She understand our our obligation to the insurance company now that seems absolutely stupid. A roofer does not have any obligation to your insurance company. It's asinine next. The money is insurance is money shot our money, it's not his money. It's insurance is money. So we would have to involve and lupin insurance in returning this fun Jonathan that's more onic as well. That money is your money right now because it sitting in your account. It's not insurance is money. The insurance company paid the caller. They wrote the check to him. He went out to find a roofer you and wrote you a check in no way is it insurance is money. And in no way. Do you need an attorney? If you've got some more onic attorney telling you, if you really do have an attorney telling you that you're not allowed to return the money, you have to return it to the insurance company that attorney is very misled. I wanna bring up Mark crane AC attorney at law, Mark. This one's got me fired up. Man, you read the contract. Did you see the twenty five percent out? Yeah. Well, the twenty five percent of the cancellation. Yup. And so they paragraph eight of the contract, so they're probably allowed to keep twenty five percent of the contract. So if we do the math if they go by their own contract. Okay. Twenty-five percent. I'm not saying, I think that's fair. But you know, what the guy agreed to it? When you signed it. They should be giving him seventy five percent of fifty two thousand dollars back. And he said, they won't do it. He outright set it in that call yesterday. What do you think Mark? I think that the refund the balance which is twenty five percent of the contract. Price comes out to about thirteen thousand seventy four dollars that the roofers allowed to keep pursuant to paragraph eight of the contract. However, there is a Reagan there that says the colora-. Roosting regulation. The contractor may be required. Also, keep the deductible that's owed to the you know, if the deductible wasn't heretofore paid, you know, out of the pocket by the customer. So let's say he had a thousand dollar deductible. They might get that as well. Right. And I think that my my reading of that rig cursory review, the red indicates the contractor has to keep that that may be what he's just a deductible the balanced needs to be refunded to the customer. There's no question about that. I think and then if this contractor just look at the data that contract, it's eight thirty one, you know, that's a long time ago. Yeah. Folks, listening in Mark is I mean, you know, because you're here for the call yesterday. They didn't do any work. They didn't do anything to his old roof. They didn't deliver any materials eight into anything. I'm sure they're contention is going to be well, we went out there and looked at it and got the insurance company to cough up more money than what he thought, you know, Jonathan Myers, Mr. moronic, in my opinion, had that to say. Well, and that's where they get the twenty five percent from me, and they did something in terms of monitoring the insurance companies adjustment of the claim. So they're they're entitled to percent of the pergram as a contract to twenty five percent. But that's it. That's it. Mark listen to this this I analyze this conversion, which is an intentional tortoise. It's unlawful sort of control over someone else's personal property, including money. It's pushing about five hundred dollars and new paint borough drag all that stuff, and I'm trying to how many miles are on it. Oh, it's got about one hundred thirty thousand on it. But it's been rebuilt all joint everything new brake shoes, if someone brings it and gets it checked out this things in great shape. It's in perfect shape. Perfect a tough word. It's got a brand new EFI standalone EFI system on it. It's you know, what is that guys? What is it fuel injection? So he went from to fuel injection from throttle body fuel injection.
