I'll get off the answer so there are three questions that are asked when you registered to vote one is are you a US citizen to are you. Vermont resident and three are you eighteen or over And those are the three questions so if you can say yes to those three you are eligible to vote in the state of Vermont And we have a very Complicated Complex database that we maintain is actually starts at the at the local level. So the town clerks and the local boards of Civil Authority are the ones that actually add or delete Uh folks from from the voter checklist and that information then flows up to the state It's it's really you know. We also have one of the most accurate good Motor checklists in the country. is as we now have automatic voter registration which has now been in effect for almost three years. Was Actually Jim. Kind of. Tell me a little bit about your thoughts on. I guess a couple of municipalities and reminding the city where I live. My fear is one of them have pushed for Folks who are not citizens of the United States to be able to vote in municipal elections and I wonder Does does that create any kind of a level of confusion or anything for For town for his clerks or other are the administrators of elections. Well well I you know I I can speak for a little bit About not for but about Montpellier and I know that the town clerk and Montpellier is A very much interested in pushing this through The the one thing that we will see in regards to non-citizen voting as as you you know right now. It's in in Montpellier has passed. It's passed the house in the in the legislature and it's sitting with the Senate If BURLINGTON does put put a vote I it has to be approved and added to the ballot By the City Council and Burlington and Ah then is approved by the voters would go to the legislature and then the house and the Senate would have to approve it before. It goes to the governor for signature. The one thing that we have cautioned is is that towns. Need to be ready if they're GONNA do this. They need to be ready to maintain their own Separate database because is WH We can't intermix this with with the state database But but in any case it's really up to the local level well and then the legislature to make those decisions and then the governor would have to also sign on as well You know and just to give a little background on this It's non-citizens actually from seventeen. Seventy six to about nineteen twenty six roughly non-citizens citizens were allowed to vote in the United States on federal elections in and it's It was after nineteen twenty six that That that that right was taken in a way And actually the Supreme Court upheld that right for several decisions But they also said it was up to the states To make those decisions now here in Vermont first of all it's in the. US Constitution that you have to be a a US citizen to vote in federal and state elections. And then we have. I'm sorry in federal elections and then in in Vermont. We have in our statutes that you're required to be a Vermont resident US citizen in Vermont registered to vote in State elections silent on local elections. Okay so So municipality like my appeal your Burlington can if they wish at least theoretically can pass an ordinance saying that folks who are not citizens of the United States can vote in municipal elections in in these two cases where these two cities of Montpellier and Burlington Have have moved to do this. The the changes are pending in the legislature. Well it's pending on the Montpellier One Charter change. But the BURLINGTON hasn't even taken hasn't even pass their city council yet to put it to the ballot. Oh I see okay so there earlier in the process assuming that correct taxi pursue the whole process which we don't know yet but Yeah and there are probably a couple of other Towns or cities that they may follow suit. I mean there was talk of it in in the city of Winooski as well well Would you know Burlington. Linski have very high non-citizen residents You know and the argument for for a and I'm not defending it. But the argument is that these folks living in their city. They pay taxes to in their city and And they should be allowed to have a say on those items that are municipally raid related. Yeah okay I I understand a and at and obviously if you're voting on a on a new school bond vote your taxes are going to be affected And and the old saying of course there's no taxation without representation So I can kind of sympathize with the truck. I suspect that the original folks who said no taxation station without representation who were mainly the the you know the sons of liberty in the Boston area during the American revolution they were not yet citizens of the United States because the the United States would still in the process of being created back. Then Greg point out the kind of an interesting case there because The founders of the country only later later in life became US citizens after the country. You know it's it's interesting you can go back and see the history and as I said from about nine hundred seventeen seventy six until about nineteen twenty five twenty six as I said earlier in non-citizens were allowed to vote in that right had been upheld by the Supreme Court and In several decisions in and it was after that that the Supreme Court said that That that it had to go to the states had the responsibility to make it goes decisions already two four four one seven seven. That's something obviously familiar to you. Because you served in the Senate and have been around this process for a long time me the with me as far as a former State House reporter for the Associated Press I watch a lot of charter changes coming through legislature the Excuse me the it's must strike people some people as I'd though to think that I said he charter. Change has to go through the legislature. Why is that that well? Th Vermont is what's called the Dylan State And and The the cities and towns in the state of Vermont are creatures of the Ah the state and therefore the legislature has the final. Say so anytime. There's a try there's about. I don't know forty some odd Towns cities these in towns that have charters And and those of the two hundred and forty six So those towns i. If you don't have a charter charter. Then you have to follow. What the what's in the state statutes if you do have a charter you follow? What's in your chart your charter as well as what's in the statute so There's there's It's kind of a hybrid for those towns and usually it's the larger towns that have Charters and any charter. Change has has to go before the legislature for their approval. in you know it's Typically the legislature. I you know as you know David I serve move for eighteen years on the South Burlington city council so we have many charters changes during that time period and I also served eight years in the Senate and was Actually Chair Government Operations Committee which which actually reviewed charter changes And recommended yes or no. And and It's very hey you know we we before will reject a charter change in the legislature. Typically there might be an attempt to make a change to it even though In in all of this is predicated on the fact that charter changes are not only approved by the local legislative body but also by the people of that town. Yeah there must be a tough thing. Actually when I when you think about it sort of politically just a question of Okay so let's say. The city of South Burlington passes the charter puts it in front of the voters the city and the city's the voters are all gung Ho for it and it goes down in my ear and the Senate Government Operations Committee as well. Actually there's this little tweeted it needs because there's a statutory issue with it or or you know there's some reason we've we've come up with fairly late in the process here that makes making us think that it's got a problem you know It must be. It must be hard to stop a train at that point. Well it is but at the same time generally the legislature that you will defer to the local electorate and and and their approval And we'll only address changes to the verbiage as necessary to meet the test of the law. He had what forty-six co-sponsors that's probably the entire Democrat or most of the Democratic Caucus and I'm wondering is. Is there a sense that this is gonNA break down on partisan lines I would not be surprised to see that that occur and Based on what we've seen so far this year I mean the other part of the problem obviously is is that the some of the Senate rules were one person can Basically holed up Any action on on a bill on a legislation so it it really comes down to whether Senator McConnell wants to move this thing and forward I mean he did for instance with with Election Security He did say that he was willing. We we we now allow In fact encourage voter registration when you go and talk to the Department of motor vehicles for example And we have several other provisions that are designed essentially they make it easier to read Cernavoda easier to vote and so on And I sometimes hear from especially from Republicans that we are running the risk of Making it so easy that We could open ourselves up to some for some type of voter fraud or that kind of thing Did are those concerns reasonable. Well those are obviously I would say no. They're not I. I think that we we have a lot of protections in place. But you you know this this idea of voter fraud when you look at around the country The real voter fraud that occurs hers is denying any eligible American the right to cast a ballot. it's it's as far as widespread voter fraud. It's it's virtually virtually non-existent there have been several studies. Nonpartisan Studies that have been completed on this That that prove that I mean these are statistical database Studies that have been completed the Brennan Center the Pew Charitable Trust You know. MIT does a elections progress. administration ranking of the states In we're proudly proudly we vermont was number one in the country after the two thousand sixteen election. The data for two thousand eighteen hasn't come out yet won't come out until probably around may or in June of next year And you know it's really. Widespread voter fraud is virtually non-existent. Are there instances where there is voter fraud absolutely and and I'm not GonNa say that there are But I will say that it's the widespread distances are virtually non existent in in terms of the the voter fraud. That does exist. The cases they end up getting uncovered from time to time do did they usually involve you know Whole boxes of voters? I don't know hundreds or thousands or are they mainly individuals usually it's individuals The in one case that was brought forward North Carolina Attorney General Probably about five or six years ago they had a big press conference and said that There were like eight hundred ninety They had done an investigation and found eight hundred ninety suspected elected voter fraud Where where a dead person had voted What didn't get a lot of play was a few months later as that investigation Asian continued? It was like eight hundred eighty five of those hundred ninety Were were determined to be people who had voted early and then passed passed away before the Election Day. So you know I mean to be honest with you David. It's you know people. All the time will say to me. Well there's dead people people on the registration list. Absolutely there are there always will be. There will be people on the registration list of every state in the country because the dead people have generally generally have a problem of not giving us a call to let us know that they've passed away. They can't vote It takes time to clean those things up. But the technology Collagen is advancing. And we're getting better and better every day. That goes by our voter registration. CHECKLISTS is more accurate than it was the day before. Yeah you know. Did people really have to get better about placing those calls after they die. I mean this this is I think we start to get Getting into a bit of a Goofy Romeo pretty quickly but I mean that is And and I mean there's no I guess I have to ask the question now that you mentioned this so somebody somebody does early voting on. I don't know October. Thirtieth Election Day is November seventh in the person dies on November fourth Had their votes go counts right absolutely if they've turned their once. You turn your ballot into the town clerk's And it's in their possession. You've you've your vote. Vote has been cast and will be counted Like everybody else's my last will and testament is I want Joe Blow for governor whatever so that would be effective such thing. I guess but that is kind of interesting. I I suppose it's a somebody could maybe AH laws and arguments saying well. Listen if the person is dead as of the official election day maybe their their ballot needs to be destroyed or not counted. Or whatever and and But I I sort of think. Also that I mean you could go either way on that and and I would think that it's it's a nonpartisan question really because you don't know whether any individual who's in that situation who casts an you know an early voting ballot and then dies before Election Day you don't know ahead of time or whether they're going to be voting Republican or Democrat or what so give you an example of what happened. governor Scott Walker in Wisconsin immediately moved when he took office back in the narrow two thousand eleven. I I guess it was He immediately moved to add a strict voter. Id Law and he claimed that people shouldn't worry about it because it was the the voter id it would be free And that they could go to any DMV and get a cop. They'd get a free voter. ID The then in his budget. He cut the budget of the Department of motor vehicles and they had to close offices around the state and people would end up having to travel one hundred to two hundred miles to get a free voter I D. And pulling this deal when they didn't have the proof in in in their hands of some kind of malfeasance. You know I just think as a matter of fundamental fairness it's it's really difficult for me to hear somebody say they don't don't have the proof and meanwhile we're not going to send the witnesses they need to ask about proof and so I mean it's just To me is just a big game. It's a shell game so no because just like in any case you're you're a lot he allowed to appear your evidence and you put up your. I'm not I'm not I'M NOT GONNA go in. It's not like any court case because at any court case subpoena witness they come in. That's how it works. And you subpoena witness basically flipping the bird himself and it is a one sided. I did want to cover This news on illegal front yesterday with you in just a few minutes left to do so Tell me a little bit about the Supreme Cream Court delay. I guess they're saying we're not gonNA decide right away on this question of The president's tax tax reform tax returns Well what happened is there's two there's essentially two cases there's one coming out of the New York District through the New York City District Attorney's Office And there is one coming out of Congress. Both seeking President Trump's pre presidential tax returns yes for various reasons the Democrats invoking specific federal law that allows them to review Individual tax returns and and the District Attorney's Office is investigating the tax returns for various allegations That may or may not be criminal but dealing with Some of the fallout particularly from his The nonprofit foundation and trump has fought vigorously to block this release on both sides And the courts have said No. You can't Block this that. These documents can be subpoenaed by these various entities and So the Supreme Court Yesterday said Hold on we're going to keep the stay in replace. We're going to keep the status quo. But the parties have until December fifth to file their notice of appeal. So basically ten days and and you know it's characterizing it as a win for either side I think is misleading. What the court is basically saying is we're going to keep the status quo but we want on? We want this issue quickly briefed as to whether we're even going to review it And and so it's it's a little bit of a delay Now that's stay can be translated into a more permanent stay until the if the Supreme Court decides to take up the case and review it they may extend the stay a in which case the stay would go until June but that's if they don't grant the review than the stay would immediately cease and and and the records would have to be turned over. So you know this is a bit of a procedural steps that they're taking It's not clear there was no dissent In this order. So you know it may very well be Just just the court process working through and and you know it's not an unfair step. Take I mean this is what courts often do when they're considering reviewing something because if in fact the state didn't issue then the documents would have been subject to subpoena And and basically the the case would have been resolved Before the court had a chance to hear it and in something like this they want to preserve the status quo so that they can in fact make that decision. Yeah I I guess What's the calendar like? I mean if if it did go to a decision by the Supreme Court Could it'd be not until spring right right. We're probably talking about June That's usually when when this term the decisions from this coming term are are issued. Yeah so it would be curly late spring early summer and again we're really getting into the heat of the main.
