Appeals court overturns death penalty for Boston Marathon bomber

The judge's decision means the 2013 attack killed three people and wounded more than 260 others. What the U. S First Circuit Court of Appeals in Boston did was. It upheld much of Dzhokhar Tsarnaev's conviction but ordered a lower court judge now to hold a new trial strictly over the penalty. Tsarnaev should receive the death penalty eligible crimes that he was convicted of. The federal appeals court says the judge who oversaw the case didn't adequately screen jurors for potential biases. It ordered a new penalty phase trial on whether the now 27 year old should be executed.
