I mean there's a thirty two round magazine for clocks right. There's a fifty round drum magazine available for glocks nine millimeter. of course. Any pistol with a detachable magazine. You could make an extra long magazine that goes in their holes a lot of ammunition so he saw what he said. Was the idea that you need a weapon that can have the ability to fire that many shots. I'm continuing to push to eliminate the sale of those things doesn't take a lot of brain howard to figure out what he just said was any gun that could be made to fire that many. "I have been most proud of the resistance to government intrusions into our rights by folks who otherwise are not willing to fight. I would tell you that those two areas see if you can guess what you would think i would. I would say those would be the two political issues legal issues that americans are willing to fight back against the democrats on and not. Just take it number one your kids. You're seeing the pushback to critical race theory because people realize. I don't want my child indoctrinated. I'm not sending my child to a public school to be told that because that child is white that they didn't earn what they've accomplished that they own apology to everyone. Who's black that white people are awful and black. Parents are increasingly stepping forward and saying this is bunk. Stop teaching this. I don't want my child to think that white people are evil. Middle america has pushed back when their children are threatened and when their guns were threatened. Those are the two issues where americans will actually stand up and do something. They won't put on the mask. They won't social distance. They won't hide under their bed. They won't close their business and go out of business. They won't live in fear they will fight back. You will fight back when it comes to your and when it comes to your guns more than anything else they can take your money because tax increases don't seem to bother people that much obamacare didn't even bother people as much as it should have but when it comes to your children and your guns god bless ya 'cause you buck up and i don't mean you of course you're the cut above. If i could prove a special need for a gun. And i tried that. I showed the threats on my life. Not good enough. They said later yet. Other people got permits big celebrities. Got so did the politically connected friends of the ruling class. That's who gets it everyone else. You're out of luck. I wasn't famous enough. But i probably would have gotten a permit if i bribed the cops. In the permit department turned out they were taking lavish gifts in exchange for gun permits. So we're so politically connected. Lawyers like this man and a man with police connections was caught offering cops as much as six thousand dollars to issue gun permits without doing background checks in other places a political contribution got people permits scams like that thrive whenever politicians past too many laws and wait. Why does such restrictions even exist. I thought the supreme court already ruled that. All americans have the right to have a gun. The high court voted five to four. That firearms are essential for self no matter where people live but many other courses thumb their nose supreme court ruling. I think there's an awful lot of people around the world that wish they had to feed them. We have in america and have a second amendment. Eight hundred thousand times. A year person uses a firearm to protect themselves. You call nine one one. They used to get there after the crime is over and fill out the paperwork and it's true in prisons felons have always told me what they feared most was not the police but a victim who might be. Are you going to rob somebody. You don't know it makes it harder because you know what the spec out of often just showing the pistol is enough to protect yourself. Just gone stops the crime from happening and yet compared to other countries there is gun crime here all sorts year compared to many other countries we have a lot of social economic cultural reasons. Yet there's also evidence that given america's culture allowing all people to carry guns reduces crime over the last decades most states switched from banning carrying guns to allowing it and as they did violent crime went down especially telling in each state. I didn't believe that until i started researching gun crime but now i think it's true. Old man was shot and injured as he entered a silla woman's house by force with an axe and threatened to kill her friday night. Alaska state trooper set the homeowner a fifty five year. Old woman shot the man with a pistol after he entered her home and made threats. According to troopers he was taken to a hospital where he underwent surgery for non life threatening injuries. That works. of course. You can only do that if you have a firearm available in. You know how to use your firearm. Today i'll be talking a little bit about. Spent a good bit of time yesterday with three of my friends at the range Private range we're able to go out. And do some drills had some fun shooting pistols different pistols. Everybody brought their own or a couple. And we tried different. Ones rights drills. And i'll pass along a few of the things we worked on such as do you actually need to look at anything other than the front side. Do you even need rear sights on your pistol. Well we tested it to see what would happen. We did the five shot drill that we talked about a week or so ago. And i'll give you a report on that as well as the other kind of fun things. This is the miller case challenging california's ban thirty two year old ban on so-called assault weapons. They were one of the first states to have this ban on assault. Weapons and judge benitez says. Now i don't think that's gonna fly. You're gonna take it from there. Yeah let me first say that will raise talking about this thirty two year old fan you have to remember. This band has been changed in incorporated with you. Know new amendments to it over the years macy defining virtually any semiautomatic rifle as as an assault weapon. And so this. It's it's changed as a whole lot the second time. It's been challenged challenged many years ago when it was first passed in the ninth circuit court of appeals ruled at the second amendment only apply to the federal government not to states and so therefore the law could stay that of course was before the second manifestation one of the us supreme court in the donald decision that incorporated the second amendment to the fourteenth amendment to bring back for challenge with the supreme court. Said that you know our gun light you know states kanter fringe on your gun rights either. Not just the federal government And so we just use case came back and of course we wanted at the trial court level Big time The judge made about phenomenal Decision in written opinion about it and of course the owners are going absolutely crazy Because he compared to speak in his opening remarks that you know like a swiss army knife at at a are fifteen you know basically has lots of different uses to it and so they were they crazy. 'cause he compared to a swiss army knife talking about trying to pretend that aren't is lethal than they are fifteen and the truth is a matter. Here is in california which you also put his decision. Which interesting is that there. I think it's seven times as many people killed homicides by knives by all rifles combined. Not just the air fifteen And so if they wanted to they want to argue that have probably as well. What's interesting about this case tom was. This is the first time really. We've got the trial with full facts and information. You know being on display with expert witnesses showing these guns aren't you know as lethal as opponents. Make him out to be And that in fact The good merits guns and there a millions have been speculation and california hadn't been started banning them thirty two years ago in california. It'd be millions more of them right now That would be able to people to purchase. I'm very excited about this ruling It's obviously a significant monumental court. Victory but to fight is not over. I mean i mean california's already noted in their appeal on it. Sure they're they're gonna they're gonna appeal it and the idea is i mean we all know. This thing is headed toward the supreme court. Whether or not the except there's another thing but this is a backup per second and talk about just benitez is also the judge who ruled that california's standard capacity magazine ban was constitutional.

"I won't go back to that for a second. Because in the heller decision two thousand eight the supreme court said you cannot ban guns which are in common use. The lower courts have perch pretty much just on their noses at that. And so what this says is we're going to establish that the ar fifteen in fact simi automatic rifles are in fact in common use therefore according to the decision which supreme court has already said. You can't ban them. It seems to me at this has the potential if it goes to the supreme court they say yes we agree. You can't ban these all these so called assault. Weapons bans evaporate as a result of this. That would that would be the idea. Yes exactly that You know none of them if you look at the reasoning and rationale in any of the other circuits Including the nine hundred so far upheld. These bans They've all found ways to kind of side stuff that and they just still down to their two part test they say intermediate scrutiny they apply intermediate scrutiny light and they say well the government's interests here is more you know more important and therefore it carries the day that they're they're banners reasonably tailored to to fit that and here you know again when we go back to what heller says Heller said that even though Certain handguns were still available. A ban on handgun was unacceptable. Just just because there were alternatives. Didn't make the ban on those few acceptable constitutional So you know again at the end of the day. That's what we're hoping to get out of all this once. We wanted to go on up and The way the ninth circuit's binge You know there there have been some okay panel decision recently now beyond is going to be the real question at that and then where we go from there well clearly no matter what happened is going to the supreme court or at least it's we're going to seek have the court except this. I do love this line. Judge benitez in ruling that the california assault weapons ban is unconstitutional. He says under. No level of heightened scrutiny. Candle law survived that just kind of like a slam dunk. Bam don't even talk to me about this anymore correcting in you know. As as we've talked about the tiers of scrutiny on your show before but if it can't survive intermediate scrutiny certainly can't survive strict scrutiny and the supreme court said rational basis which is the lowest can't even be applied to gun stuff that we would argue. That hell is just categorical. Band precludes the other two and and that's what we should just look at it as so well. This is huge. I mean this is. I don't think we can overstate the importance of this decision. And this case. But also going back and i was talking with a allan gotlieb secondhand foundation. I know you guys work together. on this. And other cases there is a strategy in force here in terms of moving a number of cases to the supreme court with the idea of getting them to rule. Yes you can't ban these guns just because you like the idea. Correct me if we do. We have Set forth a long term strategic litigation. Playing that we've gotten a great majority of those cases filed over the last two years we're working on the next round of. Don't actually go in and make a difference with more strategic litigation and we really like to get some of these to the supreme court while it still has its current makeup yes And certainly as we've talked about you know again in the past you know the addition of justice barrett and her view on things that certainly would seemingly be another favorable vote on second amendment issues.
