"Time to extremist organizations including the Proud Boys and the oath keepers as well as the leaders of those organizations The subpoenas of the latest in a wide net that's being cast by the committee in an effort to pin down the origins of the attack CBS News senior investigative correspondent Katherine herridge joined Sean and Hillary earlier on Skype These subpoenas also include a longtime friend and adviser to the president Trump Roger Stone as well as Alex Jones from InfoWars and committee investigators are trying to pin down the timeline and the plan that was in place for the rallies on January 5th and January 6th to try and discern whether they were set up to become violent or probably more particular that they knew that the potential for violence was there that day but they did not act Roger Stone has responded by saying he had no foreknowledge of the attack on the capitol and Alex Jones has claimed that he in fact tried to stop the riots on that day There are a lot of sabinus at this point Catherine is the committee closer to getting testimony and documents I think one of the really difficult decisions the select committee is facing is that as witnesses refused to cooperate whether they bring more criminal contempt cases like the recent one with Steve Bannon The problem with criminal contempt cases is that while it does send a very strong message it also means that the evidence is out of reach of the committee because the banning case I'm told could take up to two years So they want to limit who they put into that criminal court bracket in the future And the other challenge they have is that a number of witnesses are negotiating with the committee And that makes it harder to bring the case by the Justice Department that they have fully rejected cooperation as they did with Bannon Now the select committee also went to the appeals court yesterday to get former president Trump's records Is this any closer to resolving You know the short answer is that it's not The select committee has argued that they need these records and they need it on an urgent timetable because it will help them develop a timeline which is important for every investigation and will also help them identify key witnesses But the presence lawyers are expected back in court next week where they're expected to argue that their long-standing issues of executive privilege and that this is an effect in their view of fishing expedition by the select committee This case could go well beyond the appeals court right up to the Supreme Court So we're looking at protracted legal battles on some of the most significant fronts for the select committee But CBS News senior investigative correspondent Catherine herridge in conversation was Sean and Hillary Sports next on WTO and then two books that some parents really don't like are going back into some local high school libraries 9 14.

"To petition their government under any number of pretexts whatsoever. The things in this list are their right wing fever dreams. There are conspiracy theories that construct a worldview where the federal government is on the brink of tyranny and is going to take everyone's guns away and take everyone's rights away and put people in concentration camps, and so that's how they start pushing people down this path of fear and extremism and seeing this threat that's so intolerable that it starts to prepare people to think that they can respond with violence in the face of something so unacceptable. How does this group start to pick up steam? So it started off really small and it became more prominent in the mid 20 teens when oath keeper members started showing up at the racial justice protests in Ferguson. InfoWars of said before are here their document in the activities. And we're here to keep them safe. If you remember, there were a series of standoffs in the western U.S. between ranchers and federal agents because the ranchers were insisting that they were sovereign citizens. Jim lordy came from Montana to join the protesters. He says he and other militia members are not afraid to shoot if necessary. Why the gun will they have guns? We need guns to protect ourselves from a tyrannical government. And there were oath keepers involved in that. And so that is sort of how people started to hear of them and they started to grow that way also. So does the group have some sort of central hierarchy, the Justice Department describes it as loosely organized, which is apt. You know, it's really it's more of an ideology than it is like a regimented organization. And that's how it's important to understand it as distinct from a militia and more like a political entity. What was motivating this group in or around 2009? There was an analysis by the Department of Homeland Security in 2009. That raised an alarm that right wing extremists were using the financial crisis and the election of the first black president and fears about gun regulation and things like that to recruit and specifically trying to appeal to military veterans. And this report ended up being leaked and became very controversial with congressional Republicans who kind of made it out to be the Obama administration persecuting conservatives for their belief. There are no Timothy mcvay's out there right now. Portraying standard ordinary everyday conservatives as posing a bigger threat to this country. That Al-Qaeda terrorists naming veterans groups as possible extremist groups. DHS kind of apologized and disbanded the unit that did this and the message that went out from that basically was you don't want to mess with right wing extremism. It's too political. It's a bad look, just don't don't go there. And in the decade that followed, groups like the oath keepers were able to hugely expand. And there were some prosecutions of individual oath keepers for weapons charges and things like that as isolated incidents. But there was not the kind of investment in right wing extremism that that law enforcement made in left wing extremism and foreign inspired terrorism until after January 6th. Thinking about January 6th and the kinds of people I saw raging out there at the capitol. I'm picturing angry white men. I know there are members of the oath keepers who happen to be people of color. I don't know how predominant they are. But is there a racial dynamic at play within this group as far as you know? That's not really their niche in the right wing extremism universe. They are actually, they're not marketing themselves as white nationalists or white supremacists and the oath keepers are actually trying to differentiate themselves from groups that are more along those lines. And their focus is more on government tyranny. How does the tenor of the oath keepers organization change under president Trump? Their rhetoric starts getting very heated in the summer of 2020 around the George Floyd protests. And taking it on themselves to help impose from their perspective imposed Law & Order where there's rioting and looting going on. And then it escalates from there to embracing Trump's lies about the election being stolen and then setting up the idea of January 6th as being like a last stand for the country. We have men already stationed outside, D.C. as a nuclear option in case the attempt to remove the president illegally, we will step in and stop it. It's either president Trump is encouraged and bolstered strengthen to do what he must do before we wind up in a bloody fight. We all know that. The flight's coming. What role do the oath keepers play in the insurrection? When Trump tweets that, you know, he wants to see everyone at January 6th and it's going to be, quote, wild you know, they take that as a command to show up and deploy. And they start making plans for how they're going to get there and what weapons they can bring and how they're going to store and stash their weapons and then they're in communication throughout the day as a group of them go into the capital and class with law enforcement. And now we know for a fact that members of the oath keepers have been charged in connection with the January 6th insurrection. There's a large group of oath keepers that are charged as a group as a conspiracy. And then there's a handful of additional people who are charged individually just as being people in the mob who also happen to be oath keepers. And then I also found three more people who were charged individually and not identified by prosecutors as oath keepers, but as it turns out were on the membership list. How does the insurrection change the perception of this group if it does it all? One way that it changed is that that Republican leaders and the Republican Party as a whole really didn't disavow or distance itself or condemn what happened, they developed a counter narrative based on misinformation about January 6th to minimize or deny the violence and the role of groups like the oath keepers in it. So really it's kind of a legitimizing or a tolerating of the.

After story from associates from extremism trackers who describe pattern where rose will be upfront before an event saying everybody be there. Everybody arm you know. This is the one and then whether it's in the field or in the courtroom afterwards when it comes to consequences his nowhere to be found and how did all of that play out on january sixth. What was the involvement of this group in the storming of the capital. So this is still very much an active investigation and an ongoing prosecution. We're piecing together what federal prosecutors believe about this group through all these court filings in this case and to federal prosecutors roads is referenced in the filings as person one in in the prosecution's time-line roads coordinated with other participants before enduring the capital events. He allegedly gave advice about weapons to bring and then he spoke with a member. Who was part of that stack formation that we saw going into the capitol just moments before the group charged inside fight roads himself did not go inside the capitol as far as we know. There's no evidence of that. He's denied it. There's been no evidence released by the prosecution saying that he ever stepped inside. And there's no public evidence that shows him giving direct orders for oath keepers to go inside so here we are eight months later. He remains free and uncharged. And it's unclear yet whether he will be charged. It's obviously a much more dire situation for some of his associates. I mean around twenty. Two of them are facing serious. Federal charges.

The city called in the national guard dc police out in huge numbers. People were nervous in the end. There were more police and reporters than actual attendees. What a wonderful dern assorted. I wanna make sure that everybody got their wrist measured for the the handcuffs on the fbi soups and it takes all the way. We all got a risk that you're right when we came in part of the reason no one showed up is because members of the right wing groups that were at the capitol back in january. They warned each other to stay away this time. And just because they're not showing up in person doesn't mean their ideas aren't spreading they are through groups like the oath keepers from the newsroom of the washington. Post this is post reports. I'm amitav infomer- martine powers. It's monday september twentieth all these months after the insurrection for still learning more about who the oath keepers are and how they operate. They style themselves as this militia group but a deeper look shows that the oath keepers act as more of this far right propaganda machine and people who track extremists. Say the group's message will endure. No matter what happens to them. In court oath keepers is part of the american far right extremist landscape and is specifically falls under this category of anti-government or part of the militia movement cannot lamb as a national security reporter at the post and she's been reporting on the consequences for people who broke into the capital on january. Six when you think of oath keepers in january six. There's this one. Iconic image that comes to mind is that military stack formation of oath keepers associates that we saw charging up the steps and into the capitol building. And i mean that image in the apparent planning that was on display with their tactical gears and their radios is one of the reasons why many referred to that event as an insurrection. Three people affiliated with the far right militia group the oath keepers have been accused of conspiring to forcibly storm the us capitol on january six. This is a group that believes that the. Us government is systematically stripping the constitutional rights of its own citizens. Federal prosecutors are building conspiracy case involving oath keepers associates in part related to that image. That we're talking about greg. Good morning we have new charges new developments really new indications. This is the epicenter of the january. Six insurrection investigation. The far right extremist group the oath keepers appeared in federal court. They face charges of conspiracy and breaching the capital during the january sixth insurrection. And this comes. As four more members were charged over the weekend in connection with the capital as it stands now around twenty two keepers. Associates have been charged in connection with the capital attack including eighteen accused of conspiracy. And that's part of the largest single indictment of the whole probe and thirty five others who have already pleaded guilty. Some of whom are cooperating with authorities. I suppose like the sort of singularity of the oath keepers. Is that this group in particular tries to recruit former law enforcement and military veterans as well as active duty personnel and. They want them to swear an oath that that they won't follow what keepers considers unlawful order. Which is anything. They perceive as running against their literalist interpretation of the constitution in terms of wet keepers. Looks like their size or scope. Analysts agree that this is a group with exponentially more online members or sympathizers they call them keyboard warriors than they've ever had show up to any of their in person events like other groups that fall under this banner. they say they're organizing against a quote. Tyrannical federal government that it's the duty of citizens to fight back against what they see as government overreach especially around gun control measures but panning out many of the issues that they organize around are rooted and conspiracies so most recently they've been involved of course in the stop the steel movement and in a different protests against copa nineteen restrictions. I wanna ask This name oath keepers. Like what is the oath that they're keeping it's the idea that there are unlawful orders and that. Us citizens people who've an oath and law enforcement or the military that they don't have to follow what they consider anti-constitution order orders that run counter to their interpretation of the constitution. So if it were say a gun control measure they would ask that law enforcement not enforced that not go out and take guns not prosecute people but it's much more broad than that now we have now sort of ordinary people talking about unlawful vaccine mandates. That's unlawful order. So that idea that the oath keepers propagates about citizens the right to refuse unlawful unconstitutional orders. That's now sort of gone mainstream and we see that in these different protests around the country Do you have a sense of the actual numbers of people who are members of this group compared to just people who have may be adopted. This ideology anyone who's tried to pin down oath keepers membership. Numbers can tell you. It is a fool's errand. It is very hard to separate fact from fiction when you deal with this group because you know you have. The organization itself saying we have tens of thousands of of members of patriots at the ready to stand up you and they boast of this like tens of thousands strong national movement most extremism tracking groups and advocacy groups civil rights groups. Say there were never more than five thousand actual members of oath keepers. And then when you get down to who would actually show up for what they call a national call out. That's where they say okay oath keepers members. You have to be at this place at this time to protest this issue. We're talking a dozen sometimes fewer than that according to former members extremism trackers in my own observations from being out at these events. I can tell you even on january. Sixth as i was walking behind some members of the far-right right proud boys gang. I overheard a conversation where one of them told the other. Hey i heard the oath keepers are here today at the capital and the other says something like What they actually showed up to something because that was kind of their reputation. Even in these far right circles is that they talk a big game but in the end they're keyboard warriors or they show up in very small numbers if at all. So where where this group come from. So barack obama's election two thousand eight re-energize the anti-government militia movement an oath keepers was part of that wave. So there was chatter about this fledgling group online and then it was sort of officially.

There's so many people there, in fact, to the point that a lot of the leaders on the terms kind of extremism front on the far right have actually told their followers look, don't bother. Don't go to D. C because it's not. It's not worth it. You're not gonna be able to do anything, and it's the rest of two. Great Now. The same is not true for state capitals, and I think the experts I'm talking to. That's where they worry that Be violence That could be things go down. All right, so I know in the headline. It says armed militias are illegal. But these groups that could show up to state capitals don't necessarily fit the definition because they're not necessarily all organized. No, exactly. It is. It is a fine line. I mean, said, there's an there's two. There's two barriers to this number one. There's whether a group meets the state law definition the legal definition off a militia, which means that they would have to be so organized. They'd have to be doing things like drilling and marching in formation and basically sort of acting like a law enforcement agency. That's the first. But the second part is, of course, whether this the political will to prosecute them. And, of course, in many parts of the country, particularly areas of the country, the more conservative than a more kind of pro Second amendment. There was a very interesting and worrying story by an organization called Unicorn Riot that actually got hold of transcripts of internal chats between our peoples where they talked about, among other things, killing members of the news media, So there are increasingly I would say, increasingly troubling group to keep Niles you said two. She's white, and she wears glasses beneath a big combat helmet. And according to her profile, she's a bartender, and she blames Ohio Governor Mike DeWine's lockdown for hurting her business, but still no name. By the time I found this profile parlor had already been shut down. Amazon Web services had stopped hosting the platform because so many of its users had called for the insurrection. But a group of actors effectively scraped the entire website and uploaded tens of thousands of posts from January 6th two archive dot org's so that researchers and journalists Could sift through all the data.
