"Just was there for the conference. Mainly so if you have questions for us p would love for you to come over to our discord at better podcasting dot com slash discord. We'd love to have you come and ask him those questions there. You can also tweet him at better pod if you'd like to tweet better pot or at stargate pioneer on twitter and also if you want you can just come asking the question at Podcast movement twenty twenty two when you see him there when you see him there. Yeah i'll okay. I'll come into this if you go to podcast movement. Twenty twenty two. stephen. I will go to podcast movement. Twenty twenty two. Thank you very much for listening to that to replay of what i talked about over on the better. Podcasting live chat stream last week. I do have a few comments after listening to the whole thing. First of all at the beginning. I said that. I would go into the goals where there i hit or miss them and i didn't do that at the end of everything so i'm going to do that right now. Avoid it that was. That was a hit. I'd managed to avoid covert. And how do i know this is. Because i went back when i got back i got tested and it was negative so yes that was a hit it was a little bit unnerving in covert with the delta variant. Right now in the fall of or late summer of two thousand twenty one. It is impacting my area here and is impacting the nashville area. So that wasn't assure thing to avoid gobert so that was very important. Have fun that was a hit right there. I definitely had fun. I saw people. I wouldn't have. It's a fun area to be in and it was a fun conference area. I been conferences before and conference centers. None of them compared to what opera land conference center was like it was a unique experience. It was only two thousand people. I think if it was bigger like if it was san diego comic con size big. It wouldn't have been able to hold all there would have been a lot more congestion even without covert. I don't think it would have been very comfortable for the size of what the conference was. Opera land was a very accommodating. Venue for it. So yeah. I had a lot of fun there Experience a podcast industry conference. I've been to conferences before. I've been to trade shows before not with the podcasts industry. So i'm gonna call this a may didn't really hit. It wasn't necessarily a mess but it was is like al. Que did i okay. This is a podcast industry conference and it's not a fan conference. It is an industry conference. I'm not an industry person. I'm a hobby podcast. Her we podcast about hobby podcasting. It just was not a good mesh as much as the conference organizers have been touting to me over the years that it would be a good good hit go good mesh back and forth it it it just was. I don't think they get hobby podcasting and where we're coming from so you. It just was a miss their learn new and innovative podcasting tips and capabilities. I'm gonna call this amiss. I'm going to call him miss because of been passing by guessing for six years. I heard the same messages over and over mere fact in reviewing several the presentations. They were copies of presentations. That were given in years before. So i really didn't learn anything new The i did talk about hyndberg in a guy at a demonstration of that. But i just the whole thing if i was taking the whole experience together. I'm gonna call this amidst because not necessarily anything that it could have gotten right here from my studio here at home. The next goal that i had going in was find. Anything of use for a hobby pied caster again caller amiss. That's very similar to the previous one. There's not as many things that i thought there might be going into it. I'm just going to call that amiss. Maybe math but definitely a were amiss. There spent on sometimes with france. I'm going to call that a hit. Hey i didn't spend much time with amos or anybody else. That i ran into but i did get to spend time with podcasting friends that a wooden have seen anywhere else in if you go to the conference just to meet up with people that you know from cross country and around the world although this wasn't the year for around the world because kovic and travel restrictions but if you wanna go somewhere to meet up with people that you know of from australia or or different states or different provinces if you're up in canada or whatever that was it was a hidden it was a head. It was is a big part of the convention that i thought. But if that's your only reason you can travel to their cities and have a one on one conversation and and have a one on one time with them in their cities or they come to you. Whatever so yeah conferences. A neutral ground. But it's not necessarily something that has to happen. It's not mandatory k. A. experience a large industry podcast conferences in average hobby. Podcast was the next goal nets. May i run that into ground with two previous goals in the last one was get motivated re-energized and refreshed again. I'm going to call that a mess. I'm going to call it a mess. Because i didn't feel that coming out of it. I felt that coming out of other conventions and trade shows or other business meetings that have had in the past or fun vacations in the past. This did not have the same appeal to me for all the reasons gave. Okay that was the hit or miss from the goals. Let's talk about some clarifications from the presentation. The first one. I wanna go into was the pay to play clarification. I mentioned that. The conference probably paid for some keynote speakers to come in ranted. I meant with that as well that there was probably some industry people that paid to be able to present at the conference. I have no none a proof of that whatsoever. I do have to clarify that. But it just felt to me like people like mark. Cuban for instance was paying so that he could do his infomercial as keynote to podcasts movement. And if that didn't happen it still was rotten 'gate-keeping by the the conference and who has ever running that track and everything and and i feel for him. Because if i was putting their shoes i will might have been snowed over as well depending on how that whole thing works. I have not submitted to present at podcast movement. And i mentioned that in the presentation because i just there's not audience for hobby guessing. I don't think there's much that i would be able to give to the attendees there. I would wanna talk to industry to say. Hey look you need to keep in mind hobby podcasters as you develop your capabilities in Your pricing structure and stuff like that. But i don't think they would come to the presentation. Some anyway in the california law that i was referring to by the way is the california consumer privacy act or cpa very similar to the europe's gdp are so just want to clarify that. I mentioned that. I had a question about some of the things that tom webster presented in his keynote on wednesday morning and predominantly there. Were other things. But the big thing that i remember was i have a question about how he used. The definition of what a youtube podcast is. I would love to get his definition of that in context with the data that he showed with his presentation. There is a few other things but that was the big thing in. There really didn't change the motivational part or the tips and tricks of his presentation. But it was part of the data to get there and.

"What's the hell's going on room. Two thirty two. Oh my would be. It would be we would have. We would schedule something at nine o'clock nine to ten nine to ten. Thirty say are nine nine to eleven. The the next redhead will come at ten thirty so they would always overlap each other right which makes for a very exhausting day. My god i cannot imagine now today. It's a lot of lot of coffee. Yes allison has this rainbow. Look going on which is pretty fabulous. And then she has this amazing juxtaposition. it's almost like carrie. And what is she holding here. A microphone uses composer playwright and performer. it's all in the photo and she loves Lady gaga and she had a bunch of lady gaga outfits. And let's let's try to incorporate that in into into the shoot and she brought on a hair makeup person that she guide she knows very very well one of one of her best friends own And jessie yes. Yes just yes and So he came up and he did. He did all the makeup so he did all of the little musical notes. That just running down. Her face did a lot of you know. Bring a microphone. Pretend like you're seeing the microphone. Just kind of have fun with it. And now beth is going through it like beth has a lot of. I mean this looks like honestly bets. If you if you put a time code to them. I feel like this is the morning with the laptop and the tech all eating her alive and then instagram. That's her lunch break. And then this is five o'clock with the she's his point she she's she's great she's she's she would call us off the character and she and she is lava but she is a film editor. And and that's the al que. She works for or used to work for a company. And i think she does freelance stuff. Now i believe that's the if i got that wrong beth but so she's really into social media so she had one of her and this is where we get back to when you have a prop if you can have someone makes something that's looked at it. Looks really good so she had to the prop department in where she is the work that sign. That looked like an instagram. So she was. She's inside. She is the instagram page. Right right right. I'm an them with the editing. You're all the tape all over the place and yes is old and you don't work with tape anymore but just the tape wrapped around her and just craziness of heads rule. All that's cool and then this is her after work. Obviously when she she is how love whisky and things like that. So that's fantastic. That's fantastic how. This reminds me the hair wrapping around..

"Three b. thomas six bar exam. Hey if you only started listening you know about two weeks ago. This is the segment in which i perfectly nail everything we've done about two hundred something of these. You know where exactly you need to go back. And check to see if i can keep this improbable street. Going are thomas an entrepreneur from state a decided to sell hot sauce to the public. Labeling it best cops already love this. A company incorporated in state b and headquartered in e sued the entrepreneur in federal court in state. See the complaint sought fifty thousand dollars in damages and alleged that the entrepreneurs use of the name best hot sauce infringed on the company's federal trademark the entrepreneur filed an answer denying the allegations and the parties began discovery. Six months later the entrepreneur moved to dismiss for lack of subject matter jurisdiction. Should the court grant the entrepreneurs god. Okay i'm not getting this. Hey no because the companies claim arises under federal law be no because the entrepreneur waive the right to challenge subject matter jurisdiction by not raising the issue initially by motion or in the answer. Oh my gosh see yes. Because although the claim arises under federal law the amount in controversy is not satisfied or d. yes because although there is diversity. The amount in controversy is not satisfied. You know. I will note andrew while we absolutely as my failing test score historically has shown we have all the integrity in the world and this game. I will note to the listeners. I do edit out a certain amount of me silently trying to figure out what in the world. This question is even saying so. You know peek behind the curtain so there is so much going on. I think. I think i understand some of it. So here's the thing. This is the typical. We've had a lot of questions and they've been difficult. And i think i've gotten some of them right but most of them wrong when it comes to like this diversity jurisdiction yada yada yada. Here's what we have. We've got state a and i think this is all pointless. I don't think. I think this is all attractive. Destructors because you got stay selling the hot sauce. State be headquartered in state see. They're trying to throw you off with al que. The be the sea. And then the if i remember right it's seventy five thousand and damages and we have a fifty thousand damages thing. I think that's all to trick. Pass thomas who would have gotten it wrong. I think i mean. I'm i'm aided by the fact that the question. The answer is helped me out here. But i think that that doesn't matter because it's a federal thing. They've infringed on the company's federal trademark. I think all the you know diversity in the seventy five thousand dollars. I think that would all matter if it was a state thing. Like if you were suing under state as laws for state be and state see blah blah blah. I think that because it's a federal thing you're just in federal court and all that other stuff doesn't matter i think and then it adds in another wrinkle which is well. They moved on with the thing. They filed an answer denying the allegations and they began discovery but then six months later the entrepreneur tries to move to dismiss for lack of subject matter jurisdiction. And that's another attractive distracter. Because i think that would be true. I think if you didn't do that right away. I could imagine. I'm not sure about this. But i could imagine six months later. You try to dismiss and they're like well hold on. We've already started the thing like you got to do that before we start. All the things is what i think. So let's see. Let's see where this leads. So the entrepreneur who used best hot sauce blah blah blah moves to dismiss for lack of subject managers diction so a no because the companies claim arises under federal law. That's what i actually think it is. I think it's just that but let's see if there's if i'm wrong. Maybe there's another answer that's better be no because the entrepreneur waive the right to challenge subject matter jurisdiction by not raising the issue initially by motion or in the answer. Now could this be thing where that's the closer answer like that answer happens i you know i don't i don't think so. I think i'm still leaning toward a over. B c yes because although the claim arises under federal law. The amount and controversies not satisfied. Now that's a real attractive distracter. But i don't think that's how it works. I think that. I think god i help. I'm right about this. I think if you're in federal thing a year in federal thing i because otherwise it would be like you are allowed to screw someone over federally as long as the amount is seventy four thousand nine hundred ninety nine dollars you can screw someone out of seventy four thousand nine hundred ninety nine dollars and you're good. I think that's not right. I think the amount in controversy matters when you've got the diversity jurisdiction and you're trying to get into federal court but it's a state law matter. I think gosh. I hope that's right. I think that's right. So i'm gonna go nazi although see maybe like the now. I don't even think sees the second. Best d. yes because although there's diversity. The amount in controversy is not satisfied. Oh that's like the same answer. I would say d is this. I almost think b is the second best answer. I'm almost fully on the no territory. "So the mets down. Three nothing in the seventh last night. They got absolutely nothing. Cook and against charlie morton and the braves james mccann at the plate who had basically been swinging curve balls in another zip code all night but it takes just one mistake to change the course of the game two canucks a high fly ball deep toward left centerfield back goes the radio. Here's the wall and it has gone. Overrun james mccann tied the game. Charlie moore left or right over the center of the plate head mechanic. Crushed wayne randazzo. Wcbs eight eighty final. Pitch of the night for morton later that eating francisco oakland door would knock in the go ahead run with an rbi single and the bullpen. That's right was all they call him mr clutch. So that's two of the new guys. Mccann and door coming up big diaz gets another save. The whole pen was tremendous last night. Luke smith It was groggy. As i said. Got the s. eighteen. now. He's he's got more than enough money just to be hanging out for your question is what what is it going to come back looking like. Nobody looks like right now. Hopefully he's working out. And he's staying in shape yeah four three the final here's mccain. Who did have the last laugh against moore issues reaching his pitch count and his limit but and you got credited. Those two guys that led off the inning with Force him to make good pitches and you know he made a mistake. And i was just one of those able to cash in that was dom smith and kevin pillar got on base ahead of empowered took a borderline pitch for ball four and the home plate empire horrendous. Wease especially against the kundu gary cohn goes. Oh come on. I look i look back on the box in that second cooney at bat where he walked legitimately miss to like obvious. I agree half the at bat. And they kept referring to course in there and he had. The shutout going into ozzy always took him deep for three run. Shot in the fifth a lot to like about this big powerful young right-hander but mccain says it's his mental makeup. That is the key no panic. There's no stressing on his. Thank you karen your next news coming up soon these self-loading morning show is jammed. His diener a bill now because she's there. It's impossible not to answer policy questions. they've been. Give the press credit on this one. They've been trying to peg down to policy. What about romania mexico. What worked what changed now. Because you've been you physically been there. The image says you have to answer questions. Now al que but if she standing in front of a sterile quote quote staged scene and everything looks great. She was just gonna say see. These are working. You watch tie it. It's going to have to ask her about the policies that got rid of i. I agree and she'll just glaze over it just like she said she went to the border. We've been there. I've been there. I didn't go to europe either. You know it all makes sense now. Why trump didn't do it like immediately goiter tomorrow. He gave it three weeks to force their hand. Which worked net happened and boy did he take credit right away in these. Save america letterhead. It's like he added. He had it in drafts. Ready to go. He was weight and basically said to summarize because of she's finally going to the border now he can sit back though right see their play he his trip is the one that's going to be memorialized. People remember that one and it'll be it'll be something of action. It'll be a groundbreaking. It'll be with greg abbott. The texas wall private right built. Something will happen or if or if he goes to another facility that they didn't clean apple. Say what happened that it was fine. I can't say it's fine when your own border security people are saying. They've already apprehended. Since the beginning of the year a million and a half people go. How many people that is. Wow russian across that how many people from different countries are coming here and those are the ones they catch. What a nightmare. Yeah the system they have in in. I don't know who put that in. But that heat seeking those drones that they send up they can spot these people rushing across the border from miles before they even even get there so they know where they're coming in from and they just sit and wait for him exactly. But then you got these horrible coyote people and they stash when if they get him across the border they stash him in these like. They're they're called holding how homes and they're like shacks and they put you know fifty people in a place that fits ten people and it's one hundred and twenty degrees out in the middle of the desert sir. How many of them survive that. It's just it's terrible scene it's awful. It's not good idea as far as you know in international story one of the cruelest things we've ever done is is have those two campaign saying we're open again. Come iraq did yeah. It was an open invitation. That was so cruel in how many of these people don't make it that you don't hear about that. Of course not you know. Unfortunately and then what do they do at these kids you know. They're in country without their parents. Sticking him in a foster home okay. That's great for how long i don't even carry. If as long as they fix the situation go back to remain in. Mexico policy tightened up the border again. I let him take credit..

Well it should be. I think an is on. There are okay probably because several different out there. So round twelve s vs ain't no man versus escaped softest place on earth and i think the reason why they gave it to escape and i think yeah mine did too is because people probably are not familiar with eight. Noman doesn't south because one the only claim bits. I'm not right. It's from twenty is from their twenty twelve to twenty sixteen. Al que says is a whole their two last albums are really good. So i think it's on the strength of people didn't really know the song but stopped displays will nerve. I'm sorry it's about. Bobby bop uppity okay. Round thirteen estimate s. wbz's usual hud. Yeah i was like when i think about you. I don't think about. I forgot i did. I remember from the video. But when i think about the song i think about forty and t pain candy. She doesn't distract from the songsheet and take away from us own right. But i don't think about like but also i love the shortcut in video. Shit look super cute. Candy laven brand fourteen. "Access anytime and they go. Hey it guy. I can't access database anymore. Oil fix that for you and they give them access is probably what happens. Like i'm just speculating. And i gotta tell you. I am one hundred percent surprised. I mean once you put together. what they call fusion centers. So i'm out here from From denver colorado and it has the nation's largest fusion center which for those of you privileged enough to not know what that is. It's where you take all of the nsa fbi all of the alphabet soup and they Talked to each other about things. Yeah it's not to be confused with a bunch of people doing jazz music right. Yeah once they had that setup. It's like okay well this is an inevitability but it is definitely worth keeping track of as they pay less and less attention to what their own rules are so doing. These warrantless searches that the fbi is doing through the nsa databases potentially jeopardizes an accused person's ability to have a fair trial since warrantless acquired information is supposed to be inadmissible. The fbi claim to the court that none of the warrant loosely queried material was used in a criminal or civil proceeding but such usage at a trial has happened before. So on that Melanie i was hoping you'd pipe in on this. But as far as i knew it like not only is that information inadmissible but anything that that information leads to is in a really they have whole classes on that but not not really because i thought that was Fruit of the poison tree Not not really anymore. I would have thought the same thing but now we're kind of like what we like to call the exclusionary exception which the official people call it. The exclusionary rule of like that. Oh com i. You're you're gonna have to spell now for me and probably some of the listeners. Exclusionary rule implying that its role and some of the more obnoxious of us at law. School would like to call it. The exclusionary exception and what what is it What is the exception. Hang out that would make you not Able to admit evidence. Whatever a law that prohibits the use of illegally obtained evidence in a criminal trial according to a quick web search. There are three exceptions. Apparently to the exclusionary rule and they are attenuation of the taint. That means it's the best metal band name ever. I think it's about to be takes coming out. We are attenuation of the tate and the three exclusions. There are three exceptions. To the exclusionary rule. Our attenuation of the taint independent source and inevitable discovery. I get independent source and i get inevitable discovery. I don't get the first one. Okay so say okay so it's it's basically a causation. It's basically a causation rule. Also say you're in civil suits and you're saying okay you have to you have to prove causation. And you have to prove damages. So you're saying okay. This person drove into my car running a red light and that caused you know damage to my engine. You got causation and damages. There are things that are technically causation. But they're not they're so attenuated that we don't treat them that way so say you can't sue somebody and say well this guy left for work ten minutes late which caused this other guy to be in front of him in traffic which caused this other guy to run a yellow light. Okay and then hit my car. So it's going to be kind of a proximal cause yes okay now. Obviously in that kind of law they're going to run a mile with it and it's it's gone What's that movie ra like. You know a bunch of things like that sort of happened and then kill people and so final destination at salon. Yeah so it's one of those like they left this loophole in there. And at this point you can drive a mack truck through it. Yeah well that's attenuated. Selecta which the single direct cause nope it's attenuated. Because i said so. It's interesting because i come from an audio background. Doing like live sound and sound for bands in recording studios and attenuation just means how loud is a thing in that industry. The regular english word to be fair. Yeah but like. I only know it in this. You know sort of myopic view you know of this one industry so to hear it used in another way about something. Different is foreign to me. Once he hit five syllables tends to be the case. It is five. Syllables isn't it. At least i can pronounce it so here. In general the fbi and related agencies can query the allegedly foreign focused and say communications database for information on americans for a designated national security purpose to uncover foreign power such as spies or foreign terrorists but none of the identified. The queries was related to national security. The court found because that's not what the fbi does right even officially. I mean right under the relevant surveillance law. The fbi is supposed to return to the pfizer court for a warrant to query the troves for eight nine national security purpose. And i mean it's not like it's difficult to get the fis a court to sign off on things pretty much anything put in front of them well and you would think that like you would think especially for another geo another been government organization right five court. Fbi al que. Here you go up.
