Last night we learned a number of classified documents were found in an office previously used by president Joe Biden after his time as VP, but before his 2020 election. Now the Department of Justice is investigating how those documents got there and why they weren't already in the national archives. Tyler pager is covering it for The Washington Post and spoke with northwest news radios Taylor van zeiss. Tyler, what were the circumstances of how these documents were found? Yes. So what happened was after I then left The White House when he served as vice president, he set up various organizations in foundation to support some of the work he wanted to further and one of those was the center of the University of Pennsylvania focused on diplomacy and global engagement. And they had its office in Washington, D.C., and in that office, Joe Biden had his own personal office at the time. And in recent months, they were vacating that space and as part of that process, lawyers for the president went to the space to look at the documents and upon searching offices on these documents. Adreno, what kind of documents were found because there are several different kinds of classification for those sensitive documents. Yes, The White House has not specified what documents are there and obviously a review by the Justice Department remains confidential. Some in The White House are even saying they don't exactly know what was in the documents as soon as the first one was identified the lawyers in the office contacted the national archives to have them retrieved. So we don't exactly know what those documents entail, but we do know that they included some classified documents. Certainly when you look at the headlines of this story, you see some parallels to the investigation around former president Trump holding onto documents too. But tell me a little bit about the key differences between these cases. Yes, I think the two big differences is one, the voluntary notification. So the Biden lawyers immediately notify the national archives about the discovery of these documents and the difference in the number of documents, there's only about ten in the Biden case in much more in the Trump case and also just the difficulty but the national archives had in getting all the documents back from Trump. And finally, should a former president or VP for that matter ever have confidential documents in their own position once they leave office. I thought they were pretty strict rules. Yeah, there are clear rules about document retention and where classified documents go. Obviously, there's been a lot more attention on these processes in recent months, given the developments around former presidents and vice presidents finding themselves holding on to some of these documents. There's not an insignificant amount of history of former leaders from our president accidentally taking documents and having them commingled with others, but as you note, there are clear rules about not holding on to classified documents. And even unclassified documents, anything related to the work of the president of the vice president or governed and owned by the national archives. And so there's a clear process for that as well. Former Trump organization chief financial officer Allen weisselberg headed to Rikers Island today to begin his sentence after pleading guilty last year to tax fraud. ABC's Aaron koterski is outside the courthouse. Allen weisselberg was sentenced to 5 months in jail as part of a prearranged plea agreement with the Manhattan district attorney's office, but the judge said he wished he could have imposed an even longer sentence for what he called conduct driven by greed. The judge called it offensive weisselberg arranged a $6000 payroll payment from the Trump organization for his wife. So she could later claim social security benefits. Weisselberg was let out of the courtroom in handcuffs, Manhattan DA Alvin Bragg said the sentence shows you have to play by the rules no matter who you are or who you work for. Central visual and performing arts high school in St. Louis came under fire Monday morning by a recent graduate responding officer saw students on the roof awaiting rescue after the shooter opened fire on the third floor with a long gun. An AR-15 style rifle, but appears that he came into the building with more than 600 rounds of ammunition. Police are still working to determine a motive, but detectives found a note in which the shooter described himself as an isolated loner and said his life had become a perfect storm for a mass shooter. And what did things stand now? I'm joined by ABC's Alex crochet in Washington. Alex recap for us why sarver is being punished and why those players and even the teams minority owner are calling for a tougher stance. Okay, so this was something that was first kicked off last year last fall. This report by ESPN detailing over the course of servers 18 year leadership as the majority owner for the Phoenix Suns and the WNBA's mercury team cultivating this culture of misogyny and racism there for the two franchises. And there's some explosive allegations of things that server allegedly said and also behavior that he allowed in that organization many members of the staff coming out and speaking. And so the league started their own investigation. It took nearly a year to complete, and then we had this blockbuster finding where essentially they have decided to suspend server. He's not allowed to represent either the sons or the mercury in any capacity for the next year, and they also find him $10 million, which is the maximum that he could have faced. NBA commissioner Adam silver indicated that if they were able to prove some other conditions that saare may have lost his ownership. That's what a lot of people are drawing parallels to what happened with Donald Sterling, right? The former owner of the clippers. Now, a couple of things are different here, right? So number one, the Sterling stuff was caught on tape. And now you're starting to see players come out and say that they don't believe that this went far enough. And so one of them is Chris Paul and Chris Paul notably, he's going to be a Hall of Famer. He's a sudden point guard, but he tweeted. I am of the view that the sanctions call short and truly addressing what we can all agree was atrocious behavior. And then you have LeBron James who, look, I mean, he is, he is the player's spokesperson for the league in quite frankly, arguably the most powerful voice of the league right now. And he's saying I've got to be honest, I think our lead definitely get this wrong. And so what's going to be interesting is, well, is there some sort of course correction already you're seeing the Phoenix Suns secondary owner. The second largest stakeholder come out and say that the server should be removed. The mayor of Phoenix has come out and said that these allegations are atrocious and certainly disappointing. And so I think we'll see closer to the season whether or not that affects sponsors because that's going to be big, but there's certainly growing outcry. Congresswoman Elaine luria said former president Trump knew within 15 minutes the capital was under attack yet stayed in The White House dining room for three hours watching television instead of taking steps to quell the violence. Lauria said Trump did not call to issue orders. She did not call to offer assistance. She said Trump betrayed his oath of office and was derelict in his duty, and she said he refused to act because of his selfish desire to stay in power. We're joined tonight by our political analyst Steve Roberts, political director here at ABC News, Rick Klein, Karen Travers, our White House correspondent Rick, just want to start with you for a moment because we heard some dramatic Secret Service radio transmissions that we had not heard before, and an unidentified national security professional who worked in The White House complex in recorded testimonies say a lot of the vice president's security detail on January 6th became concerned about their personal safety. Chilling moment Aaron to hear that recounted for the first time that that was part of the radio traffic transmissions as officials back at The White House, the National Security Council are trying to find out what's going on. To hear that kind of crosstalk to hear on Mike's people say maybe time to say goodbye to the family as they try to plot a safe exit for the vice president vice president who had been evacuated from the floor and then coupled with the president's infamous tweet where he called the vice president Pence a coward for not having done his bidding to overturn the election. You could hear in the testimony from former Trump aides, people that resigned that day that night that discussed the anger that they felt over how former president Trump was in their view of pouring fuel on the fire and in the day that we're talking so much about what president Trump didn't do that one tweet seems to have set off an even bigger conflagration among people very close to the former president. And Steve, we heard that while the capital was being overrun, the former president called no one who could have helped the situation, but instead asked an aid for a list of senators who were willing to side with his desire to overturn the election results. Well, that's very much in keeping with everything that we know about Donald Trump. Even to this day. A year and a half later, he's still calling people. He's still arguing that the election was stolen. He still trying to find ways. Just this week he called a state official a legislator in Wisconsin, a Republican legislator to raise the question of whether somehow some way the results in Wisconsin one of the key states that defeated him could somehow be overturned. This is an obsession. This is a fixation of enormous power. And it continues long, long after that day, an interestingly, I think that with all the talk about Mike Pence, you're also seeing in recent days and weeks Aaron, Pence himself emerging much more to test the waters as an alternative to Donald Trump. Speaking around the country, endorsing candidates that are rivaling people Trump has endorsed. And so you can imagine pence's camp listening tonight and seeing the possibility of using some of this testimony to bolster his potential campaign against Donald Trump two years from now, Aaron. "House committee investigating the events surrounding the January 6th riot at the U.S. capitol is now complete after hearing from former senior Justice Department officials who served in the Trump administration. What's that going to say about you? Acting attorney general, Richard Donahue, on the prospect of Jeffrey Clark being appointed AG to help the president overturn the results of the 2020 election. Catherine, we learned today that this Justice Department official, Jeff Clark, who was pushing to be installed as attorney general, is now under investigation so much so that the FBI raided his home. Yeah, they did, we reported that federal agents rated his home yesterday on Wednesday and connection with this broader Department of Justice investigation into January 6th. Being in the room and when he was brought up when Jeff Clark was brought up by these former senior DoJ officials, it was kind of interesting Aaron because there's members of the public in the room. And people would just laugh, frankly, that this environmental lawyer who nobody really knew who he was. He was this obscure figure was actually being considered by the former president to lead the Department of Justice because he wanted him to overturn the election. Well, you can imagine that he's on having the greatest day as he is the center of this hearing and also obviously being investigated by the federal government. So look, while it focused on Jeff Clark, there are still a lot to come on, obviously, what happens with him next? Meanwhile, there's more to come, ABC's Aaron katzen Ben Siegel. We heard at the end the committee chairman say they're not done yet. The committee has put off future hearings until at least next month we believe they've amassed some new evidence and we heard the chairman say that the investigation is ongoing and will contain this influx of new information. What's going on there, Ben. There are two major things that the committee said, they're dealing with it right now that they're working across us as they try to put together this complete these public hearings. One, one thing I wish they addressed today about 11 hours of video of a British filmmaker, another British filmmaker who was shadowing the president and working on a documentary without the knowledge of many, many Trump White House officials about the first family spoke to Trump before and after January 6th along with members of the Trump family. So that would be of interest clearly to this committee seeking to understand Trump's state of mind and what he was saying publicly and privately before and after the attack on the capitol. So this filmmaker was brought into Capitol Hill to talk to the committee. He said he cooperated with them. He turned over 11 hours of tape expands over a year of filming and the committee says they want to look at this. They've been putting together a very crisp visual compelling presentation of their findings and it's possible that they can find more information in these videos to help them.
