That's the manhattan. Da the near state attorney general beneath the surface. It's clear that they want to get somebody. In the trump organization particularly mr weisselberg the longtime cfo to give them some damaging testimony about the former president. They really in my mind couldn't care less if he got the type of perks that on the here's where the former president is correct. All major corporations readily give their key employees to keep them there and nobody pays taxes on these things. I mean i have a friend who's who's driving his car new york city at twenty seven miles an hour a twenty five mile in arizona and he got a ticket he said to me what should i do. I said go to court because the judge will be furious at the cop. It gave you a ticket for going to miles an hour over the speed limit. They just don't do that what they did to. The trump organization and to alan weisselberg is comparable that such a trumped up allegation of a an accumulation of low level charges for which. No one has ever prosecuted. The only reason they're doing this is to smear the name of trump's business but primarily to squeeze mr weisselberg and others to see if they will cough up something against the former president that will help them prosecute him now. We who whose intelligence only goes so far. You're never going to know everything. God knows you're never going to see everything God sees, but he does give us enough of a glimpse of what is going on out there. Enough to know also that we can't change any of this. We are equipping ourselves the things that I read the things I like to impart to. All of you are used to equip yourself to best come against the enemy when he comes in. And and we do that as best we can, But we know that our life on this earth first of all is short. No matter how long you live, you could live 100 years and it's just not going to be all that long laid alongside eternity. But the most important thing that you can do in this life is meet Jesus Christ as your lord and savior If you don't know Jesus. You will go to a godless eternity when you take your last breath. So we who do know him understand that our marching orders which have come from the throne room of heaven. Very simple. Share the gospel with others Let other people who don't know about him know what you know, And so that's what we attempt to do. That's what we are equipped to do, and that's what quite frankly, we all need to do A better job of doing. Don't weep. But there there it is. "Good Morning America. This is the cats roundtable John. Cats Matija is Sunday the legal system in Washington legal system in the FBI. The Justice Department. Well we're talking about what happened to our friend Roger Stone with us is one of the leading experts in Washington as well as. Oh Country Judge Andrew Napolitano Good Morning Judge. How are you? I'm fine John? It's always a pleasure to be with you no matter what we're talking about that you judge. I didn't know all the scenarios that happened in the last few weeks and Roger Stone. I didn't know if I should laugh or cry. Habitability Scott if you believe in the rule of law as I know you do. You probably should cry because this is a poor example of the way the system is supposed to work it started with a twenty three federal agents armed with automatic weapons breaking down the front door. Stones has five thirty in the morning at Fort Lauderdale Florida with a boat filled with federal agents canal behind his house and a helicopter filled with federal agents flying above his house and it chipped to CNN which had three cameras there in a film. All this happened when he was dragged out of the house and brought to federal court. The federal judge said couldn't have done this for the phone call and the bail for stone with zero which is basically the judicial judiciary saying to that. You really overplayed your hand here. Why did they do that? They don't know Roger. They thought they could intimidate him into saying something. Negative about The president shortly thereafter. He was indicted He was tried and convicted on five counts of lying to Congress one count of Obstruction of justice and one count of threatening the witness that happened to November. The judge imposed a gag order after conviction. Which is on heard of John? The purpose of a gag order is to prevent the defendant from using the media to influence the jury but there was no jury after the conviction last week before prosecutors who prosecuted him following department of Justice procedures sent a letter the judge recommending jail time of between seven and nine years when president trump heard that he exploded and was harshly critical of the judge of the jury for convicting stone and of these four prosecutors. He directed the Attorney General to have the prosecutors submit a new memorandum whereupon the four of them quit at the same time the four of them quit the foreperson of the jury who is herself a lawyer and unsuccessful candidate for Congress from Memphis Tennessee now living in Washington. Dc outs herself by showing her private twitter. Feed as harsh Lee critical of president trump with two negative comments about Roger Stone. This gives rise to two applications to To dismiss the conviction against him the first is what is the prosecutor. The judge denied that. The second is juror misconduct. Alka this woman possibly have had a bias against trump and against stone and then a fair-minded Juror government. Then set a new letter to the judge recommending. Thirty SIX TO FORTY MONTHS IN JAIL. Today she sentenced him to exactly let the government requested. And what Bill Bar applauded. Which is forty months in jail? President Trump's timeout. From a speech he was giving in Las Vegas to condemn the sentence and condemn the procedure and argue. That the whole trial was tainted now. I've sentence more than a thousand people in my career. I am familiar with the process to say the least but when there is a challenge to the fairness of the trial the obligation of the judges to resolve that. I this judge shows to sentence him I. This is putting the cart before the horse and to resolve the issue of fairness next week. What does that mean they will put this for person on the witness? Stand and stones. Lawyers will interrogate her. Prosecutors will interrogate her and the judge will interrogate her about whether she was truly neutral. What is truly neutral mean? Supreme Court said we are not entitled to Perfect Jurors. They don't exist but we are entitled to twelve jurors and a judge who are quote indifferent as to the outcome. There's no way this woman was indifferent as to the outcome by a simple reading of these tweets. Which should have revealed when they were interrogating potential jurors? So that's where we are now. I almost sentenced to forty months. Exactly what the bill. Our second team of prosecutors recommended The sentence is not executed. Meaning HE GOES BACK TO FLORIDA NOT GONNA go to jail until the court decides whether or not the trial was fair. There's no question but that the trial was unfair. And there's no question that he's entitled to trial we'll see where it goes now. Those four people and sending letter for nine years they are prosecutors in the district of Columbia who wear assigned to Muller's team two of the four of them. The other two which is regular line prosecutors meaning professional trial lawyers that work for the Department of Justice when the US attorney in DC. A recent trump appointee said. Don't you think seven to nine years a little much? They threatened him with resigning any back then. Of course there that I've resigning anyway after the president Got Involved. Why should resign? They resigned from the case. Three of the four still worked for the Department of Justice. One of them resigned from the Department of Justice altogether. If I were the judge I would have rejected the resignations and said you're still on the case of by the way I'm GonNa put you on the stand under oath and find out why you resigned. Why are you trying to sabotage your own case? The the amount of lies going on in Washington. A MIND BOTTLING. For for a kid that grew up going to public school and learning all the things that we should learn it. It's just mind boggling. You know it goes back to me with justice Cavenaugh and what we go through a month or two months and the Senators Feinstein up The guy that just going to jail for the Nike thing. They wasted months of America's time with crooked lawyer that tried to tell the American people. Bring up these women. That justice cavenaugh did something that turned out. He never did anything and try. Ruin a person's name himself has convicted of extortion in an unrelated case. he's exposed to twenty years in that case. He has a theft case. Theft of a few hundred thousand dollars. from his own clients in Los Angeles and he has a bank fraud case in Mississippi. So I don't think we'll be hearing from him for a while but this is you're right. The person that some of the senators held out as a as a human being who is worthy of belief. judge Napolitano deep down in my heart. I believe some no senators nudist truth. Well they are protected as you know. But what's called the speech and debate clause of the constitution which prevents them from being Sued or prosecuted for anything they say on the floor of the Senate or at any committee hearing on the way to the center or the way to the committee hearing they all know that so they can get away with Whatever they want unbelievable anything else you tell the American people judge I mean. This is an example of a of a case that that has A lesson in the outcome and the lesson is this history of human freedom is paying careful attention to procedure. It's better that a thousand guilty people go free than one innocent person or one person unfairly convicted be punished. The judge rejected that argument. But I think that either by presidential intervention or by appellate intervention stone will ultimately be vindicated. I hope South was. You look really looks like they. They try to ruin his life of a of a something. That was really nonsense. "This is the Ben Shapiro show. So two big stories of the day. Obviously we've been talking at length about the president moving to end the government shutdown today. The other big story of the day. Of course, the arrest of Roger stone. A Trump confidants who was arrested today for lying to law enforcement lying also to the house select committee on intelligence and the Senate select committee on intelligence, no charges that he was in any underlying involved in underlying crime involving Russia wasn't involved in criminal activity involving Russia. He lied about what he had done here to analyze it. With me is judge Andrew Napolitano, Fox News senior judicial analyst judge Napolitano, thanks for joining the Ben Shapiro show. Always a pleasure to be with you, Ben. So judge Napolitano, what do you make of the stone indictment today? What does it? Tell us. More broadly about the Muller investigation in the direction in which it's moving. Well, if you if you watched the arrest of Roger stone this morning, somehow CNN was there. If you listen to my fellow commentators on FOX and elsewhere. You would think that stone was at the center of a massive conspiracy. Orchestrated by Russian intelligence agents to deliver goods on Hillary Clinton to the Trump campaign. But if you read the indictment, you can see how thin and even ephemeral it is how the lies the alleged lies and not even material did you speak to communicate with someone by telephone or by Email. Did you still have these documents with you? What time you spoke with him? I mean, I think that most of us will be thrown out as as so sin and and marginal as not to be of any interest to the to the judiciary now big picture. If this is the best of that. Bob Muller has if he is tempting to use the allegations the indictment of stone to show that stone was somehow at the center of a conspiracy. And it involves high ranking people in the Trump campaign and one of them must have been Donald Trump himself. I don't think he's going to get the first base. That's what I was noting is again, no underlying criminal activity. There's no explicit connection to President Trump. The most icy here is kind of a doofus in the middle of some communications between WikiLeaks and people associated with the Trump campaign. That's not actual criminal activity, so far virtually every every person who has been charged by the Muller investigation has been charged for lying to the FBI not charged for any underlying criminal activity, and certainly no underlying criminal activity with regard to conspiracy with the Russian government, which to lend credence to the idea that at least at this point, this feels more like a witch hunts and Trump is not completely wrong. Then it feels like an honest to goodness investigation into real Russian criminal activity in coordination with the Trump campaign. Well, it's obvious or it appears to those of us that know, Roger stone and know how the system works that the whole purpose of this indictment. Just like the two indictments of Paul Manafort was to put extraordinary pressure on and on and fear in the in the mind and heart of the defense. In order to see if he will trade some information to be relieved of the pressure and the fear. Now, Roger stone is not someone who who would succumb to this stone that I know is one of the toughest SOB's the good Lord ever created. But you know, everybody has a certain breaking for, but that's been Muller's MO. Now, he's succeeded in getting a lot of information out of Rick gates didn't get anything substantial as far as we know out of Paul Manafort, I don't think he's going to get anything out of Roger stone either. But that is his MO. I have condemned this MO, as you know, Ben for many years, but prosecutors use it and the courts permitted, and it's standard operating procedure, particularly with the federal department of Justice. And judge Napolitano, I wanna ask you about where you think what what do you think the final report looks like fr- from given again, we're kind of seeing pieces of the puzzle. And I understand it. It's. Serat painting worth seeing sort of dots here in eventually will pull back, and we'll see what the entire painting looks like it feels like to me that this is going to be more of a political more of a political attack on the Trump campaign that illegal attack. It's gonna look like the Trump campaign was involved in some shenanigans with regard to WikiLeaks, but nothing actually illegal happened. But it'll give enough grounds for the Democrats to claim that the election itself was a legitimate without actually requiring enough criminal activity for indictment. Well, if Muller does that he will undermine substantially the process in which he has engaged. I mean, he he has to stay away from the politics, Ben and just make legal Archies. I don't know what we're going to get from him. My suspicion is that we will get several reports. So that where he is really weak one not contaminate where he is stronger. I don't know when these reports are going to come out, but look this. Roger stone's thing. I mean, you, you know, as well as I how long it takes before an indictment of this magnitude comes to trial. Bob Motors gonna be in business a year from now what's going to be going on a year from now the Iowa caucuses on the New Hampshire primaries. When Rudy Giuliani said this'll be over by Easter. He was talking about Easter twenty seventeen twenty eighteen now this is going to go until Easter of twenty twenty spot mysteriously stone caves or a courageous federal judge misses the indictment that's being of no legitimate interest to the wheels of Justice. So I don't I don't know how this ends. My job is to watch this yet for FOX and for audiences like yours, and it's it's a head scratcher about ten hours topics for just a minute today. The president essentially ended the government shutdown without anything of value in return. He didn't get any commitment for border funding. He didn't get a commitment for wall. He said he was going to continue negotiating with Democrats for the next three weeks. And then if you didn't get what he wanted. He was going to think about declaring a national emergency and starting to shift funds inside the defense department toward the building of a border wall. I wanna get your take on the legality of a move like that. I've I've suggested that I think that that's. A stretch that I think that'll be likely struck down by the courts, you should he exercise national emergency power and and move funding toward the building of a border fencing. What's your take on that? Well, as as usual, we're talking about the constitution you and I are on the same page, and and this is not just a gut feeling. We both have studied a case called Youngstown sheet and tube versus Sawyer which president Harry Truman in a very serious situation during a steel industry strike in which he needed munitions to fight the war and the Korean peninsula at the time nineteen fifty two pretty much declared a national emergency directed his secretary of commerce to seize the steel mills to spend money hiring people operate the steel mills. Now in that case, the owners of the steel mills didn't watch strangers in. There are running the place sued and the case went to the supreme court about two weeks. From the supreme court said, you can't do it. If congress wants to do it. Congress would have to condemn the property pay for it own it and operate it. Now, I don't know if the president realizes the obstacles to building this wall. According to congressman will hurt a person, I like very much, a former CIA agent conservative Republican from Texas through who's district. Most of the wall would go. According to congressman heard eighty percent of the real estate is privately owned, and even though much most of the owners are supporters of the president. It's going to be a not in my backyard attitude stated differently the government's going to have to exercise eminent domain which under the law. Kennedy joined by the executive branch can only be done pursuant to a statute an active by congress. So congress has to appropriate the money and give the government the authority to condemn real estate. The president cannot take money was budgeted for column A and put it into college. Z when columns e the wall didn't exist or wasn't contemplated by congress at the time that Colonna was funded. So I agree with you not because we have an activist judiciary. Even some very fine. Judges that agree with you and me people listening to us now sitting on the district court in Texas would join this minute the ink is dry on the president's signature. That's how wide of the Mark. It would be intentional tunnel. That really does suggest that this shutdown has gone about as badly as it could go for the president in the sense that if he was not willing to use the leverage of the shutdown in order to push Democrats to allow him to build the L. I am sorry to say that I again agree with much sorry for. I'm because I mean you, and I have many friends some of them were in the same business where he wouldn't be all over him in the next twenty four to forty eight hours saying he caved and gave in Tama state all kinds of allegations. None of which are are solid. But the image of it is going to be bad for the president. No question. And that really is the biggest problem for people who actually care about the wall or who actually wants to all the walls not going to get built through a national emergency. So he box himself in by not going all the way, if you're gonna go all the way, you gotta go all the way, he didn't go all the way, a national emergency isn't going to get it out. There isn't gonna get him out of this hole in the shore up some of his support base. But I don't think that the wall ends up being built that way either. So we go into twenty twenty with no wall and his campaign promise unfulfilled now, I read all the federal statutes in immigration, which is quite a task. Then you could do it. If you're. Currently having trouble sleeping. You can see how they were compromises reflective of the cultural attitudes of the Iranian, which they were written. So one thing that Donald Trump in my view is a hundred and ten percent, correct. On is that the entire scheme from beginning to end needs to be rewritten. But not with a gun to people's heads. We need a great national debate on immigration and naturalization, and and the writing of statutes that are consistent with each other. I don't know how he thought that would happen air traffic controllers were working overtime because they're buddies were calling in sick. And look what he is being shut down on a Friday afternoon.
