"I don't know. So I'm kind of leaning more towards epic. I think I think that your initial, um concerns there are you know are are spot on. Basically, I don't think that anybody wins here, except for Apple or epic, Right? You used to take that 30% cut because you were getting the physical CD shipped out to places. It's the place that went there and you got paid to be able to do it to run it on your stuff. Now, it doesn't work like that Apple. Essentially, this is just punch it down. Epic has this huge. They're trying to prove that Apple has become a monopoly. That is all these other things like that They have to meet these legal precedents. And Apple just has to prove like not dog. We're good, like there's literally their case that they have to make some of the burden of proof is on ethic Right now they're fighting an uphill battle. Apple is a tiny country. This is like trying to sue. I don't know. Like England or Germany or something and try to come out on top, like, Can it be done? Yes. Does it look like it's probably going to happen? I'm highly doubtful of whether or not I don't know about you guys. But who do you think is going to win eventually, like, according to the court case, All I know for sure is that we're all the losers in this Well, I feel like you've ample has these rules to be a part of their app store and epic was like yes, will be a part of these rules and then decided they want to change the rules. Yeah we actually call it honest security so a big thing that i wanted to tackle when we started collide was i just felt that the current security ensure was really almost sick in the sense that we as engineers and people who work for large organizations. We'd start at these companies and then we are provision these laptops or sometimes even allowed to bring her own and all the cybersecurity shoppers sort of foisted onto that laptop and now that we're working from home and everything it just felt weird to me that the software which you can open up you know programs can really understand what your web browser history is and all these things in the name of security it just felt like to me that We really need to explore the privacy and the rules of engagement for how the security team should really be interacting with end users and users in the security and don't really have a really good relationship. Most companies even really tackle organizations. The people who are building stuff fuel really frustrated by the limitations imposed by screaming at these laptops. They're super lockdown. Oh i can't get like working it. Because i firewall is messed up and oh i can't even play with the firewall because all the options are great out. This is pretty typical slowing out there. That was really thinking about this. So i wanted to build a security product. That really focused on making that relationship between the security team any end users a lot better and actually putting them on the same page on a lot of different cyber security issues like keeping their computer up to date and working properly without having a lock out so while you know cybersecurity. Endpoint security are accused. Technical topics are application is actually really simple. Since apple has likewise scaled its effort to meet those threats taking relentless steps to combat these risks to users and developers alike. We often see the updates and don't really know what happens until now apple says it takes significant resources behind the scenes to ensure these bad actors can't exploit users more sensitive information from location to payment details waltz impossible to catch every act of fraud or ill interest before it happens. Apples industry leading anti fraud. Efforts and security experts agree that the app store is the safest way to find and download apps. This is always something. I with my android friends as apple being more secure to download apps in twenty twenty alone. Apple's combination of sophisticated technology and human expertise protected customers for more than one point. Five billion dollars in potential fraudulent transactions preventing the attempted theft of their money information and time and kept nearly a million risky and vulnerable new apps out of their hands. Let's break this down a little bit further starting with the apple app review team. The app review team is an essential line of defense carefully. Viewing every app in every update to ensure they adhere to the app stores guidance on privacy security and spam the guidelines have changed over the time to respond to new threats and challenges with a goal of protecting users on the app store. After initial reviews become real money gambling apps predatory loan issuers and pornography hubs used in game signals facilitate drug purchasing and rewarded users for broadcasting illicit and pornographic content via video chat. Another common reason apps rejected is simply ask users for more data than in need or mishandle the data that they do collect in twenty twenty. The app review team rejected over two hundred and fifteen thousand apps for those sorts of privacy. Violations believes privacy is a fundamental right and this commitment is a major reason why users choose the app store. Even with stringent review safeguards in place with one point eight million apps on the app store problems still surface users can report problematic apps by choosing the report a problem feature on the app store or calling apple support and developers can use either of those methods or additional channels like feedback assistant and apple developer support companies are always looking for ways to prevent or stop manipulating of their ratings for me once a company loses its review credibility. Twenty apple has processed over one billion ratings and over one hundred million reviews and over two hundred fifty million ratings and reviews were removed for not meeting. Moderation standards apple also recently deployed new tools to verify rating and review account of anticipation to analyze written reviews for signs of fraud and to ensure that content from deactivated accounts is removed then there is account fraud unfortunately sometimes develop. Our accounts are created entirely for fraudulent purposes. If a developer violation is agreed or repeated. The fender is expelled from the apple. Developer program and their account terminated apple terminated foreign seventy thousand developer accounts and twenty twenty and rejected an additional two hundred five thousand developer enrollments over fraud concerns preventing these bad actors from even submitting an app to the store despite fraudsters sophisticated technology to obscure their actions apples aggressive monitoring means. These accounts are terminated on average less than a month after they are created. Apple's work to ensure the safety of users who download apps extends even be on the app store over the last twelve months apple found and block nearly a hundred and ten thousand illegitimate apps on their pirate. Storefronts these storefronts distribute militia software often designed to resemble popular apps or that modify popular apps without their developers. Authorization wall circumventing the app store security protections and in just the last month apple blocked more than three point. Two million instances of apps distributed illicitly through the apple developer enterprise program. The program is designed to allow companies and other large organizations to develop and privately distribute internal use apps to their employees that aren't available to the general public fraudsters attempt to distribute apps via this method to circumvent the rigorous review process or to implicate a legitimate enterprise or manipulating an insider to leak credentials needed to ship illicit content in addition to fraudulent developer. Accounts apple works to identify. Deactivate fraudulent user accounts in twenty twenty alone apple deactivated to earn forty. Four million customer counts to fraudulent and abusive activity. In addition foreign twenty four million attempted account creation were rejected because they displayed patterns consistent with fraudulent and abusive activities next is payment and credit card fraud. Financial information and transactions are some of the most sensitive data that users chair online apple has invested significant resources and building more secure payment technologies like apple. Pay and store kit which are used by more than nine hundred thousand aps to sell goods and services on the app store for example with apple pay credit card numbers are never shared with merchants eliminating a risk factor in the payment transaction process with online data breaches frustratingly common. These protections are an essential part of keeping user's safe but uses may not realize when their credit card information is breached or stolen from another source. Some really big name epic executives, including CEO Tim Sweeney, and differed from some Apple executives, too, including that Fisher, the head of the APP store, the debate centers on the 30% cut that Apple takes from all in app purchases, Stat says Epic is arguing that the so called Apple Taxify It's more than just game developers. They wanted to be about all of software distribution on the iPhone, and that would open the gates at this kind of ultimate goal, which is to put alternative APP stores on the iPhone and two completely bypassed the APP store commissioner fee. Meanwhile, Apple says it's commission fee is a critical part of the APP store. They're claiming that you know it's all for the good of the consumer, and it's to protect them. And it's also to create this kind of cohesive consumer experience with Tech trends. But i wanted to check in with you about the epic apple case in the trial recording this on wednesday. So we're we're two and a half days into the trial i assume you following it closely I noticed you not a lot of coverage during fire. Rodley i think anyone who's listening to this show understands the broad outlines right this epic arguing the administration monopolist Because of the way they run the app store you are someone. The Epic Court Battle That Could Upend Apple's Future
"Talked on the show before about developer fees. Those are the commission's usually around thirty percent. That app store owners take from purchases made through their marketplaces. Some developers have pushed back against these fees. Saying there too high while store owners like apple and google have argued that the fees are necessary to keep transactions secure. This debate is the subject of a court battle between apple and the creator of fortnight epic games which kicks off today. The outcome of the trial will have ramifications for apple. Thank you all right before we get started we should note that the wall street journal's publisher dow jones has a commercial agreement to supply news apple services. Okay so tim can. You remind us how we got to the trial that starts today. There's actually quite a dramatic backstory. Here right now. This is a clash of the titans. If you will it goes back to last august and the creator of fortnight epic games surprised a lot of people with an update to the fort game on the apple app store that aim to create a payment system. That would get around apple's payment system. They'll allow users to go into an epic games created pay system and that was a huge violation of apple's rules and it resulted in fortnight being booted from the app store and what followed was a pretty big legal battle that we now are seeing take place in a courtroom in oakland california and so as the court case. Kicks off today like you said in oakland. What's really the central question of this case. What is this all about. There's a few things going on here. Epic feels that apple is using. Its power anti competitive way specifically. They argue that apple has this delivery device or distribution device for apps on iphones and that it's one hundred percent controlled by them and that that is a monopoly in a bad sense and that they're misusing that power so what this case comes down to a large way is the definition of what a market is in the digital

"Of apple versus epic games. We've been talking about it. All year finally begins monday monday. Monday third presided over by judge. Yvonne gonzalez rogers of the united states district court for the northern district of california. The case was brought by epoch after it tried to offer an alternative way of paying for in game purchases in fortnight earlier this year apple removed the game from the app store. The case will evaluate whether the sherman act's definition of a monopoly in the united states applies to an operating systems app store. Epic would like the right to offer. Its own app store on us as well as also be able to offer alternative payment methods within its apps distributed through. Apple's app store if epic. Were to win this case that would lead developers offer their own in app payment systems and possibly force apple to allow side loaded apps or even alternative app stores now in the case. Here's some of the arguments to be on the lookout for apple's going to argue that competition is and should be among devices not within the os and apple's going to argue that. The app store is an integral part of its operating system and that changing that would make the device worse which is not the aim of antitrust law and that making it offer alternate app stores would be like forcing it to sell iphones with chips other than its own a series or something like that epochs going to point to the mac which has an app store but also allows for other ways of buying and selling software and say. Why is it so integral on the phone and not integral on your laptop. Apple's going to point to game consoles like the playstation and the xbox which have a thirty percent commission and don't offer alternate stores and say that's the industry standard. We're just doing what they do.

"If may be bundling system updates with apps in the same interfaces may be being a problem in terms of performance as for example now us you do not get the irs update our within the update tab of the apps or but on the mac you get system updates you get security updates and you get beta saw for updates from the makeup store and i have asked myself whether diseases may be a problem because it complicates things any makes the entire thing slow and prone to these problems yeah that's an interesting point and really thought about that but i mean the the issue of the of the spinners so bad that we had an article on and i was a year or two ago really is tj the walmart added how to fix that while how to get past the spinner yeah it's it's not great the other thing i found it is really hard to deal with and mrs just because of the way i have my apple ids are set up is that i have a separate apple id for mind stuff on the on the app store and for some reason the mac app store to log me out and because my email for both apple ids is very similar if i don't notice it defaults to my i cloud i d two login on the store and i've more than once logged in with wrong apple id and then bought software fortunately you can still use all that software doesn't make it unusable if you have to apple ids and download the software under each of them onto your on your mack but to get the updates you have to kind of login and log hour that and making sure terrible every time there's there's certain apps that i use fairly frequently that i unfortunately bought under my i cloudy male by mistake and then after slog out of my main story d and it's just it's just one of those things it's it's a it's kind of a bad user experience because it first of all shouldn't log me out just just randomly and second of all why it should defaulter whatever whatever i last used i think in terms of my my lagen i remember from a couple of years ago there was this problem.

"So it's i think it's even better than it was and all the editorial changes are very welcome there clearly putting a ton more effort into the weekly editorial stuff and and now the daily editorial stuff one one area that this is a little bit um i i don't know of unsettling is the word but they they've added many ways in which companies with large marketing resources at their disposal iq companies that can afford to have a little a very large marketing effort that coordinate with apple that reaches out that supplies all sorts of different materials and and a cheese all sorts of different dino goals relationship and everything there's there's more for them to do there are more ways than ever for marketing people and marketing teams to help boost an app in the app store and that's that's good i think those should exist and i think those kind of always did exist but now they're david made a little more official uh but it also so raises the bar for independence like us for like how much of this marketing arbi ever really gonna do or can we afford to do or will be have the the tools and resources to do that is a little bit less awesome in some ways uh but i think a lot of that's just kind of an inevitable maturing of the app store over time and we're going to have to figure out how to operate in that environment now minutes and emmy it may way that he makes me think of search ads which is also some that it got a enhancements and 2017 um and with something that in i think i've just sort of gotten at once as as as i've gotten a sense of the costs associated with that issues that are of the understanding that the types of epa signed make don't justify playing in that market and that means that i'm never going to be the thing at the top of a search result even if i am the top search result there's always going to be someone else who is willing to pay more and uh as a result that's just sort of with the best i can hope for a second place and in general so far that's been fine.

"Unfair does not mean you disagree with the rules that that's a different situation so if you've been rejected for some way that you think is actually unfair unfairly the rules were not applied correctly that is usually worth filing the appeal and if that doesn't work then maybe going public with it as for arguable app store rejections vac that's a very broad that could be a lot of things if you keep hitting rules that are arguable maybe you should rethink what kind of apps you're trying to make because generally i recommend that you don't build a business or or attempt to build a business on living on the edge of rule it you know if you stay away from the edges of the rules or the vagaries or the exact interpretations of certain rules your general going to be happier and it's going to be easier to do business both you know immediately and going forward so those are generally that the things that generally you can affect bugs ap eyes and bad app store rejections and you know what you can change your take a number of different forms you know you can obviously you know without a rejections you can you can do the private appeal which i definitely recommend you do first those appeals often work i've heard a lot of stories from friends and other developers who who have appealed things and they do could overturn what's your experience with them on i have many experiences with that and in general i would say that is i've had usually we can come to some understanding on like often the deserve a i think that apple appreciates.
