"Not a boy Scout. I was in the Albany County Public defender's office in the early 19 eighties. Representing May I say the worst of the worst who couldn't have money to hire an attorney, so they had a public defender, and by the way, the public defender's often were better than the private defense bar. Some of the individuals in that office Were wonderful, like like, Darling, came mine and Pete Rosenwald and Jason and Disney and so many other great lawyers, including myself, came out of that bread. Goodson Ever find lawyers. I was often told By individuals that I represented that there was a lot of street justice going on with CPD this going back What 40 years ago before Jack Crumley was born? And it was not unusual to your story after story. Of individuals arrested by police that had the crap beat out of them by the cops in Cincinnati in the back of a police car. It was unusual, but I heard the story repeatedly. And nobody ever broke the blue wall of silence to stop it. Here. We are 40 years later. There's been a metamorphosis and policing. Is no longer let's take him out back and get money. Give him what he has coming. No. Police now are reticent there more professional. They're better trained. They understand the consequences. They're not going to sacrifice their life for anyone. Most of the time. You simply want to go home and be safe and come back to work the next day. So when you talk about Rodney King 30 years ago? Yes, I think some of that did exist, especially in Big City departments like l A P D had a terrible reputation for beating, beating people up. In today's world, It is rare. It is uncertain. I mean, the idea that a cop would do this, and actually, no one would testify against him. That's why what happened to George Floyd is even more troubling. When those three other officers were there on the scene and other than one cop saying, show me rolling on its side stand out in broad daylight being recorded on video is unusual. That is not Systematic. Derek chosen is going to spend the rest of his life in prison for doing that, and likely the other three cops should also That is not what is regularly occurring on the mean streets of Cincinnati or Covington or dating or Columbus or Chicago. That is not going on. Other examples of it absolutely, and involves to pray, human misbehavior But cops 99.9% of the time today. Do a great job in the millions of positive deeds of cops really aren't news at all. "When, when, when will the coronavirus lockdown restrictions cease I don't know. It seems like there's no end in sight. Unfortunately, it's like a spike. It's a re pop up of them. Uh, return of the lockdowns. You're listening to Saturday night on the circle on 93. W I b. C. I'm your host, Ethan Hatcher and I'm joined as always, by Dr David, professor of political science at the University of Indianapolis. And Dr Ruth, My question to you. Is. How long can temporary emergency powers be extended to make sweeping district Cockney in limitations on basic American freedoms? Like we're eight months into this thing and show the court say that can I? I want to start seeing some legislative input on this thing. Where the state legislatures Why Why is it all the governors why it was the governor's doing? The governors are charged by most state laws. Give governors Thies emergency, um Emergency powers because the governor is a single handed decision maker. You don't have to go through 100 people in the house and 50 people in the Senate, which would be like Indiana the governor Excuse me. The governor can make quick decisions. It's called Dispatch. And so that's why they have the ultimately to stop these things. You're gonna have to go to court. What's gonna do? Dr Root? I watched the Star Wars prequel trilogy. I saw Senator Palpatine be confirmed and granted emergency powers by the The republic, remember? And then he became chancellor and the whole the whole nine yards, so we should not be recreating Emperor Palpatine across the United States. I don't think we're quite doing that. I mean, Hollywood, Hollywood and storytelling in fiction. I know I'm being you know, a little bit hyperbolic for the sake of humor, but nevertheless, Dr Root on a go Okay here. I want to go to govern Gavin Newsom. He is ordering now people to stay at home. Starting today, from 10 to 5 A.m. mandatory curfew across most of 41 out of California's 58 counties, which is 38 million people in 94% of the state's population, so Well, everybody pretty much it is. But I think what you are noticing too. Even with these newly popping up restrictions, they're not nearly as coercive as they were back in the spring. I think a lot of political leaders have learned that the people don't like full shutdowns. And so they're doing everything they're doing everything they can. To try to contain the virus without completely shutting down. Some of them are quite course of the restrictions in Pennsylvania are attached with potential jail sentences. Well, no, no, I mean, we're going with them courses in terms of wide wide spread, like shutting everything down, but getting back to California. They've had amassed mandate since June. I thought the masked man dates were supposed to work, doctor, and that's a bunch of erudite liberals out in the left coast. So what gives their all supposedly wearing their masters in Washington? Hands of being responsible and bathing in hand sanitizer? So what? Going on. I honestly don't think the masts make a lick of difference. What? Well, the science disagrees. The science disagrees with itself. I mean, come on. Oh, and another thing to point out the Newsome order in California. Tesla to the car company By Elon Musk. He was granted an exception from this. His factory was so that these people can still go to work like normal. And this goes all the way back to the spring when there was this tussle between Alameda County health officials and musk and basically must got the governor to Hair into the Ala. Maybe Albany County health officials because Governor Newsome's like, Look, we're friends, and he's worth a lot of money to our state. So must jump ship. Aren't they Transfer Texas? Possibly, But that's with the new plan. I don't think he's thinking. I think he's going to leave his existing plant in California, and he's been talking about putting his new one in most likely Texas. Here's the other thing about these restrictions, doctor, and that's what really gets under my skin because it's a a story that's repeated in many cases by many different representatives across the country. I'm returning to California, where Governor Gallant Gavin Newsom violated his own State Cove in 19 guidelines. He went to a birthday party with more than three households in attendance. Worlds for thee, but not for me, right? Thank you. I mean, we've repeated that that mantra many times on this program, and it's just becoming a sickening repetition on a theme, The Chronicle reported. The news. Some of his wife, Jennifer Sybil Newsome, attended longtime advisor Jason Kenny's 50th birthday party at the French Laundry in Yonville, Napa County. On November 6th where there were more than three house three households in attendance and over 12 guests, so you know violate In a couple different regulations there in the state of California. They if they don't take it seriously, Why should the citizenry be expected to know exactly? We live in a society that has governed by the rule of law? It's not governed by the rule of people. And when the rulers can't follow their own rules, then frankly, the citizens shouldn't either. Newsome called it a bad mistake. Now you're speaking of coercive measures that other states are taking. The Pennsylvania secretary of Health issued an order requiring anyone who visits from another state to have a negative cove in 19 test 72 hours prior to entering the Commonwealth of Pennsylvania if someone can't get a test that was quarantined for 14 days upon arrival, Pennsylvanians visiting other states are required to have a negative test within 72 hours prior to returning or quarantining for 14 days days after their return, But it doesn't apply to people who are going to in front. Another state to work or medical treatment again. Dr Root, this is capricious and doesn't make a whole lot of sense because you've got to imagine there would be a fairly substantial number of people crossing state board boundaries to get either medical treatment or go to work. There's a lot of people who live on borders, you understand, and if they're able to cross the border, how does that prevent the spread of covert 19? Sicily think they're just trying to minimize it? And given this order? I'm glad I got to go visit my uncle back in September before all this Liberation lunacy was needs to be challenged in the courts. I I think you know, you made reference to the fact that this is where it needs to be settled. But my goodness, Dr Root Americans need to stop stairs to our start. Stop tolerating this nonsense and start Fighting back, Um At this point. I think most people are just waiting for the vaccine well, but flip flopping, Fauci said. The lockdowns are going to end after the vaccines introduced. They're going to keep this power in perpetuity, which is why you have to start the resistance now, and at least some people are putting up with the nonsense in Oregon in defiance of governor tape Braun's orders one of clack among help me help me pronounce Miss Clack. S. where in just two months thirty three million people found themselves unemployed most states have decided to ease up on stayed home recommendations in Georgia governor Brian kept made the announcement at the end of April the state would begin opening hair salons tattoo parlors and other businesses while restaurants theaters and other places can operate with drastically different rules across much of the state though there hasn't been a clamoring to get back people there are wary too for that let's turn to Michelle right reporter with our affiliate WSB in Atlanta your governor Brian camp was one of the first to say let's open back up again I want to get some response from the people there in Georgia when he said that what did you guys think you know what he said it was it was really shocking because our shelter in place order that he had put in place on the third of April was set to expire on the thirtieth of April and so he came out and said well you know what on the twenty fourth we're going to kind of open some businesses up and among those are gonna be hairstylists barbers massage parlors at two shops and bowling alleys and still a lot of people were questioning is this the right time to open up those type of businesses and then he opened up dining restaurant to movie theaters I can honestly say I don't know many people who have gone to the movies everybody that I've talked to is is not trying to to go to the movies as far as restaurants concern there are still a lot of restaurants that are only doing take out because there are like at least thirty nine requirements that they have to make sure are in place for those restaurants can open up and serve customers so what about the the the cases themselves in the state of Georgia since this re opening we have seen the numbers go back up which is what a lot of people have predicted might happen exactly and they continue to increase in fact there's a story I was doing on Thursday morning about eight nursing homes in the city of Atlanta that has a hundred cases right there in that nursing home and took everything continues to climb and so there it's interesting there's a group of people who are out and about like nothing ever happened I think they were just super happy to get out and then there's another group of people who are still like I'm not going anywhere I am going to remain sheltered in place until things start to drop what about the the the rural population African American population there in Georgia we have been hearing a lot about Terrell county I think it is where cases are very high and the health care system there is this whole counties that don't even have a hospital or even you know a lot of doctors offices nearby so tell us about the situation for some of those folks in state of Georgia yeah it's really quite challenging because we do have a lot of small counties a lot of rural counties especially in central and south Georgia and one of the county's early on that got hit with Albany County where they had a or Albany which is in south Georgia that's the city there and they had a super spreader who had gone to a couple funerals and they were over run with aces now we're moving more up in the hot spot in north Georgia up in the Gainesville population and we do have populations both of African Americans and Latinos that have been extremely heavily yet and heavily affected by this virus the Fulton County health department which is then not Atlanta the you know the state capitol resides in Fulton County into what Fulton County is doing is they're starting to open up some neighborhood testing sites to hit the African American population populations that don't necessarily have vehicles that can get to some of the suburban testing sites and mass transit you know hasn't really been running to effectively so they haven't been able to get out and get the test done so we're probably going to see another in crease in in testing and in confirmed cases we do have a lot of meat packing facilities in Georgia as well checking capital of the nation at least and so there are a lot of concerns that in those meat packing areas there's going to be an increase in what that looks like even as people are trying to get back to work what it looks like as we increase testing and we have more cases and is it because we're having more cases because we're having more testing or is it the spread is really spreading more and we're putting ourselves more risk and that's what a lot of people are wondering in

"And weather station. Ally. Troy attorney Joseph for her no one of his clients. His goes mayor Sean Morrison, Chris, Dan Levy who broke the story late last week. He uncovered what is reported to be an Email from Brenda Morris, the estranged wife of Sean Morris, and she says all these allegations of domestic abuse. She just made up. I don't believe it. I believe he he made it, right? That Email and told her what to write I'll tell you. I believe that. If you go back into September. There was a story in the times union that included voice recordings of him calling her and telling her we fix this problem. We have a nightmare to deal with how am I going to pay you a thousand dollars a month in terms of child support and whatnot? If they split up if I don't have a job if I don't have if I don't if I don't make any money. In other words, don't lose my job because you're alleging abuse, how am I supposed to pay child support a divorce proceedings? And then he goes on to say, you know, you have to retract everything. And then there were some tech. Messages that Brenda sent to Albany county controller Mike Connors that when she told investigators that he sat next to her and told her what to write in order to help save his political career. She told state police that back in September. So why are we to believe this situation is any different now, he's got a legal mess on his hand it related to mishandling of campaign funds. Right. Yeah. So why not have her say, okay? I made that whole thing up. So let's let's let's move on from that. So the this this Email she says that after undergoing several knee surgery, she got hooked on pain pills. She believes that was the beginning of a downward spiral for her. She was afraid she was going to lose custody. And that's why she brought up these allegations. This is the the Moore's attorney again the Joseph earned, hopefully as part of a recovery making things of that nature. I don't that's where she's at. I don't even know Bernie. She says at the time my mind was not mine, and in a very strange way, I believe the for made these allegations he would not be able to take our daughter away. My husband never laid a hand on me. Never. And then there was a long, and, you know, flowery explanation of why he's a great guy in this Email because he played Santa they left out the Santa part, which again, I may personally, I'm not buying it. I'm not buying it. Because of the previous incidents that she had reported that he told her to walk back. He told her to lie he told her to change her story in order to help save is political career now that he's got another legal mess on his hands regarding charges and mishandling of campaign funds. I do not doubt for one second in my mind that he told her to send that Email and and retract everything she said, I never I don't know what to believe anymore in this case, there's still a lot of other smoke elsewhere, including the incident that John McDonald's had happened in his drugstore way back when were you leisurely Morrison dragged away? Out by the hair, but a Hearn the attorney says, he forwarded Brindamour says emailed a police after he got it at the end of January. That's apparently what did their investigation now. Obviously from the cop's point of view if she's going to retract the statement. And then not testified that he abused her. What's the point of them bringing charges? Anyway, if you got no witness, right? Here's my only other question, if this is in fact from her, and this is in fact, the truth should she not be charged with filing a false or police report or something they've wasted. A lot of man hours investigating. Absolutely. So this made me a little bit happy Joe per cocoa. "Thank you Mike talking Kelly with three separate in for Chuck again today. All right before we get to Joel able of can we just talk about this issue with the Albany county legislature position that's open and Kahane's because Ralph Cigna rachi left the Albany county legislature seat that he had to go work for Albany county controllers office. So now they've got to replace that spot. The issue here is that there is a committee to appoint someone and usually made by the democratic committee or the Republican committee in this particular case, the host democratic committee is made up almost entirely a Sean says, family and friends father, uncle other other relatives firemen who knew him. No work for him since he's the boss. Exactly. I mean, can they can we do away with the cronyism here? We'll just get worse. You know, it's again, it's hard to say. There's a, you know, his Morse's. Key critic a economic basically saying why the legislature would defer to a committee that has this many more and a neutral committee people who don't have all these personal ties to the mayor and go about it that way. Ralston Karachi and. Sean Morris are both being investigated by the FBI for the handling of campaign funds related to Morris election campaign. And and we can't forget that Sean wars is also being investigated for is domestic violence against women wife or wife girlfriend daughter number people have asked him to resign including Andrew Cuomo. So this is quite a scandalous administration here and now as bleeding into the Albany county legislature. Again, it's a it would seem as if something something else could be in place. To to name a replacement for Cigna rachi, I don't, you know, would they named Sean Morris to the legislature? No, I don't think that's what we're talking about here. But I think I I it's just there's just something quite not right about it. It's all right. So they should empanel a neutral board to handle that Joe label. Love is no longer. The Rensselaer county district attorney, however, his legacy lives on. There was another murder charge dismissed for the third time in the same case. There's a double homicide that happened October of two thousand sixteen and there were four Mexican nationals. Who were accused of these these two murders three of the four have been thrown out and the fourth was deported. But there is one that is one opportunity to make this right here. The last one was thrown out on the twenty first, but they're given forty five days now to represent the case. Now, there is a new D A and that. Office Mary Pat Donnelly has taken over from Joe label of voters in that area voted him out. So hopefully, she can get everything accomplished. Your that Abe loves situation was not able to do it's a little complicated from a legal perspective. But it pretty much boils down to one. Key. Fact, they dropped the ball. They drop the ball and a prosecution has to prove its case to the jury beyond a reasonable doubt. And that's not what and that isn't what has happened to this point not only that is that they the evidence that was presented was never backed up. I mean, there was DNA evidence. That would this one guy there was witness testimony that will tie another guy. They're all of these things that they just didn't do and is now been two years. And so these people have a right to a speedy trial. But because they kept missing deadline at the deadline. And then they dropped the ball repeatedly. It looks like all these could walk. And by the way, he's our four Mexican nationals in what was choice saying about becoming sanctuary city. I just thought I throw. Oh that out.
