Absent characteristic and men as aristotle would say courage is the ultimate virtue because of that there are no other virtues. Where do you get your courage from the lord to be honest with you I spent many years being afraid of eking up being afraid of speaking up about my conservative values at school even to certain extent among my colleagues about my faith. I've always been pretty open about being a christian in the classroom with my students but When they pushed this initiative on starting to push this equity diversity and inclusion initiative in august twenty nineteen. Men can go into female restrooms in palestine highschool female locker rooms and basically the end of male spoiled female sports as we know it Aclu does that all the time and adf really is are equivalent of doing what needs to be done in the courts and in otherwise so everyone can check. And honestly it has been pretty much met with silence which is very frustrating and when it got to the point where Ten or cross was put on leave for the things that he said That of course just got me even more. Fire my belly over this issue And it's not tanner also for a long time. So when the When the opportunity came in. I was able to be a part of this. I just said i have to. I have to take a stand along with Tanner my brother. You know and And kim as well so it is a big deal. I can say That it didn't it wasn't really a hard decision. Actually because after two years of really fighting and being frustrated and not being heard to finally have someone come and say hey you know. We've we've got you on this. And we have the resources and the manpower and the knowledge and everything that you need in to actually take this fight to the next level in an godwilling win I was on board. So i wanna just kinda catch our audience up. Tanner cross is a pe teacher or was at leesburg elementary school and spoke out against a proposed policy at a public school board meeting and then he laid today's later put an administrative leave and his actions were labeled as disruptive now. He's suing the school board her violating his freedom of speech and free exercise of religion and has been temporarily reinstated to his position. While the case continues sense this meeting. The policy has been adopted forces teachers and school officials to violate their deeply held religious beliefs by saying things. They don't believe and are untrue. And so let me ask a question. Monica and then i have a question for you. Tyson which is on the ground in loudon county. Public schools are parents starting to get fed up with this. Are they really starting to rise. I mean we're seeing the images we're seeing all that but the critique is like oh that's just a minority of of parents. Is that true. No i don't think it is a minority. I think we have a huge groundswell of parents and interestingly enough it is parents who run across the political spectrum it's not just the christian conservative parent or the christian conservative teacher. We have parents and students and teachers from across the entire political spectrum. Are looking at this and saying this is wrong. This is harmful to kids who should not stand for it. And that has been heartening to see. I n had many parents who come up to me or send me emails saying thank you. You're you're fighting the good fight fellow teachers as well. But i think for me. The most heartening thing is van students who have come to me and said thank you so much mrs gail for taking a stand for us and i think the important thing about what they're saying is they realized that the standards for them that as much as it is about you know my free speech rights in my you know freedom of religion in tanners in kuenz. It goes beyond that. This is really about these kids. What's best for them. It's the large picture of my Responsibility as a teacher who loves to do the things that are right and best for them. Well and you've been doing a wonderful job that but the school district feels as if they need to insert themselves into your the way you're teaching students. I'm not joking soon. They will say that. You're not able to tell your students who love them. Because you told me that what you say. Because that's the next thing tyson is that is that a bridge too far now. You know that that's absolutely true charlie. Because the monica is not. They're not the only teacher we present. We currently represent a teacher. Peter flaming who was a teacher for eight years in williamsburg virginia and he was fired as a french teacher because he wouldn't refer to a female student as a male and he had a great track record they were trying to knowledge dictate how he referred to the student in her presence but said the outside of her presence she he must do that and if they heard he was avoiding the use of the pronoun an using our name he would still be fire. So they're trying to control everything. This isn't just about interacting with students. It's all your language everywhere. We currently represent professor nick. Mary mother twenty year old austrian religion professor at shawnee state university. He was punished for not referring to a a a male student as a female and they argued that his speech is not at all protected. He had no protection in the classroom at all they were trying to dictate everything he said in a classroom. That's completely contrary to everything. The supreme court has about professors in. They said we have to attack. The marketplace of ideas are schools. They said that our nation will shrivel up and die if we began controlling what the teachers are able to say in the classroom in their interactions. Because we can't export truth. We can't explore these big ideas and the the the solution to our big problems if the government comes in and start saying what you can say those classrooms and that's exactly where we are. We are headed on that. So sa- tyson. I wanna follow up. What is the status of the case. You guys filed it back in august. Where does the case stand. Yes so there's the good news. Is we follow them. Half tanner initially. We had a hearing. The court granted the injunction reinstated. Tanner to the classroom. He was able to finish out the year which was great. They appealed to the virginia supreme core and about three weeks ago. The virginia supreme court affirmed the in johnston and how that the school had likely violated tanner's rights and that he was rightly reinstated which is very encouraging. We then added monica jim. As plaintiffs to challenge the policy directly. We'd file a motion for a preliminary injunction. Were asking the court to order the school to not force that these teachers speak messages that they disagree with and we're waiting on the court schedule hearing so we're hoping within the next week the court will schedule hearing and we'll open have a ruling on that within the.

that's exactly right it is unbelievable it's one of those things you can't believe you have to go into court and argue that this is not fair to girls when every woman knows that you know biologically speaking the advantages in sprinting and and and heavy lifting are so vast man have that's why they had already separated them men have larger along with on average they have a larger bones they have more bone density they have more fast twitch muscle fibers that larger part I mean there's absolutely massive advantages so massive in fact that the fastest sprinter in the world is this remarkable woman Allyson Felix and literally almost three hundred high school boys today can be higher than Americans in America three hundred high school boys had beaten her record that's how much faster than men on average what is the biggest questions I have about America is this infection of the conscience as I would call it I love the ability to reason how deep is it in other words if we took a vote among Connecticut parents how do you think the vote would go you know it's interesting I don't know I think that all the transgender sort of issues that have been published in the last you know decade or so this is the one that is most inherently upsetting to parents because they know I mean I get calls from the fathers who say this isn't right my daughter trained so hard she's up every morning she's she's a runner in the state and they won't let and she can't even get the chance to win I don't I you know I think you know in general parents are very understanding and sympathetic I think feminists have been terrible on this issue by and large but you know they really prefer the new group that CA has a claim and that new group is a transgender group I'm unfortunately unfortunately because it doesn't get called a fair shot all these parents and families and the girls themselves in the lawsuit getting hate I think they are I mean I've talked to some of them and and they do get a is this judge alike so the judge has given very bizarre instruction in the case he told the the plaintiffs the young girls that they have to refer to in their training they have to refer to the the evidence is but we know that these trans you transgender biological boys that we know that they are some type of call so you're going to go now to refer to them as transgender girls that's highly prejudicial and he really really should recuse himself at this point what have they been referred to until now I'm in the complaint they were referred to as males they needed to because of course in order to explain what they had that what these girls why they were complaining they had to explain luck however forget about how they you know identify for a moment the reason were complaining is because they have a male body if that's the issue in sports the issue really isn't you know you can be as courteous as you want to a transgender person and one should you know one would think you know to that extent and courtesy and all kinds of situations in daily life and here is a court case in which the very issue is the maleness of these biological boys suit to tell them they couldn't bring this case Matt sharp of eighty from standpoint of precedent not just in Connecticut but elsewhere winning this case on behalf of girls who want an opportunity to be successful and compete against other girls I think this case is going to be indicative of whether we continue to have truly female sport in the future because if these girls are not successful if this case is not successful in is there any sport that guys are not going to be able to come in and start dominating start taking away those opportunities and so what we're gonna end up with is what we had before I don't mind where you have all male sport and all the money and all of their achievement an opportunity flow to mail in girls are once again going to be stuck on the sidelines that is not progress that is not preserving with title nine get in that it's not fair to women who have incredible talent and just want the opportunity to use those talents on the athletic field some people Matt who have weighed in on this and watch this particular situation in Connecticut and and and some other similar ones in different places have suggested there needs to be a third level of competition that boys race boys girls by race girls and a few are kind of a cross over if you're transitioning as the terminology is or whatever that there is a separate category for you know girls who think they're boys and boys you think they're girls and they can race against one another on on their playing field would you support them in now one we already do have coed teams that there are opportunities for schools to say which is going to have a team that guy girl are we don't really care those are open for both sexes but I don't want to deny the reality that there are only two biological sex that you have can you find if you look at nature there are two sexes and that is part of what this is about is serving that rational common sense scientifically based understanding that there are two sexes in their differences it's okay to celebrate the difference and I think when we start creating a third category how many more do you have to create because it's the same with the gender identity movement at male or female non binary an eight hour into spirit and all these other things and I think part of what we're doing is just going back to a talking about eighteen based on biological that is exactly right based on science as her son crack here's the other thing that I think about I'm wondering if this is going to be hello part of the argument that you and your clients are making here is you know
