A Conversation About Section 230 and the Future of the Internet
"Week. Senior reporter addie robertson. Who have heard on the broadcast many times before held an event about section two thirty. That's the law that says platforms aren't liable for their users publish. It is a critical lot. The internet also just turned twenty five years old last month. So addy held an event with a keynote by senator. Amy klobuchar democrat from minnesota is one of the sponsors of the tech act. That's an act that would reform section to thirty as well as a panel featuring michael chia. Who's the general counsel video sedan. Harry is a researcher writer. And a strategist human attack and amana keeping general counsel at wicca media which runs wikipedia. Talking about where section two thirty is where might go in the future. So we're going to run some highlights of that event for today addie and russell are gonna join talk about how it went and what they heard what they thought and as it happens here right now. Russell has done good. Love it addie. Congratulations on your event. It was a good one. Hey thank you so. Tell me how you think. The event went. And then i'm going to hand over the episode to you and we can listen to some highlights and talk it through. But how do you think of went. I thought it went well. One of the things i like about. Section two thirty is that. It's just a really weird conversation that people kept asking okay. What sides her can there are like fifty different sides and we had a really pretty interesting spread of perspectives and senator klobuchar speech was really good scene. Setter and i'm overall pretty happy. Yeah you know. What i thought was really interesting. Just as i watched the whole event senator klobuchar has some very strong perspectives. About what can be done in those perspectives. We're definitely not shared by the entire panel. In fact the safe tech act is it's it's always interesting to me to hear. Senators talked about their own legislation. 'cause they always make it seem so common sense but it's actually quite controversial. Some of the changes that she was proposing. Oh yeah absolutely well and also like you know. She addition to talk to thirty. She takes a pretty hard line on antitrust. I was actually surprised by how sort of enthusiastic she was about it. And i sort of imagine. The video guy is sitting there easter like. She's talking about breaking up google. He's like yeah. Okay a lot of the sort of civil society tech people which this is part of what we wanted to introduce the conversation like. They don't have a problem with antitrust. They are mostly hoping that section two thirty doesn't get changed in a way that makes it impossible to have wikipedia exist and then bringing up things like misinformation also just throws its own kind wrench into things because that's actually not largely problem that addressed with section two thirty and so you end up slipping weird stuff like first amendment reforming there. Yeah this was. I think is the panel went on the combination of we think facebook too big but if we changed to thirty to punish facebook we might end up punishing ourselves and then senator klobuchar talking about an inch. Just dead ahead. And even to some extent bringing up the idea of breakup as a potential remedy. All of that is a swirl and we've been talking on swirl for for some time and it was just really interesting to hear the spread of perspectives during this event. So at russell. I'm excited for this. Why don't you start and take us through this event and what we heard. Yeah absolutely. I think the one thing i want to start with this sort of like the chronological beginning. But like you know. I always like it when these things make a little news. And i think i was very interested to hear santa club. Stars line on antitrust. She sort of coming to the fore of like the democrats antitrust policy. She wrote a book called antitrust and is the chairman of the subcommittee on competition policy antitrust and consumer rights which is basically the senate home for antitrust policy so she's really sort of at the forefront of it and i thought it was interesting she a lot of time she gets gloucestershire's like this moderate voice but she was pretty harsh on facebook. Here we have. We have this clip at the root of this problem lies the ability of a few companies to act as gatekeepers and as we see when they dominate markets exclude rivals buy out their competitors. We've got a problem. In the emailed words of mark zuckerberg. These businesses are nascent but the networks established. The brands already meaningful. And if big go to a large scale could be very disruptive to us they could be very disruptive to us. I always about the tech industry was about disruption it's about disrupting the status quo and bringing in new good ideas that basically blow up the marketplace in a positive way we can't have monopoly stopping disruption so in a way the work i am doing is simply a reply to that email so the interesting thing so this was this was something that we had on the site like dual casey and nikolai byline. When the antitrust hearing happened he's talking about instagram and path so instagram they bought path proved not to be disruptive to facebook. I think it's fair to say but this is not a public statement. He meant to make. And i do think i don't know i mean do do we do. We hear this. And think like amy kluber. Shar is on team break-up facebook it feels like it will qualify that by saying at the very least it's team don't let facebook acquire anybody else. Yeah but team break-up facebook. I don't know it definitely seems like it's on the table ray. Which is very interesting so there have been on the left. A lot of really aggressive sort of pushes for stronger antitrust like we need some new like we need to empower the justice department. We need some new legislation that will enable us to kind of go after these businesses more heavily. And it's fairly recent that closure is trying to to kind of lead that i mean she just. She's only now coming to the to the lead on this committee. And i think because she ran in the democratic primary sort of as a moderate voice. She's been glossed as like. Well she's not in the end gonna like usher in this new era of trust busting but then elsewhere in the keynote. She's talking about well. You know it worked pretty well when we did this against. At and i mean. I don't know. I'm still kind of undecided. It's always hard to know how committed people are going. It's going to be a really politically difficult road to walk. If they move on. you know.

"Who will tell you what you WanNa hear. So THEY'RE THE NEW YORK. Times did a recent one that just came up and either today or yesterday and then buzzfeed did one. That kind of was going like behind this one. This one was done on March eleventh. It was it was right after Super Tuesday loss. And then there was the routing that happened with Michigan Washington and I can't remember that the state was Ohio. Cancel and Florida like he lost. He started losing like he lost. Every county in Michigan every single county in Michigan Bernie Sanders loss. So you're starting to find out one two things. I love the whole whole now. People are coming back from the media coming back and go on like I am thinking that. Maybe maybe there was a little bit of our immediate play a little bit role in the sexism. Like Joe Scarborough. Did this a one day on the run. For for your thing maybe we we have a little responsibility for hardware on Hillary Clinton that maybe a there was a little bit of sexism and are covers of her there. I'm going like you think think he's like maybe like twenty five years of Republican you know Badmouthing her in the media. Not Not doing any job. Maybe that kind of shaped voters views of her verses Bernie Sanders actually being the guy. You fucking thank because now you have a worse candidate and Joe Biden. Who's beating the fucking breaks off a fucking Bernie Sanders right now. Couldn't the day the day that someone who is openly said? He disagrees with busing as part of a move to integregation occasion and that. That isn't the thing that is a death knell for him moving further in his career. I tell me all the time he he he was a VP TO OBAMA. I think Bernie Sanders and great man. I think I think Bernie saying well we say that but I think he also had some really great moments as partners to write getting out in front of LGBT issues. There are a lot of things that you like. It wasn't just being like the reverse of like Bush and Cheney were buying just sat back by actually like you could actually see biden like he would fight for Obama. You bad mouth. Obama like Joe Biden. Actually get up and trying to fight you right back anyway and he was always in front of pushing these these these presumptive progressive ideas. That that that the Obama's doing there and I think that he's also the proof that you can be his age and learn and learn do better and I think people discount how valuable that is. This man has been trash at key moments in history. He's he has said something that could put him on the wrong side of history. Had he been more persuasive but he's he's learned better so he was the proof that you could stand up and say I don't believe in this and then turn around and say my personally shouldn't guide policy. I should not have the right to tell you that you can't stand equal to me. He was the guy that made more people his age. Who looked like him and sound like him realize they needed to get off their sanctimonious moralistic hypocritical high horses when it came to issues dealing with women issues when a deal with marginalized communities but most assuredly issues dealt with the Lgbtq community. And that's the thing like I keep seeing people going like like the reverse how Bernie Sanders outspent Biden in in in in February. That people don't understand like by not even campaigning is winning these things. I'm like you guys are overlooking the eight years. Yeah with Obama and what he did there I am not getting and he was not my first second third fourth or even fifth choice you know in this race right but I'm also not arrogant enough to assume that being the vice president to the the very popular vice president to the very popular first African American a president of the United States. I probably only for a while. President United State. Like that's going to carry out a weight particularly when you're now facing with a guy who's trying to undo that legacy of Obama like yeah you have to compete against that and like to compete against him as a senator and he can build consensus and if he has the right people around him who are still talking. Change Progress Anti Corruption. You can get things moved but at a minimum people believe that if a bill comes across his desk that's good for the people his credit he wanted. Sign it people. Forget this the man that you saw. When he lost his son has been on the national stage like eighteen years or not taking his acid us out. He never talked to him so he he was when he was he is the one you will see on the train like this is a reason why. Obama picked him for his vice president. He's the everyday man he's the one that can get you that that white vote that you sleep you claim so much that Bernie Sanders. We're GONNA get in that you need to read other these people. He was the one that he's the one that can get you that without actually doing the compromising forgetting who the black people are that also can gonNa get you where you need to get to come out and say that. Biden boy was at shirt exactly. I'm not GonNa Right. I'm not GonNa sit in trying to tell you that he's the most. It's a person out there. Like I say that he was the best choice in this race. But if you don't like the Bernie campaign did if you don't understand what. The appeal is of Biden. Didn't you were always going to lose. And it's very clear when you look at these two reports from buzzfeed and the one from the New York Times that Bernie and his campaign had no idea what the fuck they were dealing with with with with with Biden the fact that they didn't think that they need to even talk to Jim. Clyburn and what? Jim Clyburn talking endorsement would do to them in South Carolina. Like the fact that the the fact that you think you're going to sit there and come in here and you're going to attack the establishment. You understand what the establishment is. You don't understand the establishment dim. There's also all those house Black House Democrats in the Congressional Black Caucus and if you take your outside of the twitter world that those are the people that sit down on those churches those are the people that sit there and help your aunty and uncle those upon to help your grandmother out the ones that have a long lasting poll in that community who are going to pull them out and when they say I'm voting for Biden. They're going to follow them. So yes Bernie. Didn't Jim Clyburn and you're right. He probably never would have gotten that that endorsement. But if you ever reach out to ask if you don't use it on had competition with those and so these these two articles basic go into the fact that there were a lot of aid of a by these two groups one saying hey listen we really believe what you're doing but you need to go out there and you just attacking this dimmed and you need to start holding your hand out. He's are shaking hands. You need to start talking to people. Because if you're going to be the leader of this party you need to. You need their help. You're going to need to pull them in. You need talk to Amy Kluber charge. You don't need to talk to people to change. You're GonNa try to convince them that when they drop out could you know they're going to drop out there pulling one percent black voters that you ask them to keep coming back you right. Apparently the busby one went into detail. About how when warned worn in her campaign her aid reaching out to burn you weeks ago before she she she she dropped out saying. Let's combine. Let's let's work together. Let's try to do this. And they were blown off and then once the CL- Char Bloomberg and budejovice now all of a sudden it was like hey warns. Can you come back now because you thought about it too late now? All of a sudden you want their help. You didn't go to talk to you. You disrupted her blatantly right you didn't. You didn't think you needed it because you thought you could do it alone right. You thought you could go out there. The New York Times article goes into the detail about how they basically thought that they were going and crush the moderate Dems and this gentleman dims and then they go and try to heal later. I'm like you're not GonNa get to that point to not GonNa let you get to that point and I'm just maters. It's everybody across the board. It's like you came out and you attacked everybody. Who Wasn't you? Yep and you made no fucking friends and apparently Bernie Sanders Bernie and I get it right. Bernie Sanders is the kind of guy. He's husband hates politics. I can't my dude but guess what you can't be. President then began order Mahathir. He doesn't hate politics. He hates the fact that he's not in power in politics. There's a different he. He likes this game. He's mad because he's never been able to get people to agree to shape the sandbox the way he thinks it should be shaped. He's a politician. And I'm tired if you are a public servant and you were working in office. You're damned politician if you're a shitty politician at your own damn fault. He is a shitty politician. He does not care about black people. He does not care about poor people who do not look like him. He does not care about this Republic. He does not care about anything but power because if he cared about universal healthcare instead of standing on stage behind Hillary Clinton and the Bill Clinton when they announced he put his damn name on it and he advocated for. They accepted every single provision that he said needed to be in there. He even acquiesce in recognized at that time. The Damn nineties that trying to expand the Medicare fund would not actually end up in a fund that allowed everyone to be covered but they took every single talking point every single platform position that he said needed to be in universal national health care and they put it in that damn bill and he punted on them because it wasn't his because his name wasn't on it he does the same damn thing when they put together an economic package. They actually went to workers. The only time he talks about. Workers is when he wants to talk about collective bargaining because that's a power platform that he can leverage on his back. He's his because nobody's lobbying him right. I mean and this is a bothers me like the whole thing came here was not me us like it was such a fucking scam because we look at everything he did before there was all about him. They need to times that a black person comes up and says what is your agenda for helping my particular marginalized community who is being impacted in these ways and he wants to talk about. Oh the economic I was like. Did you really just do some all boats? Did you really just do some? Yeah the tide. Right wasn't wasn't that wasn't that wasn't the New York time in Thing when they sat down with all of them when they did two four door for Warren and Kluber Tories Demeans. And when when when Bernie? Yeah like what are you what dude apparently about Democratic Socialists. And the simple fact that somebody who wanted to be a part of the party told you that you needed to be wary of white democratic socialist coming in here talking about economic advancement to To secure our part of the American dream he told you to be very careful about those people if they didn't also WanNa talk about things that preserves the right of our free exercise of movement of employment because we don't survive and thrive in a socialist system. That tells us where we can work. We already know were white. People want us to work so when this man is sitting down with killer Mike and he wants to talk about a week and do these. And we need to reinvigorate these communities the reason why he wants to reinvigorate black community and black neighborhoods in the hood is because he wants to keep us there..

"He won Minnesota the only contest in the mid West by nine points. He narrowly won. Texas in the northeast. He won Massachusetts the Home State of Warren and remained competitive in Maine. End Quote. One reason to explain this is Biden's incredible support from black voters quote Biden one. Those voters in every state in which exit polls registered a significant black population from a low of thirty three percent and California to a high of seventy two percent in Alabama. Sanders did better with black voters outside the south but he failed to improve over his two thousand. Sixteen numbers politico continued. The democratic establishment was divided and feckless before South Carolina. After African Americans weighed in party leaders rallied around Biden wants the Democratic Establishment spoke? The effect was powerful when voters in a party are divided on a big issue. It's a well known fact. That cues from respected party. Leaders can have a galvanizing effect end quote and all the media attention on these developments helped biden in a big way politico estimates that the free coverage he received over the past few days was worth over one hundred million dollars for context. That's more than vice. President Biden has raised throughout his entire. Two Thousand Twenty Campaign Alex Sites Walled Senior Digital Politics reporter for NBC. News pointed out on twitter. One potential loser tonight is campaigns. Like in general Joe Biden had one field office in Virginia was outspent seven to one by sanders and almost one hundred to one by Bloomberg in all Super Tuesday states had barely campaigned in any states. And yet and quote. It's true that even without spending a ton of campaign cash Biden had everything else working out for him. Quoting politico again. Biden was partially assisted by the dramatic rearrangement of the viable candidates after South Carolina. Win The moderates Amy Klobuchar and Pete. Buddha judge dropped out while the left was divided by Warren remaining in the race. Biden might not have won Massachusetts or Minnesota where the totals for Warren in Sanders exceeded Biden support in a one on one race and Warren likely kept sanders from winning more delegates in California and Texas. The impact of Bloomberg who was on track to best Warren in both states may have harmed Biden as much as warren harmed sanders and quotes another feather in Joe Biden's hat is that Bernie Sanders insistence and major strategy. That he'll hugely increase voter turnout implying that it will largely be in his favor. Hasn't quite panned out says politico quotes to the extent. That new voter turnout is higher. It isn't breaking for Sanders and youth. Turnout hasn't exploded. That's the Revolution Sanders. Promised but eighteen states have voted. And it hasn't materialized. End Quote as recline expounding on this theory said quote. It's not that sanders is running a week campaign but he is in a way running the wrong campaign. He's the front runner for the Democratic nomination. At least he was until tonight. But he's still running as an insurgent. The political revolution was supposed to close the gap between these realities. If Sanders could turn out enough new voters. He could sweep away the democratic establishment and build his own party in its place but going all the way back to Iowa that strategy failed sanders one as a Democrat not a revolutionary and he needed to pivot to a strategy that would unite the existing Democratic Party around him. Klein Continues Sanders. Supporters have reacted to Biden's endorsements with fury to them. It's proof the fix is in. If that's the lesson Sanders supporters. Take about how power works. It's the wrong lesson. The work of the president requires convincing. Legislators in your party to support your agenda sometimes at the cost of your political or policy ambitions if sanders and his team. Don't figure out how to do it. They could very well lose to Biden and even if they win they'll be unable to govern persuading the Amy Kluber Jars of the world to support you even when they know it's a risk is exactly what the president needs to do to pass bills whether that's a green new deal or medicare for all or just an infrastructure package. Biden for all his week debate performances and meandering speeches is showing. He still has that. Legislators touch that he can unite the party around him and convince even moderate Democrats to support a liberal agenda is literally the case for his candidacy and quotes as the more moderate camp has coalesced around Vice President Biden and he is appearing for the first time in many months as a viable nominee. A lot of voters have moved to support him as well quoting the Washington Post exit poll results. Biden's support was consistently drawn Tuesday night from voters. Who put a higher priority on beating trump then on agreement with the candidates policy positions a clear majority of voters prioritized electability in every state according to exit polls and in nine out of twelve states? These voters favored Biden in quotes. Despite increasing pressure from all sides the sanders campaign remains confidence. Quoting The New York Times as Mr Sanders returned to Vermont where he voted Tuesday morning. His allies acknowledged that they had been caught off guard by the swiftness with which Mr Biden's former adversaries had locked arms to oppose Mr Sanders campaign. They argued that Mr Sanders was still far better equipped financially and in his campaign organization than Mr Biden to compete for the nomination over a long primary race and they vowed to highlight voters the sharp differences in their agendas and quote as responders himself. He said at a campaign party in Vermont last night. You cannot beat trump with the same old same old kind of politics. What we need is a new politics that brings working class people into our political movements and quotes the.

Everybody and letters it's weird but but but here you go number one on the ballot Hughley and Gastro Rock de la Fuente John Delaney. Who are all all these people who are running for president of the United States? I mean it sounds you know what you remember that whole thing. I mean it turned out to be a scam and I had a friend who who who his parents did it for him where you could pay money. And they would name a star after you in a win to the International Star Registry. And you've got a big fancy certificate and and people would do that for you because they wanted you to know that they loved you and so you can point out the star you got no freaking idea where it is in the sky you just kinda point up there and say. Were a bunch of people on the Republican valid in New Hampshire as well that you have never heard of beyond the whole Joe Walsh And Donald Trump and bill. Oh weld are up there on the ballot so you got all these people up there to on the Republican side and again people you can you can put their name on and and you can go check it out. You can see who's on the ballot now. All of that is to say. There are really only a few viable candidates all on the Republican side. The viable candidate on the Republican side is a guy named Donald Trump. You might have heard of him on the democratic side. There are a few viable candidates. And they're having a real hard time deciding who they are now. Now I want to read you a buddy might just sent me this link. Here are the people in the Republican side is just so you know Rocky Windy Rick Craft Donald Trump The star lock our Robert R Dini. They had five people who got up at midnight and they winning cast the votes. All five of them wrote in in Mike Bloomberg meanwhile amy Kluber shards is is going up. I recognize his name. Zoltan is divided on your ago professionally actually known as Zoltan Istvan is an American Trans Humanist Journalist Entrepreneur and futurist formerly a reporter order for the National Geographic Channel. Is Von Nell writes futurist trans humanist secular and politically themed articles for major publications. He's he's widely perceived as one of the world's most influential Trans humanise and believes trans humanism will grow into a mainstream social move into the next decade. None of us know what the Hell Trans Muniz of Trans Humanism is. He apparently Ed announced in November that he was gonNA run against Donald Trump for the Republican nomination in two thousand eighteen. He ran as a governor for California under the Libertarian Party. And this guy's on on the ballot. What is Trans Humanism? You're asking. According to Wikipedia and international philosophical movement that advocates for the transformation of the human condition by developing and making widely available sophisticated technologies to greatly enhance human intellect and physiology. It's like scientology for the rest of us. Sounds like it. Now I'm I'm a little bit flippant here and I realized that today is the day. The voting begins in New Hampshire. It is worth actually spending some time with you though on the way this is is probably gonNA play out for the Democrats they. I mentioned yesterday. They are getting a little bit antsy about this. And the reason is because I would new Hampshire for the Democratic Party have tinted to follow a pattern of the great winnowing. Know what I mean by the great winnowing. Is that the Democrats in after Iowa in New Hampshire tend to see a great multitude of candidates. Begin to drop out. Some of these candidates have already dropped out if you go back to the ballot Lean Castro dropped out cory Booker Comma Harris. They've already suspended their campaigns. They're on the ballot. There you can still vote for him but they've already suspended their campaigns much like Joe Walsh on the Republican Publican side But the problem is not enough of the major candidates. I mean let's be honest here. E- Kamla Harrison. Cory Booker and John John Delaney and the like they were never really big candidates anyway. The big candidates have always been sanders and Warren in in Biden and footage and now surprisingly Amy Klobuchar. Clovis are you should know yesterday. Did an interesting contrast with Buddha. Buddha JIB has said that you can't be pro-life and be a Democrat and Bernie. Sanders has come out and said the same thing. Elizabeth Warren has said the same thing. Amy Klobuchar Shaw was approached by a reporter in New Hampshire yesterday and asked if you could be pro-life and be a Democrat and she said yes you could and then began to talk to this person about about her work on the adoption caucus in Congress on making adoption more affordable. Now she's she's pro-choice. She defended abortion as a woman's right but she was willing to engage with this person and tell them they're welcome in our party which is actually kind of interesting because she was also the one candidate on stage who said it would be bad to have a socialist running for president as the Democrat Democrats. She actually has said last night that she liked Bernie Sanders she was fringed with Bernie Sanders but Bernie Sanders was not a candidate that they should have as a front runner in the race. So how is New Hampshire going to play out today. This is why it's problematic for the Democrats. You've got waiting in the wings Mike Bloomberg with his billions of dollars he is spending now more money than all the candidates combined and I include Donald Trump in that all I mean just just this blow your head head Mike Bloomberg on TV and radio. Advertising is spending more money than every other presidential candidate of both parties combined bill well well Joe Walsh. Donald Trump Joe Biden Bernie Sanders Elizabeth. Warren Amy Klobuchar Bush all of them combined. My Bloomberg is more money in and it's working for for the people who say you can't buy an election e he's buying an election he spent so much money he's now up at fourteen percent of the polls and he's at fourteen percent of the polls because he spend all this money on on on campaign ads. You hear among your probably your local radio that you see on Fox News. He's running them everywhere. He's not micro targeting he. She's doing a big broad pictures. He's doing big broad ads. He's doing big broad statements of candidacy. Many of them on gun control which is interesting. He's he's running those on conservative talk stations and on Fox News. He thinks that message works There he's got some problems and the opposition research is starting to drip drip drip out about Bloomberg. We'll get into that. There are some pretty damning audio from Bloomberg that's come out From his time as mayor. But along the way you've got the rise is a Bernie Sanders in the fall of Joe Biden in the polling averages. In New Hampshire right now. Joe Biden is in third place. The New York Times has been graphic on their website. Today about it That they that Joe Biden is in third place in the polling averages..

"I'm here with my good colleague and friend and co host Christopher Nixon **** became tobacco to report on the successful parliamentary elections twenty four hours since however democracy is always exciting when I spoke with the TV cameras here at one of the polling stations we visited I quoted Winston Churchill which I will again because Churchill always makes your morning in this world of sin and whoa no one pretends that democracy is perfect for all lies indeed it is been said that democracy is the worst form of government except for all those other forms that have been tried from time to time Winston Churchill nineteen forty seven the democracy in Azerbaijan has answered a parliamentary choice on in twenty five seats now we turn to the democracy in the United States since Chris and I've been away there's been a lot of men Syrian whoa yes a lot of sit in world which is part of the messiness of the best form of government compared to all the rest so I welcome my professionals thanks to skull dot com global technology firm our partners here in Eurasia in the south caucuses and the guidance of the embassy of Azerbaijan in the United States we welcome my collie and co host in Detroit that is McCotter of American greatness and our professionals David Drucker of the Washington examiner and John fund of the National Review online gentleman we are hours from the decision at Dixville notch in New Hampshire the first vote for the primary listen I enjoyed smiles when we said that's the one your grandfather one in nineteen sixty and nineteen sixty lost in sixty eight and one in seventy two but so Dixville notch has a record of getting it right wrong okay fine right right right right however we look to comment on what we've seen in the polling these last hours which is not Bernie Sanders surging he's already a dominant position in the polls but the surge from Minnesota David Amy Kluber shark just call me Amy is is a real thing we're seeing in the polling is is going on in New Hampshire is is a is New York talking about the senator from Minnesota good evening to you David your honor what everyone real resurgence yeah and I think that's what's remarkable is that she still hanging around she still viable which is managed to run the kind of campaign that can withstand a basically a fifth place finish in Iowa and a the work was finished in New Hampshire and that's what she meant she wasn't you too top heavy if you manage expectations wallet yeah I think that would be good yes has accomplished is far more remarkable one night he is setting himself up so far to be the candidate of the center line begins Burry Sanders the king of the progress of lost anything I don't think much of that is going to be sure at least according to the data in New Hampshire when the state votes on a little bit after Dixville notch kicks everything off we will have to see exactly how well clover jardins here to buy do in Warren we know by finishing disappointing fourth or fifth for him and another under the gun there's a term you might use I think the question is does more and do better than the polling suggests war does she have another third place finish one possible workplace manage which server room would be a problem because this is New Hampshire right next door to her home state and you have to wonder where she goes next to recover find it disappointing and he and he has he has been in as much trouble as she will be an afternoon Hampshire who will be in trouble at least theoretically can still need on South Carolina has one last chance to resuscitate campus Mr fund is Amy a new new thing is this is this is this just out the boredom of politico well if she you know Biden collapse leaves a space for centrist candidate and if by the collapse of the NAS enclosure beat them in their Hampshire's David indicated might happen then she lives to fight another day because she's the only woman fifty eight percent of Democrats who primaries are women warned is probably not going to survive New Hampshire any recognizable forms so she can't live to fight another day the real question is what happens to the lectern South Carolina we see polls showing Biden bleeding support in the black community even the town's dire who's been buying every black or renting I should say every black pastor in the state Nevada is next after New Hampshire to vote as a caucus state you would normally expect Bernie do do well there then we moved to South Carolina which is only three days before super Tuesday stop trying to be very important we'll Bloomberg suddenly burst out and do well in South Carolina will buy new collapsed completely can Sanders win very many votes in the palmetto state South Carolina now looms very large in the democratic nominating contest Christopher Nixon **** here there couple numbers that I'm gonna be looking at on Tuesday night one is I'm very interested to see Bernie Sanders vote total because it looks like his vote total will probably come in under what he got in twenty sixteen in the primary so he's really not expanding his base and the second one is the overall number of votes of democratic and democratic leaning independents or come out to vote and I'm wondering if that vote in New Hampshire will confirm what happened in Iowa which is for all this talk of how president trump inspires the democratic base to come out and vote against him in reality in the primaries the vote totals of actually been flat or even down and so I think that that's going to be an interesting story to come out as well David yeah we'll get it we'll we'll numbers on it now I will very interesting when Democrats are taking a hard look at I don't know the destiny compared to having trump to actually build again I think it is it's possible that it could be a sign of just how one's settled in in some way tell uninspiring this field has been even more every Canada has dedicated banks you see democratic voters not really figuring out what they want to do I think that's one of the reasons we've seen Bloomberg Ralston's third nationally even though his plan may not work we're seeing Democrats trying to find a place to go and what I do what is your observation on Sanders in that on the one hand his surge when it mattered he has been important in a significant on the other hand he is not running away with the shield and he is not even though he is consolidating the progressive left he's still having trouble with the center left party and that could be a problem for him he hopes to win the match John well Sanders is obviously proud underperforming what he did in twenty sixteen because they only had one opponent it's a divided field remember Donald Trump won the Republican primaries in twenty sixteen in the end with about forty percent of the vote so Sanders if you can hold on to a quarter a third of the democratic primary vote he comes into the democratic convention the front runner the problem he has is the stop burning movement that will start to coalesce perhaps it'll be around club which are perhaps will be around Bloomberg stock closure movement is very important because all they have to do is not have burning on the first ballot second ballot the super delegates who were almost all looking to Fishel's load Bernie come into play the problem is how to finesse that if the democratic establishment crushes Bernie too harshly the fear that his voters will either stay home third party or maybe as in twenty sixteen fifteen percent of them will vote for trump that is yes we see this very very crowded in the center you got Bloomberg ready to pounce into clubs are you cat mayor Pete but Sanders isn't it true that Warren gets out a large segment of those voters are going to be more inclined to support Sanders rather than a more centrist Democrats David in theory but you know there was one in twenty sixteen I think trying to make the these predictions can be a little dicey because somebody might be voting for warm because they they like the for a certain reason and I could see an intellectual suburban liberal going from somebody once more into somebody like he show you his warning in burning are both competing for the progressive left funny in different ways and different candidates we're we're Bernie Sanders is going to have more of your his coalition involves more of your unusual democratic voter a lot of these motors will only vote for him war has attracted a lot of **** that will Democrats who just boring her particularly appealing and I think people have your true actually be positioned to take a lot of a lot of with voters if you look at what kind of supporters she's now miss font all I think David is right look Elizabeth Warren procrit progresses were always suspicious ever because our conversion to their cause in rather late and seemed all the more convenient she benefited in New Hampshire from being from Massachusetts she she was the leading woman in the race it is not clear at all we're goes transfer often what happens when a candidate that people favored drop Souter's no longer relevant people don't vote one of the things we may see a highly variable voter turnout and that's one of the things that Bloomberg and I had a discussion with Bloomberg's poster tonight duck shown were Bloomberg is the counting on the fact that he can choose turn out in state that he spent the most money and in another state turnout will go down but it will hurt his opponents more that will hurt him I'm speaking with my professionals I'm John bachelor here with Christopher Nixon **** in Baku Azerbaijan we're speculating on the basis of the polling now complete we believe maybe they'll be more one more tracking poll of the New Hampshire vote which is not a Caucasus is straight up people go to the polls Bernie Sanders is in a comfortable lead to my reading of the polls right now Amy Kluber showers a distant fourth or third but surging and in elections with small populations such as New Hampshire the movement of the last forty eight hours is profound is very difficult to see in the polling I Joe Biden's fading is obvious you can see it in the public so question to answer but my professionals of mention one name that must now be considered profoundly Michael Bloomberg the richest man ever to run for public office in the solar system as for Bernie Sanders I quote from Henry the second living that will no one rid me of this turbulent pres I'm John bachelor sturdy reliever arouses Chapman.

"No wiggle room in this elizabeth warren amy klobuchar bernie sanders michael bennett and cory booker are still in the race bennett obviously has no chance and booker really doesn't there's an either but amy kluber shore was getting some traction elizabeth warren has traction bernie sanders is now in the lead in iowa number two behind joe biden none of them will be permitted to leave the senate to go campaign again if a synod trial were to begin it would to begin on probably the twentieth or twenty first and would run through the thirty first more likely than not the iowa caucus is the third of a february the third of february the new hampshire primary is february eleventh the nevada caucus for the democrats february twenty-second and then in the south carolina primary is february twenty-ninth that's the calendar for february if you have a synod trial that drags out for three weeks if it starts next week you're going to miss the iowa caucuses altogether together the candidates will only be able to show up on sundays or at night they'll have a time change benefit they could technically leave washington get on a plane at seven seven pm that would be an iowa six PM they could fly to iowa they could get to iowa by iowa time seven thirty thirty ish they can have a rally around nine pm and then they could get on a plane back to washington they'd have the morning that could campaign in the morning hit a flight but then there's a weather are delayed there's a weather delay that complicates forum it's wintertime in iowa and the weather's not great they can have flight delays and the senate sergeant at arms we'll arrest them if they missed the senate trial you've got new hampshire comes up the next week february eleventh at this if the trial doesn't start until the end of january then you're missing enforce certain if you're a democrat you're missing the iowa caucuses on the third of february and you're missing the new hampshire primary on the eleventh so the advantage goes to boot jude in the advantage advantage goes to joe biden the two of them get to campaign while the senate guys are stuck that's gonna be problem i mean it is it really is for them it's going to be a huge problem so then of course you have the situation of south carolina is the twenty ninth in nevada is the twenty second if the trial stretches for multiple weeks into february you're missing iowa you're missing new hampshire you're missing nevada and you could be missing south carolina because south carolina and nevada are on saturdays but according to the rules of the senate the trial has to happen on a saturday you the senate has got to be in session on a saturday to do the trial against six days a week from noon to six every day and if you don't show up you're going to be arrested by the senate sergeant at arms and you're going to be detained so they gotta do something they've they've got to come up with something in in now you've got democrats in washington openly speculated that oh my gosh did nancy pelosi do this to help joe biden is she trying to rig the game for joe biden they're actually having being that conversation in washington DC now here's the thing though here's here's the thing the reality is a lot of the spin four weeks for weeks democrats and supposedly objective members of the media have told us that nancy pelosi is a strategic genius and that by being a strategic genius and dragging this thing out she was making things difficult for the president and making things difficult for mitch mcconnell and in fact she made nothing difficult for any of them and democrats have been privately conceding it now for over a week that it actually turned out to their disadvantage to drag this thing out and it would have been better had all of this stuff happened during the senate it's an interesting talking point being sure now by multiple members of the breasts that right oh my goodness oh my goodness had john bolton actually come out and said he would testify while the senate was in trial as opposed to now the republicans would not have been able to circle the wagons were to throw them into chaos it's all nancy pelosi's fault now but you got a lot of people in the media who are emotionally invested in the idea that nancy pelosi is a genius and because is there emotionally invested in the idea that nancy pelosi's strategic genius they've decided to move the ball they've decided to move the ball and say oh wait this is really joe biden she's a strategic genius she's gonna gonna keep bernie sanders stuck in the senate elizabeth warren and the radical progressives they're not going to be able to campaign and this is all about helping joe biden on bosie she's such a genius it doesn't matter what nancy pelosi does give nancy pelosi were to fall on her face tomorrow the media would say she's a strategic genius out there showing that gravity really exists in donald trump's a liar the press has lost their ability to tell the truth the press has lost the ability to be honest they're so busy with the narrative that orange man bad that they have emotionally invested themselves for multiple weeks on the idea that nancy pelosi was some sort of like five dimensional chess deep thinker outmanoeuvring in mitch mcconnell and the republicans and you had members of the media willingly pushing the narrative members of the media openly bragging about nancy pelosi girl power narratives and all that crap and it turns out that it undermined the democrats it provided the republicans time i'm to unify on a strategy to help the president and now it's hurting the democrats on the campaign trail in those senate democrats are livid because while there are concerns about bernie sanders on the left there are also concerns that bernie sanders has such a loyal following i mean that they need him to lose fair and square because a lot of those people refused to vote in two thousand sixteen a lot of bernie sanders bernie bros. decided you know if birdies is not gonna win because the deck was stacked against him by hillary clinton and the like then a pox on both your houses i'm either voted for donald trump not voting at all and now here comes nancy pelosi make it look like she stacked in favor of joe biden by dragging this thing out so bernie can't campaign in new hampshire and iowa they're going to be back on a pox on both their houses and set it up and the democrats need every vote they can and they're not going to get them because it looks like nancy pelosi rigged it for joe biden against bernie sanders that's not brilliant strategy it's campaign suicide for the democrats that's what nancy pelosi's got you but the press is so been so busy praising her and she had the democrats all believed the press not the reality of the situation and that's going to cost them in two thousand twenty the politics news religion erik erikson talks about all the things you're not supposed to talk about every weekday and cooking too now i want to circle back to an earlier issue and that is of your ability to be good activists lists and not just passive listeners i have an email list that i use to connect you to the issues of the day in the legislature has its meeting and if you want to subscribe to it may get the occasional text message to take action immediately but what you do is you text the word army two three three three seven seven seven and if you text army two three three seven seven seven then you will be added to the email ish you'll get a text back sane what's your email address and win there when the need arises you'll get notification of here's what's happening in the state legislature and here's how you can support or you can stop it here's how you can text your member state legislature if you wanna see the ultimate system action i i will pull back the veil a little bit for you and show you there there's a resolution before the state house right now authored by state representative david clarke it needs fifteen members of the state house to sign sign onto it has got ten right now needs five more to call on the speaker of the house to step aside and if you want to see the fully operational national grassroots activist system in the state of georgia text the words speaker to five to eight eight six and you will get back immediately immediately a link to the action center and you'll be able to call your state representative and tell them to sign onto david clark's resolution this needs to happen here's why it's so important the republicans in the state house hold the statehouse by fifteen seats the democrats i think they can take back the house i actually don't think it's going to happen but they're gonna make it brutally painful because of the speaker scandals but if you get fifteen republicans to sign onto david clark's resolution it suddenly neutralizes the whole thing because that's their majority suddenly it's the democrats and if the democrats aren't going to stand up and take on the speaker when fifteen republicans willing to take him on suddenly they own the speaker they own all the problems of the speaker they absolutely it's their issue if the democrats democrats in georgia cannot join these fifteen republicans to house the speaker when they would have a majority they would have the votes to do it will then suddenly it's them and when they come campaigning in november and say hey the republicans let this guy in power he said no no no no no none of you wanted to join with the republicans to al steam and and there were enough republicans there were fifteen of them willing to do it in none of you wanna go along with him it's your fault democrats it becomes their problem that's why you need fifteen republicans you you need the houston gains as the world you need the wash burns of the world you need state representatives across georgia to sign david clark's resolution to oust the speaker tech speaker to five two two eight six see the power of the system and if you want to join the activist army text army two three three seven seven seven and you'll be subscribed and you'll be able to take action shen this legislative session as convenient.

"It's the Democrats fault. I just see his point. No. I. Totally sees point. He's over there. Trying to make peace with North Korea. And the Democrats have the chutzpah to bring Michael Cohen in and talk to him. And and. Yeah. What are they thinking? You can't take off his game. Seriously. I have to think that that. He was just I think he didn't want to say that I've been I was distracted. That's what he's saying. Without saying it. Yeah. I was distracted because I was concerned about what the the fixer was telling you couldn't concentrate on little chubby. It's like a kid blaming his parents for having ice cream in the fridge. It's their fault. That's exactly what it is. Pretty funny chubby. The the little little Trumpster, by the way, Joe Biden, I guess he praised vice president Pence during some sort of a a speech, he's another one with the gas. I mean, you're gonna you know what I mean? Like if Trump for some reason doesn't hang on and win the second time around. It's gotta be by just just for the sake of the show. You're saying is we can't have Trump. Don, Don senior we want Don also senior. But but junior. No, no, we want we want Joe Biden. That's what I'm eating. Talking about continue. Okay. So he's Thursday was talking university of Nebraska Omaha at a forum there, and and he was he was talking about number of different topics domestic foreign policy, and I guess he was talking about foreign policy. It said nice words to say about pets. See I don't know what he's doing here. I think in the last time he's talking to you see said he agreed with Trump walking away from North Korea. Then he was talking about Pence saying, you know, he's a good, man. A low limit. False sense of security, whatever. I don't know what what he's working on what he's doing. But the problem is Mike Pence has not been. A friend to the gay community. And so the gay community got involved the LGBTQ community got involved, and I guess they got angry with with Biden. He said the matter of fact of the matter of the fact is it is what's followed on. It was followed by a guy who's a decent guy. Our vice president who stood before a group of allies and leaders. This is what Biden said about Pence, I'm here on behalf of President Trump. He said there was dead. Silence. Biden told a crowd of more than three hundred four he said that even the Pence is a staunch conservative evangelical Christian. He had a long track track record of, you know, knowing the foreign policy and he's good with that. But you're also a long track record of actually being anti G Btk, you know, the rest of the rest, I can't you track. So. They got involved to go your Mike Pence as a career of attacking the rights and equal dignity of our people are women other marginalized communities have you back, then then Biden how to walk it back. Well, I I was talking about Pinson foreign policy. I was talking about that. All it takes is saying. Yeah, you know, I support pens. They they don't really read what he was talking about. How about don't talk about them at all just talk about what you're gonna do. But if you're going to run for president. That's what people wanna hear. So here's who is really for president my favorite political named so far former governor of Colorado John Hickenlooper said today, he's running for president early rolls off the tongue president president Hickenlooper today. It's a tough one that could that could be the worst presidential name ever if he wins. Although President Bush was actually pretty good. I can't wait for the Hickenlooper twenty twenty six Hickenlooper. Don't be a party pooper votes for Hickenlooper. He said he can be a UniteR. That's what they all say. Hey, dude. And I know you come from a state that legalize weed, and maybe you've been catching some contact highs or whatever it is. But nobody could be a unifier this country. Nobody not one that one presidential candidate can unify the Republicans or the Democrats, it ain't happening. It's a dysfunctional relationship that will continue till the end of time until they changed the whole thing. So you could say that. But it it's not. So he's one of twelve by the way, the other one that I guess is running is the Senator Amy kluber char from Minnesota. They should go on the same ticket two of them. Yeah. I like both names. What was it Hickenlooper? Kluber char Kubitschek twenty twenty. I know you can say those words if you could say both teams, we got your vote. She made light of a reputation for being verbally abusive to staffers. Oh, there goes that one because that's been the rumor about her she verbally abuses her staffers. And so she joked about this. I guess that. That's the way you get around to make jokes about it. So she said this as her reasons gridiron club dinner. She says how did everybody likes the salad? She goes. I thought it was. Okay. But it needed a little bit of scalpels pitch of dandruff. Okay. So why would she say that she's referring to report that said she used a comb to eat a salad on an airplane in two thousand eight after an eight forgot to bring her a fork. Where's my fork? Oh, you didn't bring I guess similar to eat the salad with Mike home. She's trying to make the point eight the salad with her com. So I guess that's the word. I got her on her. I mean, it'd would be rude to my staff to if they made me eat a salad with a cone knowing she did it because she wanted to prove a point obviously to raid. If you have nothing else to eat it with they kind of made her I'm on her side here. Okay. I apparently, she's she's one of those types. It's very abusive. So you need here is that. And that's another one that doesn't have a shot specials. Minnesota spigham Minnesota. There was a very funny story broke on Friday when get cops in Jordan, Minnesota or call to check on the welfare of a man standing motionless outside of the cold wearing no coat and hugging a pillow. Cold who would be that guy whatever's has arrived. They found the man was actually a cardboard cutout of my pillow CEO, Mike Lindell. Mike Lindell vicious my pillow, it's thirty degrees below zero. But my Pillow's keeping me warm. A badge of what he can do for you out in the cold here. My pillow will keep you warm in the coldest temperatures.

"Your chance to get in below sixteen hundred may be gone forever. Now I own. Amazon so discount that for line of the green if you want. But I think it's a terrific terrific stock, and I believe in the future. I do believe in the future even a future with the with a shutdown. Chuck Todd, add Mick Mulvaney on yesterday talk about the shutdown. Here's what Mick told Chuck about it cut number fifteen. Two different questions. Let's talk first about how close we are to deal. I honestly don't know. Because it depends on who you listen to. In fact, I think what we're seeing now in these negotiations and again at the White House at the request of all the parties on the hill is sorta step back. We're still participating we're still listening. We're still talking, but we're not leading the in the negotiations were sitting there watching what's happening. And what we hear is just as varied as what you just played out. It sorta depends on who you talk to. I've heard that there may be a deal with as much as two point one or two point five billion dollars for for border fence, then I hear that there may be zero or as little as eight hundred million for the border fence. There's one democrat who apparently wants to not only reduce the spending this year, but go back and take money away from previous years that hasn't been spent yet. So it's all over the map. And I think it's all over the map because of the Democrats and all over the map because of what you just played on the introduction to this segment. Two billion is the number. We keep caring for though, this this additional money. He wanted to five point seven two. Seems to be the number that everybody's circling is that an acceptable number. This is how the president looks at it and agree or disagree with him. You may agree disagree, folks. Watching this may have different opinions about it for the president really does believe that there is a national security crisis and humanitarian crisis at the border, and he will do something about it. So whether or not he gets one point six billion dollars from congress whether or not he gets two point five or five point seven he's going to do whatever he legally can to secure that border. So you have to look at this. I think check in terms of the larger the larger agreements regarding what we're going to do on this other. So is it fair to say, whatever congress, a handsome he'll sign he just may not be enthusiastic about it. I don't think so not ready to go the definitive we cannot definitively rule out of government shutdown end of this week. You absolutely cannot. And here's why okay, let's say for sake of this discussion that the Democrats prevail and the hardcore left wing, Democrats, prevail was a democrat congresswoman. Who put on a tank yesterday about zero dollars for DHS? So let's say the hardcore left wing of the democrat party prevails this negotiation, and they put a Bill on the president's desk with zero money for the wallet eight hundred million absurdly, low number how does he sign that? He cannot in good faith sign that it takes a presidential signature spending. Bill. Can you imagine two different questions? Let's talk. I could happen. All I can tell you is it can happen. Stay tuned. If the Democrats are unreasonable, the President Trump it if they're reasonable. He will and I do not rule out a declaration of national emergency. And I teach my class on Thursday. Youngstown sheet into one of the most famous cases in the supreme court, and there are bike seven opinions and nine opinions and the Pirker him opinion saying Harry Truman can't sees the steel mills and then six agreeing and three dissenting. I don't know. How many there were lots? I always teach the black opinion mostly Justice Jackson's opinion, which explains the zones of presidential power zone. One floodtide of presidential authority is when the president acts with the backing of the congress, even so that's not sufficient over all the constitution. As we saw with a bunch of the detainee bills in the first decade of the century following nine eleven congress would empower the president to handle detainees at Gitmo in a particular fashion and the zone run the president, and the congress agreed on what to do in the in the supreme court said, Nope, not good enough and found it unconstitutional so zone. One is not necessarily constitutional. But it usually is zone. Three is when the president has been explicitly forbidden to do what he proposes to do. Or she proposes to do in the future that zone one the low tide presidential that zone three excuse me, the low tide of presidential thorny zone to which Justice Jackson described with great. Extended analogies citing among others Joseph and the story of interpreting Pharaoh's dreams is where the president acts as commander in chief and executive of the wedge taking care to faithfully execute. The laws the chief executive the United States and congress had given him some thority but hasn't spoken specifically to the authorities requested that so two and so the president's in zone two if he declares a national emergency. And we just don't know how that's going to turn out anybody who tells you. They know is lying. We don't know. It depends on this court their view of the unitary executive the money that the president uses the people that he uses to build it. The president cannot authorize new appropriations individually. He can use money lying around. That's not designated for a particular use and put it into the construction of border barriers and he can use the army, by the way to build it near mcchord engineers, so watch that space. Nobody knows what talk with Tien San Antonio. Good morning. You're on the Hugh Hewitt Show. How are you? You. When it comes to be a lady from Minnesota, and whether or not she is appropriate, and it's good enough person rapper president or whatever it is. Hardcore leftist, and there are no good ones. And you know, it's it's kind of it's it's disingenuous to even assume that they if there are any moderate Democrats did breakthrough that they're even going to have boys within the Democratic Party. You know? So that's kind of where they're at. And and you hang out lot allotted MSNBC with Chuck Todd and Stephanie role and all this, and I kind of feel like you're a truckload event collect with a teaspoon of wisdom. And it's really hard to swallow sometimes because you're taking over for Bill Bennett who was always he's like Dennis Prager. And and you you're difficult to listen to because I you know, you you were the one who called for Donald Trump to step down after the Billy Bush. He needs to give it to Mike Pence mismatch, and you know, all the way up to the football game. You're calling for them to play the game over again. I'm listening to you. And I'm like, what is this guy? Talking about wrap wrapping up. There are no good left. Is. There are no good left tight. You're always welcome to call. I love people like you. But they share replayed the game. You know that don't you? No, that's a terrible tie the game that was injustice here. Bill Bennett agrees with me on that nobody'll agrees. Bill Bill agrees with me, and you can call not everybody knows that that was illegitimate. That's why the the the patriots won the crime Victorian play the better team. They play the worst team patriots fan. You're really a patriots fan, aren't you? That's what you are. You set your from Texas and you're really from Boston. You want to you you came in here representing yourself as a Dallas Cowboys fan, and you really from patriot land you people. All right. Thank you. Thank you, buddy. Be. Well. Was quite a call. I'm looking at Sonny bunch sixteen hours ago. God some staffers going to get such a beating tonight because it has a picture. Amy, kluber chart the beginning of the speech and at the end of the state. I don't think she Searcy Lancaster. I really don't. I we've been going up there. A long time. I don't think she is Amy the Impaler. But when a story gets legs like this, then sunny bunch comes God some staffers gonna get such a beating tonight because at the beginning of the speech. It does look like the craziest place in the world to hold people went out of there with frostbite. They went out there with with blackened toes and limbs they had saws at the side of the road to take off limbs. The s&p is up eleven points this morning in pre-market trading. The NASDAQ is up over a half percent thirty nine points. And the Dow is up one hundred and fourteen points in pre-market trading, which is point four five percent. I'm telling you if a deal get struck with China, the market's going to go crazy. I always use Amazon as a proxy for the tech sector was off twenty six bucks on Friday. It's up almost eighteen this morning in pre-market trading back above sixteen hundred your your chance to get in below sixty nine hundred may be gone forever. Now, I own Amazon so discount that for of the green if you want. But I think it's a terrific terrific stock, and I believe in the future. I do believe in the future even a future with a with a shutdown. Chuck Todd, add Mick Mulvaney on yesterday talking about the shutdown. Here's what Mick told Chuck about it cut number fifteen. Two different questions. Let's talk first about how close we are to deal. I honestly don't know. Because it depends on who you listen to. In fact, I think what we're seeing now in these negotiations and again at the White House at the request of all the parties on the hill to step back. We're still participating we're still listening. We're still talking, but we're not leading the in the negotiations were sitting there watching what's happening. And what we hear is just as varied as what you just played out. It sorta depends on who you talk to. I've heard that there may be a deal with as much as two point one or two point five billion dollars for for a border fence. Then I hear that there may be zero or as little as eight hundred million for the border fence. There's one democrat who apparently wants to not only reduce the spending this year, but go back and take money away from freebie issues that hasn't been spent yet, so it's all over the map. And I think it's all over the map because of the Democrats and all over the map because of what you just played on the introduction to the segment. Two billion is the number. We keep hearing for though, this this additional money. He wanted to five point seven two. Seems to be the number that everybody's circling is that an acceptable number. This is the president looks at it and agree or disagree with him. You may agree may disagree, folks. Watching this may have different things about it for the president really does believe that there is a national security crisis and humidity humanitarian crisis at the border, and he will do something about it. So whether or not he gets one point six billion dollars from congress whether or not he gets two point five or five point seven he's going to do whatever he legally can to secure that border. So you have to look at this. I think Chuck in terms of the larger the larger agreements regarding what we're going to do on this other. So is it fair to say, whatever congress, a handsome he'll sign he just may not be enthusiastic about it. I don't think so not ready to go there. We cannot definitively rule out of government shutdown at the end of this week. You absolutely cannot. And here's why okay, let's say for sake of this discussion that the Democrats prevail and the hardcore left wing Democrats, prevail was democrat congresswoman who put out a tent yesterday about zero dollars for DHS. Let's say the hardcore left wing of the democrat party prevails negotiation, and they put a Bill on the president's desk with zero money for the wall or eight hundred million absurdly low number how does he sign that? He cannot in good faith sign that it takes a presidential signature spending. Bill. Can you imagine two different questions? Let's talk first they could happen. All I can tell you is it can happen. Stay tuned. If the Democrats are unreasonable, the President Trump signing if they're reasonable. He will and I do not rule out a declaration, national emergency. And I teach Micon law class on Thursday. Youngstown sheet into one of the most famous cases in history the supreme court, and there are like seven opinions and nine opinions and the Pirker him opinion saying Harry Truman can't sees the steel mills and then six agreeing and three dissenting. I don't know. How many there were lots? I always teach the black opinion mostly Justice Jackson's opinion, which explains the zones of presidential power zone. One flood tide the presidential authority is when the president acts with the backing of the congress, even so that's not sufficient to a rule the constitution. As we saw with a bunch of the detainee bills in the first decade of the century following nine eleven congress would empower the president to handle detainees at Gitmo in a particular fashion and the zone one the president, and the congress agreed on what to do and the in the supreme court said, Nope, not good enough and founded unconstitutional so zone. One is not necessarily constitutional. But it usually is zone. Three is when the president has been explicitly forbidden to do what he proposes to do. Or she proposes to do in the future that zone one the low tide presidential zone three excuse me, the low tide of presidential thorny zone to which Justice Jackson described with great. Extended analogies citing among others Joseph and the story of interpreting Pharaoh's dreams is where the president axes commander in chief and executive of the ledge taking care to faithfully execute. The laws the chief executive United States and congress has given him some thority but hasn't spoken specifically to the authorities requested that so too and so the president's in zone two if he declares a national emergency. Nobody knows what talk with tie in San Antonio. Good morning tie. You're on the Hugh Hewitt Show. How are you? Hey, listen when it comes to the lady from Minnesota, and whether or not she is appropriate and good enough. I Russell president or whatever it is. Hardcore leftist, and there are no good ones. And you know, it's it's kind of it's it's disingenuous to even assumed that they if there are any moderate Democrats that breakthrough that they're even going to have a voice within the Democratic Party. You know? So that's kind of where they're at. And and you hang out a lot at MSNBC with Chuck Todd and Stephanie role and all this, and I kind of feel like you're a truckload of intellect with a teaspoon of wisdom. And it's really hard to swallow sometimes because you're taking over for Bill Bennett who was always he's like Dennis Prager. And and you difficult to listen to because I you know, you you were the one who called for Donald Trump to step down after the Billy Bush. He needs to give it to Mike bad mismatch. And you know, all the way up through the football team. You're calling for them to play the game over again. I'm listening to you. And I'm like, what is this guy? Talking about sort of wrapping up. There are no good last year. There are no good left tire. You're always welcome to call. I love you. But they share replayed the game. You know that don't you? No. A terrible press guy played the game that was injustice here. Bill Bennett agrees with me on that. Nobody hill agrees that Bill Bill agrees with me, and you can call them not everybody knows that that was illegitimate. That's why the the the patriots won the crown Victoria and play the better team. They play the worst team patriots fan. You're really a patriots fan, aren't you? That's what you are. You said you're from Texas and you're really from Boston. You want you you came in here representing yourself as a Dallas Cowboys fan, and you're really from patriot land you people. All right. Thank you. Thank you be. Well. Was quite a call. I'm looking at Sonny bunch sixteen hours ago. God some staffers gonna get such a beating tonight because it has a picture Amy kluber chart the getting of the speech and at the end of the state. They went up there with with with the blackened toes and limbs they had saws at the side of the road to take off limbs. All right time to tell you about relief factor, which will not help frostbite, but it will help if you got if you fell down on the ice.

The CEO editor in chief of the Tennessee star this morning. Thanks for joining us here, and you can dial in talk during the program anytime this morning, seven three seven wwl WNYC. Let's see last night. They had the Grammy's and Dolly Parton performance. I think people are just raving about this morning is a the honored Dahlie for many many songs and then in the, you know, her performance itself. Shallow. Bama made an appearance last night. And people are wondering is is just the beginning of getting ready to run for office. We got to new democrat candidates in the race for president. They announced over the weekend. We're not sure yet. Whether there's going to be a deal about the building the wall yet, the we thought we had one, but maybe not. So we'll talk about that this morning, Michael. How are you doing hope you had a good weekend? I did, you know nothing says musical excellence like Michelle Obama. Yeah. Well, I mean, she I think she made appearance last year or something, you know, she's sort of the. I guess she has the the rockstar sort of welcome. I guess so they were I mean they were doing and I over Michelle Obama and. Last night. This may shock you. Yeah. I did not watch one second. You probably didn't. You mean, you weren't there to see Cardi B win the female rapper song of the year. Whatever it was you miss that last night gonna bring you up to date on all of that. Is that? Oh, please. Don't. But the big thing for Dolly, though, was was was the performance she did with a bunch of others and. You know, it was good to see her. She's seventy three years old. Good to see her being honored last night. You know at those at the music awards. So we've got a couple of Democrats that we thought were running then announced over the weekend. Elizabeth Warren, you know, that was that was the announcement there and it was snowing in Minnesota. Where Abe Amy kluber jar the Senator from Minnesota made Minnesota made her announcement. Right. So anyway, it was. Pretty cold. I mean, you gotta you gotta give her supporters credit to stand out in the blizzard or whatever she's giving her announcement yesterday or this weekend. I mean, our Minnesota bureau chief Anthony account ski was there. And man, he's a brave guy. Well, cold, managing editor of the Minnesota son, which we also own he was their great story about club charts announcement. And what was interesting about it? You know, you're right. There was a big crowd. There were nine thousand people there. But. Again, they thought there was a hockey game is the only I could figure out. Well, here's the thing. Both Elizabeth Warren and Amy klobuchar. Made their formal announcements in an environment where. They had some negative things going on. Now. Let's talk about Amy. Amy. She was reelected. I think for a third term in November against a non entity in in a state that is a battleground state and yet. President Trump only wash it by forty thousand votes in two thousand sixteen in two thousand eighteen it was very much a a democratic landslide in the midterm elections. So Amy klobuchar one sixty percent of the vote in a state that President Trump only lost by one point five percent. So that would look good for her. And clearly the Democrats need to carry Minnesota. That's a bit of a long shot for Trump. I think, but it's in in in his wheels as a possibility, but you know, you did you see this just before a couple of days before she announced? The hill and BuzzFeed political, I think I'll head stories about what a mean, boss. She is. And how she is. Did you see that? Yeah. I did see that. She was. Yeah. It was something. I didn't read the whole thing. But yeah, was something like that. Working with hard to be around. True. And yeah, I. Nations. I guess all right, especially senators is sleep. Yeah. Yes. Yes. Yes. Because they're so modest well one thing she doesn't have she may be hard to get to work with and everything Michael..

"Victoria, Keven Kerry Shelvin and today's day for all of us to remember what tomorrow is about thinking today can be better tomorrow would even be better than today who all right? The cheerleading section will sit down Victoria has something of interest for Meghan, Markle, fans, everywhere and the television show, suits. So what's the story? So Meghan Markle has never publicly spoken about her relationship with her father since she got hooked up basically with Harry, Harry styles. She wishes Prince, Harry, but her father, obviously has been you know, anytime there's a camera on their ears. And so he's done. So many interviews claiming that he has no way of reaching her. He and push each other out of the way to get to the camera. You know, he claims that she that he's called her so many times, and that her number must be changed because she never calls him back. And so now, a group of her closest friends have gotten together, and it's on the cover of this week's people magazine, and some of the friends are are her fellow suits cast mates, and they are just defending her saying, look, she's not going to say anything publicly, but we can and one of the friend said that Thomas Markle knows how to get in touch with Megan telephone number has not changed. He's actually never called her. He's never texted her. And this this girl said it's super painful because Meg apparently all the friends call her Meg was always so dutiful, and she'll always genuinely feel devastated by how he's acted. But at the same time, she also still has sympathy for him because she's a daughter, and so apparently Meghan wrote a letter to to her father after the wedding. Because of course, he missed the wedding hit heart attack. He couldn't go. And so the next morning. He. I guess had received a letter from Megan Markle, and this is another one of the friends. I think this is a girl who actually used on suits. I forget her name now. But she said. She was at the wedding. Yup. Yeah. So she said after the wedding Nagin wrote him a letter she said dad, I'm so heartbroken. I love you. I only have one father, please stop victimising me through the media. So we can repair our relationship. And then the friend went on to say every time her team has come to her and done. Some fact checking that of Thomas Markle of whatever he said, it's always wrong, and she said, it's just another arrow to Meghan Markle's heart, and then he wrote a really long letter back to her in return, and he requested a photo op with his daughter and so- Meghan wrote back to him and said that's the opposite of what I'm saying. I'm telling you, I don't want to communicate through the media. And you're asking me to communicate through the media. Did you hear anything I said, it's almost like we're passing ships. And so apparently that is part of the letter that Meghan wrote to her father and a all of her friends. And and have also said that Samantha Markle the half sister who loves to talk about her. She was never even in Megan's life, and that they barely even have a picture together because they don't. No each other. They technically are siblings, but they could not have been further from actually acting like siblings, and they just were not raised together in the same house, and they don't really have any relationship. And so there is a Thomas junior Markle, and he apparently wants Megan to be at his wedding. But she has the same relationship with him. I e nun that she has with with the older sister. Samantha so it's really nice that Meghan Markle's been trashed in the news, especially in the UK press recently. So it's really nice that she has so many friends and former co workers who are stepping forward and saying look enough is enough here. Like, she's a wonderful person all of them the suits cast has they've all said some of them anonymously in this article have also said they've they've been to the house they've stayed at the cottage with Megan, and Harry, and that Nagin is still the same person who loves to cook for everyone. She loves to make a nice cute cozy home for everybody. And they said that you know, all these reports are just they felt that they had to speak up for. Your friend, which is really sweet, actually, right? All right. So Sarah Rafferty is the woman that you're looking for. She's the Ray redhead, right? They're going to continue. This is the last season of suits. It's been on for nine years and they're bringing Patrick Adams back again. The star is Gabriel macht who's been a character actor all of his career. And this is first lead role. I think he did a great job in the he'll show up in something else. So Megan played Rachel Zane. Her father, who's in the show now stayed with the sort of joined firms and stuff and giving a little background is an actor character actor name window peers that you see everywhere he was an episode last night of of Chicago PD, but he's he's all over the place. So anyway. It just makes you wonder how clueless. How can you be or how self-centered UB maybe that's the better question? Yeah. Mean this guy, obviously doesn't really love his daughter because he wouldn't be doing this stuff. Yep. Speaking of that, some of the people running for the presidency getting scrutinized, I noticed Senator Amy kluber shower is out are we pronounce your gas for Minnesota. Apparently, she has a history of misreading her staff. So there are several articles floating around today and this week about her plans to make an announcement perhaps this weekend about running for president. And she's asked so far three people to lead her presidential campaign. They're all said, no, I don't want to work for you your pain in the neck. So anyway, so the the question I have here is in fairness when a man the mistreat your staff there apparently is some not sexual innuendo to this. But. It borders on this kind of what I read between the lines is a is a sort of a thin line between various types of abuses, and because the people who are coming forward or speaking under condition of anonymity. That means.

"Welcome to the lead from meet the press. I'm Kerry, Dan, if you like pomp, and I guess well circumstance you are in for an annual event of perhaps questionable news value tonight because that's right. It's state of the union night. The event, of course was delayed because of a thirty five day government shutdown which was in turn a futile exercise in ill fated attempts at partisan point making which critics might say is a perfect symbol for the state of the union. But regardless of whether it'll be an event that is remembered forever or whether we'll all have moved onto the next thing in twenty four hours. It is a big chance for both the president and the opposition party to try to make a statement. And that's especially true. If you are a congressional lawmaker who can go to the speech because those folks can send a message by bringing a guest, which sidebar should be more common in our everyday lives. Like, hey, Bob. I'm still annoyed that you ate guacamole at the last party. So I'm bringing of cuddle industry executive here wedding. That's just me. So who's coming with whom among those potential twenty twenty hopefuls, and what kind of statements are they trying to make with those guests. Well, there's Elizabeth Warren who's bringing a federal worker and union executive who organized rallies during the aforementioned shutdown. Kamala Harris is also bringing someone affected by the shutdown an air traffic controller there's Cory Booker who's bringing a former federal inmates who benefited from the recently passed criminal Justice reform Bill that Booker cosponsored, there's Kirstin gillibrand who's bringing a transgender. Servicemember shared Brown is bringing the same guest. He brought last year. Eight pension advocate and the wife of a late Ohio Teamster and Amy kluber shar is bringing a diabetes activist the point she's trying to make with her choice of guest the need to bring down the cost of prescription drugs. The men all of these people may be hoping to replace President Donald Trump for his part is also bringing. Ng a series of his own guests, and there's a teeny bit of bipartisan overlap, although there are some contrast as well like Cory Booker Trump is also bringing a former prisoner who benefited from criminal Justice reform. He's also bringing Alice Johnson, someone whom Trump granted clemency to last year. Trump is also bringing to survivors of the synagogue shooting in Pittsburgh last year. One of whom is a police officer who suffered multiple gunshot wounds and slash butts. Trump is also bringing several guests meant to emphasize his focus on illegal immigration. That includes the family of a couple killed by an undocumented immigrants and DHS trafficking agent. So stay tuned for a state of the union that will be a state of the union complete with pomp circumstance, political statements and probably a lot of people in Washington eating cold pizza because that's the state of mind union every year. "Is a place where people will care about problem solving people that are actually trying to get things done recognize that voice that is former Colorado governor John Hickenlooper, his comment to the Moines television station about why what was he doing in Iowa porn, some beers and talking to people and kissing babies. He has not declared yet. But I think he's well on his way to making that happen. He joins what two dozen other people that have got their their hat in the race. And depending on your perspective. I don't I don't know that having sixteen people running for president was really a great thing for the for the GOP back in twenty sixteen. I think Democrats might learn that lesson themselves. So here's the contenders thus far. We've got Senator Elizabeth Warren. Who I have to admit is a little less convincing when she's just having a beer, if you if you haven't seen that video clips, I guess Senator Elizabeth Warren, she's kind of a Justice warrior, she's far left. She's had some issues of late is she's been outed as being not not exactly native American. But I guess her consultants have said to her you're not very relatable, you've got Alexandria, Cossio Cortez out there, she seems super relatable and super cute. And you you just seem kind of old and stiff and Massachusetts like so she made this little video. I assume for Facebook in which he's like, I'm gonna get myself a beer, it's like, it would have been more realistic and more authentic. I think if she had said I'm going to get myself a Cup of tea really strike me as the beer type just saying or champagne Presario, I'm gonna get myself some. That would have worked a little bit better. I think also Senator Kamala Harris, and she just recently put her her hat and the Rangers. She's a beautiful woman. She used to be a prosecutor, although that may come back to haunt her. Among the progressives seriously three zero three seven one three eight two five five if you've got an opinion about the emerging field on the left also five seven seven three nine. So Kamala Harris, I think she used to be a little bit more of a centrist is now like the rest go full on progressive Senator Kirsten gillibrand another another pretty gal. I sure some of these women wouldn't like me Klein them gals. I'm actually okay with the term gal. If you wanted to call me a gallon. I'm fine with that. But you kind of more hard core. Hardcore feminists. I don't think they really liked that. So maybe I should say this woman, the Senator pretty progressive is all about the L about these socialized medicine, and and and here's the deal for those on the far left. If you want people who are skeptical, Donald Trump, and and kind of centrist, moderate Republicans that would rather not vote for for President Trump. If you wanna get them to vote for Donald Trump. Then you should really keep pushing the socialized medicine because some of us health issues. I've got several kind of significant things not significant on the level of like cystic fibrosis, but annoying chronic problems that I got a monitor and I don't want to be in a socialized medicine system. I don't want to pay into it. I don't wanna play with it. And the reason why is washed a friend of mine die under that system. I also I've had five surgeries in the last ten years. I know that if I were in Canada, I would have waited a good year. Probably for each one of those surgeries and pain is bad. I don't wanna live in pain. I want to be an in the system like the one we have flawed as it is where I could she can get the care that I need. So you want to you wanna turn me a skeptic into a Trump fan? Then then then try to push socialized medicine on me. Just for all those democratic consultants out there if you want if you want me to put a Trump sticker on the back of my car, then run somebody who loves socialized medicine. So we also have Julian Castro, I guess, probably no relation to the Cuban dictator, but he is San Antonio mayor and former HUD secretary when he first put his hat in the ring, I was like who's that? Who's that? And so I think I would put him in the who's that category. Singles for Tulsi Gabbard. She is a I guess, she's she's pretty good friends are pretty friendly with Syrian dictator Bashar al-assad, and and that might come back to haunt. I also think the far left is is displeased with the fact that she was once anti anti gay marriage. And the, you know, your sins will not be forgotten. If you're on the left. So I think that just might keep the Hawaiian congresswoman from getting where she'd like to go former former Representative John Delaney again in the who's that category. And mayor Pete how to pronounce this name, but a gig. But a gig could the first four letters are b u t t the Indiana guy. Yeah, he's the Indiana guy mayor Pete Belichick booty Jake. Maybe it's booth. Jake. And you know, what I could vote for that. I like it. Bitty jake. The fact that he'd be the first openly LGBTQ R S president in the American in America's history. What am I going to drop that altogether? So and then also Andrew Yang in in the who's that category. Of course, Bernie Sanders. Bernie Sanders is he will keep running and everyone wants Joe Biden to throw his hat in the ring. Cory booker. Of course, just as a matter of ego. I think he'll be in Sharad Brown. Amy, kluber char Jeff Marquis. And here's where it gets a little bit interesting Senator Michael Bennet also made this list on FOX his display last weekend where he was no longer Mr. mellow. But Mr. outraged Mr Justice man that that display I think is an indication he is going to run. And I think some consultants said dude, you're to mellow you're like to centrists to mellow. Oh to to thoughtful, you wanna go toe to toe with Donald Trump you and actually get through the crazy battle of the primary than you better throw some punches, and so he smacked around Ted Cruz on the Senate floor in a way that was I think very unsettled to'real like, and I think it was it was like it was like his stage and he was doing kind of like an audition. Like, look, I could be tough to. I could be outrageous. I can be outraged. So I'm hoping we'll get him on the show sometime because I'm going to ask him about that. I actually prefer thoughtful Senator Bennett not that I agree with him on probably anything, but thoughtful senatorial statesman, like I think that's. That's that's that's the man I would have liked to have run, but Mr. spicy house. Like, he carries it, frankly. And actually, I wish nobody would carry it. I'm not I'm not into spicy. I'm into I'm into statesman-like. So former Senator governor sorry, I'm gonna sit former Senator I didn't almost I did say, I didn't mean to former governor Colorado governor John Hickenlooper. Of course, it's been talking about this for a while. And I'd like him to run I like him. I'm not going to vote for him. He's way too far left for me. He's also not pro-life, and that's kind of a. Kind of a non starter for me. You gotta be pro-life. If you want my vote because at a very basic level. That's who I am. I believe in protecting the innocent the vulnerable, even when I was a crazy far left democrat. I was still pro-life. And if you she can't stand up for the unborn can't stand up for the vulnerable. Don't believe that. It's necessary. Don't actually care about those kids because they're nameless. Faceless. Nobody's to you. Then I can't vote for you. It doesn't even matter. You could be a Republican you could be the best Republican in the world. Like Ronald Reagan, minus the pro-life part still can't vote for you. It's just the way. It is beta Aurora the first Irish Hispanic, I think president. I just of course, I think he is just Irish I don't know where he got the name Bego Michael Bloomberg TOMS tire. And the list goes on and on. I hope that they end up with a good twenty five thirty people because he knows that that goes really, well when you get that many people in their Bruce in each other up, and then hopefully, the most obnoxious person will will will win. I mean, it's happened before. Let's put it that way. Three. Oh, three seven one three eight two five five who is the most noxious democrat running for president. Do you think three zero three seven one three eight two five five Kamala Harris Ryan Ryan is has given his vote to Kamala Harris. Oh, we have Kamala. Are you giving your vote to her? And actually, let's here come on in her own words as she decides. She wants to run for president. We have leaders bullying attack of free press and undermine our democratic institutions. That's not our America. White supremacists. March and murder in Charlottesville massacre, innocent worshippers, a Pittsburgh. That's not our America when we have children in cages crying for their mothers and fathers. Don't you dare call that border security? That's a human rights. And.

"You. Now, the spiel some things that annoy me about the dismissal of Kamla Harris. First of all, come LA Harris seems fine to me. Would I vote for? I don't know. Maybe she's no Amy klobuchar Mahan how let me that Amy kluber char she and Sheldon Whitehouse are just the best members of the Senate Judiciary committee. Don't you think? I mean Harris's on it. She's okay. She doesn't really get to the nub of things like Amy klobuchar. But look not everyone can be Amy clue HR a smart former prosecutor who is a female Senator running for president weight that describes Kamala Harris too. But in the day within an hour of her announcing I found out there was a right wing smear campaign to allege she is ineligible to be president. Because it doesn't matter. Some bullshit reasons my truck with this story is not just the obvious discredited troll who is propagating this story. But the members of the media who are spreading it. They're using their credibility to point to this troll, saying don't. Believe this troll this troll. His name is Jacob troll of changes. Last name has tweeted out. Come Harris is not eligible to be president her father arrive from Jamaica nine hundred sixty one or mother from India nineteen bad bound, true untrue untrue. But Djamil hill, formerly of ESPN with her one point one million followers tweeted out. I can't believe this guy rather than not believing this guy. Just don't give them air. This fellow's Wikipedia entry is Jacob troll. Not as real name born December twelfth nineteen ninety seven. So he just turned twenty one Jacob patrol is barred for life from futures trading due to defrauding investors in two thousand sixteen by posing as a hedge fund manager and real estate investor troll. Not his real name is an American right wing fraudster conspiracy theorist online blogger internet troll. Oh, I guess it's a promise then. And he's a former columnist for the gateway pundit. It also notes the troll drew national attention in two thousand eighteen after news outlets reported his. In a failed plot to discredit Robert Muller by framing him for sexual misconduct. Great trolls troll. You just dunked on should fantastic. Hey, remember, the last time we had a laugh about someone who's alleging person didn't have the right birth circumstances to run for president that man's name was Ted Cruz. But the guy doing the alleging was Donald Trump who you might know as a right wing fraudster barred from running a charitable foundation due to lax oversight as he posed as a real estate investor 'nother thing that annoys me about the coverage of Kamala Harris that she's too tough on crime. Here's a headline from the intercept a problem for comma Harris can a prosecutor become president in the age of black lives matter. So here's the case as attorney general of California, she criminalized truancy she's overlooked misconduct of prosecutors and fought to uphold their wrongfully secured convictions. She defended California's choice to deny gender reassignment surgery to a transgender inmate. And in two thousand fourteen she appealed a federal judges holding that the death penalty was unconstitutional the list goes on and on. But in some ways, the details don't matter to quote, the intercept yet, they do to quote me, the transgender surgery issue, for instance. Well, the executive director of one of the largest LGBT groups in the state of California guy name Rick is Bir says that Harris was pretty constrained in what she could do in her office as state attorney general Bir gives her high marks today the Lambda legal defense fund isn't quite so forgiving of her time in office. But it does say they do say that when Harris became personally involved with the trans surgery case, she comported much more with what they consider to be best practices. They like Kamala Harris very much. I mean, a state attorney general she had a staff of one thousand people shouldn't know about the case until she learned about it from news coverage and she had to follow the law. Written. She was a fairly tough prosecutor. Meaning she served the interests of her constituents perhaps that means she doesn't serve the part of the Democratic Party represented by the intercept. But that we find to say in a story if the story were is Kamla Harris as good on all the issues as the left wants her to be. But recall, the phrasing of the story problem for Kamla Harris where the guardians headline comma Harris can a top cop when over progressives in twenty twenty. Well, it depends how progressive and it matters. If we're talking about a narrow slice of the electorate with the most uncompromising definition of progressively. We're just regular democratic voters who consider themselves somewhat elected and another annoying thing about camera Harris, that's not annoying about comma, Harris. It's annoying about some coverage of her is that she's from California and that California votes very early in the primaries. How early with early voting in California, they'll actually be voting before Newham. Although their primary date is after so as you know, California has a lot of delegates at four hundred ninety five delegates to be exact Iowa has forty-nine. New Hampshire is thirty three. This is a huge advantage for comma, Harris. But Rebecca buck of CNN tweeted, I feel a lot of analysis right now. Overstates Comal is potential home state advantage. Anyone here? Remember how that worked for Marco Rubio? Okay. That's true. A wounded and by then third or fourth place. Rubio lost to fellow Florida resident and infinitely more exciting candidate who conservatives Donald Trump. But you know, what decent candidates won their home states 2016 casick win, Ohio. Cruise one Texas Bernie one Vermont two thousand eight McCain when Arizona Romney won Massachusetts Huckabee one Arkansas, then Obama when Illinois and Hillary one New York in two thousand four Kerry when Massachusetts Edwards one North Carolina. And there was only one state where former Vermont governor Howard, Dean succeeded. It was Vermont California is not winner take all so there's no winning California. But she. Can get a massive haul of delegates. It's much more likely Harris does well in California. Despite the fact that one time this other guy didn't do well in his state, even though all the other times almost all the other candidates do well and the issues. Yeah. The issues seems like she's democrat not so far out there as to be concerning not so entrenched as to be boring. We'll see how the issues play out. And all I say is please let them play out and resist the premature dismissal of Kamla Harris. So annoying. And that's it for today show Pierre began his four things that annoy him about fellow just producer, Daniel Schrader. And Daniel says just four maybe I'll bring my number down from ninety two Rafael is senior producer of slate podcast. She may have lost willa, but she can't lose Dana and the rest the gist. We may have lost Doug Henning. But we've still got David Copperfield and arrest Debra do Peru and thanks for listening.
