The Ukrainian armored columns pushing towards the Sea of Azov broke through the last line of Russian defenses. It's a narrow breakthrough, but it is a breakout. The Telegraph of Great Britain reporting that the Ukrainian military punched through a section of Russia's main defensive line on the southern front with an armored assault for the first time. Video footage from the front lines is seen. The Wall Street Journal followed with Ukraine sends first armored vehicles through breach in Russian defenses. That would be a significant milestone in the three and a half month counter offensive aimed at cutting Russia's occupying army in two. Too bad they don't have the attack. Joe Biden has refused to send. This would be over at this point. Senator J .D. Vance made a good point yesterday that Joe Biden wants blank check. Doesn't have a strategy. Well, he's incoherent. That's why I didn't have a strategy. And as a result, some Republicans, I think up to 30 of the 265 senators and Republicans who are up there are turning against Ukraine aid because Joe Biden can't lead. He can't articulate. Speaking of which, presidents in a world of hurt this morning. I mean, a world of hurt. Not only is he getting crushed on the migrant invasion, it's not a flow, it's not an influx, it's not a new wave. It is quite simply an invasion. Hundreds of thousands of people, 10 ,000 people a day are being met, greeted and turned loose. And those are the people that we see at the border. And President Biden got up at a fundraiser last night, repeated the same thing twice within two minutes. John Lemire of AP reporting, giving people pause. Then he went over to the Congressional Latino Caucus to address them. And he said this again. It's the Congressional Hispanic Caucus that he's talking to, the Congressional Hispanic Caucus. Joe Biden says this cut number 12. I mean, this is certainly my dad. You say everyone, everyone is entitled to be treated with dignity and respect.

This week, FTX sued Joseph Bankman and Barbara Fried, the parents of former FTX CEO Sam Bankman Fried. Alleging that Bankman was intimately involved in a number of the allegedly fraudulent schemes, such as silencing someone who threatened to expose the alleged FTX fraud, the purchase of property in the Bahamas, Barbara Fried encouraged the use of strong donors as campaign finance laws, or allegedly, and both were accused generally of either knowing or ignoring the red flags that FTX was insolvent. Was this development surprising or expected? Thanks for having me on, Laura. Good to see you, as always. Was it surprising? No, I don't think it was that surprising. I think what was in the lawsuits in bankruptcy referred to as adversary proceeding, but what was seen in the adversary proceeding was probably a bit shocking, the actual details, but I think people knew that they were pretty involved. I think that was some of the heat they were getting post him getting a criminal complaint against him was that, why is he hanging out with his parents? Weren't they involved in a lot of parts of the business and people were saying things like that. I don't think it's that unexpected. People, I think, long knew that there were some real estate transactions where they were gifted or given some certain real estate in the Bahamas, but to see it all laid out in the complaint or I should say in the adversary proceeding was interesting. Which items in particular really struck you? I guess just the involvement in the actual day -to -day stuff. I mean, if you come from a corporate background or were a tax lawyer, which his dad, I guess, was and is, that there wasn't more, I don't know, structure to the organization. I mean, the dichotomy between what people thought pre -petition, what John Ray sort of said post -petition and now some of the revelations coming out about the pre -petition activity. I mean, it's just kind of amazing to think about people that might have been a more corporate background and saying like, if the business was so profitable, why were you cutting corners? To be fair to these guys, like in the light of day, sunlight of bankruptcy court, which as people in bankruptcy say, like my parents would say, the last place you want to be as a criminal is in bankruptcy court because there's so much sunlight and everything. Everything gets scrutinized. To be fair to people, sometimes the stuff gets overly scrutinized and they cherry pick stuff that went on. But it seems pretty damning, some of the stuff and there's, let's see what the responses will be. I mean, it's good for the estate and it's good for creditors because I'm sure they want to see sort of retribution. But in terms of recoveries, I don't think it's going to be incredibly meaningful, 10, 20, 30, 40, 50 million dollars. I mean, that's, I don't know, maybe two months of bankruptcy fees. And so, earlier when we were talking about like how some of the things are particularly damning, like if you were to kind of say, FTX will win in court for these reasons, like which were the particular acts that you think probably will put things over the edge? Oh yeah. I think almost all the stuff though, the win on the merits of the fraudulent conveyance. I mean, these are all fraudulent transfers potentially while the debtor was insolvent, potentially while it was coming with funds, so clearly all that money has to come back. I think that's pretty easy. The question is like, what's it worth now and who can actually pay it back? Like if money was given to a charity, can you actually go and get it back? Like meaning, is it there? Has it been spent kind of stuff? And you can only squeeze whatever rocked so hard. So the question will be, what is the real estate in the Bahamas worth? The 10 million bucks or whatever that was gifted to them, where did that money end up going? Can they trace it? So, these things cost money to do and then the question is like, how much of an effort do you want to make? And of course, all that can be stopped by a criminal investigation, which there isn't a complaint, but clearly some of the activity could be considered criminal. And I think, I won't pretend to be a criminal lawyer or a lawyer at all, but when you're bringing lawsuits, I mean, basically these are kind of like preponderance of evidence standards versus like higher standards that you might have for criminal complaints. So, it's easier for John Ray to like stitch together some stuff they know and slap an AP and sue these guys, but it's a little harder from a criminal side. But all of it, just facially, I mean, of course, as my lawyer likes to tell me, like, facts matter Thomas. So, if more discovery happens than they take discovery, we'll see. But on the face of it, I mean, it looks pretty obvious that it's sort of slam dunk. Just the question is what they'll actually be able to recover. Yeah, I think one of the ones that stuck out at me, simply because I could very easily imagine myself in a similar position with my own parents and I could just picture what my mother would say. And it was when they purchased the Bahamas property and everything was just getting billed or allegedly in the complaint to FTX. And the parents didn't even make an attempt to pay to furnish their home themselves. And I could just imagine if something similar was happening with my mother, she would be like, wait, is this okay that we're doing this? Like, you know, she would have so many questions about the money and like what was okay, what was kosher, what was not. Like, I could just practically hear her in my head. But at least, you know, from what the complaint described, it didn't feel at all like the parents had any of those qualms. So that was... Yeah, it wasn't 100 % owner of FTX. So it is bizarre that those red flags wouldn't have been, or people wouldn't have been like, hey, I know that you think this is okay, but I don't. Like someone would have said something, maybe they thought it was a drop in the ocean, but if FTX was so wildly profitable and Alameda was so wildly profitable, they didn't need to cut in corners and have them picking up the checks. I mean, it would have been easy for Sam to just be like, no, I'm picking this up personally or something. Well, one thing that I also noticed is that the document hedges its language saying things like, quote, Banquin and Freed either knew or ignored bright red flags revealing that SPF and other insiders were orchestrating the scheme. And again, you know, I saw later again, it was like, they either knew or blatantly ignored. So, yes. Right. That's because the standard for these civil cases is much lower. You know, like if you were trying to criminally try them, you'd have to like really show that they knew because they're going to say they didn't know, they didn't know, right. But the standard for like breach of fiduciary duty or, you know, kind of unjust enrichment, it's a much lower standard. All you have to basically show is a reasonable person should have known, you know. Oh, oh, I see. Yeah. So, that's why they keep saying that. So, you're saying – So, basically, they don't know whether or not they knew, but it doesn't matter for what they're trying to do. Is that what you're saying? I will respectfully say that I'm not a lawyer, but a stress investor and what people usually say – is the standard is usually what a reasonable person should have known, steps a reasonable person should have taken, best practices that a board should have taken. So, like a board of directors, if somebody runs off with money in a company, they don't have to necessarily show that they knew the person stole the money, but did they take any steps a reasonable person would have taken to like verify that the money was there or that the person wasn't absconding with money or whatever. So, it's this reasonable person standard that I think you trigger under Delaware and there are a lot of jurisdictions for breach of fiduciary duty or breach of loyalty, duty of care that you have, mainly in the boardroom, but also I think as a C -suite executive and it sounds like he was sort of melding between the two. So, basically, yeah, they're just trying to meet that standard for their purposes. They don't need to go beyond. And Barbara Fried, you know, also – so, as far as I understand from reading this, you know, Sam Pinkman was definitely involved more in the day -to -day, you know, he was often listed with FTX management. He could make executive decisions on his own at one point saying, oh, I'm just going to make this decision without Sam, like we don't need to involve him, that kind of thing. So, Barbara Fried was not involved at that level. However, it did say that she was a key influence on the campaign donations and I wondered what your takeaway was in that regard in terms of, you know, her involvement there. campaign finance fraud. Yeah, I don't have too much to say other than it's just bizarre that, you know, so many corners were cut in regards to stuff. I don't have a real view on – again, it's like it helps them build a story that they can, you know, just slam dunk, take back any money that was taken out of the estate at any point in the last couple of years by Barbara and the husband. But I don't think that – I don't have a real view on that. Yeah. Okay. Yeah. And as far as I understand, I don't think they're married, they're domestic partners. Just to clarify, yeah. All right. New York, California and Illinois are finished, you are saving them by keeping your business and your family there. The witness today in that courtroom was not a mistake, it's a message, you're next. The New York State Attorney General in any normal system would be under arrest right now for abusing and weaponizing their office to target political opponents. You are running out of time. The easiest, most painless. That's not painless. I said most painless, not painless. The easiest because the other ones are far worse. The easiest and most painless way for you to save your country right now is to abandon these places as quick as you can. If are you a conservative or even a moderate Republican who just doesn't accept craziness, get the hell out and go and fortify red areas so we all can. But he was a smart guy. Hi. And he said, America's never going to see another political revolution. You ask here. Most of these countries don't have a middle class. Most of countries these that aren't rich like America, they don't have a middle class. So when the rich are under attack and they lose everything, they have a reason to engage in political rebellion. The poor who are always poor and hungry always have a reason, and they just need a spark. You'll never see that here. That's a good thing and a bad thing. The good is thing we have a middle class. The bad thing is apathy sets in. And there's this tendency out there. woke I up this morning thinking, what would this look like if it all collapsed tomorrow? And the police state I know is coming, started coming to your door tomorrow. What would it look like? You want to give up everything? Everything. Your job, your kid out of school, hunger every day. You don't want to give that up. The middle class is forced some apathy upon people. The problem is you don't do need to anything dramatic, and I hope you don't. You can fix this and start to fix this right now. You can do simple things that there are still people out there not doing. This doesn't apply to you in the audience, but there are people out there you can go and get. There are people out there who amazingly still don't vote. Oh, Dan, voting's not going to solve anything. No, it's not going to solve everything, but it is going to solve something.

Like, I could just practically hear her in my head. But at least, you know, from what the complaint described, it didn't feel at all like the parents had any of those qualms. So that was. Yeah. It wasn't 100 percent owner of FTX. So it is bizarre that those red flags wouldn't have been or people wouldn't have been like, hey, I know that you think this is OK, but I don't like someone would have said something. Maybe they thought it was a drop in the ocean. But if FTX is so wildly profitable, I mean, it was so wildly profitable, they didn't need to cut in corners and have them picking up the checks. I mean, it would have been easy for Sam to just be like, no, I'm picking this up personally or something. Well, one thing that I also notice is that the document hedges its language, saying things like, quote, Banquin and Freed either knew or ignored bright red flags, revealing that SPF and other insiders were orchestrating the scheme. And again, you know, I saw later again, it was like they either knew or blatantly ignored. So right. Yes. That's because the standard for these civil cases is much lower. You know, like if you were trying to criminally try them, you'd have to like really show that they knew because they're going to say they didn't know, they didn't know, right? But the standard for breach of fiduciary duty or unjust enrichment, it's a much lower standard. All you have to basically show is a reasonable person should have known, you know? Oh, oh, I see. Yeah. So that's why I keep saying that. So you're saying, so basically they don't know whether or not they knew, but it doesn't matter for what they're trying to do. Is that what you're saying? I will respectfully say that I'm not a lawyer, but a stress investor. And what people usually say is the standard is usually what a reasonable person should have known, steps a reasonable person should have taken, best practices that a board should have taken. So like a board of director, if somebody runs off with money in a company, they don't have to necessarily show that they knew the person stole the money, but did they take any steps a reasonable person would have taken to like verify that the money was there, that the person wasn't absconding with money or whatever. So it's just this reasonable person standard that I think you trigger under Delaware and under a lot of jurisdictions for breach of fiduciary duty or breach of loyalty, duty of care that you have, mainly in the boardroom, but also I think as a C -suite executive and it sounds like he was sort of melding between the two. So basically, yeah, they're just trying to meet that standard for their purposes. They don't need to go beyond. And Barbara Fried, you know, also, so as far as I understand from reading this, you know, Sam Pinkman was definitely involved more in the day to day. You know, he was often listed with FTX management. He you know, could make executive decisions on his own at one point saying, oh, I'm just going to make this decision without Sam, like we don't need to involve him, that kind of thing. So Barbara Fried was not involved at that level. However, it did say that she was a key influence on the campaign donations. And I wondered what your takeaway was in that regard in terms of, you know, her involvement there. Campaign finance fraud? Yeah. Again, I don't have too much to say other than it's just bizarre that, you know, so many corners were cut in regards to stuff. I don't have a real view on. Again, it's like it helps them build a story that they can, you know, just slam dunk, take back any money that was taken out of the estate at any point in the last couple of years by Barbara and the husband. But I don't think that I don't have a real view on that. Yeah. Okay. Yeah. And as far as I understand, I don't think they're married. They're domestic partners. Just to clarify. Yeah. All right. A highlight from SEC Punts ETF Applications Till October
"Welcome back to The Breakdown with me, NLW. It's a daily podcast on macro, Bitcoin, and the big picture power shifts remaking our world. What's going on, guys? It is Friday, September 1st, and today we are catching up on crypto, on macro, on all the things. You can find a link in the show notes or go to bit .ly slash breakdown pod. Well, friends, the end of the summer, the beginning of the fall is here. We are kicking off the best season of the year with tons of catch up across both macro and crypto. And we're going to start with a follow up on what is obviously the biggest story and theme of the week, which is Grayscale's defeat of the SEC in their lawsuit and the implications for Spot Bitcoin ETF approval. Now, somehow, apparently some people thought that just because they lost in court, the SEC was likely to turn right around and approve an ETF. That of course was not the case, and the SEC have in fact deferred their decisions on approving Spot Bitcoin ETFs until at least October. On Thursday, the agency filed to defer decision making across all seven ETF applications that were filed in June, including applications from BlackRock, VanEck, and Bitwise. Now, even though they didn't make the decision now, that Tuesday publication of the court order delivering victory to Grayscale was widely viewed as moving the needle on the likelihood of an ETF approval. In the wake of the decision, Bloomberg analysts had bumped up their odds of an ETF approval by the end of this year to 75%. Still, they cautioned that their expectation was, of course, that the SEC would defer decision making this week. Markets reacted pretty dramatically to the Grayscale order on Tuesday, with Bitcoin pumping more than 7 .5 % on the news. That move has now been completely retraced on the delays, with Bitcoin back trading at around 26 ,000. One small subpart of this story that some have been interested in is that the dumping began around 11 .40am on the East Coast, but the SEC's first decision wasn't released until 3 .20 in the afternoon. Coincidental, or did someone have advance information? That seems like a great thing to speculate about on Twitter. The next decision point for the SEC will be on the week of October 16th, when all seven ETFs have another chance to be approved or delayed. Remember that the SEC is able to delay each application up to three times before making a final decision. If the SEC drags this out to its conclusion, they will have a total of 240 days to make their call, bringing us to mid -March next year for this cohort of ETF applications. Now, in practical terms, we're likely to have a better idea about how this will all play out by January 10th. That's the final date for the SEC to either approve or deny the ARK and 21 shares application, which was filed two months earlier than the others. The pattern is certainly for the SEC to delay. During the Grayscale application to convert GBTC into an ETF, the SEC took each opportunity it had to delay their decision making. Still, analysts appear convinced that the Grayscale decision leaves little wiggle room for the SEC to deny the current crop of ETFs. Three appellate judges found that the SEC had indeed acted in an arbitrary and capricious manner in denying Grayscale. They pointed out the hypocrisy of approving futures -based ETFs while denying spot -based claiming that the two markets had a 99 .9 % correlation. The judges further said that the existing surveillance sharing agreements with the Chicago Mercantile Exchange, which operates the Bitcoin futures market, quote, are identical and should have the same likelihood of detecting fraudulent or manipulative conduct in the market for Bitcoin and Bitcoin futures. And so now, although the SEC has been ordered to reconsider Grayscale's application, the timeline for that happening is still extremely unclear. Indeed, in an interview with Bloomberg on Wednesday, Grayscale CEO Michael Sonnenshine said he didn't even know exactly how this process would work. Grayscale isn't even clear on whether it needs to submit a new application. Now after this ruling, the SEC has the next 45 days to appeal the order. And after that time, the court can provide more detail on how Grayscale's application should be dealt with. When it comes to markets, they are showing an increased conviction that GBTC will successfully convert into an ETF. On Tuesday, the GBTC discount closed to 17%, which is the slimmest margin since late 2021. Since then, the gap has widened by a few percentage points, but it's still a long way from the deepest discount of over 48%, which occurred in December of last year. Moving on to catch up on the latest FUD from Binance, yet another senior executive has resigned. Leon Fung, Binance's Asia -Pacific head, has parted ways with the exchange. Fung's resignation was initially leaked to Bloomberg before being publicly disclosed, and a Binance spokesperson declined to elaborate on his departure other than confirming the resignation. Fung had been responsible for Binance's recent push to expand into Asian markets, including Thailand, Japan, and South Korea. But since he maintains no active social media presence, it's unclear when he joined and left the exchange. Now, one thing we haven't mentioned recently as we've talked about Binance's various issues is that they have actually seen a fairly significant decline in market share over the past six months. In February, Binance enjoyed 63 % market share and spot crypto trading volume, but by August that number had slipped to 45%, with the shift mainly being captured by Huobi and Poloniex. Over in the world of BUSD, its days are numbered, with Binance winding down the white -label stablecoin. In a statement released on Thursday, Binance confirmed that support for the token would end in February of next year. BUSD was of course kneecapped by New York regulators at the beginning of this year, when Paxos was ordered to cease and desist, minting the stablecoin. Until now, Binance had not officially commented on the future of BUSD, which was still available on the centralized exchange and Binance Smart Chain. The decision to end support for BUSD in February is in line with Paxos' commitment to end redemptions at that time. In a statement, Binance encouraged users to convert their BUSD into other stablecoins ahead of the sunset date. The exchange promoted conversion to FDUSD at no cost and at a one -to -one peg. FDUSD is a new stablecoin issued by Hong Kong -based trust company First Digital that was launched in June and is featured in other Binance promotions since then. Staying on the theme of markets, Bitfinex launched a perpetual futures contract for Binance's BNB token on Thursday as well. And over the first day of trading, BNB fell by more than 4%. Investor Travis Kling tweeted, BNB has been trading for nearly six years and Paolo and the gang at Bitfinex waited until today to launch a perp on it. Cryptoskeptic CryptoHippo says, Tether is getting ready to obliterate CZ, an unbacked infinite money printing machine versus the biggest wash trading volume crypto exchange in the world. I'm going to put my money on Tether winning this fight. Expect sudden price drops on the Bitfinex BNB perp. Now the biggest mystery of this week was a sealed filing that showed up on the court docket of the SEC's lawsuit against Binance late on Monday night. We have, it should be clear, no information about the contents of the filing. Speculation on Tuesday covered a wide range of theories. Some thought the filing could simply be related to a dull procedural issue regarding discovery. Others thought the filing might involve sensitive material gathered by a criminal investigation conducted by the DOJ. Andrew at AP Abacus says, Update, sources state that the sealed Binance motions this week are riddled with heavy, heavy claims. One source said, Given the natures of the issues here, surprised that we, the SEC, are taking this on, should be in the hands of the DOJ at this point. Andrew adds that he was instructed to go back and look at Bizlato claims and indictments and then add scale. Bizlato was, of course, a tiny unknown exchange that engaged in money laundering for Russia dark web markets. Some evidence revealed ties between Bizlato and Binance. When the indictment was unsealed, the DOJ treated Bizlato as their crowning achievement with a flashy preannounced press conference. This caused, of course, widespread confusion within the crypto community, who basically, without exception, had never heard of the obscure exchange. Now, also on Thursday, the old lawsuit between the New York Department of Financial Services and Tether and Bitfinex also saw some action. This is the case which was brought by the regulator in April 2019, with allegations that Bitfinex had manipulated Bitcoin markets and Tether's reserves were lacking. The matter was settled in February 2021, with Tether agreeing to publish quarterly reserve attestations over the following two years. The court retained jurisdiction in case the matter needed to be reopened at a later date. This week, the regulator filed a heavily redacted motion with sealed evidence attached. Because the filing is secret, we only have a vague idea of what it relates to. Unredacted parts of the motion appear to relate to accounting irregularities and deficiencies, as well as a lack of clarity around loans between the two firms. The regulator has requested that Bitfinex prepare an unknown witness for testimony. Knapp -Jenner tweets, Now, of course, Sam's involvement as a potential witness against Tether, against Binance, are likely going to be part of the rumors surrounding all of these issues, right up until the moment it's either proven true or proven not true. Still, with that, let's shift over for a moment to the macro side of the house. Tuesday's Job Openings and Labor Turnover Survey showed cracks beginning to open up in what has been a surprisingly robust labor market. Nick Timaros, the chief economics correspondent at the Wall Street Journal, wrote, This is a JOLTS report the Fed will be pleased to see. Basically, this July, JOLTS report indicated that job openings across the US had decreased to 8 .8 million from 9 .17 million in June. This marks the sixth month of declines in open positions over the past seven months and the lowest level since March of 2021. Compounding the story of a softening labor market, June's job openings number was massively revised. When first reported, the data showed almost 9 .6 million open rolls across the labor market. That means the Fed is now looking at data that shows around 800 ,000 fewer job openings than the data available last month. Importantly, job openings has been frequently referenced as Fed Chair Jerome Powell's favorite metric for gauging the tightness of the labor market. The collapse in job openings over this year and accelerating into the summer should give the Fed some confidence that their policies are beginning to bring supply and demand for workers back into alignment. There are now just 1 .5 job openings for every unemployed worker. That ratio peaked above two during May of last year. This means that by this metric, the labor market is now at its weakest point in almost two years. Now this morning, we also got the non -farm payrolls report for August, and Bloomberg summed it up with an article titled US Jobs Report Signals Smooth Downshift in Labor Market. TLDR, employers in August added 187 ,000 jobs, slightly higher than the 170 ,000 anticipated. In addition to that, hundreds of thousands more joined the labor force, with a growing number unable to find work right away. As Bloomberg puts it, quote, combined with wage growth running at the slowest pace since early last year, the data illustrate why Americans are a little less upbeat about the job market. While hiring and incomes are still firm enough to bolster consumer spending, job openings have retreated and layoffs are picking up. This Bloomberg says gives the Fed room to pause interest rates later this month while keeping their options open for another rate hike before the end of the year. And that's basically what traders are anticipating, at least when it comes to September. Over in GDP land, US GDP for Q2 was revised on Wednesday down to a fairly middling 2 .1%. The second GDP estimate report from the Bureau of Economic Analysis trimmed the forecast down from 2 .4 % in the advanced estimate. Both household spending and gross domestic income rose for the quarter, with GDI reversing a negative trend over the previous two quarters. This metric typically tracks GDP closely, but a pretty significant gap has opened up over the past three quarters. Now, while the GDP number isn't stellar, it's also far from the recessionary conditions that were forecast for this year in late 2022. An almost consensus opinion among economics had the US hurtling towards a recession in the latter half of this year. So far, there are few signs that a recession will actually materialize. One of the most telling data points that indicates the US may be on track to avoid a recession has been the Atlanta Fed's GDP Now forecast. The estimate has Q3 GDP coming in at a blisteringly hot 5 .6 % currently, which is far above the blue chip consensus forecast, which was last reported at 1 .7 % in early August. Now, pretty interestingly, some economists believe that blockbuster entertainment consumption has provided a significant boost to Q3 GDP. Bloomberg economists wrote in a note this week that the combination of tours from Taylor Swift and Beyonce, as well as the dual hit movies Barbie and Oppenheimer, are believed to have added 8 .5 billion to GDP this quarter. Still, the note recognized that the economic strength driven by these cultural phenomenon is short -lived. The note said, A large chunk of the strength comes from temporary factors. These factors create a mirage of resilient consumption when in fact it's running out of steam. So, overall, it feels like the data are showing a leveling off across the board. Nothing is great, but nothing is also dramatically bad. The big question is whether this is moderation into a soft landing or something more of an inflection point. From the Fed's perspective, it certainly doesn't suggest anything alarming that would justify another September hike, but also nothing that would knock them out of the pause stance into actually considering cuts. The bigger questions are what happens in Q4, as things like student loans restart, employer retention credit might get repealed, and of course, Taylor Swift leaves the country. Just some of the things to watch as we move into this fall season, but for now, I am going to send you off into Labor Day weekend, full of brightness, optimism, and all the possibility that September brings.

Sinclair, AP Polls: Biden Is Not Fit to Serve Another Term
"I need to find something else that would be supporting evidence to it. See how much of an outlier that poll is. Well, there's been no other recent poll nationally. done That was exactly the language that was used in the one I just mentioned, but the one that got closed and also came down within the past week was from the Associated Press. The Associated Press asked the question differently. They asked if he is too old to serve another term. OK, so that's the way they frame questions. the Is he too old to serve another term? And 77 percent in the U .S. said yes. So basically, I mean, we're splitting here. Seventy seven. Eighty six percent. Bottom line is the overwhelming majority of Americans. And regardless of how you phrase the question, thank you. Business serving. And while that says something about President Biden in our perception of him, oh, boy, it says just as much about us or more specifically and correctly stated in the context of Joe, not Mitch. That's a whole other issue. But Joe. Democrats. Here was the next piece of this that just kind of blew my mind. I mean, not really, but it's just like in the grand scheme of. Come on, man. It's one of those. So in this Associated Press poll in which 77 percent of people said that Joe Biden is too old to serve a second term. That included 70 percent of Democrats, 70 Democrats percent of said, yeah, you know what? Too old to serve another term. But in the next breath and the

So there's a lot of physical evidence in Georgia. So I think that we'll see that and I think that what will happen is if what to the federal case goes first, then Bonnie Willis can take advantage of some of the testimony of the people in the federal case. But the problem is suppose there are contradictions and suppose those witnesses are somehow in, you know, on cross -examination. They're caught up. Then she's also caught with that. She has to deal with that. So the person who goes second is, I think, would be, you know, the person who has the most work ahead. Yeah, now and let's not forget, too, that that there were those allegations of interference in Pennsylvania, in Michigan, in Arizona. May have been one more that slipped my memory, but charges were not caught there because you had really some evidence come out and you had Gabriel Sterling and Raffensperger coming out so strongly saying, you know, and releasing that that the recording that you mentioned. So so that's all part of the equation as well. But but this is particular to Georgia. Now, AP AP is reporting June. Let me just get this and then I'll go get back to you. AP is reporting that Donald Trump and several allies were indicted in Georgia. So I don't know whether they've gotten a peek at the document or not. I'm seeing Rudy Giuliani and Mark Meadows.

I'm sure that it's it's been uplifting fun You know, and I'm sure you just want it to go on for another two years Well first off early I want to say that no matter what happens in this crazy circus that we are all endlessly sucked into and cannot get out of the orbit of You and I were friends before all of this and I will be friends after this even if temporarily We're on I don't even want to say opposite side It seems that we're both I would say in different camps or but we're on Team America Dave We're just wearing different jerseys in the primary Is that fair to say that is fair to say and that's also why and I think you were kind of getting to this in That intro there. That's why it's been so disappointing to see the level of Craziness, I would say coming far more out of one side than another which is defending itself for the most part Because I've really really been trying it and for the people for your listeners and viewers that watch my show I have really been trying to stay above the fray to the best of my ability I am not perfect at it. Just like you are not perfect at it and and often politics brings out the worst in all of us But I think the best we can do right now is fight for the things we believe in and the people that you think And accomplish those things at a political and cultural level. That's what I'm doing that's what you're doing and and that's what many other people are doing and and hopefully if you do it with a Degree of honesty and integrity. It was in it was in a security car outside Morton's near the Transamerica building and Dave lost everything So Dave, I want to actually give our audience a fair opportunity here and this is not a gotcha in any way Just make the case for Governor DeSantis is policy agenda how you think the campaign is going Obviously, we've been you know voicing my personal opinions on President Trump's agenda what he's doing I want our audience to be able to hear all sides of it. You know, you're a very articulate I could say spokesperson for I don't not officially but obviously advocate Kind of make the case especially to our conservative audience. And then secondly, how do you think his campaign is currently going? Well, first off just to be clear I'm not a spokesperson I am not paid for you know By the campaign or anything like that. I would not even if they offered me money. I wouldn't I'm doing what I think is Right. I tell people what I think for a living and my life Literally my life and the life of my family and my employees who are in this room and them who work remotely But many of them who live in Florida and the two companies that I moved to Florida is all enriched by the things that Ron DeSantis has done here in the great state of Florida. I left I don't know that anyone in the entire country left California fled California more publicly than I did about a year and a half ago to move to the free state of Florida I would say and I'd love to hear your thoughts on this if you are a I would say right leaning person meaning you are Let's say a disaffected liberal or you're a traditional You know religious conservative or you're a libertarian something in that or you're just I said disaffected liberal But you're just sort of an old -school liberal who's a little confused about what time it is say like an RFK type You in essence should be loving every single thing that Ron DeSantis has done. I don't know one thing that Ron DeSantis Has not done that we would have wanted him to do Florida is safe. Its economy is absolutely booming We fund the police here. We're getting ESG out of our institutions We've done that which that's actually perhaps the biggest issue that people don't talk about that often because it's kind of in the weeds on How corporations are putting wokeness on all of us? I know you talk about it, but the average person doesn't and they certainly don't in corporate America. He has fought Disney He has fought the endless racialization of our children by getting rid of this AP African American Studies course That was in essence going to teach gender theory. We've gotten some of these books that are sexualizing our children out of schools He has done Literally everything that anyone right -leaning could believe in or could possibly want to happen I would say he's done one or two things that are a little bit more like right -leaning then then I will they're perfect for me Dave I got to say I love that stuff No, absolutely. So for example, Charlie, I'll give you one that you agree with DeSantis more than I do Which is the abortion one for me, Florida had Florida had 15 week Abortion ban and I've been to every Republican event in the year and a half since I've been here and I never heard anyone complaining About it DeSantis often said that he personally was pro -life And by the way, it's it's completely within his jurisdiction as the chief executive of the state especially when you win by a freaking crazy 1 .6 million vote landslide 20 % to do what you think is right and he has the Supermajority in the state Senate to make that happen. So he switched it six now I think it's possible that will hurt him in the in the general election I think at the primary it probably a little bit works to his favor But but I know he did what he thought was right and that's what he believes At he should use his power to do as the governor So I have a disagree with disagreement with him on that, but I think that's fine But I would ask you what is there anything that Ron DeSantis you're you're at least apart Oh, he's America's greatest governor. I've said that and I and by the way, I just I've said that repeatedly and some people say oh You're anti -de Santis. I said I'm not anti -de Santis. I've said he's America's greatest governor, but let me ask you Dave Is there anything can you what would what would you say would be your biggest my biggest complaint is the last six months? He's allowing consultants and Chamber of Commerce folks to run his campaign. He doesn't sound like the Ron DeSantis of last year I'll just be very honest. So so give so we can talk about the Ukraine give me like a specific example The Ukraine language, right? So the Ukraine language he was kind of dilly -dallying and flip -flopping on that at first. He was great His instinct was territorial dispute. Then he's talking about, you know more weapons for Zelensky and all that But honestly, it's also just kind of a vibe and a tone Dave where you know, the base for example I'll give you another example his miss handling of the Trump indictment I said that Ron DeSantis should have went down to Miami done a press conference showed that hey, this is my state Hey Vivek Ramaswami did it he ascended in the polls and now Vivek and DeSantis Vivek is working with Trump and everyone knows hold on a second But you're not gonna win the primary unless you understand Trump has a bait, you know has a built -in 50 to 60 percent But but hold on but if you listen to what DeSantis his words were related to the indictment He said he would not on the first indictment He said he would not extradite him and he's gone out of his way saying he's gonna destroy the very agencies I think has been more that's fair. No his policy fine But let me tell you how the base heard it Dave the base heard this and it might not even be fair I'm just telling you how the base heard it right because remember the base is like a lover scorned They hear one thing from a politician like Paul Ryan or Boehner and Lindsey Graham So they have a heightened sense of distrust and they love Trump and that's not going to change They heard Ron DeSantis go out of his way the first time to say well I don't know really what goes into payoffs to You know play boy. I'm not even saying that's fair That was just a joke and Trump makes silly jokes and sex jokes about everything like that The laws of Trump don't apply to everyone else Dave, you know that we're in this it's a different primary, right? The laws the guy is levitates. He's a once in a 200 -year, you know He says I'm gonna shoot somebody on Fifth Avenue and he goes up in the polls. He attacks He's not a politician at this point. He's something beyond a politician, which I also think there's a certain demagoguery That's somewhat dangerous related to that. But oh, by the way, again, you know, I you know, I voted for Trump I like no, I know No, and I just so that was another thing and then finally I know that I'm a little biased when very biased when Ron DeSantis Didn't show up at our event that bothered me, right? It wasn't some sort of gotcha or trap I think he would have done very well I don't think he would have gotten booed or anything But here's what I would like to see out of DeSantis, you know When we go to a college campus you say hey if you disagree go to the front of the line I want to say I want to see somebody get in the arena and say hey I'm willing to throw out the script. I'm willing to just take any question. I'm willing to kind of just fight It's more kind of total and attitudinal Dave your reaction sure So look if in essence and we'll pick it up after the break if in essence your your point is oh I agree with Virtually all of the policies and nobody has accomplished more than this guy and done everything I want to do But but there's a little bit of a marketing issue here All right, I'll go with you on that and I think that can be dealt with but we'll pick it up on the other side Well, look, I will say this the base the base is very smart and they're constantly Looking in a way of who's gonna betray me next This is the advice I'd get I gave the DeSantis privately and publicly and right now the Rubicon has been crossed where they think DeSantis is gonna betray. I'm not even saying that's fair, but but I'm not saying it's fair. It's honest I mean Trump Trump has done far more to betray the truth and and in a certain way the Respect of the base every time he lies about dissent, right? So when he lies about kovat in Florida who was the best governor for kovat in Florida kovat in the country DeSantis 100 % But who has more who has more in who has done more work and more praise for Paul Ryan Is it Ron DeSantis or Donald Trump for Paul Ryan? I can't I can't either way but at the same time we could talk about getting after the break I can't speak either way. I mean I could show you plenty of videos of I'm gonna tell you this this line of what you're getting at is not persuasive to the base and I'll explain why after the break Because I'm telling you the truth. I'm not trying to persuade anybody Okay, but no lecturing the base is not how you win a primary That's that what you're doing is why he's losing because they want to hear well Not necessarily the little things Trump got wrong. Yeah No, it's all good at Charlie really like this is we would do this over drinks I want people to understand that like there is something that transcends politics here Well, let me ask you something because one thing that I've been confused sort of going off what you said right before the break Was that he's sort of that DeSantis has like handed this off to that glass of people or something Do you is it your position that that Ron DeSantis has anything to do with Karl Rove or Paul Ryan? Oh, no I because Donald Trump does that I don't think he does does that repeatedly and that's what all the people but Dave I'll be honest He's acting like he does He's acting like he might as well because he's acting and talking like Karl Rove is running his campaign. No, no, no No, hold on Hold on you do you have any evidence or any reason to believe that Karl Rove or Paul Ryan have anything? No, except for the fact that Fox has been very favorable to DeSantis and Paul Ryan sits on the board But that seems like a reach and and so what I'm not gonna do Dave is I'm not gonna go through every Truth social and go through all that with you know Trump saying But sure we don't have to go through all of that except but it is important I think to some degree because I agree with what you're saying about The base in that in their passion for Donald Trump and why it's important and shouldn't be ignored and by the way When I'm frustrated with some of the the surrogates let's say or some of Trump's behavior lying about Florida and kovat that sort of thing That's that's a direct frustration. It's not a frustration with the people that support him But for example, I mean I have the exact quote right here from DeSantis about a month ago I actually did a little research before I joined you today. This is a direct quote from DeSantis I have not spoken to Paul Ryan since I was elected governor and I've met Karl Rove won I really think it's important that your viewers who are the base understand that because if you listen to any of the surrogates and Donald Trump himself They're implying that he's somehow working with these people and that they are in charge of his campaign and everything else and it's simply not Okay, and I think that that's important. That's important to know but know that that's that's fair. I'm glad I'm glad we cleared that up DeSantis has gotten favorable treatment on Fox and Paul Ryan as a board member there, but let me let me put that aside Let me just say though the type of campaign Trump was on with Brett Baer what two weeks ago? Fair enough. I would say though That was a that was a mostly peaceful interview as we would say But let me let me just put it with the type of campaign I want DeSantis to run is like the vague which is there needs to be a sign of respect towards Trump But I don't feel with this from DeSantis. I'll be very honest DeSantis is a governor Thanks to Donald Trump that primary was not going well for him, right? So he's challenging the alpha beast, right? He's challenging the guy that did kind of Anoint him to win the primary and eventually the general the vague is smart The vague is reading the room that these indictments the amount of criminalization of Trump really Increases people's fervor of the injustice towards him. So DeSantis has a choice Do you run kind of a policy technocratic campaign? which is what he's running and I don't think it's going very well or do you read the room and you realize the base has an attachment to Trump and I'm going to respect that it seems as if it's in some kind of murky middle. I guess my question is Dave How do you think the campaign is going? Right. Well, I would say that first off just quickly on the Vivek things I don't want to spend too much time on that I mean It's fairly obvious to anyone paying attention that that Trump and Vivek are coordinating right Vivek is doing all Endless attacks on DeSantis no attacks on Trump and all of the Trump surrogates online, you know who they are They're always pumping up Vivek because Vivek is going after DeSantis Also, if I was to believe any of the polls and national polls, by the way mean absolutely nothing We're also seven months away from the first primary I mean really think about that like the first primary isn't until January of next year and Everyone's going crazy as if oh my god on any given day. Like the whole world is gonna spin out of control The you would never you would never if you were so confident of your lead you would never spend all day Attacking the number two guys. So that's just a little insider political jockeying However, I will agree with you that in terms of some of the strategy of the rollout They probably should have been more aggressive. I do see that changing. Look DeSantis just went on Russell Brand last week He just went on CNN for the first time last week I think he's doing Megyn Kelly this week if I'm not mistaken and she's been very very critical of him Russell's a lefty. I mean he certainly isn't you know, no one that you would call a traditional conservative by any stretch I would love to see him go on the view sit directly with those women and call out their endless lies about Florida, you know Anna Navarro who lives in Miami who rails against Florida every day He should sit right next to her and call her out so if you want if your question is really do you want to take some of the Anger that the base has because of the way Trump being treated and he's being treated horribly And I completely agree with righteous. I agree. I agree There's probably some way to do that But I would also say to some extent if you just want to view this if you just want to view this in the political lens Maybe this is why Trump should stop lying about DeSantis every which way and you know, he is Everything he says about DeSantis is a lie. Everything he says Dave. I'll be honest It's also a lie when DeSantis goes after Trump and says he was pro Fauci and all that. That's just not true But but and it is what it gave Fauci an award on the way out. We're out of time Dave Rubin.
