So what we did is we opened this thing up. Gosh, now almost what has it been probably like 11 or 12 days? We've been open. We've been bringing people on the platform a couple of days ago. We started bringing on people who had pre ordered the app from the Apple App Store and our goal here is to try to get all those people on in the next week or so that have pre ordered and continue to pre order, get them all onto the platform. An app how about two million. That's about how many apps are currently and apples. Ios app store but hold onto those iphones. Folks changes coming to the app store. That's after a ruling handed down in mid september and a long and complicated legal battle between apple and epic games. That's the maker of the video game. Fortnight first let's talk about what happens when you download an app from the ios app store. The app might be free to download but if you then make an inapt. Purchase say you pay for new levels in a game. Who gets a cut of that money. Well because it's using its own apple design. Payment platform apple does and non apple developers are currently prohibited from including their own payment mechanisms on their own apps that they designed so basically no matter. Who designed the app if it's in the ios app store apple's making money on it and that doesn't seem entirely fair right at least a judge thought so. She ruled that apple had to let developers direct users to other payment options beyond those offered by apple. This case has been heated for a while but it really came to a head last august. That's when epic games did something questionable see epic didn't want apple taking a cut of the in-app purchases made on its fortnight app so it developed its own payments system. Yep it completely undercut apple system which turned out to be a breach of contract in a separate decision. A judge ruled at epic. Now must pay apple thirty percent of the money it made through its own system around three point five million dollars even though it faces new restrictions in the app store apple was the big winner in the case. A judge ruled in apple's favor. In nine of the ten counts in the lawsuit epic couldn't get a judge to affirm that apple was a monopoly for one and the judge did not agree that apple's iowa's platform had to support any other app stores than its own. That was a big blow for epic which is working on. Its own epic game store for iphone and ipad so epochs day in court. Well wasn't quite epic but you know how it is in lawsuit land. The judge ruled and just a few days later. Epic filed an appeal cases. Like these often take years to iron out so it may be a while before the battle of the app stores officially settled but it looks to be a battle of epic proportions from wondering. "News. The epic versus apple trial on at eight covered. A bunch of it. We covered it very in depth. It had twists and turns. It had a lengthy digression into what the definition of a game is. We knew this was coming very soon. It's funny because there's an apple event on tuesday but friday morning the ruling doesn't hit first injunction against apple hits i the injunction says apple can't prohibit developers from linking to other kinds of payment systems and other stuff. We'll get into it but that's that's big news on its face. Then there's a ruling i would say. The ruling is for epic lost a bunch at explain the shape of the ruling to people. So at the very highest level the ruling is ruling both on epochs claims against apple which are antitrust related and then counterclaims. That apple made against epic which were mostly breach-of-contract related. So the really big thing that epochs been arguing is that iowa's ecosystem itself is an unlawful monopoly. Just sort of by existing in the state at does and that claim failed. There was the idea that ios locking down app distribution not allowing third party. Stores are not allowing side loading was a thing that apple was doing to lockout competition and was violating anti trust laws that also failed then related. There's an argument that apple had been doing been of self preferencing. It's own apps and creating a bunch of sort of pretexts to kick apps out of the app store also not illegal or not convincingly breaking antitrust law. There is apple. "Back. Do you think apple is surprised that they're in this fight. As the sort of theoretical tech lash was growing focus was on facebook and google and twitter to some degree about you know bad effects having on society and if you asked anyone over at apple if they thought you know what should be done they'd say well we think there should be more regulation but just to be clear. We're talking about google and facebook because those are those are the company's doing bad stuff where were in another boat do you think they anticipated this level. Scrutiny about the way they're running the app store and calls to have you know the elizabeth warren of the world and amy klobuchar of the world. Saying that they should be. They need structural changes the way they run their business. First of all. I mean me personally. I don't agree that structural changes are necessary. I don't think apple needs to be broken up. They just need to give equal footing to third party developers. They need to adjust their fees in some of their rules. I don't particularly think apple music or apple podcasts. Or tv plus should be you know entities on their own. I think apple was expecting some sort of regulation or criticism. The unique part about the apple situation compared to google and facebook Is that apple's not only getting heat from regulators. They're also getting heat from the legion of millions of app developers. And as you know when there's money to be lost and there's money on the line it's gonna get pretty hot and heavy right in. You have developers who are giving up thirty percent of their paychecks before tax off the top two to half trillion dollar company and these are small businesses. You know maybe making less than a million dollars per year if they're part of apple small business program so there's a lot of money to be lost here. There's a lot of money to be gained here depending on what side you are. And that's why this is so complicated. If there was no money. Involved i don't think this would be as big of a deal. Go round and round. And this i do. I do think there's something of that sort of general defence of. Hey you know who else runs big business. All there's lots of big businesses that have sort of asymmetric relationships with smaller partners right. Think of any retailer whether it's amazon or walmart or anybody else. There's lots of people who would like to pay less for shelf space etcetera. But they they can either take the deal. That's offered and be part of that store. Or they cannot. And i'm i'm reasonably sympathetic to that version of the apple argument which we don't want wanna be in in the app store. Don't be in the app store being some other business or saw your stuff and some other platform and the counter. That is you can't. That's just that's a non answer because they're effectively monopoly because they affect even though they don't own the only own half of the smartphone market or less globally they have the dominant platform for all these apps. I agree and i think the fix is like i said earlier are quite simple. You make sure you do everything you can to put third party apps on equal footing you adjust your commission structure and some of the app store rules. I i think this is over but there's too much money at stake so it's never going to happen unless apple's very much forced to do it. And you know the apple hundred million dollar settlement. You mentioned earlier. The class action developers right apple essentially gave up nothing right. I know one hundred million dollars is a lot of money but not to apple and so you're probably going to see one off deals like this very curious to see the outcome of the epic lawsuit I my sense or my speculation. Is that the epic lawsuit will probably go in favor of apple. The judge that lawsuit is the same judge that is probably going to approve this class action settlement so it all goes together. We're expecting that that the results of that suit any day now. It could have already happened by the time. You hear this podcast. It also certainly be appealed So it's it's going to go on for awhile. Let me let me ask you about Apple's take on its media businesses. We've we've mentioned apple music and apple. Tv a few times apple music is the same thing as spotify. No one's re passionate about it but it certainly makes money for apple so that's kind of a straightforward business is still remained very confused about what their intent for apple. Tv plus is spending an enormous amount of money. They want you to buy subscriptions to apple. Tv plus even though it doesn't have nearly the breadth of stuff that competing services. Have they also want you to pay money to subscribe to things like hbo via the apple. Tv hub do you think they think ultimately this is a big subscription service business for them. Do you think it's a store for them. Do you think it's both and and how important do you think. Do you think this is still like. Do you think this is a major thrust for them or an interesting business. I think right now. It's an interesting side business. But i think apple. Tv plus as structured. Today is just the beginning. I think on its own building a portfolio of original content. And of course peter. You know better than than anyone. It's expensive and it can go very poorly. And i don't think that apple has any business being a originals company. I think originals should be only one slice of the pie. They have the tv which is sort of through aggregate or for other content. They have the tv channels that you mentioned the hbo and such where you can buy. Subscriptions to outside channels. They have originals. I think the real play is some sort of service where they can get the existing movie industry to they can get backlogs of content from them like netflix and amazon prime or doing so you augment the originals with tons of movies and ever changing library movies just like netflix right and they have said they don't want it even though they've definitely looked at some of this stuff i don't i don't i don't believe them people people don't wanna pay just for apple originals. Right they would just have to create a death or billing system to collect royalties from developers. Now i don't believe on any planet that apple would actually do. That just sounded like something that they said in order to defend their case and it sounded like something they would say to try to make such thoughts less convenient for app developers. A lot of media companies framed sort of concessions from apple but which actually turned out to be things that were more like. Well we'll we're doing things this way and we promise we'll keep doing them this way for at least a little while. So there were very few actual changes to the policies. As a result of that. "There and i was like yes fine whatever. Sometimes you need the app store. And i just leave it there. I appreciate that it is a is a weird decision and i may and i actually resolved program. Today was the right to get rid of it. But i didn't want to get rid of it just because i knew you make fun of me for it but it is like it's a weird one. I think to have the. I do like to know when i have updates for apps. Don't like to do things automatically. I don't like automatic app updates. I hate the thought of opening an app. And it's changed. And i didn't know i gave an ios like i don't have automatic app updates and i always likes well most of the time i skim the update list because i kind of just wanna know. There are some apps that i'd like to kind of keep track of late like cross for example like i always want to know what they're up to and i to know win an update and i want to read the release notes before. Do the update. I have automatic. Applegate's turn it on my phone. But they never worked. So i still have to do the manually. All the time. I had turned on my ipad like my phone and it just doesn't work It's just sometimes. I put my is seventy one app. Updates it's like all right so you didn't do anything did you. That information is also a president under the apple menu if you go to app store it'll say three updates in a little spend a little time. I know apple is also talk right now right now. I have in the apple menu six app updates and the app store has nothing on it. So what is the app store safe. And i guess the silver lining here is that now apple has company because the attorneys general thirty six states and the district of columbia have filed an antitrust lawsuit targeting. Googles app store arguing that google maintains a monopoly for distributing apps for the android operating system. I'm not a lawyer but this is one of those situations where i'm having a hard time seeing where the harm is for consumers. I get that if you're in the business of creating apps know if you're an app developer maybe this isn't the greatest situation but for consumers like you and me i said i don't know i i would not want to be in the position of having to prove significant consumer harm. It's true chris. It's sort of hard to see this. I i'll put the argument this way. So this comes is sort of a summation of the argument from the state. So google play. It's now back in apple's app store and users are once again able to use their iphones to log in for more on this. I'm joined by our tech reporter. Sara adelman hey sarah thanks for joining me. My pleasure okay. So it's been a while since we've talked about parlor. Can you remind us what this platform is and why all these various tech platforms blocked parlor is a social media service. That bills itself as an unbiased free speech alternative to the more mainstream platforms like facebook and twitter. It has a lot looser. Policies content moderation and. It's attracted many high-profile conservative media personalities. Such as fox. News host sean hannity supporters of former president trump and even people who've been banned by other large social networks like the right <unk>. Far-right talk show host. A conspiracy theorist alex jones and the reason parlor was taken down by the app store and google play and why amazon stopped providing cloud hosting services to it is because of the kind of content that appeared on parlour especially in the days leading up to the capitol hill riots. There were a lot of calls for violence and rhetoric. That just didn't fly with those companies rules. Okay so where has parlor ben since. Then what's been going on behind the scenes for parlor basically went dark. You couldn't get to it on the internet in terms like a website and you couldn't get to its apps in february resumed operations on websites and also on android devices. The company has a new web hosting service. So it's not using amazon anymore. It said that it's not planning to make an effort to get onto google. Play being that you can access the app through android versions of the platform. Anyway google does power the android operating system but that is distinct from google play. And so that's when it resumed in at that point they said they had about twenty million users up from fifty million prior to when it went dark and then since then parlor has been trying to regain access to apple's app store and that has happened now.

The company said its goal is to cut its injury rate in half by twenty twenty five and tesla's ceo elon. Musk has become infamous for his habits on twitter in particular for his commentary cryptocurrencies and our reporter. You had similar falls on early monday in sunday when people were speculating that maybe tesla might start selling again based off of one of his tweets and so it's seconds from that tesla you on. Musk have lent to a lot of the valley that we've seen that larger adoption and if that starts to wane maybe bitcoins future forward a bit more challenged our eight coming up. That i'm also looking forward to and even a fourth installment of the matrix so these are big names that going to be released and hbo max stents to continue and continue the trend of growth. You might say well. Everyone is streaming online or through. But that's actually not true if you look at other apps from Discover plus discovery plus in really all the other ones that launched fairly recently. None of them are having as good a time as hbo mac so these titles the releasing to tv end theater at the same time all that. It's working well done. Also i heard this week. Snapchat mentioned that they're seeing big growth on android the so i took a closer look at the data to see what that's all about and also verify their statements and they're they are since two thousand seventeen. The ratio of downloads from iowa devices to android devices has grown drastically for snapchat in the social media world to x. ratio is pretty standard twitter instagram. And tiktok or all that range that means that for every download on an ios device there to downloads on an android device. This is pretty standard because android is much more common outside the us and all of these services are popular enough that there's a lot of demand for them in all countries in twenty seventeen snapchat ratio was only one point three which is a bit low but it climbed since quite a bit in two thousand eighteen. Iro's to just about to in two thousand nineteen got the two point. Four and in twenty twenty peaked at five point five as downloads. In india ballooned it since dropped a bit mainly because demand in india dropped significantly in two twenty twenty one. But it's still ahead of the game into march of this year snapshots iowa's to andrew. Download ratio was three point three x according to our intelligence. Now why is this important. Snapchat might be chasing instagram and tiktok but it has its own fan club. That's kind of large up until a few years ago. That was mostly made up of iphone users which really limited were snapchat can go but for snapchat to grow. They have to be sticky and other countries and other countries android so this growth is a really good sign for snapchat and for scaling in the future. Also this week. I think also also territory maybe at this point corn base kind of so last week coin based dominated the top charts because of its ipo and trope increases in cryptos and bitcoin and others.
