And it's a big one night just because it's twenty one but because this the weekend everybody's waiting for that first weekend in. May only it's not the derby expect it to be right? We expected this to be the Kentucky Derby. We're expecting this to be a big podcast. And it's still a big podcast. Thank you to the people at Oaklawn for putting together an enormous program for the Arkansas Derby this weekend saving the weekend getting some amazing horses to run a couple races for us and these are the racists. We're going to talk about. So yeah I'm I'm the formula and I'm joined by empire maker. How's it going on your end going? Good Man I'm I'm Just wanted to give a shout out to the cove virus for just destroying the first half of the year for everybody. Thanks thanks buddy. Besides all that. We're actually getting back to work next week Things are starting to normalize slowly hopefully because little bit afraid of some resets on death tolls going back but other than that We're GONNA stay on a positive note and talk about some horse racing I wanted to mention to just a massive week at will rogers. We played three slates there. This week and slade all of them. I think we had fifty percent wire greater on all three of them. Yeah and we've we've kind of figured out a strategy on will rogers. It's been paying out and I think a lot of people been following us on that too. Yeah I've gotten a ton of good feedback and you know people people asking for other picks from different tracks based on the success. We've had their gets. It's been a great week. Probably the best week of twenty twenty to be honest with you. Yesterday we played oaklawn not not terrible but not good We were negative but again it wasn't something's didn't yeah it. I may even put the audio of the race on to To live give feedback on how we're doing so anyway Let's jump into Oakland for Saturday because there's fourteen races in their full fields and it's going to be an awesome day tomorrow. What did we got going on here? We are looking forward to oaklawn tomorrow. We are going through one through fourteen. But WE'RE GONNA skip to. We didn't have enough data on that race to make a competent pick and for these picks in the past. I've given you what were are one. Two three in terms of an exact try box or an exact a three horsebox We're changing it up a little bit. We're giving you our top two favorites to win and then we're also going to throw in what we consider to be a long shot so I think at the most or at the least are long. Shot to sorry are long shot to finish in the money. I think at the least. We've got maybe an eight to one horse squeezed in there but most of these are Morning Line odds of ten or more so basically a value played up to bounce into your exotic exact to try to pick three and four hours to cover the coverage basically. Yeah exactly something that we think could show could place and provide a pretty good value and and you know in these huge races. This is what we've noticed. I'm sure other people notices while there's always a that squeaks into the money when you've got twelve horses run in like that that you know it wasn't in your top three may not have been in your top four wasn't in your top five so we're trying to find any of those value. Plays out there that we think could be the horse that as a ten to one morning line. Odds maybe even a twenty to one squeaks into that that money spot and Gives you a nice little fat payouts? Is this the dual? Arkansas derbys is about as cool as we could hope for right now. So yeah it's awesome and the fact that the fact that they split up Dolon Charlotte and into two different races. Yeah instead of putting them head to head it. Only builds up the drama even more for the Derby and maybe I'm an idiot for not knowing that process that they went through to split those but I'm glad I'm glad they're split up because I think it allows for the drama to unfold all year better this way although I think that division to believe Nidal's division is is a much tougher division. I would say so I. I agree with that wholeheartedly. There's there's some horses that I did not put in my top three. That shocked even me. So yeah and without further ado race one. We got a six Furlong Race. Six six and a half for a long time member which it is. Let's start going are are. It's a six okay so our number one horse here timely tradition. You'll Rosario on that horse. Been extremely strong All year been extremely strong at Oaklawn all year. And that's the The morning line odds top horse as well. We've got timely tradition in there. I'm digging deep for my number two horse. My second horse as a really good chance to win is I think it's the eleven horse jackets or Jacquat died yesterday. Pronounce it Jay. Acc I'll say Zhukov. Because it sounds awesome more sophisticated ways. Let's go with it absolutely so it's it's second to last race puts it probably one of the top horses in this race Its last race was a bit of a letdown in in terms of matching up with a rating on this race. But if you remove that and you start to look down it's it's done really well Flavian Pratt on top of the horse. Not Hurting you there now. Fly does a beast man. Yeah for sure at eight to one. That's an extremely good value. And I'm not even at my value play yet when I get to my value plates the number eight Lexington Grace from Ireland. Twenty two one morning line odds it ran to ninety S in its past couple of races really strong horse had a little bit of a dip down in its third and fourth previous races. But even before that it's been running really strong And also it's Yeah. It's A it's a Horse. That's finished in the money several times. A lot of thirds a couple seconds. So I see no problem at twenty one in place in some sort of wager on Lexington gray so I got one eleven and eight. It's my two top favorites to win. And then a nice long shot in there as well. And that segues into the eight horse for the relevant metric for race one Lexington Grace Irish horse just another just another reminder how thanks again. "So again a big car this weekend in Oakland Park obviously not the Kentucky Derby unfortunately. I think we would have preferred to have to be running in the first Saturday in. May Have have all the the fun with the Kentucky Derby Street that we we normally come to expect around this time of the year. Unfortunately we're not going to get that But looking ahead to what? We've got coming forward again. Obviously next week I mentioned at the top of the show hall of fame will come out on Wednesday. We will wait and do the show as tempted as we will. Beat to do the show. Probably even on Sunday. 'cause I assume it's GONNA be a really entertaining daybreak and we will hold off on that until the hall of fame. We will get a reaction to the famous wolves. Everything that happened this weekend with racing like I mentioned. We're going to do individual previews for the two divisions of the Arkansas Derby and the fantasy and oaklawn handicaps respectively. Those will be on Youtube over the course of today being Tuesday and tomorrow Wednesday. So keep your eye out for those as well. Keep your eye out for the remainder of the hall of fame videos. I tried to space them out. Unfortunately Kinda ran out of time. But that's just GonNa there's GonNa keep your eye on youtube. I'm going to be pumping out content on Youtube over the course of the next week so that we hit the deadline of getting all the hall of fame stuff out before the actual inductions are announced. "It's it can't possibly be that. Only poor people are not allowed to hold signs up while firefighters and others are. I appreciate you bring up the point that what actually the government needs to do is to deal with these underlying problems not criminalize homelessness. I wanted to just talk talk about one other free speech case and it's one that we talked about with an ACO. You attorney my colleague. Brian House during a previous episode and it was concerning an Arkansas Law that requires contractors with the state to sign a certification that they will not participate in a boycott of Israel and our client in that case is the Arkansas Times teams which incidentally had no intention of boycotting Israel but also had no intention of signing a loyalty oath of any kind. We have some audio from Allen Leverett founder and publisher of Arkansas Times. I'm a citizen okay. I pay taxes in this state and I. This is my home and no they do not have a right to punish me for exercising my constitutional right to be silent in this in this instance. It's just to be silent. We don't take a position on this. Our job is to write about Arkansas. We're a lot more interested in Medicaid expansion. Here in Arkansas. Then we are. What's going on in Jerusalem so the only government in contract the Arkansas Times has his running ads for the local community college campus but the state asked them to sign the certification on the less? Unfortunately this case isn't going going as well as we had hoped. Can you just update US where this case stands since we filed suit in federal court well federal court said that there was not a right to boycott and therefore the government attempting to tell these journalists. What they could and couldn't ride or call for was not a violation of free speech H.? And of course we very much disagree with that the right deploy. Kat has been an important tool in changing the face of civil rights and civil liberties and as Brian noted in court the Revolution Hayes were boycotting elands so all the way back to King George. Their boycott has been apart of the fabric of our nation and an important one that we strongly believe is protected under the First Amendment. This this state law is absurd for many reasons but one of the most absurd provision is that it says you can't contract with the state unless you agree three not to boycott Israel in the future or if you take a twenty percent discount off the state contract price then you can boycott all you like but but as long as you give this day to twenty percent discount those fundamental important interests. The State is trying to protect not so important anymore. Well that's a Sort of a preliminary loss in the boycott case. which hopefully the Appeals Court will overturn and bring in line with actual Supreme Court precedent? But I wanted to talk talk about another big win that you had recently in an abortion case which is little rock family planning services versus Rutledge. Can you tell us briefly. What the laws you were challenging in that case I would have done and why you thought it was important to block them? We challenged three new laws. One of which would have banned abortion starting at eighteen weeks which is course Ability Point in pregnancy and other law imposed a blanket ban on abortion prior to viability based solely on on the woman's reason for seeking care and then a third law that we've challenged prohibits highly qualified trained physicians from providing safe. Legal abortion. Care in Arkansas. If they're not board certified or board eligible in obstetrics or gynecology in so that was aimed at ensuring that the providers that we've had an estate for many years who are doing fine job hunting gear. Their patients could no longer provide that patient patient care so we challenge those three laws in one case and took it to Federal District Court and the judge in join those three laws and and of course the state has appealed that injunction but as it stands right now those laws are not ineffective in place. Well congratulations on the win. But I'm wondering wondering. Is it too early to celebrate. I know that we've had several conversations with our colleagues working on reproductive justice both at national end in different states. I'm wondering if this is part of the broader national chess game where advocates are trying to get the Supreme Court to Revisit Roe v Wade. DC This case. Going up to the Supreme Gordon. I definitely think the state will try to take it to the Supreme Court in his absolutely part of the effort to overturn Roe Versus Wade. Our legislators just lighters who propose and pass these bills have made no secret of the fact that they want to overturn Roe versus Wade. And it's like there's a competition to see. You may be able to to do that. We've had a twelve week ban that we had to have struck down. We've had all kinds of challenges to these laws. But we cannot rely a solely on the courts to protect the right to reproductive liberty. We need people who support people's right brought to make private personal decisions about their medical care and weather and wind bear children to communicate that to elected officials and hold their feet the fire if they don't support them in the past four years there have been twenty five or more laws passed in Arkansas solely around abortion one session. We had a wonderful buell. That allowed telemedicine for everything except abortion including taking the morning after pill that healthcare could be provided by telemedicine. Obviously telemedicine is very important. A rule state like ours where people may not have access to healthcare readily available or they have to travel or it's cost prohibitive or things of that nature and so we have filed WanNa say seven or eight cases in the last several years challenging eleven or twelve different laws maybe more but there are always laws that still remain on the books and so the list and litany of things that the doctors have to say to their patients some some of it even untrue that the state imposes is amazing. What they don't require is the doctors to actually tell women about the risks of pregnancy minh-city? So it's very much targeted exactly at the woman's right to an abortion and we'll keep fighting in the courts will keep finding in the legislature that folks are GonNa have to step in at the ballot box really grateful for all of your work in the courts but as you said elections certainly do matter. I want to come back to what you said was your first animating inspiration to enter this world of civil rights and civil liberties. We talked a little bit about the criminalization of poverty and other marginalized folks but also about racial justice. And how core that was for you recently. You wrote an OP. Ed where you said. Arkansas holds the shameful shameful distinction of having the fastest growing prison population in the country training. Money from other priorities exacerbating racial disparities and failing to make our communities safer. Mass incarceration is obviously a nationwide problem. But why is Arkansas specifically have this distinction of having the fastest growing prison population Asian. And what is the ACLU trying to do about it. Instead of providing pre K. or adequate education or mental health prevention and treatment or addiction treatment. We put people in jail. uh-huh imprison we jail and imprison people because they cannot pay their fees fines and costs. We have to stop that you you know the. US Supreme Core told us in the seventies in a case. Call bearden versus Georgia. You're not supposed to be locked up if you're unable to pay your fees fines and costs debtor's prisons are not supposed to exist in America but even though the courts are supposed to inquire about ability you pay before they Jail or between prison because of it. That had not been happening. We had one client who was affected did BADASS and had been to jail about twenty times over the same too hot checks over about a a two decade period so at one point he was two days away from getting a new job and they picked him up for non payment on those fees fines and costs and it's widespread. Our courts are doing better now. A lot of our judges are conducting those questions and answers with people before the court to make sure that they are able to pay. Hey before they require them to pay and then jailed him for nonpayment but even in our parole system. There was a case at Western Arkansas aware. The man was nearly end of his six year parole term. He had done everything the state told him to do. Meet with his parole officer taken passes drug drug tests maintaining employment except he had not paid all the fees fines cost restitution that were ordered by the court and because because he was unable he wasn't even sheltered he did not have housing he was able to achieve all these other things and the prosecutor filed a petition for parole revocation advocation. Judge granted it in this man who had worked so hard and challenging circumstances to become again a reintegrated productive member of his community. They plucked him out and put them in prison for six months where he had to start all over again. So it's really a broken cycle and Dan until recent years there had been no study about the racial inequities in our criminal justice system. And so oh working with our national office and the Urban Institute we undertook a survey and research of our system and through our state state blueprint for reducing incarceration. We've come up with numerous initiatives to try to combat. Not only this addiction on incarceration our solution that we have but also the racial disparities in the system and so there are a lot of things that we don't know but there are a lot of things that we do and one thing where we're woefully behind is really accountability for police. Most of the professions in this state state and across the nation have a state professional or ethics standards board so that if they violate professional standards you can complain to them and they can investigate and take appropriate action whether it's education or resources a reprimand suspension or taking law center when it's warranted David. Whether it's doctors lawyers teachers beauticians pool cleaners bail bondsman almost every profession. has an ethics or standards board. You can complain to but police do not they do have a licensing board but that licensing or does not take complaints from from the public. I WANNA close by taking a bit of a step back. You're the legal director at the ACLU of Arkansas. And I'm curious how you choose. WHO's among these variety of challenges in front of you and how you maintain your passion throughout all of the challenges that are in front of you? That's a really good question. It's one of the things that I ask when I was I interviewed for the job here at the ACLU back in two thousand and six. How do you pick and choose your cases and it really is more of an art than a science and obviously depends on what resources we have available? We recruit attorneys. Who Lost in the state of Arkansas? We ask them to dedicate dedicate or volunteered their time to take these cases up. Sometimes I get three nos and yes sometimes I get an immediate yes sometimes I don't get any. SS So there are resource questions but then also look for impact cases. What cases will to help correct the law or defend the law that will help the most number of people or make sure that we have proper laws in place place and it's really interesting because we have amazing clients and there are exactly? The types of clients had in private practice. They are upset upset because I wrong has been perpetrated toward them but what they want more than anything is for this never to happen again to them or anyone when else in so our clients tend to look for opportunities where they can actually change the law or get. The law declared such that people's rights will be respected from this point forward. And that's the top bucase that we look for someone described it as kill as many parts as possible with the one stone that we have and some things are just so egregious and unconstitutional that you pretty much have to challenge it Holly Holly. Imagine you're an intrepid seventeenth century, French explorer transverse in the expense of wilderness of Louisiana, aka new France, a territory spanning the entire Mississippi basin for modern day, Louisiana through Illinois and northward into Canada, you encounter, dozens of native tribes each with its own language or a dialect, and you attempt to record their names in your journal as best you can this imperfect system is how English speaking Americans eventually arrived at many of their names for native American tribes, including the Dakota, Iowa, Alabama, Nebraska Ottawa Chippewa and Tuscaloosa, I think of it as a centuries long game of multi-lingual telephone these words evolved from their original pronunciation into a French approximation and finally into an English sized mangle ING of the French which brings us to the legitimately confusing. Question of how the state of Kansas spelled K N SAS. Could be pronounced Kansas while the nearby state of Arkansas spelled A R K A N as a s is pronounced Arkansas. This question was the subject of a pamphlet published way back in eighteen eighty one titled fixing the pronunciation of the name Arkansas the booklet written by members of the Arkansas. Historical society was bent to provide historical context to a resolution passed by the Arkansas general assembly declaring the one and only correct pronunciation of Arkansas to quote, it should be pronounced in three syllables with the final s silent the AM each syllable with the Italian sound and the accent on the first and last syllables being the pronunciation formerly universally and now still most commonly used. Apparently, what happened was that?
