yet. Well, Charles probably grant it would be a lot easier for you so you could just raked the bark out and and probably come back and top dress with granite and a good size granite for blowers half inch. So what? Three quarter one inch rock. When you put that down, the leaves tend to get stuck in it. Or and quarter inch The blower come blow now, depending on if you break a little bit quarter inch is easier to rake. But if you want to use the blower, I'd probably use half inch rock. Great and I can't. I assume I can get that from any of the rock places all the rock yards yet, and they'll probably have numbers of guys who will spread it for you and the old days of McCormack Ranch.
