The top stories we're following for you tonight, top officials are starting to assess whether CIA intelligence was compromised as they review that material seized from former president Donald Trump's Mar-a-Lago resort. The Justice Department believes some of those documents include some of America's most closely held secrets this comes as a federal judge is indicating she is open to appointing what's called a special master, a neutral party to examine those materials. There are signs it may be too late as we're learning investigators have already gone through the material. CBS News is Robert Costa with more. FBI investigators and agents reviewing the evidence gathered at former president Trump's estate say they found a limited number of documents that could be covered by attorney client privilege and sources close to the Trump legal team say that could bolster their push for an outside attorney or special master to be appointed to review the material, but the Florida federal judge overseeing the matter Eileen cannon a Trump appointee could also conclude that it is now unnecessary. A hearing on this matter is set for Thursday. A Republican U.S. senator is issuing a warning involving the possible prosecution of former president Trump over storage of classified documents at his Florida home. Here's WTO's Mitchell Miller on Capitol Hill. There's those double standard when it comes to Trump. South Carolina senator Lindsey Graham, an ally of the former president, speaking on Fox. If they try to prosecute president Trump for mishandling classified information after Hillary Clinton set up a server in her basement, they literally will be rights industry. The Justice Department, meanwhile, says an illegal brief that materials from mister Trump's home have been reviewed, and it's found that some of the documents may include information protected by attorney client privilege. New tonight, a top FBI agent accused of political bias for the way an investigation into Hunter Biden's business ties was handled has now resigned from the agency. Two U.S. officials confirmed to CBS News that Timothy Tebow resigned and was walked out of the FBI late last week. Tebow reached retirement age and retired according to these officials, Tebow was recently removed from his position as assistant special agent in charge at the large Washington field office of the FBI. He was working out of FBI headquarters, Tebow came under criticism earlier in the year from Republican senator chuck grassley, who accused him of improper conduct in the Hunter Biden investigation, grassley accused him specifically of trying to close the investigation. FBI director Chris wray was asked about Tebow at a hearing earlier this month on Capitol Hill. He said accusations that Tebow liked social media posts that were critical of former president Trump's associates was troubling. There is no comment on this situation from the FBI so far. Expect a prime time speech from President Biden this week on what The White House calls a battle for democracy. The White House has announced president Joe Biden will deliver a prime time address on what is termed the continued battle for the soul of the nation Thursday night from outside independence hall in Philadelphia. Billed as a major address, Biden's remarks will come just over two months ahead of the midterm elections. The White House says Biden will discuss how the nation's standing in the world and its democracy are at stake. Biden has been framing the November elections as a choice between ultra maga Republicans and Democrats. He told supporters last week they have to vote to save democracy once again. Mike Gracia, Washington. A few students at suitland high school two of them were arrested today for bringing loaded handguns to their first day of the school year. Prince George's county sheriff's deputies arrived at the school this morning to arrest a student on a carjacking incident from June when they found that student deputy say he had a gun on him. Later, a parent told the school about another student who brought a loaded gun in his backpack, the 16 and 18 year old students were both arrested in a statement suitland high school administrators say safety is their highest priority and any student found in possession of a weapon will face disciplinary action and could be expelled from school. Big news in the Maryland governor's race on the Republican side, WTO's Kate Ryan has been watching the results, Kate joins us now live what's the story there? That's right, as you well, the big story is the wind Bond, the GOP side from Dan Cox with 56% of the vote he was declared the winner by AP and NBC. He is the far right candidate in that race Kelly Schultz at 40% was handpicked by governor Larry Hogan outgoing governor Larry Hogan. This is a pretty big surprise here There were some who warned that a lot of Republican establishment folks were taking this for granted that just because Schultz had Hogan's blessing that she would be able to coast to victory. She did leave her party without conceding, but again, Dan Cox had convincing gap there for her to have to overcome. He's got 56% of the vote. Over on the democratic side westmore leading 36% of the vote to Tom Perez at 27%, the comptroller Peter Franco, not conceding at 20%. He insists that there may be enough mail in ballots to put him up and overcome that gap. And then in the county executive race, again a squeaker between David Blair, a local businessman 39% of the vote, Mark L rich with 38% of the vote, el rich, hoping to keep his seat. And again, we have a lot of mail in ballots yet to be counted Thursday morning. Thanks so much, Kate. You got it. All right. And we move along to the race for attorney general. Anthony Brown jumped to an early lead over Katie O'Malley in the democratic primary there. With accounting of early in person voting in early results of election day voting, Anthony Brown held a steady lead over Katie O'Malley in their bid to become the state's chief legal officer. With votes still to be counted, Brown was pacing O'Malley with 61% to O'Malley's 39%. In prince George's county, Angela also broke swept to victory. The Associated Press projected her the easy winner over her four challengers with more than 90% of the vote. And now with more on the various races across Maryland, we go back to WTO's Nick ianelli, he's live at the election desk. Yes, Michelle, we're watching primaries for races in all 8 of Maryland's U.S. House seats. And we do have some winners tonight, which have locked in general election matchups. In Maryland's 6th congressional district which includes Frederick county and a part of Montgomery county. It's one of the most competitive races statewide. Congressman David trone won the democratic primary. Neil parrot won the Republican primary so it's going to be those two facing off in November. In the 5th district, which includes parts of Anna rudel and prince George's counties, congressman steny Hoyer won the democratic primary. Chris palumbi won the Republican primary so they will face each other in November. In the first district along the eastern shore, Heather mazur won the democratic primary, she's going to face Republican congressman Andy Harris, who ran unopposed on the Republican side, and we should mention that U.S. senator Chris van hollen won the democratic primary tonight. There are ten Republicans still battling in a crowded, very competitive primary for the chance to face van hollen in November, no decision in that Republican primary yet.
