So zelensky is obviously probably realizes he's on the ground after all that Ukrainian victory is not really in the cards. So there's going to have to be some sort of a ceasefire.

"Turn to one now that is, I think, in the end is going to hold for the Republicans, but it is far closer than frankly, it should be. Mayor for Allen, who was the governor of Oklahoma, run in 2014. She won by 15 points. Kevin Smith, who is the current governor of Oklahoma one by 12 points just four years ago. And now this race is a dead heat. As far as polling goes, it's a dead heat. This is also one of those races where the national environment is, I think, affecting an inversely a little bit. Kevin said, he's been a great supporter of not only Republican conservative colleges, but also criminal justice reform, making sure his state is getting the most bang for their buck as far as when it comes to punishing those who do wrong. But yet also making sure that there is a way for them to come back home to get jobs to stay out of jail, all things that conservatives should be about. And it's really interesting in this race you've had the Democrat joy hofmeister who has been attacking Kevin Smith for basically doing things that Democrats have talked about for a long time and that is reintegration and using criminal justice system to actually help people break the cycle of violence and break the cycle of pain in their own life. This is a very much of a disappointment and the idea that from governors actually taking a stand on issues that matter, Republicans have got to come together in this race. I think they will. Mark Wayne Mullen is on the Senate side here and he's going to win and cruise to this election fairly easily. James lankford is well. I think this will pull this into the Oklahoma governor's race and that you'll see when this one. But

possible strategy could be at this point other than saying you know what let me just throw everything out there and hope that maybe something along the way resonates with at least one person to make this not a unanimous verdict At this point I think all he's trying to do is convince at least one person on that jury that Kyle is guilty of one of the charges so that at least there is a hung jury on something And that's what they trust you in these types of cases If he was in any way a good prosecutor he would go in he would make his case He would go through the elements and say look at how much we have proven this case Of course it's beyond a reasonable doubt But because he doesn't have that he just has to blow V8 hoping that something he says somehow clicks with at least one gym member and that he can be like okay great We didn't lose the entire thing But this is why again the prosecution charged initially 6 counts and all of the western included because they're hoping that something sticks If they were ethical and they weren't trying to just overcharge this thing then they wouldn't even allow this case to proceed Like we talked about before But they would only charge what they know that they can prove And prosecutors do all the time have lesser included That's not a big deal But this just shows you how so many prosecutors will charge the highest possible offense they think they can get away with to try to coerce the plea agreement And when Kyle was and his lawyer said no way we're going to trial Now they're just trying to throw everything against the wall to see what sticks He's doing the same thing but CNN and MSD and C and all of these other pundits are trying to do is just save face and save their narrative And I hope and pray to God that these jurors understand their obligation to be fact finders and not listen to all of this character assassination and warp theory but actually look at the law look at the facts and render and appropriate verdict according to the law Jenna walk me through something I know you were not an attorney in Wisconsin but this seems like a pretty basic legal question I'm almost perplexed as how this happened So there was a lesser misdemeanor charge of this possession It was a possession charge for the firearm Now the possession charge had two elements that were not optional they had to be met One of the two either the individual had to be underage which rittenhouse was not That's just a matter of fact not a matter of opinion So forget that Or the second element was that the weapon the rifle rittenhouse possessed to meet the misdemeanor possession charge How to be a certain length A short barrel like carbine type rifle How is it that just today just today Like we're a day whatever of this this incident happened a well over a year ago just today the judge finally says the prosecutor banger hey man like you charge them with this possession charge for the firearm Has anybody measured it So it meets the short barrel And am I crazy How is that ethical I mean I'm just thinking in my time as an investigator things we investigated counterfeit One of the elements of a counterfeit charge to pass in counterfeit is the money's got to be counterfeit I mean if you don't bring in case the court then the last minute go oh snap It's real money where we screwed that up How did this happen That is a great question And you know this isn't just about not being able to meet the elements of the offense when you have witnesses when you have people who are testifying that maybe a little bit flexible in their memory and are some of these things that can happen because this is a live ongoing trial But these are things like there's no dispute what age Kyle was There's no dispute the length of the firearm And so this is I think just this is bad practice on both sides of the table Both sides of the aisle So the prosecutor absolutely shouldn't have charged this if he can't meet the elements of these events And he could have figured that out a long time ago But this is also what pretrial motions are for And I don't know how hard the defense looks at this Obviously probably not well But this seems like this could have been a pretrial motion to say listen they charged this but clearly the facts here do not meet the elements of the offense And this could have gotten thrown out much much earlier So I don't know what the defense was thinking there if they didn't do a lot of pre trial motions practice A lot of times in criminal trials they're just there aren't as many motions practices like this as there should be and likely and I'm obviously just speculating but likely the defense was so focused on the highest They weren't really looking at many of the lesser included potentially until today after the close of it You know I'm glad you said that because you know I'm not here you know cheerleading for anything other than justice I mean it And if it was an oversight by the defense attorney as well then that's kind of a big one I mean that's a big deal Again I'm just thinking back to not a lawyer I don't pretend to be but as an investigator there are elements of the crime in Jenna's a lawyer they're not optional correct You have to either meet the elements or you don't And the fact that nobody thought to ask that did this firearm fit the criteria for an illegal possession charge I don't know is just really stunning Let me ask you one final question procedure wise talking to Jenna Ellis great lawyer good friend hosted the Jenna Ellis podcast which you should check out Mechanics wise So the defense has to rap Sue in the running out of time So they'll wrap excuse me prosecution The defense comes in then gives their two two and a half hours if they choose to take up that time And then correct if am I correct here the prosecutor geese they have the burden of proof comes in and gets a rebuttal of that And then it's over and then the jury is I guess in this case I don't know I don't think there's sequestered I'm not sure But that's mechanically how this moves forward correct Yes so prosecutor finishes defense has their closing argument and prosecutor gets a rebuttal So the state gets first and last And then the jury will start deliberations tonight And that goes as long as they want to deliberate The judge can not give them a time constraint So while everybody is out there tweeting hey we may get a verdict tonight Remember there are 5 counts There's a ton of jury instructions There are evidence a lot of evidence to review that the jury can do So I don't think we're going to get a verdict quickly here But the judge and the attorney.

early said hey we got a problem in Georgia and you were right So we're gonna hear to talk about California polls and so all right Richard let's cut through all of the nonsense Yes the way it works in California for all of our friends in Maine and Massachusetts in Florida and South Carolina It's a two part question Yes or no recall Gavin Newsom And if yes then who Let's start with the yes or no Do you think that the yeses are going to outnumber the nose Yeah so we polled it a couple weeks back and we had no ahead by a little bit Charlie but let me leave this with you The caveat here is that I thought my share of the you know this is part of polling I thought my share of the white vote was a little bit high California's usually 45 50% tops and did see other pollsters that had him in the 60s If you look at who is voting right now this is why Democrats are nervous The electorate is very white and it's much older So if the electorate and we had them at 50 we had whites at 55 but we still had the age breakdown to be pretty young So that could a two point advantage could easily be swamped by a demographic difference like that The problem knew some has then I was just saying this before He needs white liberals and Asian voters to come out And they are the least likely to want to vote The whites were over 80% certain to vote when we pulled them And Asian voters were in the 50s So I mean it really goes to show you Yeah I've got a close race can turn into you know a nail biter either way It really can So you think this is so really tight Gavin is kind of already sort of saying the polls are showing him with big separation ten point lead He's going to defeat this recall Are you seeing that You know I'm not I'm not seeing that yet Is it possible toward the end California groups together a little bit I suppose it is but again The X Factor really is at the most likely somebody is to vote the more likely they are to vote against him So we looked at the entire register voter universe too and Gavin Newsom would survive by probably ten or 12 points if he got a typical turnout That's the problem We didn't see that it was going to be a typical turnout I can't even tell you guys how many people we spoke to and they didn't even really know there was an election I'm not kidding So as much hype as there has been that's why I mean I do give the possibility that you know he feels a little bit better I give it some credence because he's spending an awful lot of money now And they did that because they knew they were in trouble He can not count on Hispanics to come out like a presidential election or a typical governor gubernatorial race They don't like him That's just the reality He needs his white liberal base and which is you know the Bay Area and he needs those Asian voters that have slid a little bit actually in the last two years But in the end when we press them they said well if I go and vote I'll vote to keep him So they're the most loyal base that he has But if you go throughout the central valley Southern California he's performing very weak there I mean people should understand And we got Virginia around the corner If Gavin Newsom even survived by ten points it's a flashing red light for Democrats He's going to talk up at ten point win He should survive this recall by 30 35 points I mean this is a very blue state So you know in Virginia you just can't you can not afford a 20 point slide if you're a Democrat in Virginia Yes I was going to ask you regionally So basically the base for Gavin is that whole Bay Area right It's San Jose It's Oakland It's downtown San Francisco But as soon as you start to get into Stockton and you get into Modesto and you get into Fresno and you get into Bakersfield that kind of central valley corridor that could screw up some of the polling in my right Richard I mean they could run up the score almost probably like 7 to three almost like a 70% to 30% margin against Gavin which could really it would be more probably more decisive than a regular election would be because they hate Gavin Newsom in the central valley Yeah you have benefited to from doing some district level polling Some of that's So let's see what happened today said on Wall Street was a mixed session. The big news of the day came in. Before the open was the jobs report, and you had the jobs number. The headline number miss expectations. They were weaker than expected. So I'm going to read some notes. Gary sent me for the show. I'm going to go on just how he sent them. And then I'll talk about the market wrap that we can review and all the other fun stuff so first carries his employment is less than expected. The headline number was less than expected, blaming on Delta Covid. But don't forget you're getting checks that are being sent out. There's still nine million unfilled jobs, the economy slowing down a bit, but not sweating it just yet. The major indices are fine, Gary says. NASDAQ is still good, especially software. Gold mining stocks are now doing better. They may be an emerging area mentioned that they were starting to move out a few days ago, but they're moving out even more now. So Gary mentioned a few days ago on the radio. That gold mining stocks are looking good. They're getting better, and they're looking much better now. So that's something to watch. There's the Gld, which is an ETF that tracks gold. There's GDX, which is e t f that tracks gold miners. GDX J. Richard Juniors the You know the miners, but the junior wants, so there's just some and then we can go through some gold stocks as well. And then also, Gary says, the last piece the note that he sent me was also semis. Semiconductor stocks may be ready for another leg hop up, and that's take her symbol s M H so you can go through and we'll talk about semis and gold stocks after the market wrap. So first thing I want to cover here is the jobs report, which we just did. And give you the market wrap. So the market ended mixed today The Dow was down about 75 points closed at 3 35,069, the S and P. 500 was down about a point and a half. 45 35. The NASDAQ composite closed up 32 points to 3 15,063. The Russell 2000. Was down. 12 points to 22 91 the vics, which I don't normally cover in the market. Rapid I do want to cover it Is that 16 37 so far, that's fine. But walk the Vicks the major industries like I've told you before our extended carries mentioned it as well here due to pull back if the VIX spikes above 20 and or 25 you start seeing a big pullback in the market that could spell trouble, But for now, the markets fine. It's just something I like to watch every once in a while. Look at the vics and look at these spikes in the vic's tend to correspond with big down movement in the market, so For the day. The NASDAQ ended higher than has that composite the Q Q. Q was up for the week. Its up and now we're getting extended above the 50 Day moving average, like I mentioned to you multiple times on this show this week. It doesn't mean we can't go higher. It's just that probabilities are you know we're going to be pulled back at some point in the near future. Typically extended markets need the pause, and in order to put digest the recent move. They either do one of two things either pull back. Or they move sideways if they move sideways at the more bullish scenario, But a light volume pulled back into the 50 would also be very, very welcomed for the Q Q. Q. The NASDAQ 100 Now for the S and P 500. The S P. Y also ended higher for the week. It's also very extended. I mentioned yesterday on the show if you want to go look at a daily chart of one year daily chart of the S P Y. Take a look at it. And look at how the 50 Day moving average has really been important support for really about 12 to 16 months or so. It's once again extended every time the S and P or the NASDAQ has gone extended over the last 12 to 15 months or so. Since April in March of 2020, it's pulls back into the 50. It's just every single time it does that It's normal. It's healthy. It's now extended again. Which doesn't mean it's going to pull back tomorrow. But just be on alert that we are overdue for a nice pullback. That's the SP. Why the Dow D I A ended the week. Slightly lower, not a lot, but slightly lower still above the 50. It's not as extended as the S and P and the NASDAQ. So this is moving sideways Watch resistance 3 56 60 for the DEA, which is an ETF that tracks the Dow Jones industrial average to be taken out, But the data was still basing. Meaning it's still consolidating its latest move and is still moving sideways, which is fine and healthy. The mid caps the M D y the S and P 400 steam thing. Still basing. The high this week was 57 31 the high from back in April of this base, you've had a four I guess. Five month base forming now with the mid caps was 507 63. And the high this week was 57 31 again. Please, General, I can't make this stuff up. That's how technical analysis works, right? You want to just look at prior highs prior lows, Inflection points, moving averages. Bases patterns so on and so forth, because all of that is very, very important when you analyze markets. So, um, the mid caps are about to break out there. I mean, they came within a few cents of breaking out this week, so watch for that to just move sideways for a little bit and then break out. If they do break out, that would bode well for the broader market. Now there's finally the Russell 2000 small cap index. The, um, for those of you following at home, is moving sideways in along. I guess. Sideways consolidation going back to February. That's a seven month base or five months base depending on how you want to count the basically the weeks but more or less than February. The markets the I W has been going sideways back in February. The idea, um was at 2 20. 2 30. Now you're at 2 27. So as far as I'm concerned to seven month base that being said it's now in the middle of that base. Briefly undercut the 200 day moving average for a day and then got right back above it back in early August. About 3.5 weeks ago, and then it got back above the 50 right afterwards. So Think of resistance as a ceiling in a room and supported the floor in the room. For the last seven months, the I W and the Russell has been going between 2 34 53 about 207. On the downside, so to 34 on the upside and to seven on the downside, right now you're at 2 27. It's just been range bound, which is normal and healthy because from the March low if you go back to the Covid low of last year, it was at 95. So basically the small cap index, Russell 2001, from 95 to 2 34. It's not a type boats on a mistake. The low in March of 2020 was 95 for the I W m. Hi just a few months ago. Was to 34. It has to pause and digest that move, and that's exactly lays General. What's happening right now. It's healthy action. We're in the middle of the base. If this can get going and break out above 2 34 that's 2000 stocks that are going to break out of range and go up that would bode very, very well for the rest of 2021. And really into 2022.
