"We know that the bar likes to throw in stuff. That's you know that's raw like there will be an answer where it's like well. That's totally wrong or that's whatever but can't lie to you can be like 'cause like false pretenses. What is that crime? I don't know what that crime is. False your like if if in Conversation Andrew Torres tells me me like Oh yeah I used to. I had a girlfriend in Canada. She Super Hot. You'll never meet her but she was like you're guilty. Faltering tenses yeah like what what is false pretenses the crime. I've never heard of that. I feel like there's gotta be more to it than that but but can the Barbie messing with me. There can cause like yeah. There's false pretenses going on but <hes> be larceny. Catherine was what the hell was larceny. Why was it different than theirs robbery larceny? There's some difference between between them <unk>. Oh Oh wait was larceny. Okay wait a minute. Larceny was the one where there's no. Oh do I have it got. I hope I'm not GonNa make a fool myself. I think larceny meant you didn't like us. Violence or weapons or anything like that and robbery was like stick them up like that kind of thing like there's there's violence involved. I think that was it so that actually makes me think that the answer is going to be low. Well hold on hold on not. I'm not done because then the customer said in the in the in the second interaction the clerk was at a gathering when she spotted the customer wearing the watch. She told him that he must either pave the watcher. Give back he hits. You'll be sorry if you mess us with me intimidated. The clerk backed off. Oh my God I think this might mean the answer is a robbery robbery because at first I think it was larceny. I think the first one was larceny. 'cause you just Larson it. You're just like I'm larcenous <unk>. I'M GONNA slip out of here. I didn't I just ran you know that's we. We lost everybody Larson's from no not really <hes> the second one though when when when caught the guy used intimidation and we know from the fact pattern that the clerk was intimidated intimidated. I think that would mean it's robbery like if I go to a watch store and I have my like my fist cocked back and I'm like give me your watch or something. Give whatever that's gotta be robbery even though I didn't hit anybody it's kind of the threat is there. I'M GONNA say it's between A and B for me so I'll eliminate C._N._d.. And I think it's a robbery because of the intimidation in the second part of the question final answer good day Sir I lose now. That doesn't really fit. I just wanted to really declare that that's I feel good about this on a robbery all right and if you'd like to play along the Thomas you know how to do that just share out this episode on social media include the Hashtag include your guests the reasons therefore please please don't cheat and we will pick a winner and shower that person with never ending fame and fortune fame and fortune not guaranteed right. I'll never know. I did a stupid thing on that too. But but we'll get to that. All right. Well, I'm throwing myself as a human shield to try to. Distract whatever you did. Now. All right. Hey, everybody. There is a really good sl a- with Andrew Torres. You may have heard of them from such podcasts as this one. This one such date says last night. It's it's really good. There was a recent FGM court case decision in Michigan that I think some of you find listeners asked about. But also a lot of my listeners had asked about and Andrew was kind enough to hop on over to to series inquiries, only and break that one down and tell you what it was it was, you know, like a great episode of opening arguments because there's a lot of concepts that I'm a little fuzzy on sometimes that I think I understand a lot better. Now, like, you know, the commerce clause, and planetary powers and that sort of stuff so it was really good. Thank you so much Andrew for doing that. But we never have any shortage of stuff to do. "Episode two hundred thirty six I'm your host Thomas Smith out over there's Andrew Torres. Hey, doing Andrew. I am fantastic. I'm really really excited about today's. Is it because people are still waiting with baited breath to hear the answer to whether or not a corporation can be pardoned. No, it is because we are going to reverse roles on today's episode because this is a question we're under which the legal analysts is pretty straightforward. But the musical analysis reminders expertise that I don't have. But my amazing co host does so super excited about this. I'm excited to finally play stairway. And get all the girls was the was the plan all along in high school. Oh, I have I have my iphone out and the light on and and that's in one hand. And then I have old school cigarette lighter in the other. And I'm just going to say Thomas will you play stairway. No stairway denied. Yeah. That's exciting. We're going to follow up on the the corporations or people and maybe criminals from last week. And then we've got our main segment is going to be spirit versus Led Zeppelin spirit is a ban that you've probably never heard of and Led Zeppelin bend. You probably have heard of because really interesting case involving potential plagiarism there with Led Zeppelin stealing from spirit on the song. That's kind of obscure. But anyway, it had it I been overturned denied. And then like the well, Andrew will explain the legal ins and outs. But it it everyone thought it was a done deal. And then all of a sudden on appeal they figured out that the jury hadn't been instructed properly, so. It's going back. So really interesting case there, and I had an idea to maybe turn the tables on Andrew a little bit. And do like he did with UB. The supreme court a longtime back one of my favorite episodes where he took us all through the arguments on one side and on the other. I thought Ooh, I can try to do that with this spirit versus Led Zeppelin. So that's the goal. Hopefully, it'll work out. So there you have it. That's our show. What do you think? Should we get to it? I am super excited. Unfortunately, some members of the media members of the media members of the media the media. Person..

"Hello. And welcome to opening arguments. This episode two hundred and thirty three I'm heroes. Thomas myth that over there as your lawyer Lee host Andrew Torres. How're you doing it? I'm fantastic Thomas. How are you? Good. Are you feeling loyally today? I I am feeling loyally. I've got I've got my powdered wig on. I am ready barrister. Solicit solicitors solicitor. Say solicitous that would have. And that's why said it. All right. Well, little bit of news. A few things this week. News. The little just a modicum of news. We've got yodel mountain. We've got yodeling for you. And of course, we've also got a talk about really frustrating and disturbing power grab in Wisconsin. The Republicans are doing everything they can to minimize the power of the incoming governor and more. So we'll talk about that. And then we'll round it out with a quick little Andrew was wrong segment. Those are. My favorite your favorite, my least favorite segments. Got hold me accountable. And I was gonna call t t t the Thomas was wrong segment, but it's only forty percent of the time. Statistically, speaking. That is a Thomas was right segment. Right. If we wound up to the nearest whole integer, you are at one point zero. You're at one hundred that's nice of you to say. Now, I feel like a clown horn. Andrew your rear rarely wrong you cover so much. And then you're wrong about tiny little things that people people. Correct. And and actually I joke, but people send really nice helpful emails. You know, when when we when we get little stuff wrong here there, and it's I it is appreciate it. So no, I. Joke. Here we we have a bunch of new listeners, and and just in the interest of full disclosure. I mean, I'm the one who puts Indra was wrong on the schedule. Right. Like. Yeah. If I if you did hardly even want to do it. And I was like constantly just trying to tell me when Andrews wrong all that show. No, I I love and I want to it's a it's a good opportunity to emphasize the thing that that you, and I particularly me that I've tried to say from way back in one, right? Which is I never ever want this show to be o. X is this way? Because Andrew said it was that way, right? That's not the whole goal here is to bring legal education to a non law audience. And so I get stuff wrong. I try and be really really upfront about where my experience lies where you know, where am I educate goes? And and I love that people are out there ready to to let me know when when I've made a mistake, it's seriously. I enjoy learning from the the show, and it's part of it's part of the lesson is that this is it's it's about us all bringing bringing to bear, you know, skepticism and critical thinking and everything else. And so some of the segment. Oh, yeah. A little teaser for you. We might be having a a new segment not not this episode. But you know, it might have something to do with you own amount. Remembering also, we'll see we'll see Andrew is making us do it on Tuesday much as it's like when the kids wanna open the presence on Christmas Eve, and it's like now now, you know, it really would be more properly it to do on Christmas morning..

"Lohan welcomed opening arguments. This is to twenty-seven Thomas out over there, Andrew Torres. Andrew, and I were just working on my class action lawsuit against the concept of fire that I've gonna be filing is that he'll tell me if that's something. I can actually do. How's it going Andrew? It's going. It's going. Okay. I as as we were just talking about off the air. I was gonna complain that I have landed in the United States and instead of being in the most beautiful place on earth. I have come home to snow which is delightful. And then as you put it out is it snowing fire where you are. So no less oxygen, right? Because we don't have that anymore. I'm just doing the I'm over here. Doing the space balls opening the cans of air and breathing them into to even do the show. It is I'm looking at the air map, and they invent new color. It looks like kids coloring project gone wrong. Like, they did all the wrong Krantz for all the colors, and you still have to be like. Oh, yeah. Really good. It looks like that. There's they don't even the air quality scale. It doesn't even have a number for what the next color that's about to take over Sacramento is. So this is awful. But how's everybody else? Hey, I'm not in the fire. I know a lot of people who who were displaced by it, actually. And it's it's it's it's a total health gape. No, all joking aside. It's it's really awful. And while yes, I've been suffering through over a week of smoke and not being able to take Phoebe outside. Could be worse. Could always be worse. Yeah. And now I have in the in the southern California fires, and we're going to actually have a segment about the fires, you know, in our segment, but. What's the song? We didn't start the fire will be called. Yeah. That would go for you. But I really. Okay. That's a that's a bits of Billy. Joel novelty song from I think either nineteen eighty nine or nineteen ninety. So that's that's that qualifies. I think is it is it is a quintessentially recognize. Yeah. People do in fact recognize that reference. But yeah, we are going to. I'm I'm interested to hear what you have to say about talk, a little liability and stuff in terms of what happens with these wildfires. Figuring out his responsible. We also need to talk. I love this. We always this is fun..

"Hello and welcome to opening arguments. This is episode, two hundred. Eleven. I'm your host. Thomas Smith that over there is well. I think it's Andrew Torres. How you? Hello? Stranger bravely roused myself out of bed on like metric, ton of cold medicine and and the show must go on right nor nor snow, nor win or rain. However they post office goes. Yeah, let's let's get to it. Yeah, we if we can't be better than the post office than what are we doing here? No, that's that's awesome. You're powering through it is the one downside of this line of work? I realized when we don't have any like sick, our credits that we can just like tell her, hey, we're just taking it a little sick time here. We can do fake call to our audience. Just I can't work today. No, we can't do that. But we are here to talk about that NHL trade. Here we go. No. Oh, sorry, different show. I'm still excited about that. But now we've gotta talk about a lot of stuff. We're going to briefly address if we got sent by a lot of people, the new story about the defense, distributed person was charged with sexual assault of a minor little update to that story, and also we're gonna talk about Manafort interesting. Man for news came of course right after we record as always well-timed last week. So we'll do some updates on that. Actually, there's some interesting issues going on. Andrew thinks that maybe the media is getting some stuff wrong on that source. So I always love that those are my favorite kind of Andrew segments. And then finally, we are going to talk about cavenaugh. So that's our Genda. Let's get to Charlton. Heston famous chant. Do son's bitches this foreign? No. Further with your damn tater hammers Kilmore the guns. I'm a gun club Mukundan. Yeah, so so let's really, really quickly about nine thousand people sent us the message that Cody Wilson is apparently on the run. That's the founder of defense, distributed and person. We have identified as a crazy person, you know, behind the release of the three d. printed guns to prevent gun control from ever being affective ever. Again, apparently he got onto a website and you know, had sex with a minor and that's super itchy, and and it's really terrible..

"Hello and welcome to opening arguments. This is two hundred four. I'm your host. Thomas Smith. That over there is Andrew Torres. Andrew, are you exhausted and outta breath from all the laps you've been doing around the office? The Andrew was right victory laps. Yeah, I've, I've been making the the Richard Nixon v for victory and yeah, no, we, we need to. Yesterday. I did it. I Nixon stolen from opening arguments. Take back the v for victory. It's it's where reclaiming a a time honored. This is we, we are. We're, we're now recording at our usual time for the Tuesday episode for episode, two, four, and and freaking news. Oh. L. you're gonna say what the breaking news was. Okay, I was I was setting you. That's what the poll. Packers screws Trump or was the other one. Breaking news. These are all be nice and well worn out by the time. People hear this all the. All the pecker jokes that everybody got tired of the four days since this. Yeah. So that was exactly what you had kind of talked about, right. Yeah, I was a, I was proud of us that we went one hundred and fifty five minutes yesterday and did not make a single pecker joke, so so we can. We can. We can break that we can bring Brian edit that one out. No, it even. I am surprised at how quickly this move, right? Like so the, let's let's do this for an analogy, right lake prosecutions are kind of like punctuated equilibrium, right? Like there are these rapid decision points that come up really, really quickly, and then there are long stretches, we know of investigation things. So you know, we've been urging caution on the overall Muller investigation of, hey, you know, these things move slowly, these things take time this. The flip side of that right yesterday, we told you that the allegations in the Cohen information regarding David pecker serving essentially as the lookout for Donald Trump as CEO of the National Enquirer that that pecker was the guy who found out about stormy Daniels and put Michael Cohen in touch with storm. Daniels lawyer, which is not something we knew before the that led me to say, I think you know, one of our takeaways was was watched pecker right? Like that's coming up next and and today I mean ten minutes prior to this record, we got the breaking news that pecker has been offered immunity. I have not seen the terms of his immunity deal. I'm going to continue to scour and look for it while we get on a special guest, but but my instant take on this. I said this on the away Twitter feed. This is the opposite of Michael Cohen, right? Like we spent a fair amount of time saying the Coen didn't get much of a deal yesterday and, and that seems to indicate that the prosecutors felt like they had an awful lot of leverage over co and I read this the exact opposite to to be out there with somebody who was characterized as. Having the level of involvement that that the pecker has in the co and information and to immediately offer him immunity strongly suggests that he has something or things that the Muller team desperately wants. And, and that's good news for us. Wow. Yeah. No, sorry. No, pecker jokes. Not making package. Okay. Yeah. In, you know, we're going to get rid allies in on here. I'm excited to talk to him again as always and we, you know, I also have to announce Zeke will the important as all the pecker news that he wasn't around for t, you know, this was kind of an impromptu thing. So you know, I just had to do that by now. The real reason is I just don't wanna be embarrassed by somebody on t t t be. So that's the real reason he wasn't there for the the question. No, I I wanna ask you before Randall joins us. I think that question that I, I wonder if. If you could tackle real quick, is the what's his name is the asshole. Okay. Is the Ben Shapiro who actually isn't really a Trump support to be fair, you know, months, I don't like him. He's at least not a Trump guy really. Although he's as a horrible conservative, so I don't. I don't know why he's not, but but anyway, he put up the kind of the defense and said, I'm surprised Trump isn't using the simple defense of, I pay porn stars all the time..

"Hundred ninety five. I'm your host. Tom Smith over there is Andrew Torres. How're you doing Andrew? I am doing fantastic. How are you? Good. It is a trouble shooting. Windows ten Bs audio kind of day. I'm sure everybody feels it, but enough of all that which I believe we have fixed by the way novel that this was one hell of an insane. I mean, we. This week. Wow. Wow. I full. There's a lot going on. Yeah, the other few things to cover. I think we're, I think we've, we've got it. We've got at least the bare minimum under control. You know, last week we gave you two ninety minute episode. We're going to try and not go a full ninety minutes today, but but the longer we do this pre show the the higher better get it. You know, don't say we never did anything for you listeners because you got three shows especially last week, but we better get to it because there's so much to do. But you know, we got a couple of things. I just meant to say this last week, so it's a little out of time now, but I was just going to recommend on over on series inquiries only. I had to really, really powerful interviews in back to back that I just was. I just really wanted to see if people onto check him out with Kelly. Right? And then Zahren Feroze and. With with Kelly. It was a very compelling discussion about her life as a trans person, and and so much more and then with Zahren Zahren is an example of seventy billion ways why Trump is harming people. I mean, she's she's an immigrant, although right now she's applying for a Silom and she's not able to get it. She's an ex Muslim. She also needs healthcare and can't get like it was a million things that just were all intersected with how Trump in the Republican agenda is hurting people. And I thought it was very powerful interview. So I just wanted to recommend those if people wanted to check those out. Yeah, no, I totally agree with with both of that. Obviously, I've been a big fan of Kelly's for a long time, and I thought that interview was fantastic, and I love her story and I love her work, and, and this was my first exposure desire and and and I'm really glad that you brought her story. To light. So I wholeheartedly endorse that Willink those in the show notes head on over and and check those two pursuits out. And then once again, we're already at the end of another month. I just can't even believe how fast this goes. So that means we've got the goodies coming up for you. Patrons. We've got the live q. and a. Andrew already has the question thread going there. Although he, he never looks at the questions because it's a rapid fire kind of thing, but it's up there on patriot dot com slash law for you to.

"Hello and welcome to opening arguments this is episode one hundred eighty nine i'm heroes thomas smith that over there is andrew torres how you doing andrew i am fantastic thomas how're you i'm pretty good i'm curious why you're so good if we're covering the supreme court justice you know the the supreme court ruined or justice cavanaugh but okay i'm i'll go with your your optimistic attitude right now tell you what here's something that maybe we'll we'll cheer everybody up we had mentioned i believe in the qna episode we did and by the way thanks to everybody who came out for that that's always fun to to interact with you guys on the chat and everything we had mentioned we wanted to do some sort of donation from opening arguments and find a good charity so we're still working on that but we wanted to announce we were thinking of doing it in a sort of a matching donation format so we'll come up with with an amount weaken do and we'll match listener donations and that way we can do double the amount of good that we might have been able to do so that's kind of what we had in mind and hey maybe we'll take maybe we'll take some suggestions i know it's actually hard between andrew and i think like okay which we're gonna decision do we want to donate to because there's so many good ones but maybe we'll take some listener suggestions or maybe we can throw up a listener poll or something like that after we get a few that might be interesting what do you think yeah i think that's i think that's a great idea on both counts and you know we are continuing to look for ways to help and so i i love this idea yeah awesome maybe something focused around i dunno reproductive rights gay rights getting democrats into office any number of those things would be would be good for our show but works for that we're just going to figure out of course it takes patriot awhile to figure out the months revenue for for june so we're gonna get that all ironed out and we're going to come up with what we can do and make it happen try to do some do a little bit of good in the country what do you think andrew yeah absolutely and i want to add to that that you know we mentioned last week that you know we were going to talk about good news this week and and we are no good but it's but that's going to be pushed on it's going to be pushed off until tuesday because today we are going to do a detailed breakdown of the next supreme court justice brad kavanagh here's why i'm chuckling because we totally needed to move the good news episode because what we did last time with gorsuch was as listeners may well remember we moved the gorsuch episode where andrew perfectly predicted that the next supreme court justice was gonna be gorsuch we moved it to the tuesday episode and then the announcement came out monday and it made it look like andrew didn't predict it like he was reacting to it so not making the same as i can't wait for this prediction to now be incorrect that's going to be make it really doubly hilarious that's why we're not moving this one well at ad and we'll talk about that but but i just want to say that in the good news episode is also a a plan of action right one of the things that you know you and i have talked about off line and that i'm i'm really happy to share on the air is you know how to incorporate the information that we put out make sure that you know were understanding what's going on and and also that we're not just kind of like feeding the pit of despair of you know it's terrible and everything is going to be impossibly worse and it never ever gets better and and you know one of the things that is i my leading candidate to take the place of elections have consequences or at least two to go alongside elections have consequences is you know fighting holding actions sucks but the only thing that sucks worse than that is not fighting holding actions that quite as pithy i i need i need i need a speechwriter to barrack obama to polish that one up a little bit for me but but yeah you know we wanna we wanna continue to to sort of.

"Legal conception of privacy does not remotely matchup with the way the world works today right like we've talked about the whole you know have have you have you thrown something away in your trash and taking the trash can out to the street right like that's that's the analysis that a court uses to determine whether you have a reasonable expectation of privacy while how does that begin to help you understand when you know your friend on facebook plays a quiz designed by cambridge analytica to mind your data right like i just analogize in that to taking out the trash isn't helpful doesn't answer the question and so you know i think i think ultimately at the end of the day like there will be a a reckoning we're gonna have to rewrite our our privacy law standards to conform to what how people actually behave and where those those actual risks are so that's not i know it's not a full answer to your question i don't i don't know that the question can can be answered in in in kind of the the the individual i think it's more about the aggregate about what are we doing to to to protect things that we think of as being private that are not yeah all right well there you have it anders breakdown of the movie cloud atlas thanks for thanks for that injury absolutely tom hanks greatest living actor but you're more host andrew torres.

"From the she was part of the black panthers a and then later the black liberation movement and it was with some other people from the black liberation movement that she was pulled over by the state trooper she was driving she was in the front seat and they dug that's no one knows exactly what happened but gunfight ensued and she was eventually charged though it wasn't really proven that she actually killed the guy but as we've learned from andrew torres once you're in a conspiracy of that kind what you're in a group of people who commit a felony like that like you can be charged with felony and so this is weird this was something it and it was so agree gis of in the mind of one jake tapper the actually tweeted a the to her shukor is a cop killer fugitive in cuba this ugly sentiments from else are sore and dyke march she church a some other leader of that movement i guess any progressives out there condemning this and it kind of went on from there and what happened was linda sarsour ended ups tweeting at him while jake tapper joins the ranks of the all right in criticising me which i think is very unfair thing to say just because someone criticises you and also the all right criticizes you doesn't make any criticize criticism of you all right criticism so this is this is weird now i wanted to look into this because i was thinking how on earth.

"Crime behavior because that's what the rest of the eye tunes charts are four not my putt cast so just wanted to give it that heads up but i i think this is definitely worth listening to because this is confusing people are are outrage now is a justified or is it not let's go to the experts to find out in that expert is andrew torres here ugo boom boom boom down adjust your said the andrew how you doing today i'm great this is the show where i got started so this feels like old home we oncoming love yeah you'd love gone back on home act you've got a real friendly hometown crowd on the show i mean on on on opening arguments everyone hates you but on this show nonstop gut so yeah but this is so interesting because this girl as actually honestly it's a it's a really difficult story to even listened to but i heard they covered it on the daily podcast this girl who texted this guy to end in essentially i mean convinced him to commit suicide to an extreme degree to the point where he id even like left the truck that was that had the carbon monoxide in it that was gillingham and she convinced them to go back really horrify kind of stuff that i just i cannot believe happened it's really gruesome but it but it is raised a ton of legal questions you know like can you be convicted for convincing someone to do something in that way like are mere words able to get you manslaughter so take us through the case yet this is the case of a michelle carter it is a massachusetts criminal trial uh as you know as you know i am a civil lawyer not a criminal lawyer so i've uh of kinda done my best to research this was actually on a show yesterday when the news broke and we talked about it a little bit and um and some of the things i think or in were not entirely correct that works for being said by the panel of glad to get a guy if well yet because of i mean let me start out with.
