The First Amendment protects peaceful assembly and peaceful protest, But what we saw yesterday was not protected by the First Amendment. And certainly Congress's role. It has a legal and constitutional role to play. They exercise that in the wee hours of the morning So does VP pence Because a lot of people are talking about the 25th amendment. Does the VP have a legal basis to remove the president under the 25th? So it's a very straightforward analysis. If vice president Pence and a majority of Cabinet members in the Trump administration determined that President Trump is unable to carry out his constitutional duties. They can remove him and and vice president. Pence would become the acting president. How do you determine that? Well, it's determined based on their observations based on their experience. There really is no legal standard. It's never been done, so there's no legal test that we would look at. It's based on whether a majority of Cabinet members and vice president Pence decide that it's it's required because the president can't carry out his duties. The president could object to that. And then it goes to Congress. To vote on whether or not to maintain that, But look, I think that is probably unlikely. We're seeing things I think calm down a bit Congress carried out its constitutional duties. But it's certainly legally on the table. If the vice president the Cabinet wanted to pursue that. Well, you know, social media. There are lots of theories and ideas floating around. One of them is that the president would want to be removed under the 25th amendment. So that vice president Pence could pardon him for anything that has or will be done it. Does that sound feasible at all? Well looks Nixon and Ford. Uh, certainly this precedent for vice president becoming president and then pardoning, but I don't think that's going on. Vice president Pence and statements he's made has been very clear. He's gonna follow the Constitution and the law with Fidelity on. I don't think we're gonna see those sorts of maneuvers play out. And there are questions, you know, can the president used, for instance, the chaos that we saw yesterday in D. C to declare any kind of emergency constitutionally, And what would that look like? Well, there are federal laws, the insurrection act that do allow in certain circumstances, the president to declare, uh in insurrection or national emergency. I think that's entirely unlikely. It looks as though the National Guard the Capitol police D C. Police have got this under control and for an insurrection to be declared, you really have to have civil authorities in complete chaos, unable to control the situation, and that's not what we're facing so sure the president could try to do that, although I don't think you can tweet right now, Speaking of Social social media I'm not sure exactly how we get that message out.
