"So a couple Jason Riley from Wall Street Journal last month October he wrote a piece out how San Francisco has become a shoplifter Paradise Thefts under $950 are effectively decriminalized Okay now you can get a lot of stuff under a 150 bucks I don't know if you've noticed lately TVs are way under $950 I'm not saying they're like the greatest TVs Or they have all the great features But you can a 100% get a big flat screen TV for well under $950 So now if you shoplift TV because you're part of looting or grab and go or fun and games where everyone call you get a TV and it's under 9 $50 you basically you won't get prosecuted They're gonna let you go Why Because they have now this ridiculous idea Prop 47 California bout initiative theft of less than $950 in goods is treated as a nonviolent misdemeanor and rarely prosecuted So stores don't want to get sued they tell people we don't even do it anymore But now when you've got marauding mobs of people going in and stealing things all at once because they're organizing on social media and they're going hey let's meet up at target at 7 o'clock and we'll all go in at the same time and just overwhelm them Four men on Wednesday in California and Santa Rosa fled with $20,000 of merchandise from Apple store In San Jose $40,000 of items were stolen from a Lululemon store That's right they're even stealing yoga pants now I thought yoga pants were so sacred that nobody would ever want to steal them I just know there's certain things in our society that we just don't touch Yoga pants being among those things But clearly not they went and grabbed those as well In Chicago they stole over what I mean how much was it in Chicago now Can I go $25,000 at a village shopping center It's happening all across the country And so now what's happening is employees are quitting as a turning around saying I don't want to deal with this Why would

Unpacking the Apple vs Epic Ruling

"Versus epic. We kind of got the ruling after the whole lawsuit. We've talked about it before epic suing apple because they made them take out button that was leading people pay on third party site in apple. Obviously with their iowa store in their thirty percent. Cut doesn't want that to happen. so kind of is like Win lose lose more. Even though that's three parties there's only two parties associated. This seemed like everybody was not happy yet. Kind of kinda sorta so pretty much. The judge ruled that they're not being anti-competitive they claim. Success is not illegal and both apple and third party developers like epic have symbiotically benefited from ever increasing innovation and growth from the ios ecosystem. Fair feels pretty fair now they did also though and this is what kind of is a lose aspect for apple is that they They ruled there for permanent nationwide injunction blocking apple not only from keeping iphone users in the dark about alternate ways to pay but potentially allowing developers to stick their own purchase mechanisms into apps. So that's a win for developers. I'm yeah so initially that one rule that Epic was pretty mad about was that in-app purchases had to go through apple's payment method which automatically took a thirty percent cut and the argument was. Why should there be an only apple at purchase that there should be other options to be able to have our own in-app purchase methods. Should be offer alternates. Maybe some of them are cheaper because they don't have to go through a thirty percent cut from apple and this ruling is that apple will now need to allow other purchase methods for in-app purchases and there's a little bit of they're not quite sure how this is gonna work. What constitutes a button inside it and stuff so that'll be a little weird but so the reason epic doesn't really win on. This is because the way they started. This whole suit was by adding that and the judge also ruled that it was a breach of the contract and apple is allowed to continue to knock basically let four-night back into the not. Give them back their developer account. So while you are there blocking that and you will potentially be able to put a button in for this kind of skirting. The rules epa can't because they're not allowed back in apple store epic knew what they're doing when they broke the rules so developers win apple kind of loses epic really loses. Because they're not back on the ios store and they also had to pay some sort of a fine because of the money that they made in that process of breaching the contract. So that's super super. "Apples expected to real a new iphone today but the biggest update may be in its app store. That's because of a ruling in the epoch versus apple lawsuit which came down in apple's favor with one big exception. A judge ruled that apple does not have to reduce the fees. It charges developers in its app stores. It's currently from fifteen to thirty percent. Fortnight epochs gay may. We're maine's banned from the app store. However because they broke their contract over the judge allowed the divers can use a non apps or payments to get around the apple store fees. That's a big change. It's a big win. Epoch still filed an appeal because it didn't declare apple monopolised etc etc. It's a really interesting ruling and to me. It's not that much money for them. They were going in this direction. Anyway and most people will probably still pick. Apple is the payment system. So what do you think about mark. Gherman swanee guess is your dog walker now anyways Look this was. This is an interesting case of the media deciding. Wouldn't it be more interesting to say. Epic fail for apple right and the reality was it was probably more of a win for our it distills down to it. A lot of anti-trust lawyers on both sides of the issue will say that it being a monopoly as an illegal. It's abusing monopoly power. And what they've said is okay you've minder standing of the ruling is the judge has basically said you've invested a lot. You've done a good job. People get utility from this consumers. Clearly love it. They don't feel angry that they you know they. They have to wait for someone to come installed their cable between the hours of one and five and three months because you have a regulated monopoly. But what they've said is its monopoly abuse. You can continue to charge thirty percent. You can continue to have somewhere between fifty five and eighty five percent market share depending on how you calculated. But we can't do is when someone's downloaded the app. Then decide that all tail activity within the app. You get a commission on their saw that as monopoly

"Several years ago journalists and kepler was on his very first work trip. He was an intern. Us news and world report. At the time he was excited. We did carry okay the first day and i got a little bit drunk. Nothing crazy but i fell asleep with my laptop in my bed watching comedy or something like on netflix. When jason woke up the laptop had moved down to the end of the bed without him realizing it and what happened next. Has that painful almost slow motion quality that anyone who is broken anything expensive knows all too well kicked it off the edge of the bed and the lcd broke on on me laptops. So the screen wasn't broken but if you opened it was just us all kinds of crazy colors and tickets be apple store and they wanted seven hundred dollars exit money that jason. An intern did not have so. We figured why not try to fix this thing myself he went on ebay and found a replacement. Lcd screen for fifty bucks. A fraction of the price that apple had quoted him and then he found some instructions online. It actually took me like ten hours to do like couldn't get the screen off. And i remember at one point. It was like four in the morning. And i grabbed in exacto knife which is not something you want to take the wires but i was just so frustrated and i just couldn't get the screen off to put the new one end eventually jason fixed screen and he used that computer for six years but the experience opened his eyes to a really important story in the tech world. One that he's been covering ever since it made me think like. Why does it cost so much to do this. It costs so much to get a device repaired by the manufacturer. And it's so hard to do it yourself because manufacturers from apple to samsung to microsoft. John deere make it that way.

So if you wanted to you could have gotten all this last week But no one wants wants to actually go thrilla before we go into the particulars of of what we've heard because we can't see We've been we've been listening to these calls and looking at documents Let's just talk about the case. Rodley i think anyone who's listening to this show understands the broad outlines right this epic arguing the administration monopolist Because of the way they run the app store you are someone. I i often think of referred to as an apple enthusiast so i would think you are mostly sympathetic to apple in this case but i think also you have been increasingly critical about the way apple runs the app store for the last few years so before we get to the specifics of epic and apple. What's your overall. take on the way. Apple runs the store. And and what you'd like to see from them. You thought you said it was going to be a short show. I i would. I think it's useful to break this down. I took a note. I wrote before coming on the show. What exactly is epic asking for. "Alternate app stores would be like forcing it to sell iphones with chips other than its own a series or something like that epochs going to point to the mac which has an app store but also allows for other ways of buying and selling software and say. Why is it so integral on the phone and not integral on your laptop. Apple's going to point to game consoles like the playstation and the xbox which have a thirty percent commission and don't offer alternate stores and say that's the industry standard. We're just doing what they do. Apple will also use browsers as a defense saying. There's an alternate way to implement software outside of the app store. If you want just use a web app microsoft's doing it for its game streaming service so is amazon. We're going to get all star witness cast to this is. This is microsoft antitrust suit level witness. We're gonna get epic co founder. Ceo tim sweeney. Ceo tim cook. We're gonna get all the senior executives from both companies and we're going to get a nice round of third party witnesses including microsoft's vp of xbox business development to speak about the game console. Part of this and laurie right are her name's lori. Right and nvidia is director of product management. Sheesh patel is going to talk about the streaming service aspect of this. The ultimate decision of this case will set a precedent for how digital marketplaces are treated by the law. This trial is expected to take three weeks but keep in mind. Whatever the decision it will likely be appealed no matter who wins so it's not going to be solved in this case but this case will set the tone for any of those appeals. This is probably gonna go all the way to the supreme court. The case will evaluate whether the sherman act's definition of a monopoly in the united states applies to an operating systems app store. Epic would like the right to offer. Its own app store on us as well as also be able to offer alternative payment methods within its apps distributed through. Apple's app store if epic. Were to win this case that would lead developers offer their own in app payment systems and possibly force apple to allow side loaded apps or even alternative app stores now in the case. Here's some of the arguments to be on the lookout for apple's going to argue that competition is and should be among devices not within the os and apple's going to argue that. Twenty twenty. so it's been nearly a full year of being closed for some stores. The company had been opening locations on a case by case basis over time. And the last of apple's us retail stores reopened this week in texas. That means you can at least arrange in store pickups for apple items again and in some cases you can even do in-store shopping but before you do let me just point out a couple of things. First when apple did close stores march these seven day average of new covid cases was two hundred seventy three cases in the united states. That's across the country this week. According to the cdc that number is sixty six thousand three hundred forty eight new cases over the last seven days. That is you might say. Things are way worse right now than they were when apple stores. I shut down now. Apple does have lots of safety measures in place. Customers must wear a mask and there is a strict occupancy limit for stores all that being said. I would strongly suggest that if you don't have to go to a store take that option. I understand that some people do need to go. In and of course the employees have to go in but to keep people as safe as possible. And if you wanted to go there but the fact that these types of the stores are all reopened across the. Us is a good sign that we're on the right track to some semblance of retail. "I wanna talk to you about the airpods max. There was many rumors this fall that these were coming and being mid december. It looked like maybe we're not gonna get it before. Two thousand twenty one but no early on tuesday morning apple announced and released the airpods max. They went up for sale. I think it was like eight thirty in the morning and to everyone's shock and awe and let's just talk about now five hundred and fifty dollar price tag for the airpods. Max i would love to have your initial thoughts not only on the price tag but on the name. Because i kind of wish. They went with studio because the rumored codename airpods studio because they're over the your headphones with the cups. Noise cancelling airpods max. I don't know it sounds a little funny. What do you think william. I did as she laughed when i saw the name but only because apple keeps used to keep everything secret and now everything seems to come out but they hit us with a new name. We weren't expecting and that did the same with the apple a. m water. It is like there's a naming department that can keep a secret. I agree studios san sense better so these headphones they're very expensive. They're five hundred and fifty dollars despite that they're basically sold out until march if you try to buy a pair now it'll say twelve to fourteen weeks shipping time so even despite the price very popular you can actually go and watch him hd. And i just actually have these. They did initial videos unboxing and some initial thoughts. I'll put those links in show notes as well just kind of a quick specs. These are over the ear cups headphones controls on these. It is all physical controls. There's a large digital crown on one of the earcups that you'll use to adjust volume or you can press it down for siri. And then there's also another button to go from transparency to noise cancelling mode so they have a lot of the features of the airpods pro. They have spatial audio. They can do dolby. Atmos and seven point. One surround virtually in the headphones. So that's all very cool but a couple of the noticeable omissions will say no power brick in the box so with your five hundred and fifty dollar headphones. You do not get a powerbook to charge you. Do get a cable. You get a usb c a lightening cable so you can charge it with one of the twenty usb c charging that apple will sell you but it also does not come with the cable to physically connect these headphones to an audio source. If you would like that you have to pay an additional thirty five dollars for a lightning. Two three and a half millimeter cable to plug into an audio source and again the fact that they went with lightning on instead of usb bbc. I'm not sure i feel about that. But those are the omissions and again on that price tag at least put the cable in there. I don't know that's just me. What do you feel wind. Packwood's and i agree with you. That seems wrong. I know we got loose. Packers have old ones. So i don't know how much use they would be i. It never occurred to me to think about a physical connection with this their wireless headphones release anything else. But actually yeah. If i am a musician pro use a full who. This is a bargain but a worthwhile cost. I'm likely to want to better connection wireless bluetooth so yeah on quite taken aback. Especially if you cross into that audio file realm and one of things. I'm going to do with it I did order a pair though becoming tuesday. So i'll be able to talk about him on next week's episode personally but i'm actually a classical music fan. I don't think i've ever share this with amish on the podcast. But i'm a classical trumpet player. That's my wife degree. yes i love. Actually listening to classical music. Believe it or not and so. I'm very curious to see how these sound. On some of those mozart requiems and brahms symphonies at to see the audio quality is really up to snuff. But for five hundred fifty dollars should sound amazing. You know per se. Obviously this is in comparison and in competition with headphones. Like the sony w.h. Xm fors which usually cost like three hundred. Three hundred and fifty dollars was like attuned dollar premium for these and the bose noise cancelling headphones seven hundred are very popular. Those are around three hundred and forty dollars. So you're getting two hundred to two hundred and fifty dollar premium to pay for these airpods. Max so i really hope have to imagine that the sound quality is excellent. But you're also paying for apple's features like the h. One chips the ability to the noise. Cancelling connect your devices seamlessly switch just like other airpods and airpods pro another cool feature to the cups. The ear cushions that are on the headphones are actually connect magnetically. And so if you want to replace the earcups for whatever reason they come off very easily and attach very easily as well and hd shows that had his video looks pretty satisfying and you can also get replacement ear cushions again. Not cheap but seventy bucks on apple you can actually order them now in the apple store and on their website but you can get replacement cushions for seventy dollars again in the future if you need them and you can mix and match colors. There's actually a cool chart you know if you will have to get the space gray headphones and put some blue cushions on it. You can be fancy like that if you'd like but again you're paying a premium for all these. I don't know. I'm curious to try them. But these don't tempt you at all as i once used the bose actions that you mentioned don. I was very impressed on. I do like us. I'm more of a malla guide. The mets on no. It doesn't tempt me. Except there is one thing this one specification you've just kind of lewd to skipped a very good. That is crucial. What color did you buy on. I won't with space gray because the size of these. I mean they're large. They're over the ear headphones. And i like to be discreet when i'm around other people the rare times that happens and so white white was tempting. But i don't have so much you know every other airpod is white and i didn't like the green or the pinkish red color. Blue was the only other one that tempted me. But i don't know. I just went discreet. I want black now. You wouldn't touch. That's what it is so next day. Jiang at a party somewhere. Nobody's gonna notice because she didn't have blue headphones. That's what i would have gone full blitz. Obviously the blue did look very nice. i was tempted. Also attempt to engrave these. I've actually never engraved an apple product. I don't know why i just have never done. It and i was very close to engraving these. But i had a moment of. I don't know what to put on them. And i know shipping. Times are gonna slip. So i just four went the engraving and just sorta without. But i'm curious william. Have you ever engraved an apple product. No because of always thoughts. And i'm gonna pass it on somebody else or might resell it to somewhere right. So it's been like having a set to somebody on their name. Just you break up with something. It feels wrong in a weird way. It feels like it's studies the the pristine finish of the device as well especially if you wanna resell it. That definitely makes it more difficult but I know you have tons of tattoos. You have sleeves don't you. Have you have tattoos all over please. I'm not illustrated unless you know what you said about coming up with something to say. I know whatever. I had written on me. I would change my mind magic instantly and want to me. I did work with a young writer. Who said she was aiming to have some text for every significant part of her life tattooed on and i wished to long life and much fatness so that you have room okay. Well staying on the grieving for a second. I saw that in addition to letters you can actually engrave emojis on apple products. Now you can choose emojis if you'd like. So here's my question to you william. If you could engrave any emoji apple device what emoji do you think you would choose. Would it be the winking smiley face sticking out the tongue or would it be money flying away. What do you think is the money involved here with page to do this. I give you twenty bucks.
