"Right so ordinarily when you seek injunctive relief from court which includes a stay right. What what the court wants to know really are in there. There's a four part test but okay so this was this was in their request for or. They're they're motion regarding this day. This is the application for the state. Right got it. They have not yet filed the Sur petition. They they will on June one got But but what you need to show a court right is you've got to show them to fix right and and again you. There's there are other factors but the real the real questions that non-lawyers are are going to want to look at our number one. You WANNA show irreparable harm. Right that there must be you need injunctive relief to preserve the status quo because otherwise right. There's no turning back right. And that's what I alluded to sort of the start of this interview like it. They they do have that ran. That's really their best argument and I don't know why they're not making it. Well they make it but the problem is is that you you have to show the other half of the argument to some reasonable likelihood of success on the merits of your argument. You say it would be really really bad if we lose and so therefore we need injunctive relief and the courts going to be like right but but if it's super duper likely that you're GONNA lose. We're not going to step in here and and this is why right at we were talking about this before the record but like I think a lot of people sort of look at the past three years and say. Gosh it's it sure seems like the Supreme Court is staying an awful lot of lower court mandates and this is not a thing that usually happens and that's right and the reason is because the burden of of proving that both of those things happen is really really high right and I you know look like I. I think it's clear that the Supreme Court's puts its thumb on the scale for the president. One could hypothesize that maybe they wouldn't be so so likely to put their thumb on the scale for a Democratic president. I think that goes without saying particularly if you read like the Clinton Jones decision and then compare that against you know the Supreme Court's Newfound love of Not Harassing the Executive Glenn. V was correctly decided. That was the case that said that Bill Clinton had to sit for a deposition in a civil lawsuit brought by Paula Jones. It was unrelated to his conduct in office. Yeah right you're you're not so. You're not so busy that you can't that you can't do that. Well that's exactly right who I appreciate. You clarifying all this for us because I am I. I know that I'm going to get million tweets. Oh my God. The Supreme Court is bought and paid for. We're all going to die in a everyone. Just sorta over seems to overreact to these kind of kinds of things that are just administrative ways to allow more time for people to file their appeal on the merits. Yeah it again. It's a half step in the wrong. I've gotten those those tweets and e mails already wants the started coming out but but but I would say if you are looking for optimistic reasons if the Supreme Court just wanted without a doubt to place all of these materials beyond the purview of the American public until after the election which is now effectively. What they've done with trump's tax returns thanks to the maze are cases that they they could have granted the stay. Just granting thing the stay and leaving the government on the same hundred. There's a reason that you have to kind of, you know, get educated in order, it's the law and oftentimes not always. But but more than half the time the way a lot of the media covers major cases major breaking Legal News the way, they covered is wrong. And it's unfortunate. But it's I guess it's good for us. It's job security for us. Because there I have just been there's no end to how impressed I have been with Andrew you have a job that not too many people can do because you're able to break these things down in a way where sometimes and there's two categories we're going to see with these clips sometimes it's, hey, here's a thing. We should be. Just totally alarmed about that we aren't because people haven't noticed it cough. Stormy daniels. You know, kind of thing. Nobody's notices we should be. But sometimes there's something that everybody is alarmed about and panicking about and and Andrew will say, no, actually, you shouldn't be as worried about this as you might be. And I think that you've overwhelmingly been right in in those kinds of interpretations, and those kinds of stories, and of course, if you ever get anything wrong, you're the first to admit it with an Andrew was wrong segment. So that's why you can rely on the show. I really do tell people. I'm so proud of the show. And it's because it's not me. It's you that if you wanna make sense of what's going on. And the the fact that that the news these days with the Trump administration so much of it requires legal analyst a good legal analysts who who doesn't have. Any other agenda? So dealing with a reported icing condition on seventy eight just east of exit seven in Bethlehem use caution there also forty six near Hacketts town and across the Hudson, George Washington Bridge, leaving New Jersey minor delays. Same thing goes for the Lincoln and Holland. We still have path train delays stemming from an earlier incident this morning cross honoring on the rails. Effective Newark Penn station and Hoboken, also buses are cross honoring New Jersey transit buses at Newark. And journal swear, Andrew Torres New Jersey traffic north Mike Barker, New Jersey, traffic, south up and down the turnpike up the now the two ninety five corridor. We're in pretty good shape here in the southern half of the rain Garden State. And if you are south of cherry hill, we're seeing snow on both the turnpike into ninety-five quarter. But the good news is I really don't see any backup at all. Because of the snow, but you definitely won't be prepared as you coming south on both roadways that rain. You're seeing we'll change to smell forty two of the Atlantic City expressway all in pretty good shape. And I see no problems on the Parkway southern half. I'd say about ten to fifteen minutes and another note route twenty four accidents being cleared out of the way, one westbound by exit one Morristown one eastbound just picked up by route seventy eight Andrew Torres New Jersey traffic north Mike Barker, New Jersey traffic south on the westbound side of seventy slow coming into the turnpike ninety five that's all because of a crash being cleared. And you know, I did just a quick reading of a news story. I I wanted to save the real now is this for you. But it's interesting. It's something I've talked about on the show. I've had a few guests on who who were in the area of GM, internationally and stuff. But this was something that I think was perhaps at times badly reported and at times misrepresented, and I think a lot of people are unsure what this means. You know? So so what happened, and let's let's start breaking down gigging the real details from a lawyer you can actually trust on like under. So so here's what happened congress passed a law in nineteen ninety six that is eighteen USC one sixteen that prohibits as a matter of federal law female genital mutilation that law says whoever knowingly circumcisers excises or infibulated the whole or any part of the labia majora or labia minora clitoris of another person who has not attained the age of eighteen years shall be fined under this title or imprisoned not more than five years or both so felony. I had to look up the word infibulated don't one. Yeah. It's a special word that was coined just for female genital mutilation. It means to close off or obstruct the generals by sewing together. Yeah. So horrific disgusting practice. The question is in in in the law is whether that can be made a federal crime. It seems weird. But remember that right states have plenary power. Right. So that was kind of those gathered from the article, I tried to find a good source on it. And it seemed as though the question was can they actually do this? So that sensor jogging about so what can you define plenary power for us people who I know what it is. I'm sure but. So a state can pass a law on anything. Right. So long as it does not violate the constitution of that state or the federal constitution. Right. That's that's what states do right? That's what plenary means right over anything. So for example, murder is not a federal crime. Right. It doesn't mean that the US government doesn't think thinks that the purge is a good thing. Doesn't despise states. The federal government is like gosh, we want murder, but we just don't seem to have the power. And and that's true. Right. So congress has enumerated power so rather than having. So plenary powers are just residual powers. You you get it. Because you're the state the US congress only has the enumerated powers that are given to it in the constitution. And I know what you're thinking which is. But I listened to my libertarian friends all the time, and they tell me that, you know, there's no specific power that says the government can regulate the internet, or can, you know, set minimum wage laws or whatever. And and and the answer to that is interstate commerce. Yeah. All of that. That's exactly right. All of that has to be traced back to the commerce clause. Right. So obviously, congress can regulate interstate commerce that is one of the things that was specifically. Author. You know that it was specifically authorized to do in the in the constitution. There are two justifications given for this F GM law, and the first is in fact in the commerce clause, and and so so I want to evaluate that..

"Stuff that radio host, we no one else's looking. Andrew Torres, co host the opening arguments podcast has been kind enough to have a very candid conversation, and it's, you know what I appreciate about you as you take very complex legal language and some very intricate situations and you, you're good storyteller. You're good at making those palatable for those of us who don't play in the sandbox, you know, it's is it designed to be overwhelming. I mean, Jesus, we, we look around and we just have a hard time processing the complexity of the mechanism that is American politics. Right? You know, some of it is right, and some of it is job security. So it's in lawyers interest to make you think that the law is a bunch of magic words in Latin. You have to say in the right order or else the spell doesn't work right. Like because if you start to realize that there's a lot of common sense involved, then all of a sudden, maybe you're not hiring the lawyer anymore. So you know there's a little bit of self interest in there. One of the things I do on my show that I, it's become like beloved recurring segment is every week we do my co host Thomas Smith. We do a a segment called Thomas takes the bar exam, and and what I do is I read where eighty five questions, and I've read him a bar exam prep question right the exam that actual lawyers take to be admitted to practice law. And Thomas is an exit companies. A podcast got like he's got no legal background other than doing the show and he's over fifty five percent in taking these questions where they're multiple choice, you get ABCD so you're blind chance would be twenty five percent, right? So he's he's better than twice what random chance would suggest. And the point the reason I do the segment is because I keep trying to drive home the lesson that they're this some segments, right? There's some aspect of the law that is left over from thirteenth century Saxony. And you have to say like witness, if the party the first part does hereby convey to the party of the second part in fee simple, I get right, but eighty percent of the law. A good chunk is governed by common sense and the number of cases that I've had to do where gone into court and the other side has said, this doesn't seem fair. I got only a case on of a law of a statute of this doesn't seem fair, and the judge or the appellate court has looked at me and, and their response is not while Andrew, you know, tell them why. You know he gets to go pound sand, but the responses counselor. What's your response to that? Why is this fair? Why do we care? And I've had to deal with that, right and it and it's kinda led to this belief like at its y, the Trump administration is so hard for me, right? Because I'm an American lawyer like love this country. Like this is where I've chosen to practice law and there's this. Sort of fundamental belief of inherent in the system built in is this notion that things are fair, the notion that things are comprehensible from the outside, like, you don't have to pay the priest translated from Latin, and that's why I try and do the show. I know we all want to engage somehow. We wanna find a way to participate in the process to see our candid win our values. When when I look Donald Trump's, Andrew, I'm the alike likely like you do. I think this is an indictment of us. This is saw, can't believe I'm quoting Kevin Costner, but he just he haven't because he's been like four good movies. We had to uninstall Skype and reinstalled the old version of Skype because the new version of Skype just adjusts his microphone domestically, no matter how many settings you say, no, don't do this matter how many different checks boxes you do. It just decided, no, we're still going to just Andrews Mike. You have no choice in the matter. So he had to go to the old version of Skype just to give you an indication. Like a lot of people always think it's the simplest thing like, oh, you're just not doing this one easy. Simple thing it's like now wasn't. It's it's because of an incr-. Credibly frustrating program in this new Skype. So sorry, rant over, but I think it's a hundred percent fix now, and I don't wanna hear it anymore is we're, we're, we're a lot. A lot of folks we reached out to us including Michael Rops who gave us a whole bunch of help to go down the right path. Alternately Thomas was the one who fixed it because he is audio genius.
