"On the common sense Talk. NewsRadio. 6 10 W T V Air. I'm the host joined today in the LAPD studios with my father co owner Phil, who has the gun of the week coming up really soon. J C system I left, and Chuck Douglas says to my right Good pick by Emily that, you know. Maybe we should just let her pick the songs from from here on out. But JC, let's get back to some news. There is something that has a lot of potential ramifications right here in Ohio, I think, and I really think it will. And this is this is not good, but just just shows you to the depths that Bloomberg is trying to go in every city, every law, everything. His Bloomberg laws picking everything over well. To Democrats, and they have now enlisted the AKP and Bloomberg's every time for gun safety of challenged Ohio's no duty to retreat law in court. Uh, if you remember there was a big change to conceal carry, Uh, you had three things you had to do, and one of them was. You had to prove that you tried to retreat from the situation and everybody knew that was gonna be impossible when most most of the situations So they passed a law. It was, um It was passed in December of last year, and it was part of Senate Bill 1 75. Senate Bill 1 75 also dealt with a couple of other things, which is kind of least of the crux of the problem. Uh, the governor signed the bill on January 4th, and it went into effect on April six. So as of April six And as of today, you still do not have a duty to retreat. You still have to meet the first two. You can have started this whole thing or been involved in starting of it. And you had to be in in in fear of your life or serious bodily harm to you or loved one. Um, anyway, uh, those two still have to be met. But they came through and they looked at this and found out that you know what Ohio has a constitution. The Constitution says. There's a single subject rule, meaning that if you have a bill And has a single subject that you're voting on. You can't add something else to it. Kind of like the government does when they pass a bill when they had a bunch of junk to it. There's also part of it as a three consideration rule, where lawmakers have to consider a bill on three different Days. Well, this bill that when it first came out was involving, um, concealed carry with within churches that said that Hey, you're allowed to carry in churches now, and that was the basic crunch of the bill. And and everyone kind of jumped on board with it. Even a couple of Democrat, one Democrat co co sponsored it. Well, when this was added kind of at the last minute, it goes and including being able to carry in church. You don't have a duty to retreat. They were considering duty to retreat from church. You don't have to run out of this happens, but it applied to everybody. So that past well the um Bloomberg's and the AKP A and, uh, Now, these two how Democrats came up and said, Look, this isn't right. This violates Ohio's constitution, so they're challenging this now. What happens is is this It's going to be. It's been filed already. Just on Thursday. I believe in Franklin County Court of Common Pleas What they've asked for is a kind of a summary judgment. Judge. Does this violate the Constitution or not? And the judge says Yes, it does. On that day you have you are not protected anymore. You have to have a duty to retreat. So think of the repercussions for all the people out there that have this all the security, Uh, security all the concealed carry holders. If this if this passes, then honestly, the way it's written, it looks like that's what's going to happen. I think already they're looking for How do we do this? We're going to the solution is, um, is to come up with a new bill. Maybe an emergency session single minded bill because this is already passed. Put it out there. Meet the three day requirement and have a single bill and try to get this passed before the end of the year. But when the judge makes that decision, it affects all of us instantly that day, and it's crazy. I mean, and I get it. I mean, we got to play by the rules. And if they have something was not right and how this past in than it needs to be done in the right manner. The thing that kind of Made me mad is when you go out there and read the actual 18 or 30 pages of documents that was submitted to the court, and of course, it was an N double ACP in the Bloomberg organization doing this hand in hand. This is one of the lines. This is right out of the court documents, it says The Ohio NAACP opposes Ohio stand your ground law because such laws are applied in a racially biased manner. I can't figure I mean, racially biased. If you're in fear for your life or life of another where there's rates come into that they go on and say, Stay in your ground loads, including including Ohio make it easier to kill humans without the perpetrators facing eagle. Any legal consequences. I mean, how How I mean that is such a lie. It is Hawaii. Not true. You still have to meet the elements of like being in fear for your life, and but they continue to put this stuff out there and in the last time says, and because of Ohio stand your ground law. These human beings will more often be black Ohio Highlands. Well, I wonder why well Like what's their motive are. They must be concerned because majority of the confrontations must be minority. That's what it implies. I mean, where are the confrontations? Guys? When is the last time you heard of case in the state of Ohio? A stand your ground even came into play. Right. What are we? What are we? Even Why did we even need to add churches to the legislation? How about this government control government buildings and stay the hell out of everybody's house business and everything else. He didn't need a law to tell me. I've got a second Amendment right to keep and bear arms right. If the government would have stayed out of it, every time government gets involved and the AKP first of all The ACP. If anybody calls anybody with dark skin colored, they're going to get bounced all over the place. Change your name. Secondly, really, I mean, really, The colored people thing has has outlived its usefulness. Uh And and I would think, especially if the White man is out to get every black man in America. You would want every black man in America to be able to stand his ground and defend his self and his family and his hope, and instead you are protecting him into taking away his right. To stand firm. Should somebody in a white sheet ever decided to burn a cross on his front yard? This is stupid. It is. It is. Sorry I got a little bit. Then.

"Go? He's all his knowledge. I'm ready to share with us for the next four hours. I've got it Stacked up here in the paper plate. Exactly. Show dog couldn't jump over it. Ladies and gentlemen. No, they couldn't know it. Good. Not as you heard the news here. Governor Greg Abbott has signed this voter. I guess we call it reform Bill this voting reform bill in the state of Texas. I mean, there's been a lot of other adjectives that people use a I was I was listening to Nicole and listening very close. And the thing that caught my ear. The most was that it's you now, you you can't drive through and vote right? That's one of the provisions of it. No drive through voting. You drive through voting. Remember, we had that in Houston and yeah, and that's what this is all about. Exactly. But I just I'm glad we don't have drive through voting. Well, it is it no longer exists. That's sure. Yeah, it is the election integrity Bill. Republicans say this is a necessary step to put a stop to voter fraud. Of course. Uh, Boost voter confidence with the integrity of elections as well. And you know what? There's a question that folks folks ask, and I think it's I think it's great. In fact, this was asked during the debate. How like how much fraud is okay? How much because and I think we've said this on the show before you know there's going to be voted for There's voter front. It's going to happen, but the answer is nine. Right, but but getting there probably close to impossible. But you have. The answer is none. Yeah. You don't want any voter fraud? This is getting us closer that you hope. Democrats say there's no evidence to support the notion that there's voter fraud and that and that it's a problem in the state. You know, that's not true. We have stories all the time. The, uh but, uh I think back to the past and not just this past. Presidential election but go back two or three presidential elections. That we have problems, then. Sure you you pointed him out of the Mitt Romney race with Barack Obama the issues in Cleveland, Okay, you know? Yeah. Every election, it seems, Yeah, well, there's always a problem. And you're not going to get rid of them, Uh, with with Governor Abbott, citing this is going to be problems. But I think a mistake we operate a little differently than Ohio does that Michigan does than Pennsylvania does, you know, and I think this bill Titans add up even more in the in the cold newscast. She had some sound of a person saying as long as everybody has the opportunity to vote. Has access to vote has access and an opportunity to vote. And there shouldn't be a problem, right? What was the Republican governor signing it? The Democrats are going to like it, and it would be vice versus the same way. Mhm But ask yourself who is denied access to vote due to this bill. This is what I'm trying to figure out No. One. No. One Okay, well, then I'm just trying to find The problem. With what the Democrats don't like about it. And and want to change because because it changed what happened in Houston last year. Well, you shouldn't be able to drive through holler out. Trump right, Biden and keep driving, right? It's not a place you vote and get of Doc, create exactly I'm with you. Yeah, and and and that's what this legislation does. Well, you know it Governor Abbott making good on the promise that he made to rewrite the state's election process practices. And and a rewrite is it's a little, um It's a little bit of a reach. Little too much. Yeah, to call it a rewrite. Maybe not a rewrite, But here's a few things you can't do when you Yeah. I mean, what he said is no one who is eligible to vote will be not denied the opportunity to vote. It does make it however harder. For cheaters to cast an illegal ballot. I'm all for that. Yeah. Okay, that isn't that what we should be about? I would like to know if there's some people out there now that this has been signed into law. I would like to know. Well, he just signed my Uh, in the law would now I can't go vote. Is there anybody like that? Yeah. There may very well be the AKP Legal Defense and education fund. Argued that Republicans ignored opportunities to make it easier to register to vote and to cast a ballot instead placing restrictions on drive thru voting voter assistance. And mail in ballot applications. Well, if you'd need voter assistance side, you can get voter assistance. You know? Does that mean getting somebody gets you out of the house? But it's not a poem. No, Here's some. It's different word. How it's not assistance. It's not a S s. I s t a N c. E. Uh huh. It's a S s I s t a N. T s. Yes. His assistant to assist you. It's an assistant assistant. Yeah, to help you with voting. So that's what this legislation takes away. These people You know who would get in a van and go around the communities and pick people up and take them to the to the to the ballot box and hold their hand and stand beside him while they voted? Well, now that that that brings to question then most people that needed to be picked up And taken.

"I'm Ailsa Chang in Los Angeles and I'm Ari Shapiro in Washington, the U. S. Supreme Court today sided with rich donors and their desire to remain anonymous. By a 6 to 3 vote along ideological lines. The court struck down a California law requiring non profits to file a list of their large donors with the state. The court said the law subjected donors to potential harassment, chilling their speech in violation of the First Amendment. NPR's Domenico Montanaro joins us to explain the ruling. Hi there. Hey, Ari. What were the details of this case? Well, at issue here was a California law. It's similar to laws in other states. It requires tax exempt charities or non profits to file a list of their large donors. Anyone who gives over $5000. It's the same as what these groups would provide to the IRS every year. Now, some of these groups Use this status as a way to influence politics in California wanted to crack down on the prevalence of some of the so called dark money groups by following the money and looking for malfeasance and other problems, But because of these groups statuses under the law, the names of the donors are supposed to remain private. The problem is that California at one point inadvertently made the names public, and that led the Americans for Prosperity Foundation, a group founded by the billionaire Koch brothers to bring the case to court. And others join them. They said that the risk of a leak, intentional or not, would create a quote chilling effect on donors and has subjected them to threats and harassment. The court agreed and said California's law violated these donors. First Amendment Freedom of association, right. And what has the reaction been so far today? Well, you can imagine the reaction is largely fallen along partisan lines, but not entirely. You know, Senator Sheldon White House, a Democrat from Rhode Island, called it a dark, dark day for democracy. He referred to the Supreme Court as the court that dark money built. That's a call back to the courts. Citizens United decision, which largely took away restrictions from corporations being involved in elections. On the other hand, Obviously, the Americans for Prosperity Foundation and the Thomas More Law Senator Christian Conservative law firm that was also party to this case, applauded the court's decision. But it's also notable that groups like the AKP Legal Defense fund. And the Council on American Islamic Relations, praised the decision to the argument before the court, in fact, rested on a 1958 Supreme Court decision that struck down in Alabama law that required the AKP to publicly disclose its membership list. Care noted that governments can sometimes quote improperly used bulk collection of data to target disfavored minorities. This obviously has implications beyond this one. California law tell us what the broader repercussions might be. Well, Absolutely one major piece of this. First of all is in the states and how they regulate charities and nonprofits to try to root out wrongdoing, self dealing and other problems. It was already a pretty tough task. California alone has About 115,000 of these kinds of groups, and this decision makes it even harder. More broadly, there are now questions about what it will mean for campaign finance laws. Take a listen to Rick Hasen, a law professor at the candidate at the University of California, Irvine. How we put it. I think it calls into question both campaign disclosure laws as well as campaign contribution laws. It's going to be much harder for states and Congress to justify some of their campaign disclosure rules and campaign contribution rules in this case, in of itself doesn't affect how money is raised for elections. But alarm bells are being rung by pro disclosure watch groups, watchdog groups in dissent by the way, Justice Sonia Sotomayor Says the ruling marks reporting and disclosure requirements with a bullseye. The big question here is what does the courts What does what do the courts conservative do if a case is brought that challenges the constitutionality of federal and state campaign finance disclosure laws? NPR's Domenico Montanaro. Thank you. You're welcome. We're nearing.
